और रािपत्र की प्रजतयां जिसम ें उि अजधसूचना प्रकाजित की गई थी, िनता को 29 फरवरी, 2024 को उपलब्ध करा िी गई थीं ; और उि प्रारूप जनयमों की बाबत िनता स ेकोई आक्षेप और सुझाव प्राप्त नहीं हुए थे ; अतः अब केन्द्रीय सरकार केन्द्रीय मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 27, धारा 41, धारा 109 और धारा 110 द्वारा प्रित्त िजियों का प्रयोग करते हुए, केन्द्रीय मोटर यान जनयम, 1989 का और सिं ोधन करने के जलए जनम्नजलजखत जनयम बनाती ह,ै अथागत ् :- 1. संजक्षप्त नाम और प्रारंभ .- (1) इन जनयमों का संजक्षप्त नाम केन्द्रीय मोटर यान (आठवााँ संिोधन) जनयम, 2024 ह ै। 3820 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) इन जनयमों म ेंअन्द्यथा उपबंजधत के जसवाय, य ेजनयम रािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंगे। 2. केन्द्रीय मोटर यान जनयम, 1989 (जिस े इसमें इसके पश्चात् मलू जनयम कहा गया ह)ै म ें जनयम 2 के खंड (iघ) के पश्चात ् जनम्नजलजखत खंड अंतःस्ट्थाजपत दकया िाएगा, अथागत ् :- ‘(iङ) “प्रवग ग एल2-5” से जतपजहया मोटरयान अजभप्रेत ह ै जिसमें िपु जहया-जतपजहया संयोिन मोडयूल ह,ै जिसको इस तरह से जनर्मगत दकया गया ह ै दक एल2 के िपु जहया यान को स्ट्वतः नोदित न होने वाली पार्श्ग मोडयूल इकाई के साथ संयोजित कर जलया िाता ह,ै इसे आवश्यकतानुसार पृथक् दकया िा सकता ह ैया संयोजित दकया िा सकता ह ै : परंतु दकसी भी समय केवल एल2 प्रवग ग के िपु जहया वाहन या एल5 प्रवग ग के जतपजहया वाहन का भी उपयोग दकया िा सकता ह ै ; (iच) “प्रवग ग एल2 -5एम” से याजत्रयों के वहन के जलए आिजयत तकनीकी जविेषताओं के मद्दे एल2 -5 प्रवगग का वाहन अजभप्रेत ह ै; (iछ) “प्रवग ग एल 2 -5 एन” से माल के वहन के जलए आिजयत तकनीकी जविेषताओं के मद्द े एल2 -5 प्रवगग का वाहन अजभप्रेत ह ै: परंतु एल 2 -5 प्रवगग का वाहन यात्री वाहक एल 2 -5 एम या एल 2 -5 एन माल वाहक के प्रवगग में याजत्रयों के भार पर जनभगर करत े हुए, जिसके अंतगतग चालक सजममजलत ह,ै जिसके जलए बैठन े का प्रबंध दकया गया ह ै जिनका भार माल वाहक के भार से अजधक या कम ह ै और यह एल 5 प्रवगग के वाहनों के जलए समय-समय पर यथा संिोजधत आईएस 14272 : 2011 में जवजनर्िगष्ट ितों के अनुसार होगा ।’। 3. मलू जनयमों के जनयम 50 के उप जनयम (8) के पश्चात ्जनम्नजलजखत उपजनयम अतं ःस्ट्थाजपत दकए िाएंगे, अथागत् :- “(9) एल 2-5 प्रवगग के वाहनों की ििा में िोनों संरचनाओं के जलए एकल रजिस्ट्रीकरण नबं र आबंरटत दकया िाएगा अथातग ् एल 2 प्रवगग के पृथक दकए गए िपु जहया वाहन या एल 5 प्रवग ग के संयोजित जतपजहया यान ; और दकसी भी समय संयोिन पर ध्यान न िेते हुए यान के आगे और यान के पीछे एक-एक रजिस्ट्रीकरण जचन्द्ह प्रिर्िगत दकया िाएगा। (10) एल 2-5 प्रवग गके यानों के जलए जवमाएं 200x100जममी होंगी ।”। 4. मलू जनयमों के जनयम 122 के उप जनयम (3) के पश्चात ्जनम्नजलजखत उपजनयम अंतःस्ट्थाजपत दकया िाएगा, अथागत् :- “(4) एल 2-5 प्रवगग के वाहनों की ििा में पहचान नंबर, जिसके अंतगगत जनमागण का मास और वषग सजममजलत ह,ै को उस पर उत्कीणग दकया िाएगा या कुरेिा िाएगा या पंच दकया िाएगा, िो दक समय-समय पर यथा संिोजधत एआईएस 177 : 2021 के अनसु ार तब तक होगा िब तक दक भारतीय मानक ब्यूरो की तत्स्ट्थानी जवजिजष्टयों को भारतीय मानक ब्यरू ो अजधजनयम, 2016 (2016 का 11) के अधीन अजधसूजचत नहीं कर दिया िाता ह ै।”। 5. मूल जनयमों के जनयम 125ढ के पश्चात् जनम्नजलजखत जनयम अंतःस्ट्थाजपत दकया िाएगा, अथागत ् :- “125त : एल 2-5 प्रवग ग के सभी वाहन समय-समय पर यथा संिोजधत एआईएस 177 : 2021 के अनुसार तब तक होंग े िब तक दक भारतीय मानक ब्यूरो की तत्स्ट्थानी जवजिजष्टयों को भारतीय मानक ब्यरू ो अजधजनयम, 2016 (2016 का 11) के अधीन अजधसूजचत नहीं कर दिया िाता ह ै।”। [स.ं आरटी-11036/104/2023-एमवीएल] महमूि अहमि, अपर सजचव रटप्पणः - मलू जनयम भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उपखंड (i) में अजधसूचना सं. सा.का.जन. 590(अ), तारीख 2 िून, 1989 द्वारा प्रकाजित दकए गए थ े और अंजतम संिोधन सा.का.जन. सं. 195(अ), तारीख 14 माचग, 2024 द्वारा दकया गया ।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 26th June, 2024 G.S.R. 354(E).—WHEREAS, the draft rules to amend the Central Motor Vehicles Rules, 1989, were published, as required by sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Ministry of Road Transport and Highways number G.S.R. 150(E), dated the 29th February, 2024, in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Official Gazette containing the said notification were made available to the public; AND WHEREAS, the Gazette containing the said notification were made available to the public on the 29th February, 2024; AND WHEREAS, no objections and suggestions were received from the public in respect of the said draft rules; NOW, THEREFORE, in exercise of the powers conferred by sections 27, 41, 109 and 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:- 1. Short title and commencement.- (1) These rules may be called the Central Motor Vehicles (Eighth Amendment) Rules, 2024. (2) Unless and otherwise specified, these rules shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the principal rules), in rule 2, after clause (id), the following clause shall be inserted, namely:- ‘(ie) “Category L2-5” means a three wheeled motor vehicle, with a 2 wheeler-3 wheeler combination module, constructed in such a way that a two-wheeled vehicle of category L2 is combined with a non-self- propelled rear module unit. It can be separated or combined, as and when required: Provided that at any point of time, either a two-wheeler of Category L2 or a three-wheeled vehicle of Category L5 can only be used; (if) “Category L2 – 5 M” means a category L2-5 vehicle on account of technical features intended to carry passengers; (ig) “Category L2 – 5 N” means a category L2-5 vehicle on account of technical features intended to carry goods: Provided that category L2-5 vehicle may fall under the category of L2-5M for passenger carrier or L2-5N for goods carriage, depending on the weight of persons including driver for whom seating arrangements are provided is more than or less than the weight of goods carried and this shall be as per conditions specified in IS 14272:2011, as amended from time to time for L5 category of vehicles.’. 3. In rule 50 of the principal rules, after sub-rule (8), the following sub-rules shall be inserted, namely: - “(9) In case of L2-5 category of vehicles, a single registration number shall be allotted for both the configurations, namely separated two-wheeled vehicle of L2 category or combined three wheeled vehicles of L5 category; and at any point of time there shall be only one registration mark displayed on the front and one on the rear of the vehicle irrespective of the configuration. (10) Dimensions for plate for L2-5 category of vehicle shall be 200 X 100 mm.”. 4. In rule 122 of the principal rules, after sub-rule (3), the following sub-rule shall be inserted, namely: - “(4) In case of L2-5 category of vehicles, the identification number including month and year of manufacture, embossed or etched or punched on it shall be in accordance with AIS 177:2021, as amended from time to time, till the corresponding Bureau of Indian Standards specification are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016).”. 5. In the principal rules, after rule 125N, the following rule shall be inserted, namely:-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “125P: All L2-5 Category of vehicles shall conform to the requirements specified in AIS 177:2021, as amended from time to time, till the corresponding Bureau of Indian Standards specification are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016).”.
