## Policy Analysis Report: Amendment to the Administrative Tribunals Act, 1985 Regarding Bench Jurisdictions in Jammu & Kashmir and Ladakh
**1. Executive Summary:**
This report analyzes a notification (G.S.R. 805E) dated November 17, 2021, which constitutes an amendment to the Government of India's notification G.S.R. 610E, dated July 26, 1985, concerning the jurisdiction of benches under the Administrative Tribunals Act, 1985. This amendment specifically addresses the jurisdiction of the Jammu and Srinagar Benches with respect to districts within the Union Territories of Jammu & Kashmir and Ladakh. The key finding is the clear demarcation of districts falling under the jurisdiction of each bench, likely intended to streamline administrative justice within the newly formed Union Territories.
**2. Introduction:**
This report aims to provide a clear and concise overview of the amendment to the Administrative Tribunals Act, 1985, as detailed in the provided Government of India notification. The analysis is based solely on the text of the notification and related references.
**3. Policy Overview:**
* This notification amends the original policy established under G.S.R. 610E, dated the 26th July, 1985.
* **Core Objective:** The core objective of this amendment, as inferred from the text, is to redefine and clarify the jurisdictional boundaries of the Jammu and Srinagar Benches of the Administrative Tribunal within the Union Territories of Jammu & Kashmir and Ladakh.
**4. Background and Rationale:**
Following the reorganization of the former state of Jammu and Kashmir into two Union Territories (Jammu & Kashmir and Ladakh), this amendment likely aims to ensure clarity and effective administration of justice by precisely defining which districts fall under the purview of the Jammu and Srinagar Benches. The amendment resolves potential ambiguity regarding jurisdictional responsibilities following the territorial changes.
**5. Key Provisions / Changes:**
This section details the specific changes introduced by the amendment.
* **Change 1:** The entry for serial number 18 (Jammu Bench) in the original notification is substituted.
* **Old Provision:** The original text for Serial Number 18 is replaced entirely (although not provided in the excerpt).
* **New Provision:** The Jammu Bench now has jurisdiction over the following districts: Doda, Jammu, Kathua, Kishtwar, Reasi, Poonch, Rajouri, Ramban, Samba, Udhampur (in the Union Territory of Jammu and Kashmir) and Leh (in the Union Territory of Ladakh).
* **Effect:** This change explicitly lists the districts under the Jammu Bench’s jurisdiction, providing clarity and preventing jurisdictional disputes. The inclusion of the Leh district is specifically noteworthy.
* **Change 2:** A new entry (serial number 19) is inserted for the Srinagar Bench.
* **Old Provision:** There was no explicitly defined Srinagar Bench before this insertion.
* **New Provision:** The Srinagar Bench now has jurisdiction over the following districts: Srinagar, Anantnag, Bandipora, Baramulla, Budgam, Ganderbal, Kulgam, Kupwara, Pulwama, Shoplan (in the Union Territory of Jammu and Kashmir) and Kargil (in the Union Territory of Ladakh).
* **Effect:** The creation of a distinct Srinagar Bench, with specified district jurisdiction, establishes a clear point of administrative justice within that region of the Union Territory of Jammu and Kashmir and Ladakh. The explicit mentioning of the Kargil district under its jurisdiction is particularly important.
**6. Target Audience and Stakeholders:**
Based on the text, the primary target audience and stakeholders include:
* Residents of the specified districts within the Union Territories of Jammu & Kashmir and Ladakh who may need to utilize the Administrative Tribunal system.
* Government employees and officials within these districts who are subject to the Administrative Tribunals Act.
* The Administrative Tribunals themselves, specifically the Jammu and Srinagar Benches, as the amendment directly affects their jurisdictional responsibilities.
* Legal professionals practicing within these jurisdictions.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Department of Personnel and Training (Ministry of Personnel, Public Grievances and Pensions) is responsible for implementing and overseeing the amendment, as evidenced by the notification's origin.
* **Procedures:** No specific procedures or timelines are detailed in the provided text regarding the implementation of these jurisdictional changes. However, it can be assumed that internal directives would be issued to the Administrative Tribunals to reflect these changes. The F. No. P1302412019AT is likely a reference number for internal document tracking.
**8. Expected Outcomes / Impact of Changes:**
The intended outcome of these changes is likely to:
* Reduce ambiguity and potential disputes regarding the jurisdiction of the Jammu and Srinagar Benches.
* Streamline the administrative justice system in the Union Territories of Jammu & Kashmir and Ladakh.
* Ensure efficient handling of cases by clearly defining the geographical areas each bench is responsible for.
* Facilitate better access to justice for residents of these regions by providing clarity on which bench to approach.
**9. Conclusion:**
The amendment to the Administrative Tribunals Act, 1985, detailed in notification G.S.R. 805E, represents a significant step in clarifying the jurisdictional responsibilities of the Jammu and Srinagar Benches within the Union Territories of Jammu & Kashmir and Ladakh. By explicitly defining the districts under each bench's purview, the amendment aims to improve the efficiency and accessibility of the administrative justice system in the region. This amendment is crucial for ensuring smooth functioning of the Administrative Tribunals in the newly reorganized territories.
