**Report on Amendment to the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999**
**1. Executive Summary:**
This report analyzes an amendment to the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999. The core purpose of this amendment is to update the membership of the Board of the National Trust. The key finding is that the amendment replaces specific members representing various organizations and disabilities with new representatives, ensuring continued representation from diverse disability-related organizations across India. It also specifies term lengths and age limits for members.
**2. Introduction:**
This report provides an overview of an amendment to the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999 (hereinafter referred to as "the Act"), based on the notification published in the Gazette of India on November 9, 2022. The report aims to inform stakeholders about the specific changes introduced by this amendment regarding the composition of the National Trust's Board.
**3. Policy Overview:**
* **Original Policy Being Amended:** The amendment modifies notification S.O. 1700(E), dated May 3, 2019, published in the Gazette of India, Extraordinary, Part II, section 3, subsection ii, dated the 7th May, 2019.
* **Core Objective(s):** The core objective, as inferred from the provided text, is to ensure appropriate and updated representation of various organizations working in the field of autism, cerebral palsy, mental retardation, and multiple disabilities on the Board of the National Trust.
**4. Background and Rationale:**
The amendment likely addresses the need for periodic updates to the membership of the National Trust's Board. It suggests that the previous members' terms had expired or required replacement, necessitating a new notification to reflect the current representatives from different organizations and regions of India. This ensures that the Board remains active and responsive to the needs of persons with disabilities.
**5. Key Provisions / Changes:**
This amendment focuses specifically on modifying the composition of the Board of the National Trust by replacing members.
* **Specific Part of the Original Policy Being Changed:** The amendment specifically substitutes serial numbers 2 to 10 and their corresponding entries in the original notification. These entries pertained to the members appointed under clause (b) of subsection 4 of section 3 of the Act.
* **New Rule/Provision:** The new rule involves replacing the existing members listed under serial numbers 2 through 10 with a new list of individuals, each representing a specific organization working in the field of autism, cerebral palsy, mental retardation, or multiple disabilities from various states in India. The amendment identifies each new member by name, affiliated organization, and the type of disability the organization focuses on (e.g., Autism, Cerebral Palsy, Mental Retardation, Multiple Disabilities). A provision indicating that one position is vacant is also included.
* **Difference/Effect of the Change:** The effect of this change is to bring in new perspectives and expertise to the Board by appointing new representatives from diverse organizations and geographical locations. This refresh ensures the board remains active and the representation is up-to-date. Further, the amendment reinforces that Members shall hold office for a period of three years and cannot hold office after the age of sixty-five.
**6. Target Audience and Stakeholders:**
The direct target audience and stakeholders include:
* The newly appointed members of the National Trust Board.
* The organizations they represent.
* The Department of Empowerment of Persons with Disabilities, Ministry of Social Justice and Empowerment.
* Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities and their families.
* Voluntary Organizations in Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities.
* Associations of Parents in Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Department of Empowerment of Persons with Disabilities within the Ministry of Social Justice and Empowerment is the responsible agency for implementing this amendment.
* **Timelines/Procedures:** The amendment takes effect from the date of its publication in the Official Gazette (November 17, 2022). The new members will hold office for three years.
* **Specific to changes**: Members should be appointed effective from the date of notification and terms of previous member are expired. This ensures that members do not serve after they have attained the age of sixty-five.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of these changes is to revitalize the Board with fresh perspectives and continued representation from various disability-related organizations. It aims to improve the effectiveness of the National Trust in fulfilling its mandate of protecting and promoting the rights of persons with autism, cerebral palsy, mental retardation, and multiple disabilities. The impact would be better-informed policies and programs due to relevant representation.
**9. Conclusion:**
The amendment to the National Trust Act, as detailed in the provided text, focuses on updating the membership of the National Trust Board. This ensures that the Board remains representative, active, and responsive to the needs of individuals with autism, cerebral palsy, mental retardation, and multiple disabilities. The changes reflect a commitment to maintaining an effective and well-informed governing body for the National Trust.
