और िबदक, उक्त अजधजनयम के कायाान्वयन के अनुभव स ेइंजगत ह ैदक जनिी भूस्ट्वाजमयों द्वारा अपनी भूजम पर दकए गए वृक्षारोपण और कृजि-वाजनकी गजतजवजधयों, जविेि रूप स ेतीव्र गजत स ेबढ़न ेवाली तथा वाजणज्यक रूप स ेखेती की िान े वाली वृक्ष प्रिाजतयों स ेसंबंजधत गजतजवजधयों को वृक्षों की कटाई और उनके पारगमन के जलए अनुमजत स ेसंबंजधत प्रदियात्मक आवश्यकताओं के कारण पयााप्त प्रोत्साहन नहीं जमला ह;ै 7594 DG/2026 (1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] और िबदक, एक सरलीकृत, पूवाानुमाजनत और पारििी जवजनयामक संरचना के अभाव ने व्यजक्तयों तथा भूस्ट्वाजमयों को जनिी भूजम पर वृक्षारोपण करने के जलए हतोत्साजहत दकया ह,ै क्योंदक कृजि-वाजनकी या वाजणजज्यक उद्देश्यों के जलए मानव प्रयासों स े उगाए गए वक्षृ ों के पररपक्व होन े पर उन्ह ेंकाटना या उनका उपयोग करना मुजश्कल हो िाता ह;ैं और िबदक, जनिी भूजम पर कृजि-वाजनकी और वृक्षारोपण को बढ़ावा िेना हररत आवरण बढ़ाने, काबान पथृ क्करण को बढ़ाने, लकडी तथा बायोमास की आपूर्त ा को परू क करन,े प्राकृजतक वनों पर िबाव कम करने, आिीजवका का समथान करने और िलवाय ुपररवतान िमन तथा पयाावरणीय जस्ट्थरता म ें योगिान करन े के जलए आवश्यक ह;ै और िबदक, कई राज्यों और केंद्र िाजसत प्रििे ों न े पयाावरण सरं क्षण के साथ व्यवसाय करने म ें आसानी तथा वन क्षेत्रों के बाहर वृक्षारोपण को प्रोत्साहन िेने के साथ संतुजलत करने की आवश्यकता को पहचानते हुए जनिी भूजम पर वृक्षारोपण और कृजि-वाजनकी प्रिाजतयों के जलए सरलीकृत जवजनयामक तत्रं अपनाए ह,ैं और िबदक, “पयाावरण, वन एव ं िलवाय ु पररवतना मंत्रालय, भारत सरकार” न े कृजि वाजनकी को बढ़ावा िने े, जवजनयामक बाधाओं को कम करने और जडजिटल पंिीकरण, पता लगाने की क्षमता तथा सत्यापन तंत्र के माध्यम स े सुरक्षा सुजनजित करन ेके उद्देश्य स ेकृजि और जनिी भूजम म ेंवृक्षों की कटाई के जलए आिि ाजनयम तथा दििाजनिेि पररचाजलत दकए ह;ैं और िबदक, दिल्ली वृक्ष परररक्षण अजधजनयम, 1994 के अंतगात जवजनयामक संरचना को उपयक्तुा नीजतगत उद्दश्े यों, राष्ट्रीय दििा-जनििे ों और सवोत्तम पद्धजतयों के अनुरूप बनाना आवश्यक समझा िाता ह,ै िबदक िरुु पयोग को रोकने तथा कानून या न्यायालय के जनििे ों के अतं गता संरजक्षत वनों, ररज़ क्षत्रे ों और वृक्षों की सुरक्षा सुजनजित करन ेके जलए उजचत सुरक्षा उपायों को बनाए रखना आवश्यक ह;ै अब इसजलए, दिल्ली वृक्ष परररक्षण अजधजनयम, 1994 (1994 का दिल्ली अजधजनयम 11) की धारा 29 और 34 द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए,तथा उक्त अजधजनयम की धारा 34 की उपधारा (1) के अंतगता यथा अपेजक्षत पूवावती प्रकािन के पिात,् राष्ट्रीय रािधानी क्षत्रे दिल्ली के उपराज्यपाल, इस बात स े संतष्टु होकर दक ऐसा करना िनजहत म ें आवश्यक ह,ै एतद्द्वारा जनम्नजलजखत जनयम बनात े ह,ैं अथाात:् — “दिल्ली वक्षृ परररक्षण (कृजि-वाजनकी एव ं छूट प्राप्त वक्षृ ारोपण प्रिाजतया)ाँ जनयमावली, 2026”

1. सजं क्षप्त िीिका एव ंप्रारंभ:-

(1) इन जनयमों को दिल्ली वृक्ष परररक्षण (कृजि-वाजनकी एव ंछूट प्राप्त वृक्षारोपण प्रिाजतयााँ) जनयमावली, 2026 कहा िाए।

(2) य े आजधकाररक रािपत्र म ेंइनके प्रकािन की जतजथ स े लागू होंग।े

2. अनप्रु योग:- ये जनयम, राष्ट्रीय रािधानी क्षत्रे दिल्ली के अतं गता आने वाली जनिी भूजम पर लाग ूहोंग,े जसवाय उस भूजम के िो जनम्नजलजखत का जहस्ट्सा ह—ै (क) वन, ररज़ क्षत्रे या माजनत वन; या (ख) कोई भी भूजम जिसके संबंध म ेंतत्समय दकसी कानून के अंतगता या दकसी न्यायालय अथवा न्यायाजधकरण के आििे द्वारा वृक्षों की कटाई जनजिद्ध या प्रजतबंजधत ह।ै स्ट्पष्टीकरण:- यह स्ट्पष्ट दकया िाता ह ैदक वन जस्ट्थजत जववाि, ररज़ क्षत्रे , पयाावरणीय उल्लघं न, क्षजतपूर्ता वनरोपण िाजयत्व या जवद्यमान न्याजयक जनिेिों स े सबं ंजधत मामलों म ेंछूट/माजनत अनुमजत तंत्र लागू नहीं होगा।[PART IV DELHI GAZETTE : EXTRAORDINARY 3

3. पररभािाएाँ:- इन जनयमों म,ें िब तक संिभ ासे अन्यथा अपेजक्षत न हो,— (क) “अजधजनयम” का अजभप्राय दिल्ली वृक्ष परररक्षण अजधजनयम, 1994 स े ह;ै (ख) “वृक्ष” का वही अजभप्राय होगा िो अजधजनयम की धारा 2 के खंड (ि) के अतं गता इस े जनर्िाष्ट दकया गया ह;ै (ग) “जनिी भूजम” का अजभप्राय दकसी व्यजक्त, पररवार, रस्ट्ट, सोसायटी या जनिी संस्ट्था के स्ट्वाजमत्व वाली, उसके पास मौिूि या उसके वैध कब्ि े वाली कृजि भूजम स े ह ै तथा िो केंद्र सरकार, राष्ट्रीय रािधानी क्षत्रे दिल्ली सरकार या दकसी स्ट्थानीय प्राजधकरण म ेंजनजहत नहीं ह;ै (घ) “वृक्षारोपण / कृजि-वाजनकी” का अजभप्राय लकडी, ईंधन, चारा, वाजणजज्यक, कृजि या मृिा उवारता बढ़ान ेके उद्देश्यों हते ु जनिी भूजम पर व्यजक्त/संस्ट्था द्वारा उगाए गए वृक्षों स े ह,ै जिसम ें फामा वाजनकी और ब्लॉक वृक्षारोपण िाजमल ह;ैं (ङ) “छूट प्राप्त वृक्षारोपण प्रिाजतयों” का अजभप्राय अनुसूची-I म ें जनर्िाष्ट ऐसी वृक्ष प्रिाजतयों स े ह ै जिनकी वाजणजज्यक रूप स े खेती की िाती ह ैं या िो तीव्र गजत स े बढ़न े वाली वक्षृ ारोपण प्रिाजतयााँ ह ैं और प्राकृजतक वनों या ररज़ पाररजस्ट्थजतकी तंत्र का जहस्ट्सा नहीं ह;ैं (च) “वन वृक्ष” का अजभप्राय दकसी भी प्रकार के प्राकृजतक रूप स े उगने वाले वृक्ष स े ह ै िो वन या ररज़ पाररजस्ट्थजतकी तंत्र का जहस्ट्सा होता ह,ै चाह े उसका स्ट्वाजमत्व दकसी के भी पास हो;

(छ) “कटाई” म ेंवृक्ष को काटना, िड स े उखाडना, िाखाए ाँ काटना, छाँटाई करना या हटाना िाजमल ह;ै (ि) “वृक्ष अजधकारी” का अजभप्राय अजधजनयम की धारा 3 के अतं गता जनयुक्त वृक्ष अजधकारी स ेह;ै (झ) “पोटाल” का अजभप्राय वन एव ं वन्यिीव जवभाग, राष्ट्रीय रािधानी क्षत्रे दिल्ली सरकार के ई-वन पोटाल स े ह ै िो

https://dpta.eforest.delhi.gov.in पर या कोई उत्तरवती या एकीकृत प्रणाली पर उपलब्ध ह।ै

4. पवू ा अनमु जत की आवश्यकता स ेछूट:- अजधजनयम की धारा 5 और 6 म ेंजनजहत दकसी भी बात के होत ेहुए भी, इन जनयमों के अधीन, जनिी भूजम पर जस्ट्थत छूट प्राप्त वृक्षारोपण प्रिाजतयों के वृक्षों की कटाई, हटान े या जनपटान के जलए पूव ा अनुमजत की आवश्यकता नहीं होगी।

5. छूट प्राप्त वक्षृ ारोपण प्रिाजतया:ाँ- इन जनयमों के प्रयोिनाथ ा छूट प्राप्त वृक्षारोपण प्रिाजतयााँ वे होंगी िो अनुसूची-I म ें जनर्िष्टा ह।ैं अनुसूची-I (जनयम 3(ङ) और जनयम 5 िेख)ें

1. पॉपलर (पॉपुलस डल्े टोइड्स)

2. सफेिा (यूकेजलप्टस प्रिाजत)

3. सेझना (मोररंगा ओजलफेरा)

4. गमारी (ग्मेजलना आबोररया)

5. मालाबार नीम (मेजलया ड्यूजबया)

6. ित ेंएव ं सीमाएं:- इन जनयमों के अतं गात छूट वहां लाग ू नहीं होगी िहां—4 DELHI GAZETTE : EXTRAORDINARY PART IV] (क) भूजम वन, ररज़ श्ृंखला या माजनत वन भूजम ह;ै या (ख) दकसी न्यायालय या न्यायाजधकरण के दकसी कानून, अजधसूचना या आिेि द्वारा वृक्षों की कटाई जनजिद्ध या प्रजतबंजधत ह।ै

7. वक्षृ ारोपण का पिं ीकरण:-

(1) जनिी भूजम का स्ट्वामी, छूट प्राप्त वृक्षारोपण प्रिाजतयों के वृक्षारोपण को पोटाल पर पंिीकृत करेगा।

(2) पंिीकरण म ेंजनम्नजलजखत िाजमल होंगे— (क) स्ट्वाजमत्व संबंधी िस्ट्तावेि; (ख) भूजम की भू-टैग्ड की गई तस्ट्वीरें और केएमएल फाइल; तथा (ग) वृक्षों की प्रिाजत और संख्या।

(3) पंिीकरण होन े पर पोटाल स्ट्वचाजलत रूप स ेवृक्षारोपण पंिीकरण प्रमाणपत्र सृजित करेगा।

8. वक्षृ ों की कटाई हते ुसचू ना तथा पवू ा जनधारा रत अनमु जत:-

(1) िस वृक्षों तक की कटाई के जलए, स्ट्वामी को वृक्षारोपण पंिीकरण प्रमाण पत्र और काटे िान ेवाल ेप्रस्ट्ताजवत वृक्षों की भू- टैग्ड की गई तस्ट्वीरें अपलोड करनी होंगी तथा ऐसी प्रस्ट्तुजत पर,िहााँ कोई आपजत्त ििा नहीं की िाती ह,ै वहा ं वृक्ष अजधकारी सात काय ादिवसों के भीतर आवश्यक अनुमजत िारी करेगा। बिते दक कोई भी आपजत्त केवल इन जनयमों या दकसी कानून या न्यायालय अथवा न्यायाजधकरण के आिेि के उल्लंघन पर आधाररत होगी।

(2) िस स ेअजधक वृक्षों की कटाई के जलए, स्ट्वामी पोटाल पर सचू ना प्रस्ट्ततु करेगा और— (क) वृक्ष अजधकारी प्रस्ट्तुत करन े की जतजथ स ेचौिह काय ा दिवसों के भीतर स्ट्थल का जनरीक्षण करेगा; तथा (ख) िहााँ उक्त अवजध के भीतर कोई आपजत्त िि ानहीं की िाती ह,ै वहा ंवृक्ष अजधकारी तीन सप्ताह के भीतर आवश्यक अनुमजत िारी करेगा। बिते दक कोई भी आपजत्त केवल इन जनयमों या दकसी कानून या न्यायालय अथवा न्यायाजधकरण के आििे के उल्लंघन पर आधाररत होगी।

9. पारगमन, पररवहन एव ं उपयोग :-

(1) छूट प्राप्त वृक्षारोपण प्रिाजतयों स े प्राप्त लकडी या उत्पाि को राष्ट्रीय रािधानी क्षत्रे दिल्ली के भीतर या बाहर दकसी अलग पारगमन परजमट के जबना ले िाया िा सकता ह।ै

(2) वृक्ष अजधकारी द्वारा कटाई हते ु िारी की गई अनुमजत लकडी के जलए वैध पररवहन िस्ट्तावेि के रूप म ें काय ा करेगी।

(3) िरुु पयोग को रोकन े के जलए यािजृ छछक सत्यापन दकया िा सकता ह।ै

10. क्षजतपर्ू त ा वक्षृ ारोपण स ेछूट:- इन जनयमों के अनुसार काटे गए वृक्षों पर अजधजनयम की धारा 8 के अतं गता क्षजतपूर्ता वृक्षारोपण लाग ू नहीं होगा।

11. बचाव:- इन जनयमों म ेंस े कोई भी बात वृक्षों या वृक्षारोपण पर लागू नहीं होगी— (क) जिन्ह ेंतत्समय लाग ू दकसी भी कानून के अंतगात जविेि रूप स े संरजक्षत अजधसूजचत दकया गया हो; या (ख) जिनके संबंध म ेंदकसी न्यायालय या न्यायाजधकरण के दकसी आिेि या जनिेि द्वारा वृक्षों की कटाई जनजिद्ध या प्रजतबंजधत ह।ै[PART IV DELHI GAZETTE : EXTRAORDINARY 5

12. सिं ोधन करन ेकी िजक्त:- सरकार, िनजहत म ेंअजधसूचना द्वारा इन जनयमों के अतं गता अनुसूची-I या प्रदियात्मक आवश्यकताओं म ेंसंिोधन कर सकती ह।ै

13. सामान्य बचाव:- इन जनयमों म ें ऐसा कुछ भी नहीं ह ै िो वनों, पयाावरण या वन्यिीवों स े संबंजधत दकसी भी कानून के संचालन या दकसी न्यायालय या न्यायाजधकरण के दकसी बाध्यकारी जनिेि को प्रभाजवत करेगा। राष्ट्रीय रािधानी क्षेत्र दिल्ली के उपराज्यपाल के आिेि से तथा उनके नाम पर जविय कुमार जबधुरी, सजचव (पयाावरण एव ं वन) DEPARTMENT OF FORESTS AND WILDLIFE

NOTIFICATION Delhi, the 30th September, 2026 F.No. FAWL-L/1/2026-Tree Cell/e-323873/9777.— Whereas the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994) was enacted with the primary objective of conserving tree cover and protecting the environment in the National Capital Territory of Delhi;

And whereas, experience in the implementation of the said Act has shown that plantation and agro-forestry activities undertaken by private landowners on their own land, particularly involving fast-growing and commercially cultivated tree species, have not received adequate encouragement due to procedural requirements relating to permission for felling and transit of trees;

And whereas, the absence of a simplified, predictable and transparent regulatory framework has acted as a disincentive for individuals and landowners to undertake plantation on private land, as trees raised through human agency for agro-forestry or commercial purposes become difficult to harvest or utilise upon maturity;

And whereas, promotion of agro-forestry and plantation on private land is essential for increasing green cover, enhancing carbon sequestration, supplementing timber and biomass supply, reducing pressure on natural forests, supporting livelihoods, and contributing to climate-change mitigation and environmental sustainability;

And whereas, several States and Union Territories have adopted simplified regulatory mechanisms for plantation and agro-forestry species on private land, recognising the need to balance environmental protection with ease of doing business and encouragement of tree plantation outside forest areas;

And whereas, the Ministry of Environment, Forest and Climate Change, Government of India, has circulated Model Rules and Guidelines for felling of trees in agricultural and private lands with the objective of promoting agro- forestry, reducing regulatory barriers, and ensuring safeguards through digital registration, traceability and verification mechanisms;

And whereas, it is considered necessary to align the regulatory framework under the Delhi Preservation of Trees Act, 1994 with the aforesaid policy objectives, national guidelines and best practices, while retaining appropriate safeguards to prevent misuse and to ensure protection of forests, ridge areas, and trees protected under law or court directions;

Now, therefore, in exercise of the powers conferred by section 29 and 34 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), and after previous publication as required under sub-section (1) of section 34 of the said Act, the Lieutenant Governor of the National Capital Territory of Delhi, being satisfied that it is necessary in the public interest so to do, hereby makes the following rules, namely:—6 DELHI GAZETTE : EXTRAORDINARY PART IV] “DELHI PRESERVATION OF TREES (AGRO-FORESTRY AND EXEMPTED PLANTATION SPECIES) RULES, 2026”.

1. Short title and commencement.

(1) These rules may be called the Delhi Preservation of Trees (Agro-forestry and Exempted Plantation Species) Rules,

2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.

These rules shall apply to private land within the National Capital Territory of Delhi, other than land forming part of—

(a) forests, ridge areas or deemed forests; or

(b) any land in respect of which felling of trees is prohibited or restricted under any law for the time being in force or by order of any court or tribunal.

Explanation:- It is clarified that exemption/ deemed permission mechanism shall not be applicable in cases involving forest status disputes, ridge areas, environmental violations, compensatory afforestation obligation or subsisting judicial directions.

3. Definitions.

In these rules, unless the context otherwise requires,—

(a) “Act” means the Delhi Preservation of Trees Act, 1994;

(b) “tree” shall have the same meaning as assigned to it under clause (h) of section 2 of the Act;

(c) “private land” means agricultural land owned, held or lawfully possessed by an individual, family, trust, society or private entity and not vested in the Central Government, the Government of National Capital Territory of Delhi or any local authority;

(d) “plantation / agro-forestry” means trees raised by individual/entity on private land for timber, fuel, fodder, commercial, agricultural or soil-improvement purposes, including farm forestry and block plantations;

(e) “exempted plantation species” means such tree species specified in Schedule-I which are commercially cultivated or fast-growing plantation species and do not form part of natural forests or ridge ecosystems;

(f) “forest tree” means a naturally occurring tree forming part of forest or ridge ecosystems, irrespective of ownership;

(g) “felling” includes cutting, uprooting, lopping, pollarding or removal of a tree;

(h) “Tree Officer” means the Tree Officer appointed under section 3 of the Act;

(i) “portal” means the e-Forest portal of the Department of Forests and Wildlife, Government of the National Capital Territory of Delhi, accessible at https://dpta.eforest.delhi.gov.in, or any successor or integrated system.

4. Exemption from requirement of prior permission.

Notwithstanding anything contained in sections 5 and 6 of the Act, no prior permission shall be required for the felling, removal or disposal of trees of exempted plantation species situated on private land, subject to these rules.

5. Exempted plantation species.

The exempted plantation species for the purposes of these rules shall be those specified in Schedule-I.

SCHEDULE-I (See rule 3(e) and rule 5)

1. Poplar (Populus deltoides)

2. Safeda (Eucalyptus spp.)

3. Sejhana (Moringa Oleifera)

4. Gamari (Gmelina arborea)

5. Malabar Neem (Melia dubia)

6. Conditions and limitations.

The exemption under these rules shall not apply where—

(a) the land is forest, ridge or deemed forest land; or

(b) felling of trees is prohibited or restricted by any law, notification or order of any court or tribunal.

7. Registration of plantation.

(1) The owner of private land shall register the plantation of exempted plantation species on the portal.

(a) ownership related document;

(b) geo-tagged photographs and KML file of the land; and

(c) species and number of trees.

(3) Upon registration, the portal shall generate an automatic Plantation Registration Certificate.

8. Intimation and default permission for felling.

(1) For felling of up to ten trees, the owner shall upload the Plantation Registration Certificate and geo-tagged photographs of the trees proposed to be felled and, upon such submission, where no objection is recorded, the Tree officer shall issue necessary permission within Seven working Days. Provided that any objection shall be based only on violation of these rules or any law or order of a court or tribunal.

(2) For felling of more than ten trees, the owner shall submit an intimation on the portal and—

(a) the Tree Officer shall conduct a site inspection within fourteen working days from the date of submission; and

(b) where no objection is recorded within the said period, The Tree officer shall issue necessary permission within three weeks. Provided that any objection shall be based only on violation of these rules or any law or

order of a court or tribunal.

9. Transit, transport and use.

(1) Timber or produce obtained from exempted plantation species may be transported within or outside the National Capital Territory of Delhi without any separate transit permit.

(2) The felling permission issued by the Tree officer shall act as a valid transport document for the timber.

(3) Random verification may be undertaken to prevent misuse.

10. Exemption from compensatory plantation.

Trees felled in accordance with these rules shall not attract compensatory plantation under section 8 of the Act.

11. Savings.

Nothing in these rules shall apply to trees or plantations—

(a) specifically notified as protected under any law for the time being in force; or

(b) in respect of which felling of trees is prohibited or restricted by any order or direction of a court or tribunal.

12. Power to amend.

The Government may, in public interest, amend Schedule-I or procedural requirements under these rules by notification.

13. General savings.

Nothing in these rules shall affect the operation of any law relating to forests, environment or wildlife, or any binding direction of a court or tribunal.
