टक्पा हाउस, स्ट्कारा लेह, संघ राज्र्क्षेत्र लद्दाख-194101 (ख) इिीजनर्र अब्िलु वाजहि चाजचचक कारजगल, - सिस्ट्र्; और अब्िलु वाजहि फराओ, द्रास रामबीरपुर (द्रास), कारजगल, संघ राज्र्क्षेत्र लद्दाख-194202 (ग) वचर्िीव वाडान, लेह, वचर्िीव जवभाग, - सिस्ट्र्-सजचव। प्रर्म तल, लद्दाख प्रिषू ण जनर्त्रं ण सजमजत भवन, स्ट्कारा, र्ोकामा लेह, समीप के बीआर वार्ुपत्तन, जपन-194101 1747 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 2. प्राजधकरण के अध्र्क्ष और सिस्ट्र्, रािपत्र में इस अजधसूचना के प्रकािन की तारीख से तीन वषा की अवजध के जलए पि धारण करेंग े। 3. प्राजधकरण ऐसी िजिर्ों का प्रर्ोग करेगा और ऐसी प्रदिर्ाओं का अनुसरण करेगा, िो उि अजधसूचना में जवजनर्िाष्ट की गई ह ैं। 4. प्राजधकरण, पैरा 6 के अधीन गरठत संघ राज्र्क्षेत्र स्ट्तरीर् जविेषज्ञ मूल्र्ांकन सजमजत की जसफाररिों पर अपना जवजनश्चर् करेगा । 5. प्राजधकरण के सभी जवजनश्चर् बठै क में दकए िाएगं े और साधारणतर्ा सवासम्मत होंग े: परंतु र्ह दक जवजनश्चर् बहुमत द्वारा लने े की ििा म ें इसके पक्ष और जवपक्ष में जवचारों के ब्र्ौरे कार्ावृत्त म ें स्ट्पष्टतर्ा अजभजलजखत दकए िाएगं ेऔर उसकी एक प्रजत केंद्रीर् सरकार को भेिी िाएगी। 6. केंद्रीर् सरकार, लद्दाख संघ राज्र्क्षेत्र के परामिा से, प्राजधकरण की सहार्ता करन ेके प्रर्ोिन के जलए, लद्दाख संघ राज्र्क्षेत्र के जलए संघ राज्र्क्षेत्र स्ट्तरीर् जविेषज्ञ मूल्र्ांकन सजमजत (जिसे इसमें इसके पश्चात् सजमजत कहा गर्ा ह)ै का गठन करती है, जिसमें जनम्नजलजखत सिस्ट्र् होंग,े अर्ाात:् -- (क) डा. संिीपन मुखिी, - अध्र्क्ष; ज़रगर हाउस अपर कारिू, लेह-लद्दाख, संघ राज्र्क्षेत्र लद्दाख जपन-194101 (ड.) डा. सुब्रत िमाा, - सिस्ट्र्; डीन अनुसंधान अध्र्र्न, लद्दाख जवश्वजवद्यालर्, टारु पररसर, टारु लेह, लद्दाख संघ राज्र्क्षेत्र -194101 (च) प्रभागीर् वन अजधकारी, - सिस्ट्र्-सजचव । फोटा रोड़, लेह-वन प्रभाग, लद्दाख 7. सजमजत के अध्र्क्ष और सिस्ट्र्, रािपत्र में इस अजधसूचना के प्रकािन की तारीख से तीन वषा की अवजध के जलए पि धारण करेंग े। 8. सजमजत ऐसी िजिर्ों का प्रर्ोग करेगी और ऐसी प्रदिर्ाओं का अनुसरण करेगी िो उि अजधसूचना में जवजनर्िाष्ट की गई ह ैं। 9. सजमजत सामूजहक उत्तरिाजर्त्व के जसद्ांत पर कार्ा करेगी और अध्र्क्ष प्रत्र्ेक मामल ेम ेंसवासम्मजत पर पहुचं ने का प्रर्ास करेगा और र्दि सवासम्मजत नहीं बन सकती ह,ै तो बहुमत का अजभमत अजभभावी होगा ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 10. जहत के दकसी जवरोध से बचने के जलए, -- (i) प्राजधकरण के अध्र्क्ष और सिस्ट्र् तर्ा सजमजत के अध्र्क्ष और सिस्ट्र्, - (क) र्ह घोषणा करेंगे दक वे दकस परामिी संगठन के सार् सहर्ुि रह ेह ैंऔर पररर्ोिना प्रस्ट्तावक भी रह ेह ैं ; और (ख) पररर्ोिना के जलए पर्ाावरण समाघात जनधाारण और पर्ाावरण प्रबंध र्ोिना को तैर्ार करने के संबंध में कोई परामिा नहीं िगें े और सहर्ोग नहीं करेंग,े जिसे उनके कार्ाकाल के िौरान प्राजधकरण द्वारा जवजनजश्चत दकर्ा िाना ह ैर्ा जिसका सजमजत द्वारा मूल्र्ांदकत दकर्ा िाना ह ै ; और (ii) र्दि प्राजधकरण र्ा सजमजत के अध्र्क्ष र्ा दकसी सिस्ट्र् न ेपूवावती पांच वषों के िौरान दकसी पररर्ोिना प्रस्ट्तावक के जलए परामिी सेवाएं प्रिान की ह ैंर्ा पर्ाावरण समाघात जनधाारण अध्र्र्न संचाजलत दकर्ा है, तो उस ििा म ें वे ऐसे प्रस्ट्तावकों द्वारा दकसी प्रस्ट्ताजवत पररर्ोिना के मल्ू र्ांकन की प्रदिर्ा म ें प्राजधकरण र्ा सजमजत की बैठकों से स्ट्वर्ं को िरू रखेंग े। 11. संघ राज्र्क्षेत्र लद्दाख का प्रिासन, प्राजधकरण और सजमजत के जलए सजचवालर् के रुप में कार्ा करने के जलए एक अजभकरण अजधसूजचत करेगा और सजचवालर् उि अजधसूचना के अधीन सभी जवत्तीर् और संभार तंत्र सहार्ता जिसके अंतगात आवास, पररवहन और उनके कृत्र्ों के संबंध में ऐसी अचर् सुजवधाएं भी हैं, उपलब्ध कराएगा । 12. प्राजधकरण और सजमजत के अध्र्क्ष और सिस्ट्र्ों को बैठक फीस, र्ात्रा भत्ते और मंहगाई भत्ते संघ राज्र्क्षेत्र के प्रिासन के सुसंगत जनर्मों के उपबंधों के अनुसार संित्त दकए िाएंग े । [फा.स.ं आईए3-13/3/2024–आईए.III] रित अग्रवाल, संर्ुि सजचव MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 13th March, 2025 S.O. 1202(E).— In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India, in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the Union territory Level Environment Impact Assessment Authority for the Union territory of Ladakh (hereinafter referred to as the Authority) comprising of the following Members, namely: - (a) Shri Jigmet Takpa, - Chairman; Takpa House, Skara, Leh, Union territory Ladakh-194101 (b) Er. Abdul Wahid Chanchik Kargil, - Member; Abdul Majed Furao, Drass, Rambirpur (Drass), Kargil, Union territory Ladakh - 194202 (c) Wildlife Warden, Leh, Wildlife Department, - Member- Secretary. 1st Floor, Ladakh Pollution Control Committee Building, Skara Yokma Leh, near KBR Airport, Pin- 194101 2. The Chairman and Members of the Authority shall hold office for a period of three years from the date of publication of this notification in the Official Gazette.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 3. The Authority shall exercise such powers and follow such procedures as specified in the said notification. 4. The Authority shall take its decision on the recommendations of the Union territory Level Expert Appraisal Committee constituted under paragraph 6. 5. All decisions of the Authority shall be taken in a meeting and shall ordinarily be unanimous: Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof sent to the Central Government. 6. The Central Government, in consultation with the Union territory of Ladakh, for the purpose of assisting the Authority, hereby constitutes the Union territory Level Expert Appraisal Committee for Union territory of Ladakh (hereinafter referred to as the Committee), comprising of the following Members, namely: - (a) Dr. Sandipan Mukherjee, - Chairman; Centre Head G.B. Pant, National Institute of Himalayan Environment, Ministry of Environment, Forest and Climate Change- Government of India Union Territory Ladakh, Rutpa House near Islamia Public School, DIHAR Road, Leh-Ladakh-194101 (b) Dr. Om Prakash Chaurasia, - Member; Director, Defence Institute of High Altitude Research, DRDO, Leh – Ladakh Union territory- 194101 (c ) Dr. Mohd. Hussain, - Member; Coordinator Zoology/ Dean Science, University of Ladakh, Department of Zoology Leh Campus, University of Ladakh, Pin-194101 (d) Shri Gulam Nabi Zargar, - Member; Zargar House Upper Karzoo, Leh- Ladakh, Union territory Ladakh, Pin-194101 (e) Dr. Subrat Sharma, - Member; Dean Research Studies, University of Ladakh, Taru Campus, Taru, Leh, Union territory of Ladakh, Pin- 194101 (f) Divisional Forest Officer, - Member- Secretary. Fort Road, Leh –Forest Division, Ladakh 7. The Chairman and Members of the Committee, shall hold office for a period of three years from the date of publication of this notification in the Official Gazette. 8. The Committee shall exercise such powers and follow such procedures as specified in the said notification. 9. The Committee shall function on the principle of collective responsibility and the Chairman shall endeavour to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail. 10. In order to avoid any conflict of interest,- (i) the Chairman and Members of the Authority and the Chairman and Member of the Committee shall,⸺ (a) declare as to which consulting organisation they have been associated with and also the project proponents; and[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (b) not undertake any consultation or associate with regard to preparation of environment impact assessment and environment management plan for a project, which is to be decided by the Authority or to be appraised by the Committee during their tenure; and (ii) if the Chairman or any Member of the Authority or the Committee has provided consultancy services or conducted environment impact assessment studies for any project proponent during the preceding five years, in that event they shall recuse themselves from the meetings of the Authority or the Committee in the process of appraisal of any project proposed by such proponents. 11. The administration of Union territory of Ladakh shall notify an agency to act as Secretariat for the Authority and the Committee and the Secretariat shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of their functions under the said notification. 12. The sitting fees, travelling allowances and dearness allowances to the Chairman and Members of the Authority and the Committee shall be paid in accordance with the provisions of relevant rules of the Union Territory administration.
