L.-33004/99 सी.जी.-डी.एल.-अ.-27122025-268857 CG-DxLx-xEG-I2D7H1x2x2x0 25-268857 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 5819] नई ददल्ली, िुक्रिार, ददसम्ब र 26, 2025/पौष 5, 1947 No. 5819] NEW DELHI, FRIDAY, DECEMBER 26, 2025/PAUSHA 5, 1947 जिद्यतु मत्रं ालय आदेि नई ददल्ली, 24 ददसम् बर, 2025 का.आ. 6018(अ).— िबदक मेससस अिाडा एनिी प्राइिटे जलजमटेड, आिेदक ने जिसका रजिस्ट्टड स ऑदिस सी-11, सेक्टर 65, गौतम बुद्ध नगर, नोएडा – 201301 पर जस्ट्ित ह,ै न े मेससस अिाडा एनिी प्राइिेट जलजमटेड (AEPL) को कच्छ, गुिरात में उनके सोलर पािर प्रोिेक्ट के जलए 200 MW (App No. 2200000200) की कनेजक्टजिटी देने के जलए रांसजमिन जसस्ट्टम में िाजमल ओिरहडे रांसजमिन लाइन जबछाने के जलए जिद्युत अजधजनयम, 2003 की धारा 164 के अंतगतस प्राजधकृत करने हते ुआिेदन दकया ह।ै और िबदक, जिद्युत मंत्रालय, भारत सरकार ने अपन े फाइल नं. 25-17/50/2025-PG ददनांदकत 15.05.2025 के अंतगसत मेससस अिाडा एनिी प्राइिेट जलजमटेड (AEPL) को कच्छ, गुिरात म ें उनके सोलर पािर प्रोिेक्ट के जलए 200 MW (App No. 2200000200) की कनेजक्टजिटी देने के जलए रांसजमिन जसस्ट्टम में िाजमल ओिरहडे रांसजमिन लाइन जबछाने के जलए जिद्युत अजधजनयम, 2003 की धारा 68(1) के अतं गतस पूि सअनुमोदन प्रदान दकया िा। मेससस अिाडा एनिी प्राइिेट जलजमटेड न े प्रस्ट्ताजित रांसजमिन मागस के बारे में स्ट्िानीय अखबारों, द इंजडयन एक्सप्रेस (अग्रं ेिी में) ददनांदकत 08.08.2025, यंग लीडर (हहदं ी म)ें ददनांदकत 08.08.2025 और संदेि (गुिराती में) ददनांदकत 08.08.2025 तिा भारत के साप्ताजहक रािपत्र ददनांक 06.07.2025 म ेंप्रकािन की तारीख स ेदो महीनों के भीतर आम िनता से अिलोकन/ अभ्यािेदन की मांग करत े हुए नोटटस प्रकाजित दकया िा। इसके पश् चात, मेससस अिाडा एनिी प्राइिेट जलजमटेड, न े ददनांदकत 14.11.2025 को एक हलफनामा प्रस्ट्तुत दकया, जिसमें घोषणा की गई िी दक भारत 8712 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] के िासकीय रािपत्र में सािसिजनक सूचना के प्रकािन के दो महीनों के भीतर िनता से कोई अिलोकन/ अभ्यािेदन प्राप्त नहीं हुआ िा। और अब आिेदक न े जिद्युत अजधजनयम, 2003 की धारा 164 के अंतगसत मेससस अिाडा एनिी प्राइिेट जलजमटेड के जलए ओिरहडे रांसजमिन लाइन जबछान ेके जलए उन्ह ेंि ेसभी िजियां प्रदान करन ेका अनुरोध दकया है, िो टेलीग्राफ लाइन्स के प्रयोिन के जलए सरकार द्वारा स्ट्िाजपत टेलीग्राफ लाइन्स और खंबों या उनके रख-रखाि के जलए भारतीय टेलीग्राफ अजधजनयम 1885 के अंतगसत टेजलग्राफ प्राजधकरण के पास ह।ै इस स्ट्कीम के अंतगसत जनम्नजलजखत ओिरहडे लाइन्स िाजमल ह:ैं- • एईपीएल सौर प्रोिेक्ट (गांि आधोई, तालुका भचाऊ, जिला कच्छ, गुिरात में जस्ट्ित्त) – एआईपीएल सौर ऊिास संयंत्र पूहलंग स्ट्टेिन (गांि रामपर, तालुका भचाऊ, जिला कच्छ, गुिरात में जस्ट्ित्त) M/C टािर पर 33 केिी T/C लाइन। इस योिना के अतं गतस ओिरहडे पारेषण लाइनें गुिरात के जनम्नांदकत गााँिों, कस्ट्बों और िहरों से होकर, उन पर से, उनके आसपास से और बीच स ेहोकर गुज़रेगी। गािाँ तहसील जिला राज्य आधोई, रामपर, हलरा भचाऊ कच्छ गुिरात अब, सािधानीपूिसक जिचार करने के पश्चात, जिद्युत मंत्रालय, भारत सरकार, जिद य ुत अजधजनयम, 2003 की धारा 164 के अंतगतस मेसस स अिाडा एनिी प्राइिेट जलजमटेड को उपरोि ओिरहडे रांसजमिन लाइन को लगाने के जलए ि े सभी िजिया ं जनम्नजलजखत जनबंधनों एिं ितों के साि प्रदान करता ह,ै िो टेलीग्राफ के उद्देश्य के जलए सरकार द्वारा स्ट्िाजपत टेलीग्राफ लाइनों और खंबों या उनके रख-रखाि के जलए भारतीय टेलीग्राफ अजधजनयम, 1885 के अतं गसत टेलीग्राफ प्राजधकरण के पास ह ै i. यह अनुमोदन 25 िषों के जलए प्रदान दकया िाता ह।ै ii. आिेदक को प्रस्ट्ताजित लाइनों की स्ट्िापना स े पूिस संबंजधत प्राजधकाटरयों अिासत स्ट्िानीय जनकायों, रेलिे, राष्ट्रीय रािमागस, राज्य रािमागस आदद की सहमजत प्राप्त करनी होगी। iii. आिेदक को जिद्युत अजधजनयम, 2003 के अंतगसत समुजचत आयोग के द्वारा तैयार दकए गए पारेषण, ओ एडं एम, ओपन एक्सेस आदद के जिजनयमों/संजहताओं का पालन करना होगा। iv. आिेदक केंद्र सरकार के जिद्युत जनरीक्षक/मुख्य जिद्युत जनरीक्षक के अनुमोदन के पश्चात ही लाइनों का प्रचालन करेगा। v. यह अनुमोदन आिेदक द्वारा जिद्युत अजधजनयम, 2003 के प्रािधानों और उसके अंतगसत बनाए गए जनयमों की अपेक्षाओं का अनुपालन दकए िाने के अध्यधीन ह।ै vi. मेससस अिाडा एनिी प्राइिेट जलजमटेड को जिद्युत जनरीक्षण के समय जिमानन एि ं रक्षा प्राजधकरणों इत्यादद, स े अपेजक्षत अनुमजत को प्राप्त करन े के बाद, इसे केंद्रीय जिद्युत प्राजधकरण को जिद्युत जनरीक्षण के समय प्रस्ट्तुत करना होगा। vii. अगर उपरोि ओिरहडे लाइनों का मागस (या उपरोि ओिरहडे लाइन के माग स का कुछ जहस्ट्सा) ग्रेट इंजडयन बस्ट्टड स (िीआईबी) क्षेत्र म ें आता है, तो आिेदक को ग्रेट इंजडयन बस्ट्टड स (िीआईबी) के मामले म ें याजचका सं. 2019 के न.ं 838 में माननीय सिोच्च न्यायालय द्वारा ददए गए आदेिों तिा माननीय सिोच्च न्यायालय द्वारा इस बारे में गटित टेदिकल/एक्सपटस कमेटी के जनदिे ों का पालन करना पड़ेगा. [फा. स.ं 25-16/77/2025-पािरजिड(एमओपी)] एम. िी. एन. िरा प्रसाद, अिर सजचि (पीिी) MINISTRY OF POWER ORDER New Delhi, the 24th December, 2025 S.O. 6018(E).—Whereas M/s Avaada Energy Private Limited, the applicant with its registered office at C-11, Sector 65, Gautam Buddha Nagar, Noida – 201301, Uttar Pradesh, has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line included in the Transmission system for providing connectivity of 200 MW (App No. 2200000200) to M/s Avaada Energy Private Limited (AEPL) for their Solar Power Project in Kachchh, Gujarat.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 And whereas, Ministry of Power, Government of India vide its File No. 25-17/50/2025-PG dated 15.05.2025 had granted prior approval under section 68(1) of the Electricity Act, 2003 for laying of overhead transmission line included in the Transmission system for providing connectivity of 200 MW (App No. 2200000200) to M/s Avaada Energy Private Limited (AEPL) for their Solar Power Project in Kachchh, Gujarat. M/s Avaada Energy Private Limited had published notice for transmission scheme in local newspapers The Indian Express (in English) dated 08.08.2025, Young Leader (in Hindi) dated 08.08.2025 and Sandesh (in Gujarati) dated 08.08.2025 and in Weekly Gazette of India dated 06.07.2025 for the general public to make observations/ representations on the proposed transmission route within two months from the date of publication. Subsequently, M/s Avaada Energy Private Limited has submitted an affidavit dated 14.11.2025 declaring that no observation/ representation was received within two months from the date of Publication in the official Gazette of Government of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of overhead transmission line for M/s Avaada Energy Private Limited. The following overhead transmission line is covered under this scheme: • AEPL Solar Project (located at Village Adhoi, Taluka Bhachau, District Kachchh, Gujarat) – AIPL Solar Power Plant Pooling Station (located at Village Rampar, Taluka Bhachau, District Kachchh, Gujarat) 33 kV T/C line on M/C tower. The overhead transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Gujarat. Villages Tehsil District State Adhoi, Rampar, Halra Bhachau Kachchh Gujarat Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Avaada Energy Private Limited for laying above overhead transmission line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/ codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under the Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s Avaada Energy Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) area, the applicant has to comply with the orders of the Hon’ble Supreme Court in the petition No.838 of 2019 regarding Great Indian Bustard (GIB) case, and the directions of the technical/expert committee constituted by the Hon’ble Supreme Court in this regard.
