सिक् त ह;ै और िबदक केंर सरकार ने उक्त अजधजनयम की धारा 4 की उपधारा (1) के अधीन प्रदत् त िजक्त यों का प्रयोग करते हुए, िूट सामग्री म ें पैकेजिंग के मानकों की जसफाररि करने के जलए, ददनांक 19 िनवरी, 2022 के का.आ. संख् या 295(अ), द्वारा स्ट्थ ायी सलाहकार सजमजत का गठन दकया ह;ै और िबदक केंर सरकार, स्ट्थ ायी सलाहकार सजमजत द्वारा की गई जसफाररिों पर जवर्ार करने के पश् र्ात ् इस बात स े संतुष्ट ह ै दक िूट पैकेजिंग सामग्री म ें पैक दकए िाने के जलए वस्ट् तुओं या वस्ट् तओंु के वगच या उसके प्रजतित को जवजनर्दष्च ट करना, कच् र् े िूट और िूट पैकेजिंग सामग्री के उत् पादन और इनके उत्पादन म ेंलग े हुए व् यजक्त यों के जहत म ेंअजनवाय च ह;ै अत:,अब, केंर सरकार,िूट पैकेि सामग्री (वस्ट् त ु पैककंग अजनवाय च प्रयोग)अजधजनयम, 1987 (1987 का 10) की धारा 16 की उपधारा (1) के साथ परठत धारा 3 की उपधारा (1) द्वारा प्रदत् त िजक्त यों का प्रयोग करत े हुए ददनांक 27 ददसंबर, 2021 के का.आ. संख्य ा 5421(अ),और ददनांक 30 ददसंबर, 2022 के का.आ. संख्य ा 6172(अ),को उन बातों के जसवाय अजधक्रमण करते हुए जिन्‍द ह ें ऐसे अजधक्रमण स े पूवच दकया गया ह ै या करन े का लोप दकया गया ह,ैएतद्द्वारा यह जनदिे देती ह ै दक नीर् े दी गई सारणी के कॉलम (2) म ें जवजनर्दचष् ट वस्ट् तुए,ं उक्त सारणी के कॉलम (3) की तत्स्ट् थ ानी प्रजवजष्ट यों म ें िून, 2023 तक िूट पैकेजिंग सामग्री म ें पैक की िाएगी, अथाचत्:- सारणी क्रम संख्या वस्ट् तुए ं भारत म ें उत् पाददत कच् र् े िूट स े भारत म ें जवजनर्मचत िूट पैकेजिगं सामग्री म ें पैक करने के जलए अपेजित वस्ट्त ुओं या वस्ट्त ुओं के वग च के कुल उत् पादन का न्‍द यनू तम प्रजतित (1) (2) (3) (i) खाद्यान्‍द न *उत् पादन का ित प्रजतित (100 %) (ii) र्ीनी **उत् पादन का बीस प्रजतित (20 %) *रटप्पण 1:- आरम्भ म ें खाद्यान्न के जलए मांग पर का दस प्रजतित प्रजतवती नीलामी के माध्यम स े सरकारी ई-जवपणन पोटचल (िीईएम)पर रखा िाएगा । **रटप्पण 2:- क्रय एिेंजसयों द्वारा जमलों या खुल े बािार स े सीधे क्रय दकए गए जवजवध प्रकार के िूट बैग् स। इस अजधजनयम के तहत आरिण मानदडं ों के जलए जवर्ार दकए िाने वाले खाद्यान्नों म ें र्ावल, धान और गेह ं िाजमल दकया िाएगा। िूट बैगों के वार्षचक उत्पादन का पूणच उपयोग सुजनजश्चत करके माजसक आपूर्तच योिना को प्रभाजवत दकए जबना र्ावल, गेह ं और अतं म ें र्ीनी के संबंध म ें पारस्ट्पररक प्राथजमकता के अनरूु पिूट बैग का उपयोग होगा, तादक उक्त अजधजनयम के अजधदेि के अनुसारिूट उद्योग और इसके उत्पादन स े िुड े व्यजक्तयों की सुरिा हो सके। 2. खाद्यान्नों की पैककंग के जलए उपयोग दकए गए िूट के थलै ों की उपलब्धता सुजनजश्चत करने के जलए, जमलों द्वारा नए िूट के थैलों की अपयाचप्त आपूर्तच के मामले म,ें खाद्य और सावचिजनक जवतरण जवभागकेवल िेम पर प्रजतस्ट्पधी बोली के माध्यम स े भारत म ें उत्पाददत कच्चे िूट स े बने ऐसे प्रयुक्त थैलों को पहले खरीदने के जलए एक उपयुक्त तंर तैयार करेगा िो उक्त अजधजनयम के तहत पैकेजिंग मानदडं ों के सापेि वस्त्र मंरालय द्वारा दी गई छूट का जहस्ट्सा नहीं होगा। 3. खाद्य और सावचिजनक जवतरण जवभाग िूट वष च 2022-23 के जलए खाद्यान्न की पैककंग के जलए आवश्यक िूट बैग की मारा का माह-वार अनुमान और नई िूट पैकेजिंग सामग्री की आपूर्तच या अन्‍दय आकजस्ट्मकता/आवश् यकता म ें दकसी भी कमी अथवा व्यवधान के मामले म ें अजग्रम रूप स े सूजर्त करेगा, वस्त्र मंरालय, संबंजधत उपयोगकताच मंरालयों और खाद्य और सावचिजनक जवतरण जवभाग और वस्त्र मंरालय के अजधकाररयों वाली सजमजत जिसे जवर्ार और जसफाररि करने के जलए गरठत दकया गया ह,ैके साथ परामिच करेगा िो माजसक आधार पर मारा कम, या िब भी अपेजित हो, इन प्रावधानों को उक्त ताजलका के कॉलम (3) म ें जवजनर्दचष्ट प्रजतित के अजधकतम तीस प्रजतित तक छूट दे सकत ेह।ैं 4. उच्च घनत् व वाल े पॉलीथलीन/पॉलीप्रोपाइलीन थलै ों के न्‍द यनू तम उपयोग सुजनजश्चत करन े की दजृ ष्ट स,े खाद्य और सावचिजनक जवतरण जवभाग राज्य खरीद एिेंजसयों (भारतीय खाद्य जनगम सजहत) के परामि च और समन्‍दवय स े िूट बैग की आपूर्तच की पूवच सहमत अनुसूर्ी के अनुसार वास्ट्तजवक मागं पर समय पर प्रस्ट्तुत करेगा और यदद खरीद एिेंजसयां द्वारा खाद्य और सावचिजनक जवतरण जवभाग द्वारा तैयार की गई आपूर्तच योिना के अनुसार खाद्यान्न पैक करने के जलए िूट बैग के जलए मांग पर नहीं ददए िाते ह ैं और मांग अजधक (मांग पर) एकर हो िाती ह ै तो िूट जमलों को िूट बगै की आपूर्तच के जलए यथोजर्त अजतररक्त समय जमलगे ा बित े दक यदद बढी अवजध म ें थलै ों की आपूर्त च करन े म ें जमल ें असफल रहती ह,ैं तो कम करन े स े संबंजधत ितें लाग ूहोंगी। 5. उपरोक्त व्यवस्ट्थाओं से लाभाजन्‍दवत िूट जमलों को संबंजधत राज्य सरकारों की संतुजष्ट के जवषय पर श्रम कानूनों और जवजनयमों के प्रासंजगक प्रावधानों को लाग ू करन े की आवश्यकता ह ै और कच्ची िूट के उत्पादन पर पटसन दकसानों और बेलरों को िीघ्र भुगतान प्रमाजणत करना होगा। 6. उक्त अजधजनयम के तहत जनम्न जलजखत को आरिण की पररजध से बाहर रखा िा सकता ह,ै अथाचत:् - (क) जवटाजमन से पुष्ट र्ीनी; (ख) जनयाचत की िान े वाली वस्ट्त ुओं की पैकेजिंग ;[भाग II—खण् ड 3(ii)] भारत का रािपर : असाधारण 3 (ग) खाद्यान्‍द नों के जलए दस दक.ग्रा. और उससे कम और र्ीनी के जलए पच्चीस दक.ग्रा. और उससे कम के छोटे उपभोक्त ा पैकेि; (घ) एकसौ दक.ग्रा. स ेअजधक थोक पैकेजिंग; और (ड.) जनयाचत के जलए पैक की गई र्ीनी जिसे खाद्य और सावचिजनक जवतरण जवभाग द्वारा दकए गए जनधाचरण और जसफाररिों के आधार पर जनयातच नहीं दकया िा सका था। 7. यह सुजनजश्चत करने के जलएदक कच्चे िूट और िूट पैककंग सामग्री के उत्पादन म ें लग े व्यजक्त अजनवाय च पैकेजिंग स े लाभांजवत हों, िूट श्रजमकों को वैधाजनक बकाय े का भुगतान और कच्च े िूट के क्रय पर िूट दकसानों और वले रों को िीघ्र भुगतान के जलए मिदरू ी संजहता, 2019 (2019 का 29) सजहत लागू श्रम काननू ों के अनुसार उपयुक् त तंर बनाया िायेगा। [फा. सं. िे-7/1/2022-िूट] प्रािक्त ा एल. वमाच, संयुक्त सजर्व MINISTRY OF TEXTILES ORDER New Delhi, the 31 March, 2023 S.O. 1532(E).—Whereas, the Central Government is empowered under sub-section (1) of section 3 of the Jute Packaging Materials (Compulsory Use in Packing Commodities) Act, 1987 (10 of 1987) to specify, by order, the commodities or class of commodities or such percentage thereof to be packed for the purpose of its supply or distribution in such jute packaging material, after considering the recommendations of the Standing Advisory Committee; And whereas, the Central Government has, in exercise of the powers conferred under sub-section (1) of section 4 of the said Act, constituted the Standing Advisory Committee vide number S.O. 295(E), dated the 19th January, 2022, to recommend the norms of packaging in jute material; And whereas, the Central Government, after considering the recommendations made to it by the Standing Advisory Committee, is satisfied that it is necessary in the interest of production of raw jute and jute packaging material, and of persons engaged in the production thereof, to specify the commodity or class of commodities and percentage thereof to be packed in jute packaging material; Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with sub-section (1) of section 16 of the Jute Packaging Materials (Compulsory Use in Packaging Commodities) Act, 1987 (10 of 1987) (hereinafter referred to as the said Act), and in supersession of Orders numbers S.O. 5421(E), dated the 27th December, 2021 and S.O. 6172(E), dated the 30th December, 2022, except as respects things done or omitted to be done before such supersession, the Central Government hereby directs that the commodities specified in column (2) of the Table below, shall be packed in jute packaging material for supply or distribution, in such minimum percentage as specified in corresponding entries in column (3) of the said Table, with effect from the date of publication of this notification in the Official Gazette, upto the 30th June, 2023, namely:- TABLE Serial Commodities Minimum percentage of total production of commodity or class of commodities required to be packed in jute packaging material manufactured in India from raw Number jute produced in India (1) (2) (3) (i) Foodgrains* One hundred per cent. (100%) of the production (ii) Sugar** Twenty per cent. (20%) of the production *Note 1:- Initially ten per cent. of the indents for foodgrains are to be placed through reverse auction on the Government e-Marketplace (GeM) portal. **Note 2:- In diversified jute bags under direct purchase by the procuring agencies from the mills or open market.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] The foodgrains to be considered for reservation norms under this Act would comprise of rice, paddy and wheat. The use of jute bags shall be in line of inter se priority with respect to rice, wheat and finally sugar, without affecting the monthly supply plan by ensuring full utilisation of all the yearly production of jute bags so as to safeguard the jute industry and the persons engaged in production thereof as per the mandate of the said Act. 2. To ensure availability of used jute bags for packing of foodgrains, in case of inadequate supply of new jute bags by the mills, the Department of Food and Public Distribution may work out a suitable mechanism in advance to first procure such used bags made from raw jute produced in India and bags made in India through competitive bidding on GeM only which shall not form the part of relaxation granted by Ministry of Textiles against packaging norms under the said Act. 3. The Department of Food and Public Distribution shall communicate in advance the month-wise projection of required quantity of jute bags for packing of foodgrains for the Jute Year 2022-23 and in case of any shortage or disruption in supply of new jute packaging material or in other contingency/exigency, the Ministry of Textiles may, in consultation with the user Ministries concerned and the Committee comprising officers from the Department of Food and Public Distribution and the Ministry of Textiles, which has been constituted to consider and recommend the dilution quantity on monthly basis, or as and when required, relax these provisions up to a maximum of thirty per cent. of the percentage specified in column (3) of the said Table. 4. With a view to ensure the minimum usage of High Density Polyethylene/Polypropylene bags, the Department of Food and Public Distribution in consultation and coordination with State Procurement Agencies (including Food Corporation of India) shall place realistic indents on time as per pre-agreed schedule of supply of jute bags and if the Procurement Agencies do not place indents for jute bags to pack foodgrains as per supply plan prepared by the Department of Food and Public Distribution and bunching of demand (indents) takes place then the jute mills shall get reasonable additional time for the supply of jute bags. Provided that if the mills fail to supply the bags in the extended period, the conditions relating to dilution will be applicable. 5. The jute mills benefitting from the above arrangements are required to implement the relevant provisions of labour laws and regulations on the subject to the satisfaction of the State Governments concerned and shall certify prompt payment to jute farmers and balers on production of raw jute. 6. The following may be kept out of the purview of reservation under the said Act, namely :- (a) sugar fortified with vitamins; (b) packaging for export of commodities; (c) small consumer packs of ten kilograms and below for foodgrains and twenty-five kilograms and below for sugar; (d) bulk packaging of more than one hundred kilograms; and (e) sugar packed for export but which could not be exported on the basis of an assessment and recommendation by the Department of Food and Public Distribution. 7. To ensure that persons engaged in production of raw jute and jute packaging material are benefitted from the mandatory packaging, a suitable mechanism shall be devised for enabling payment of statutory dues to jute workers and prompt payment to jute farmers and balers on procurement of raw jute as per the labour laws in force including the Code on Wages, 2019 (29 of 2019).
