L.-33004/99 सी.जी.-डी.एल.-अ.-11042023-245097 xxxGIDHxxx CG-DL-E-11042023-245097 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 1615] नई ददल्ली, मगं लवार, अप्रलै 11, 2023/चत्रै 21, 1945 No. 1615] NEW DELHI, TUESDAY, APRIL 11, 2023/CHAITRA 21, 1945 मजहला एव ंबाल जवकास मत्रं ालय अजधसचू ना नई ददल् ली, 11 अप्रैल, 2023 का.आ. 4961(अ).—जबदक, सेवाओं या लाभों या सजससजडयों की प्रदायगी के जलए पहचान दस्ट्तावेज के रूप में आधार का प्रयोग सरकारी जवतरण प्रदियाओं को सरल बनाता है, पारदर्शिता और दक्षता लाता ह,ै और लाभार्शथयों को सुजवधाजनक और जनबााध तरीके से उनकी हकदाररयों को हाजसल करने में सक्षम बनाता ह ै और आधार दकसी की पहचान साजबत करने के जलए कई दस्ट्तावेज प्रस्ट्तुत दकए जाने की आवश्यकता को समाप्त करता ह;ै और जबदक, भारत सरकार म ें मजहला एवं बाल जवकास मंत्रालय (इसके बाद मंत्रालय के रूप म ें संदर्शभत) दकिोर न्याय (बच् चों की देखभाल और संरक्षण) अजधजनयम, 2015 (2016 का 2) में स्ट्वीकार दकए गए बच् चों के जलए राष्ट्रीय, राज्य और जजला स्ट्तर पर सेवा जवतरण सरं चनाओं का सुरक्षा जाल तैयार करने के साथ ही संस्ट्थागत और गरै -संस्ट्थागत देखभाल के माध्यम से बच् चों को पुनवाास और सामाजजक पुन:एकीकरण प्रदान करने के उद्देश्य से केंद्रीय प्रायोजजत स्ट्कीम, जमिन वात्सल्य स्ट्कीम - पूवावती बाल संरक्षण सेवा स्ट्कीम (इसके बाद स्ट्कीम के रूप म ें संदर्शभत) का संचालन कर रहा है, जजसे राज्य सरकार या संघ राज्य क्षेत्रों (इसके बाद कायाान्वयन एजेंसी के रूप में संदर्शभत) के माध्यम स े कायााजन्वत दकया जा रहा ह;ै और जबदक, स्ट्कीम के तहत सवे ाओं का प्रावधान ह ै जजसम ें अन्य बातों के साथ-साथ व े लाभ िाजमल ह ैं जजनम ें या तो नकद में कमाचाररयों का वेतन िाजमल ह ै या स्ट्कीम और उसके तहत जारी दकए गए मौजूदा ददिाजनदेिों के अनुसार कायाान्वयन एजेंसी द्वारा दकिोर न्याय (बच् चों की देखभाल और संरक्षण) अजधजनयम, 2015 (2016 का 2) के दायरे में आन े वाले देखभाल और संरक्षण के जरूरतमंद बच् चों की देखभाल, उपचार, पोषण, कपडे, जबस्ट्तर, दैजनक जरूरतों, मनोरंजन और ऐसी ही जरूरतों (इसके बाद लाभार्शथयों के रूप में संदर्शभत) के जलए बच् चों का स्ट्थापन िाजमल ह;ै और जबदक, स्ट्कीम के कायाान्वयन में भारत की संजचत जनजध से दकया गया आवती व्यय िाजमल ह;ै 2380 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अतएव, अब, केंद्रीय सरकार आधार (जवत्तीय और अन्य सजससजडयों, लाभों और सेवाओं का लजक्षत जवतरण) अजधजनयम, 2016 (2016 का 18) की धारा 7 के अनुसरण म ें और पूवावती बाल सरं क्षण सेवा स्ट्कीम की अजधसूचना संख्या का.आ. 620(अ), ददनांक 23 फरवरी, 2017 (कमाचाररयों का वेतन), अजधसूचना संख्या का.आ. 6110(अ) ददनांक 11 ददसंबर, 2018 (प्रायोजन) और अजधसूचना संख्या का.आ. 6110(अ) 11 ददसंबर, 2018 (वस्ट्तु रूप म)ें के अजधिमण में, ऐसे अजधिमण से पहले की गई या छोडी गई चीजों को छोडकर, एतद्द्वारा जनम्नजलजखत को अजधसूजचत करती ह,ै अथाात:्- 1. स्ट्कीम के तहत लाभ प्राप्त करने के इच्छुक प्रत्येक लाभाथी को आधार नंबर का प्रमाण प्रस्ट्तुत करना या आधार प्रमाणीकरण कराना होगा। 2. स्ट्कीम के तहत लाभ प्राप्त करन े के इच्छुक दकसी पात्र लाभाथी, जजसके पास आधार नंबर नहीं ह ै या उसने आधार नंबर के जलए नामांकन नहीं कराया है, को अपन े माता-जपता या संरक्षकों की सहमजत से (बाल लाभार्शथयों के मामले में) आधार नामांकन के जलए आवेदन करना अपेजक्षत होगा, बिते वह उक्त अजधजनयम की धारा 3 के अनुसार आधार प्राप्त करन े का हकदार हो और ऐसे बच् च े आधार हते ु नामांकन करान े के जलए दकसी भी आधार नामांकन केंद्र [सूची भारतीय जवजिष्ट पहचान प्राजधकरण की वेबसाइट www.uidai.gov.in पर उपलसध] पर जा सकते ह;ैं 3. आधार (नामांकन और अद्यतन) जवजनयम, 2016 के जवजनयम 12 के अनुसार, मंत्रालय को अपनी कायाान्वयन एजेंसी के माध्यम से उन लाभार्शथयों के जलए नामांकन सुजवधाएं प्रदान करना अपेजक्षत ह ै जजन्होंने अब तक आधार के जलए नामांकन नहीं कराया ह ै और यदद संबंजधत सलॉक या तालुका या तहसील में कोई आधार नामांकन केंद्र जस्ट्थत नहीं ह,ै तो मंत्रालय या जवभाग अपनी कायाान्वयन एजेंसी के माध्यम से भारतीय जवजिष्ट पहचान प्राजधकरण के मौजूदा रजजस्ट्रारों के समन्वय म ें सुजवधाजनक स्ट्थानों पर नामांकन सुजवधाए ं प्रदान करेगा या स्ट्वय ं भारतीय जवजिष्ट पहचान प्राजधकरण रजजस्ट्रार बनकर आधार नामांकन सुजवधाएं प्रदान कर सकता ह:ै बिते दक दकसी लाभाथी को आधार सौंपे जान े तक, ऐसे लाभाथी को जनम्नजलजखत पहचान दस्ट्तावेज प्रस्ट्तुत करने पर स्ट्कीम के तहत लाभ ददया जाएगा, अथाात :- I: अठारह वष ा से कम आय ुके बच् चों के जलए : (क). (i) यदद लाभाथी का पांच वषा की आयु के बाद नामांकन दकया गया (बायोमेररक संग्रह के साथ) था, तो उसकी आधार नामांकन पहचान पची, या बायोमेररक अपडेट पहचान पची -, (ii) लाभाथी द्वारा आधार नामांकन के जलए दकए गए अनरु ोध की एक प्रजत; और (ख). लाभाथी के जनम्नजलजखत पहचान दस्ट्तावेजों में से कोई एक, अथाात ्:─ (i) जन्म प्रमाणपत्र या उपयक्तु प्राजधकारी द्वारा जारी जन्म का ररकॉड;ा या (ii) स्ट्कूल के प्रप्रजसपल द्वारा जवजधवत हस्ट्ताक्षररत स्ट्कूल पहचान-पत्र, जजसमें माता-जपता के नाम हों; और (ग). मौजूदा स्कीम के ददिाजनदेिों के अनुसार माता-जपता या कानूनी अजभभावक के साथ लाभाथी के संबंध के प्रमाण के रूप में जनम्नजलजखत दस्ट्तावेजों में से कोई एक, अथाात:् (i) जन्म प्रमाण पत्र; या उपयुक्त प्राजधकारी द्वारा जारी जन्म का ररकॉडा; या (ii) रािन काड;ा या (iii) भूतपूव ा सैजनक अंिदायी स्ट्वास्ट््य स्ट्कीम काडा; या कमाचारी राज्य बीमा जनगम काडा; या केंद्र सरकार स्ट्वास्ट््य स्ट्कीम काडा; या (iv) पिें न काड;ा या (v) सेना का कैंटीन काड;ा या (vi) कोई भी सरकारी पररवार पात्रता काडा; या (vii) मंत्रालय द्वारा जनर्ददष्ट कोई अन्य दस्ट्तावेज II: अठारह वषा स ेअजधक आय ुके लाभार्शथयों के जलए: (क). यदद उसने नामांकन कराया ह,ै तो उसकी आधार नामांकन पहचान पची, और (ख). जनम्नजलजखत दस्ट्तावेजों में से कोई एक, अथाात्: (i) फोटो सजहत बैंक या डाकघर पासबुक, या[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3 (ii) पैन काड,ा या (iii) पासपोट,ा या (iv) रािन काड,ा या (v) मतदाता पहचान पत्र, या (vi) महात्मा गांधी राष्ट्रीय ग्रामीण रोजगार गारंटी अजधजनयम, 2005 काडा, या (vii) दकसान फोटो पासबुक, या (viii) मोटर वाहन अजधजनयम, 1988 (1988 का 59) के तहत लाइसेंप्रसग प्राजधकरण द्वारा जारी ड्राइप्रवग लाइसेंस, या (ix) दकसी राजपजत्रत अजधकारी या तहसीलदार द्वारा आजधकाररक लेटर हडे पर जारी दकए गए ऐसे व्यजक्त की फोटो युक्त पहचान का प्रमाणपत्र, या (x) जवभाग द्वारा जनर्ददषट् कोई अन्य दस्ट्तावेज बिते दक उपरोक्त दस्ट्तावेजों की जांच मंत्रालय द्वारा जविेष रूप से उस उद्देश्य के जलए नाजमत अजधकारी द्वारा की जाएगी। 4. लाभार्शथयों को स्कीम के तहत सुजवधापूणा तरीके से लाभ प्रदान करने के जलए, मंत्रालय अपनी कायाानव् यन एजेंसी के माध्यम से यह सुजनजित करने की सभी आवश्यक व्यवस्ट्था करेगा दक लाभार्शथयों को स्ट्कीमों के तहत आधार की जरूरत के बारे म ेंजागरूक करने के जलए मीजडया के माध्यम से व्यापक प्रचार दकया जाए। 5. लाभार्शथयों के खराब बायोमेररक्स के कारण या दकसी अन्य कारण से आधार प्रमाणीकरण जवफल हो जाने पर, जनम्नजलजखत उपचारात्मक तंत्र को अपनाया जाएगा, अथाात-् : (क). फफगरप्रप्रट की खराब गणु वत्ता के मामले में, प्रमाणीकरण के जलएआईररस स्ट्कैन या फेस ऑथेंरटकेिन सुजवधा अपनाई जाएगी, और मंत्रालय अपनी कायाान्वयन एजेंसी के माध्यम से आईररस स्ट्कैनर या फ़िंगर ऑथेंरटकेिन सजहत फेस ऑथेंरटकेिन से जनबााध तरीके से लाभ के जवतरण की व्यवस्ट्था करेगा; (ख). फफगरप्रप्रट या आईररस स्ट्कैन या फेस ऑथेंरटकेिन के माध्यम से बायोमेररक प्रमाणीकरण सफल नहीं होने पर, जहां भी संभव और स्ट्वीकाय ा हो आधार वन टाइम पासवडा या टाइम-बेस्ट्ड वन टाइम पासवडा द्वारा सीजमत समय वैधता सजहत मान्य प्रमाणीकरण, जैसी भी जस्ट्थजत हो, की व्यवस्ट्था की जाएगी; (ग). उन सभी अन्य मामलों में जहा ं बायोमेररक या आधार वन टाइम पासवडा या टाइम-बेस्ट्ड वन टाइम पासवड ा प्रमाणीकरण संभव नहीं ह,ै स्ट्कीम के तहत लाभ भौजतक आधार पत्र के आधार पर ददया जा सकता ह ै जजसकी प्रामाजणकता आधार पत्र पर मदु द्रत त्वररत प्रजतदिया (क्यूआर) कोड द्वारा सत्याजपत की जा सकती ह ै और मंत्रालय द्वारा अपनी कायाान्वयन एजेंसी द्वारा सुजवधाजनक स्ट्थानों पर क्यूआर कोड रीडर की आवश्यक व्यवस्ट्था उपलसध कराई जाएगी। 6. यहां ऊपर जनजहत दकसी भी बात के बावजूद, दकसी भी बच् चे को प्रमाणीकरण के माध्यम से अपनी पहचान स्ट्थाजपत करन े म ें जवफल रहन,े या आधार नंबर होने का प्रमाण प्रस्ट्तुत करन े म ें जवफल होन े पर, या ऐसे बच्च े के मामले म,ें जजसे कोई आधार नंबर नहीं ददया गया ह,ै स्ट्कीम के तहत ् लाभों से वंजचत नहीं दकया जाएगा, ऐसे बच् चों को नामांकन के जलए आवेदन प्रस्ट्तुत करते हुए, पैरा 3 के उप-पैरा (1) के खंड (ख) और (ग) के तहत उपलसध कराए गए अन्य दस्ट्तावेजों के आधार पर उसकी पहचान की पुजष्ट करके उसे लाभ ददया जाएगा, और ऐस े अन्य दस्ट्तावेजों के आधार पर लाभ ददए जाने पर, उसे दजा करन े के जलए एक अलग रजजस्ट्टर रखा जाएगा, जजसकी मंत्रालय द्वारा अपनी कायाान्वयन एजेंसी के माध्यम से समय-समय पर समीक्षा और लेखापरीक्षा की जाएगी। 7. यह सुजनजित करन े के जलए दक स्ट्कीम के तहत कोई भी वास्ट्तजवक लाभाथी (बच् चों के अलावा) उन्ह ें देय लाभों स े वंजचत नहीं ह,ै मंत्रालय अपनी कायाान्वयन एजेंसी के माध्यम स े प्रत्यक्ष लाभ अतं रण जमिन, मंजत्रमंडल सजचवालय, भारत सरकार के कायाालय ज्ञापन सं. डी-26011/04/2017-डीबीटी, ददनांक 19 ददसंबर, 2017 (https://dbtbharat.gov.in पर उपलसध) में जनर्ददष्ट अपवाद प्रबंधन तंत्र का पालन करेगा। [फा. सं. 30/30/2022-सी डसल्यू-II] श्रीमजत इंद्रा मालो, संयुक्त सजचव4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF WOMEN AND CHILD DEVELOPMENT NOTIFICATION New Delhi, the 11th April, 2023 S.O. 1694(E).—Whereas, the use of Aadhaar as identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly to them in a convenient and seamless manner and Aadhaar obviates the need for producing multiple documents to prove one’s identity; And whereas, the Ministry of Women and Child Development (hereinafter referred to as the Ministry) in the Government of India, is administering the Centrally Sponsored Scheme, Mission Vatsalya Scheme erstwhile Child Protection Services Scheme (hereinafter referred to as the Scheme) with an objective to create safety net of service delivery structures at National, State and District level for the children as acknowledged in the Juvenile Justice (Care and Protection of Children) Act, 2015( 2 of 2016) and also for providing rehabilitation and social re-integration of children, through institutional and non-institutional care, which is being implemented through the State Government or Union territories (hereinafter referred to as the Implementing Agency); And whereas, under the Scheme provides services which, inter-alia, include benefits that are either in cash which includes salary of staff or in kind like placement of children in need of care and protection for their care, treatment, nutrition, clothing, bedding, daily needs, entertainment and the like (hereinafter referred to as the benefits) to the children who fall within the ambit of the Juvenile Justice (Care and Protection of Children) Act, 2015 (2 of 2016) (hereinafter referred to as the beneficiaries), by the Implementing Agency as per the Scheme and the extant guidelines issued thereunder; And whereas, the implementation of the Scheme involves recurring expenditure incurred from the Consolidated Fund of India; Now, therefore, in pursuance of section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) and in suppression of the Notification number S.O.620(E), dated 23rd February, 2017 (Salary of staff), Notification number S.O. 6110 (E) dated 11th December, 2018 (Sponsorship) and Notification number S.O.6110(E) 11th December, 2018 (In Kind ) of erstwhile Child Protection Services Scheme, except as respects things done or omitted to be done before such suppression the Central Government hereby notifies the following, namely: - 1. an individual desirous of availing the benefit under the Scheme shall be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication. 2. any individual desirous of availing the benefit under the Scheme, who does not possess the Aadhaar number or has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment subject to the consent of his parents or guardians (in case of child beneficiaries), provided he is entitled to obtain Aadhaar as per section 3 of the said Act and such children shall visit any Aadhaar enrolment centre (list available at Unique Identification Authority of India website www.uidai.gov.in) to get enrolled for Aadhaar. 3. as per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Ministry through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Ministry or Department through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of Unique Identification Authority of India or by becoming Unique Identification Authority of India Registrar themselves: Provided that till the time Aadhaar is assigned to the individual, the benefit under the Scheme shall be given to such individuals, subject to production of the following documents, namely: - I. For children below the age of Eighteen years : (a) (i) if the beneficiary was enrolled after the age of five years (with biometrics collection), his Aadhaar Enrolment Identification slip, or of bio-metric update identification slip, or; (ii) a copy of the request made for Aadhaar enrolment by the beneficiary; and (b) any one of the following identity documents of the beneficiary, namely:- (i) Birth Certificate or record of birth issued by the appropriate authority; or (ii) School identity card, duly signed by the Principal of the school, containing parents names; and (c) any one of the following documents as proof of relationship of the beneficiary with the parent or legal guardian as per the extant Scheme guidelines, namely: –[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 5 i. Birth Certificate or record of birth issued by the appropriate authority; or ii. Ration Card; or iii. Ex-Servicemen Contributory Health Scheme Card; or Employees' State Insurance Corporation Card; or Central Government Health Scheme Card; or iv. Pension Card; or v. Army Canteen Card; or vi. any Government Family Entitlement Card; or vii. any other document as specified by the Ministry: II. For beneficiaries above the age of eighteen years : (a) if he has enrolled, his Aadhaar Enrolment Identification slip; and (b) any one of the following documents, namely :- i. Bank or Post office Passbook with Photo; or ii. Permanent Account Number Card; or iii. Passport; or iv. Ration Card; or v. Voter Identity Card; or vi. Mahatma Gandhi National Rural Employment Guarantee Act, 2005 card; or vii. Kisan Photo passbook; or viii. Driving license issued by the Licensing Authority under the Motor Vehicles Act, 1988 (59 of 1988); or ix. certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or x. any other document as specified by the Ministry: Provided further that the above documents shall be checked by an officer specifically designated by the Ministry for that purpose. (4) In order to provide benefits to the beneficiaries under the Scheme conveniently and the Ministry through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through media shall be given to the beneficiaries to make them aware of requirement of Aadhaar under the Scheme. (5) Where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason and the following remedial mechanisms shall be adopted, namely:- a. in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication and the Ministry through its Implementing Agency shall make provisions for iris scanners or face authentication along with finger print authentication for delivery of benefits in seamless manner; b. in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time-based One-Time Password with limited time validity, as the case may be, shall be offered; c. in all other cases where biometric or Aadhaar One Time Password or Time-based One-Time Password authentication is not possible, benefits under the Scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response code printed on the Aadhaar letter and the necessary arrangement of Quick Response code reader shall be provided at the convenient locations by the Ministry through its Implementing Agency. (6) Notwithstanding anything contained herein above, no child shall be denied benefit under the Scheme in case of failure to establish his identity by undergoing authentication, or furnishing proof of possession of Aadhaar number, or in the case of a child to whom no Aadhaar number has been assigned, producing an application for enrolment, the benefit shall be given to him by verifying his identity on the basis of other documents as provided under clauses (b) and (c) of sub-paragraph 1 of Paragraph 3 and where benefit is given on the basis of such other documents, a separate register shall be maintained to record the same, which shall be reviewed and audited periodically by the Ministry through its Implementing Agency.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (7) In order to ensure that no bona fide beneficiary (other than children) under the Scheme is deprived of his due benefits, the Ministry through its Implementing Agency shall follow the exception handling mechanism as specified in the Office Memorandum of Direct Benefit Transfer Mission, Cabinet Secretariat, Government of India no.
