सा.का.जन. 467(अ).—केंद्रीय मोटर यान जनयम, 1989 जनम्नजलजखत प्रारूप जनयम, जिसे केंद्रीय सरकार,
मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 64 के खंडों (ध) खंड (ध), (छ), (ि), (झ), (ट), (ि) और
(त),धारा 88 की उपधारा (14) के उप-खंड (v) खंड (ख), तथा धारा 211 द्वारा प्रित्त िजियों का प्रयोग करते हुए
कुछ जनयमों म ें और संिोधन करन े का प्रस्ट्ताव करती ह,ै को उि अजधजनयम की धारा 212 की उप-धारा (1) द्वारा
यथापेजित उनके द्वारा संभाव्य प्रभाजवत सभी व्यजियों की िानकारी के जलए प्रकाजित दकया िाता ह ैऔर एतिद्वारा
नोरटस दिया िाता ह ै दक उि प्रारूप जनयमों पर उस तारीख से िब इस अजधसूचना की प्रजतयां, भारत के रािपत्र म ें
यथाप्रकाजित, आम िनता को उपलब्ध कराई िाती हैं, स े तीस दिन की अवजध की समाजि के पश्चात ् जवचार दकया
िाएगा।
आपजत्त या सुझाव, िो दकसी व्यजि से उि प्रारूप जनयमों के संबंध में इस प्रकार जवजनर्िगष्ट अवजध की
समाजि के भीतर प्राि दकए िाते ह,ैं पर केंद्रीय सरकार द्वारा जवचार दकया िाएगा;

प्रारूप जनयम
1. संजिि िीर्गक एवं प्रारंभ – (1) इन जनयमों को मोटर यान (........संिोधन) जनयमावली, 2025 कहा िाएगा।
(2) य ेजनयम आजधकाररक रािपत्र में अपन ेप्रकािन की तारीख से प्रवृत् त होंगे।

2. केंद्रीय मोटर य़ान जनयमावली (सीएमवीआर), 1989 (इसके बाि उि जनयमों के रूप म ें उजल्लजखत) में, जनयम 2
म,ें -
(i) खडं (य घ) म,ें "पररवहन।" िब्िों के स्ट्थान पर, "पररवहन;" िब्ि प्रजतस्ट्थाजपत दकए िाएगं े;
(ii) खंड (य घ) के पश्चात, जनम्नजलजखत खंड प्रजतस्ट्थाजपत दकए िाएंगे,-
" (य इ) " बकाया प्रयोिा िुल्क" स े तात्पय ग दकसी वाहन द्वारा कानूनी रूप स े िेय प्रयोिा िल्ु क है, िोदक राष्ट्रीय
रािमागग के उस खंड के प्रयोग के जलए ह ै जिस खडं पर इलेक्ट्रॉजनक टोल संग्रहण अवसंरचना द्वारा वाहन के माग ग को
जवजधवत रूप से ररकॉडग दकया गया ह,ै लेदकन राष्ट्रीय रािमागग िुल्क (िरों का जनधागरण और सग्रं हण) जनयमावली,
2008 के प्रावधानों के अनुसार लागू प्रयोिा िल्ु क वसूलने म ें जवफल रही है, चाह े इसका कारण यह भी हो दक वाहन
पर वैध, कायागत्मक फास्ट्टैग नहीं लगा ह,ै और इसके संबंध में एक इलेक्ट्रॉजनक नोरटस िारी दकया गया हो जिसमें
वाहन के माग गका जववरण और भुगतान दकए िाने वाल ेसंबंजधत प्रयोिा िुल्क की िानकारी िी गई हो।"
3. उि जनयमों म,ें जनयम 51ख में, उपजनयम (3) म,ें-
(i) चौथ ेपरंतुक म,ें "भुगतान दकया गया।" िब्िों के स्ट्थान पर, "भुगतान दकया गया:" िब्ि प्रजतस्ट्थाजपत दकए िाएंग;े
(ii) चौथ ेपरंतुक के पश्चात् जनम्नजलजखत परंतुक अंतःस्ट्थाजपत दकया िाएगा, अथागत,् -
“यह भी प्रावधान ह ै दक पंिीकरण प्राजधकारी मोटर वाहन पर लगने वाले कर (टैक्ट्स) को िमा करने या पंिीकरण
प्रमाणपत्र में स्ट्वाजमत्व हस्ट्तांतरण ििग करने या अनापजत्त प्रमाणपत्र िारी करने या पंिीकरण जचह्न को बीएच
श्ृंखला से जनयजमत पंिीकरण श्ृंखला में पररवर्तगत करने के अनुरोध को तब तक स्ट्वीकार नहीं करेगा िब तक दक
बकाया प्रयोिा िुल्क का भुगतान नहीं दकया िाता ह;ै
इसके अजतररि प्रावधान ह ै दक अजधकृत बीमाकताग अजधजनयम की धारा 62बी के तहत बनाए गए राष्ट्रीय मोटर
वाहन रजिस्ट्टर के माध्यम स े एक ऑनलाइन प्रदिया के द्वारा यह पुजष्ट करेगा दक अजधजनयम की धारा 137 के
अनुसरण म ेंबीमा प्रमाणपत्र िारी करन े से पहल ेबकाया प्रयोिा िल्ु क का भगु तान कर दिया गया ह।ै ”
4. उि जनयम के जनयम 52 के उपजनयम (2) म,ें-
(i) तीसरे परंतुक म,ें “अजधजनयम।” िब्िों के स्ट्थान पर, “अजधजनयम:” िब्ि प्रजतस्ट्थाजपत दकए िाएंगे;
(ii) तीसरे परंतुक के पश्चात् जनम्नजलजखत परंतुक अतं ःस्ट्थाजपत दकया िाएगा, अथागत,् -
“यह भी प्रावधान ह ैदक पंिीकरण प्राजधकारी पंिीकरण प्रमाणपत्र के नवीकरण के जलए आवेिन पर तब तक कारगवाई
नहीं करेगा िब तक दक बकाया प्रयोिा िल्ु क का भुगतान नहीं कर दिया िाता।”
5. उि जनयमों म,ें जनयम 53 म,ें उपजनयम (2) के पश्चात,-
(i) िब्ि और अंक “जनयम 81।” के स्ट्थान पर िब्ि और अंक “जनयम 81:” प्रजतस्ट्थाजपत दकए िाएंगे;
(ii) जनम्नजलजखत परंतुक अंतःस्ट्थाजपत दकया िाएगा, अथागत्,-
“प्रावधान ह ै दक पंिीकरण प्राजधकारी पंिीकरण प्रमाणपत्र की िसू री प्रजत िारी करने के जलए आवेिन पर तब तक
कारगवाई नहीं करेगा िब तक दक आवेिक द्वारा बकाया प्रयोिा िुल्क का भुगतान नहीं कर दिया िाता।”
6. उि जनयमों म,ें जनयम 55 के उपजनयम (2) म,ें खडं (iv) के पश्चात,् जनम्नजलजखत खंड अतं ःस्ट्थाजपत दकया िाएगा,
अथागत,् -
“(v) फॉमग 28 में अनापजत्त प्रमाण पत्र।”
7. उि जनयमों के जनयम 58 म,ें-
(i) उप-जनयम (3) म,ें “प्रपत्र 28 के भाग-III को भरें और उस भाग को आवेिक को जवजधवत् हस्ट्तािररत करके
लौटाए”ं िब्िों, अिरों और अकं ों के पश्चात् “या भाग-III को भरकर पोटगल पर इलक्ट्े रॉजनक रूप से िारी करें” िब्ि
और अिर अंत:स्ट्थाजपत दकए िाएंगे;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3
(ii) उपजनयम (4) म,ें "उसके।" िब्ि के स्ट्थान पर, "उसके:" िब्ि रखे िाएंग े और जनम्नजलजखत परंतुक अतं ःस्ट्थाजपत
दकया िाएगा, अथागत,् -
“प्रावधान ह ै दक पंिीकरण प्राजधकारी तब तक अनापजत्त प्रमाण पत्र प्रिान नहीं करेगा िब तक दक आवेिक द्वारा
बकाया प्रयोिा िुल्क का भुगतान नहीं कर दिया िाता।”
8. उि जनयम के जनयम 62 के उपजनयम (1) म,ें-
(i) पांचवें परंतुक म,ें “पंिीकरण।” िब्ि के स्ट्थान पर, “पंिीकरण:” िब्ि प्रजतस्ट्थाजपत दकया िाएगा;
(ii) पांचवें परंतुक के पश्चात ्जनम्नजलजखत परंतुक अतं ःस्ट्थाजपत दकया िाएगा, अथागत:् -
“यह भी प्रावधान ह ै दक आविे क द्वारा बकाया प्रयोिा िल्ु क का भुगतान दकए िाने तक दफटनेस प्रमाणपत्र का
नवीनीकरण या सृिन नहीं दकया िाएगा।”
9. उि जनयमों म,ें जनयम 90 म,ें िम संख्या (6) के पश्चात,् जनम्नजलजखत खंड अतं ःस्ट्थाजपत दकया िाएगा, अथागत:् -
“(7) वाहन पर कोई भी बकाया प्रयोिा िल्ु क नहीं होगा।”
10. उि जनयमों म,ें प्ररूप 28 म,ें भाग I-आवेिन म,ें िम संख्या 10 और उससे संबंजधत प्रजवजष्टयों के पश्चात ्
जनम्नजलजखत अंतःस्ट्थाजपत दकया िाएगा, अथागत्:-
10क. क्ट्या बकाया प्रयोिा िुल्क की कोई मांग लंजबत ह,ै यदि हां, तो ब्यौरा िें।

NOTIFICATION
New Delhi, the 11th July, 2025
G.S.R. 467(E).—The following draft rules to further amend the Central Motor Vehicles Rules,
1989, which the Central Government proposes to make in exercise of the powers conferred by clause(s)
clause(s) (g), (h), (i), (k), (n) and (p) of Section 64, sub-clause (v) of clause (b) of sub-section (14) of section 88,
and section 211 of the Motor Vehicles Act, 1988 (59 of 1988) is hereby published as required by sub-section (1)
of Section 212 of the said Act for information of all persons likely to be affected thereby and notice is hereby
given that the said draft rules shall be taken into consideration after the expiry of a period of thirty days from the
date on which the copies of this notification, as published in the Gazette of India, are made available to the
public.
The objections or suggestions which may be received from any person with respect to the said draft
rules before the expiry of the period aforesaid will be considered by the Central Government;
Objections and suggestions to these draft rules, if any, may be sent to the Additional Secretary (MVL),

Draft Rules:
1. Short title and commencement - (1) These rules may be called as the Central Motor Vehicles
(………….Amendment) Rules, 2025.
(2) They shall come into force from the date of their final publication in the Official Gazette.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), in rule 2,-
(i) in clause (zd), for the words “transport.”, the words “transport;” shall be inserted;
(ii) after clause (zd), the following clauses shall be inserted, namely,–
“(ze) "unpaid user fee" means the user fee legally payable by a vehicle for use of a section of a National
Highway, where the Electronic Toll Collection Infrastructure has duly recorded the vehicle passage but has
failed to realize the applicable user fee as per the provisions of the National Highways Fee (Determination of
Rates and Collection) Rules, 2008, for whatsoever reason including due to the vehicle not being affixed with a
valid, functional FASTag, and an electronic notice has been issued for the same intimating the details of the
passage of the vehicle and the corresponding user fee to be paid."
3. In the said rules, in rule 51B, in sub-rule (3),-
(i) in the fourth proviso, for the words “paid.”, the words “paid:” shall be substituted;
(ii) after the fourth proviso, the following proviso shall be inserted, namely,-
“PROVIDED also that the registering authority shall not grant the request for depositing motor vehicle tax or
recording transfer of ownership in the certificate of registration or issue of no objection certificate or conversion
of registration mark from BH series to regular registration series until unpaid user fee is paid;
PROVIDED further that the authorised insurer shall confirm through an online process through the National
Register of Motor Vehicles maintained under section 62B of the Act, that the unpaid user fees before issuing the
certificate of insurance in pursuance of section 137 of the Act.”.
4. In the said rules, in rule 52, in sub-rule (2),-
(i) in the third proviso, for the words “Act.”, the words “Act:” shall be substituted;
(ii) after third proviso, the following proviso shall be inserted, namely,-
“PROVIDED also that the registering authority shall not process the application for renewal of certificate of
registration until unpaid user fee is paid.”.
5. In the said rules, in rule 53, after sub-rule (2),-
(i) for the word and figures “rule 81.”, the words and figures “rule 81:” shall be substituted;
(ii) the following proviso shall be inserted, namely,-
“PROVIDED that the registering authority shall not process the application for issue of a duplicate certificate of
registration until unpaid user fee is paid by the applicant.”.
6. In the said rules, in rule 55, in sub-rule (2), after clause (iv), the following clause shall be inserted, namely,-
“(v) No objection certificate in Form 28.”.
7. In the said rules, in rule 58,-
(i) in sub-rule (3), after the words, letters and figures “fill Part-III of Form 28 and return that part to the
applicant duly signed”, the words and letters “or issue filled in Part-III electronically on the Portal” shall be
inserted;
(ii) in sub-rule (4), for the word "thereof.", the words "thereof:" shall be substituted, and the following proviso
shall be inserted, namely,-
“PROVIDED that the registering authority shall not grant the no-objection certificate until unpaid user fee is
paid by the applicant.”.
8. In the said rules, in rule 62, in sub-rule (1),-
(i) in the fifth proviso, for the word “registration.”, the word “registration:” shall be substituted;
(ii) after fifth proviso, the following proviso shall be inserted, namely,-
“PROVIDED also that a certificate of fitness shall not be renewed or generated until unpaid user fee is paid by

9. In the said rules, in rule 90, after Serial Number (6), the following clause shall be inserted, namely,-
“(7) The vehicle shall not have any unpaid user fee.”.
10. In the said rules, in FORM 28, in PART I-APPLICATION, after Serial Number 10 and the entries relating
thereto, the following shall be inserted, namely,-
“10A. Whether any demand of unpaid user fee is pending, if so, give details.”.
