(1) इन जनयमों का संजक्षप्त नाम केंद्रीय मोटर यान (प्रथम संिोधन) जनयम, 2023 ह ै। (2) य े1 अप्रलै , 2023 प्रवृत्त होंगे । 2. केंद्रीय मोटर यान जनयम, 1989 म,ें जनयम 52 के पश् चात,् जनम् नजलजखत अतं :स्ट् थाजपत दकया िाएगा, अथागत:् - “52क. सरकारी यानों के रजिस्ट् रीकरण प्रमाणपत्र का नवीनीकरण-(1) जनयम 52 म ें अतं र्वगष्ट दकसी बात के होत े हुए भी, दकसी यान की बाबत रजिस्ट्रीकरण प्रमाणपत्र िो जनम्न जलजखत के स्ट् वाजमत् व म ें ह-ै ” (i) केंद्रीय सरकार; या (ii) राज्य सरकार या संघ राज्य क्षत्रे प्रिासन; या (iii) दकसी नगर जनगम या नगर पाजलका या पंचायत; या (iv) सड़क पररवहन जनगम अजधजनयम, 1950 (1950 का 64) और कंपनी अजधजनयम, 2013 (2013 का 18) के अधीन स्ट्थाजपत दकसी राज्य पररवहन उपक्रम; या (v) दकसी सावगिजनक क्षत्रे के उपक्रम; या (vi) केंद्रीय सरकार या राज्य सरकार के स्ट् वाजमत् व या जनयंत्रणाधीन दकसी स्ट् वायत् त जनकाय, यान के आरंजभक रजिस्ट् रीकरण की तारीख स,े धारा 41 की उप धारा (7) म ें यथा उपबंजधत, पंद्रह वषों की अवजध के अवसान के पश् चात् समाप् त हो िाएगा: परंतु सरकारी यान का रजिस्ट् रीकरण प्रमाण पत्र यदि आरंजभक रजिस्ट् रीकरण की तारीख स े पद्रं ह वषग के अवसान के पूवग पहल े ही नवीनीकृत हो चकु ा ह ै तो ऐसा प्रमाणपत्र यान के आरंजभक रजिस्ट् रीकरण की तारीख स े पंद्रह वष ग पणू ग होन े पर रद्द हुआ माना िाएगा: परंतु यह और दक, यह जनयम ििे की रक्षा के जलए कायागत् मक प्रयोिन और आंतररक सरु क्षा तथा कानून व्यवस्ट्था बनाए रखन े के जलए उपयोग दकए िाने वाल े जविेष प्रयोिन यानों (बख़्तरबंि और अन्य जविेष यान) पर लाग ू नहीं होगा। (2) ऐस े यानों का जनपटान, यान के आरंजभक रजिस्ट् रीकरण की तारीख स े पद्रं ह वषों की समाजप् त पर, समय-समय पर संिोजधत मोटर यान (रजिस्ट् रीकरण और यान स्ट् क्रैपपंग सुजवधा संबंधी काय)ग जनयम, 2021 के अनुसार स्ट्थाजपत रजिस्ट्रीकृत यान स्ट् क्रैपपंग सुजवधा के माध्यम स े सुजनजित दकया िाएगा।"। [फा. सं. आरटी 23013/1/2021-टी] महमूि अहमि, अपर सजचव रटप्प ण: मलू जनयम, भारत के रािपत्र, असाधारण, भाग-II, खंड 3, उप-खडं (i) म ें अजधसचू ना स.ं सा.का.जन. 590(अ), तारीख 02 िून, 1989 द्वारा प्रकाजित दकए गए थे और अजधसूचना स.ं सा.का.जन. 901(अ), तारीख 22 दिसंबर 2022 के माध्यम स े अंजतम बार संिोजधत दकए गए ।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 16th January, 2023 G.S.R. 29(E).—Whereas draft rules further to amend the Central Motor Vehicles Rules, 1989, were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 845 (E), dated the 24th November, 2022 in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i) inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Official Gazette containing the said notification were made available to public; And whereas copies of the said Official Gazette in which the said notification was published, were made available to the public on the 25th November, 2022; And whereas the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government; Now, therefore, in exercise of the powers conferred by sub-sections (1) and (4) of section 59 and clause (p) of section 64 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rule further to amend the Central Motor Vehicles Rules, 1989 namely: - 1. (1) These rules may be called the Central Motor Vehicles (First Amendment) Rules, 2023. (2) They shall come into force on the 1st day of April, 2023. 2. In the Central Motor Vehicles Rules, 1989, after rule 52, the following rule shall be inserted, namely: - “52A. Renewal of certificate of registration of Government vehicles. – (1) Notwithstanding anything contained in rule 52, the certificate of registration in respect of a motor vehicle owned by - (i) the Central Government; or (ii) the State Government or Union Territory administrations; or (iii) any Municipal Corporation or Municipality or Panchayat; or (iv) a State transport undertaking established under the Road Transport Corporation Act, 1950 (64 of 1950) and the Companies Act, 2013 (18 of 2013); or (v) a Public sector undertaking; or (vi) an autonomous body owned or controlled by the Central Government or the State Government, shall expire after the lapse of fifteen years, as provided in sub-section (7) of section 41, from the date of initial registration of the vehicle: Provided that the certificate of registration of government vehicle if already renewed before lapse of fifteen years from the date of initial registration, such certificate shall be treated as cancelled on completion of fifteen years from the date of initial registration of the vehicle: Provided further that, this rule shall not apply to the special purpose vehicles (armoured and other specialised vehicles) used for operational purposes for defense of the country and for the maintenance of law and order and internal security. (2) Disposal of such vehicles shall, after the expiry of the fifteen years from the date of initial registration of the vehicle, be ensured through the Registered Vehicle Scrapping Facility set up in accordance with the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021, as amended from time to time.” [F.
