L.-33004/99 सी.जी.-डी.एल.-अ.-03122025-268207 CG-DxLx-xEG-I0D3H1x2x2x0 25-268207 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 5365] नई ददल्ली, मगं लिार, ददसम्ब र 2, 2025/अग्रहायण 11, 1947 No. 5365] NEW DELHI, TUESDAY, DECEMBER 2, 2025/AGRAHAYANA 11, 1947 जिद्यतु मत्रं ालय आदेि नई ददल्ली, 1 ददसम् बर, 2025 का.आ. 5553(अ).— िबदक मसे सस एनटीपीसी निीकरणीय ऊिास जलजमटेड, आिेदक ने जिसका रजिस्ट्टडस ऑदिस एनटीपीसी आरईएल, ई3, इकोटेक-I1, उद्योग जिहार, ग्रेटर नोएडा, (यपू ी)-201306 पर जस्ट्ित ह,ै ने गुिरात के खािडा में एनटीपीसी आरईएल को प्रस्ट्ताजित 1200 मगे ािाट सौर ऊिास पररयोिना के जलए कनेजटटजिटी प्रदान करने हते ु रांसजमिन योिना में िाजमल ओिरहडे रांसजमिन लाइन जबछान ेके जलए जिद्युत अजधजनयम, 2003 की धारा 164 के अतं गतस प्राजधकृत करने हते ुआिेदन दकया ह।ै और िबदक, जिद्युत मंत्रालय, भारत सरकार न े अपने फाइल नं संख्या 25-17/19/2023-पीिी ददनांक 15.09.2023 के अतं गतस गुिरात के खािडा म ेंएनटीपीसी आरईएल को प्रस्ट्ताजित 1200 मगे ािाट सौर ऊिास पररयोिना के जलए कनेजटटजिटी प्रदान करन े हते ु रांसजमिन योिना में िाजमल ओिरहडे रांसजमिन लाइन जबछान े के जलए जिद्युत अजधजनयम, 2003 की धारा 68(1) के अतं गतस पूि सअनुमोदन प्रदान दकया िा। 8087 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] मेससस एनटीपीसी निीकरणीय ऊिास जलजमटेड ने प्रस्ट्ताजित रांसजमिन मागस के बारे में स्ट्िानीय अखबारों, द टाइम्स ऑफ इंजडया (अग्रं ेिी म)ें ददनांक 23.11.2024, गरिी गिु रात (हहदं ी म)ें ददनांक 22.11.2024 और कच्छ उदय (गुिराती म)ें ददनांक 09.05.2024 और भारत के साप्ताजहक रािपत्र ददनांक 14.12.2024 में प्रकािन की तारीख स े दो महीनों के भीतर आम िनता स े अिलोकन/ अभ्यािेदन की मागं करत े हुए नोरटस प्रकाजित दकया िा। इसके पश् चात, मेसस स एनटीपीसी निीकरणीय ऊिा सजलजमटेड, न ेददनांदकत 13.10.2025 को एक हलफनामा प्रस्ट्ततु दकया, जिसमें घोषणा की गई िी दक भारत के िासकीय रािपत्र में सािसिजनक सूचना के प्रकािन के दो महीनों के भीतर िनता से कोई अिलोकन/ अभ्यािेदन प्राप्त नहीं हुआ िा। और अब आिेदक ने जिद्युत अजधजनयम, 2003 की धारा 164 के अंतगसत मेसस स एनटीपीसी निीकरणीय ऊिा स जलजमटेड के जलए ओिरहडे रासं जमिन लाइन जबछान े के जलए उन्ह ें ि े सभी िजियां प्रदान करने का अनरु ोध दकया है, िो टेलीग्राफ लाइन्स के प्रयोिन के जलए सरकार द्वारा स्ट्िाजपत टेलीग्राफ लाइन्स और खंबों या उनके रख-रखाि के जलए भारतीय टेलीग्राफ अजधजनयम 1885 के अंतगतस टेजलग्राफ प्राजधकरण के पास ह।ै इस स्ट्कीम के अंतगसत जनम्नजलजखत ओिरहडे लाइन्स िाजमल ह:ैं • एनटीपीसी आरईएल – केपीएस3 400 केिी एस/सी लाइन, डी/सी टािरों पर। इस योिना के अंतगसत ओिरहडे पारेषण लाइनें गुिरात राज्य के जनम्नांदकत गााँिों, कस्ट्बों और िहरों से होकर, उन पर से, उनके आसपास से और बीच से होकर गुज़रेगी। गािाँ तहसील जिला राज्य खािडा में आरई पाकस भुि कच्छ गुिरात अब, सािधानीपूिसक जिचार करने के पश्चात, जिद्युत मंत्रालय, भारत सरकार, जिद य ुत अजधजनयम, 2003 की धारा 164 के अंतगतस मेससस एनटीपीसी निीकरणीय ऊिास जलजमटेड को उपरोि ओिरहडे रांसजमिन लाइन को लगाने के जलए िे सभी िजियां जनम्नजलजखत जनबंधनों एिं ितों के साि प्रदान करता ह,ै िो टेलीग्राफ के उद्दश्े य के जलए सरकार द्वारा स्ट्िाजपत टेलीग्राफ लाइनों और खंबों या उनके रख-रखाि के जलए भारतीय टेलीग्राफ अजधजनयम, 1885 के अंतगसत टेलीग्राफ प्राजधकरण के पास ह ै i. यह अनुमोदन 25 िषों के जलए प्रदान दकया िाता ह।ै ii. आिेदक को प्रस्ट्ताजित लाइनों की स्ट्िापना स े पूिस संबंजधत प्राजधकाररयों अिासत स्ट्िानीय जनकायों, रेलिे, राष्ट्रीय रािमागस, राज्य रािमागस आदद की सहमजत प्राप्त करनी होगी। iii. आिेदक को जिद्युत अजधजनयम, 2003 के अंतगसत समुजचत आयोग के द्वारा तैयार दकए गए पारेषण, ओ एडं एम, ओपन एटसेस आदद के जिजनयमों/संजहताओं का पालन करना होगा। iv. आिेदक केंद्र सरकार के जिद्युत जनरीक्षक/ मख्ु य जिद्युत जनरीक्षक के अनुमोदन के पश्चात ही लाइनों का प्रचालन करेगा। v. यह अनुमोदन आिेदक द्वारा जिद्युत अजधजनयम, 2003 के प्रािधानों और उसके अंतगसत बनाए गए जनयमों की अपेक्षाओं का अनुपालन दकए िाने के अध्यधीन ह।ै vi. मेससस एनटीपीसी निीकरणीय ऊिास जलजमटेड को जिद्युत जनरीक्षण के समय जिमानन एिं रक्षा प्राजधकरणों इत्यादद, से अपेजक्षत अनुमजत को प्राप्त करने के बाद, इस े केंद्रीय जिद्युत प्राजधकरण को जिद्युत जनरीक्षण के समय प्रस्ट्ततु करना होगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 vii. अगर उपरोि ओिरहडे लाइनों का मागस (या उपरोि ओिरहडे लाइन के माग स का कुछ जहस्ट्सा) ग्रेट इंजडयन बस्ट्टड स (िीआईबी) क्षेत्र में आता ह,ै तो आिेदक को ग्रेट इंजडयन बस्ट्टडस (िीआईबी) के मामले में याजचका सं. 2019 के नं. 838 में माननीय सिोच्च न्यायालय द्वारा ददए गए आदेिों तिा माननीय सिोच्च न्यायालय द्वारा इस बारे म ें गरित टेदिकल/एटसपटस कमेटी के जनदेिों का पालन करना पडगे ा. [फा. स. ं 25-16/64/2025-पीिी] एम.िी.एन. िरा प्रसाद, अिर सजचि (पीिी) MINISTRY OF POWER ORDER New Delhi, the 1st December, 2025 S.O. 5553(E).— Whereas M/s NTPC Renewable Energy Limited, the applicant with its registered office at NTPC REL, E3, Ecotech-l1, Udyog Vihar, Greater Noida, (UP)- 201306 has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line included in the transmission scheme for providing connectivity to NTPC REL for its proposed 1200 MW Solar Power Project at Khavda, Gujarat. And whereas, Central Electricity Authority (CEA), Ministry of Power, Government of India vide its File No. 25-17/19/2023-PG dated 15.09.2023 had granted prior approval under section 68(1) of the Electricity Act, 2003 for laying of overhead transmission line included in the transmission scheme for providing connectivity to NTPC REL for its proposed 1200 MW Solar Power Project at Khavda, Gujarat. M/s NTPC Renewable Energy Limited had published notice for transmission scheme in local newspapers The Times of India (in English) dated 23.11.2024, Garvi Gujarat (in Hindi) dated 22.11.2024 and Kutch Uday (in Gujarati) dated 09.05.2024 and in Weekly Gazette of India dated 14.12.2024 for the general public to make observations/ representations on the proposed transmission route within two months from the date of publication. Subsequently, M/s NTPC Renewable Energy Limited has submitted an affidavit dated 13.10.2025 declaring that no observation/ representation was received within two months from the date of Publication in the official Gazette of Government of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of overhead transmission line for M/s NTPC Renewable Energy Limited. The following overhead transmission line is covered under this scheme: • NTPC REL – KPS3 400 kV S/c line on D/c towers The overhead transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Gujarat: Villages Tehsil District State RE Park at Khavda Bhuj Kutch Gujarat Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s NTPC Renewable Energy Limited for laying above overhead transmission line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/ codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under the Electricity Act, 2003.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s NTPC Renewable Energy Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) area, the applicant has to comply with the orders of the Hon’ble Supreme Court in the petition No.838 of 2019 regarding Great Indian Bustard (GIB) case, and the directions of the technical/expert committee constituted by the Hon’ble Supreme Court in this regard.
