122008, हटरयाणा ह,ै ने ‘‘बीकानेर, रािस्ट्थान म ें 400 मेगािाि सौर ऊिास पटरयोिना के जलए एसआरआईपीएल को कनेजक्िजििी प्रदान करन े के जलए रांसजमिन जसस्ट्िम” के तहत जिरोपटर रांसजमिन लाइन जबछान े के जलए जिद्युत अजधजनयम, 2003 की धारा 164 के अंतगतस प्राजधकृत करने हते ु आिेदन दकया ह।ै और िबदक, जिद्युत मंत्रालय, भारत सरकार ने अपने पत्र सं. 25-17/2/2023-PG ददनांक 26.06.2023 के द्वारा ‘‘बीकानेर, रािस्ट्थान म ें 400 मेगािाि सौर ऊिास पटरयोिना के जलए एसआरआईपीएल को कनेजक्िजििी प्रदान करन े के जलए रांसजमिन जसस्ट्िम” के अंतगसत आने िाली जिरोपटर रांसजमिन लाइन के जलए जिद्युत अजधजनयम की धारा 68(1) के अंतगतस पूिस अनुमोदन प्रदान दकया था। मेससस सेरेंटिका टरन्यूएबल्स इंजडया प्राइिेि जलजमिेड (एसआरआईपीएल) ने स्ट्थानीय समाचार पत्रों िाइम्स ऑफ इंजडया (अग्रं ेिी में) ददनांक 02.09.2023, दैजनक निज्योजत (हहदं ी में) ददनांक 02.09.2023, प्रभात अजभनंदन (हहदं ी में) ददनांक 02.09.2023 और भारत के साप्ताजहक रािपत्र ददनांक 21.10.2023 म ें रांसजमिन योिना के जलए प्रस्ट्ताजित 1116 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] रांसजमिन मागस पर प्रकािन की तारीख से 2 महीने के भीतर आम िनता की टिप्पजणयों / अभ्यािेदन की मागं करत े हुए नोटिस प्रकाजित दकया था। इसके पश्चात, मेससस सेरेंटिका टरन्यूएबल्स इंजडया प्राइिेि जलजमिेड (एसआरआईपीएल) न े 22.12.2023 ददनांदकत एक हलफनामा प्रस्ट्तुत दकया, जिसमें घोषणा की गई ह ैदक भारत सरकार के आजधकाटरक रािपत्र एिं स्ट्थानीय समाचार पत्रों में प्रकािन की तारीख से 2 महीने के भीतर कोई टिप्पणी / अभ्यािेदन प्राप्त नहीं हुआ था। और अब आिेदक ने जिद्युत अजधजनयम, 2003 की धारा 164 के अंतगसत ने ‘‘बीकानेर, रािस्ट्थान म ें 400 मेगािाि सौर ऊिास पटरयोिना के जलए एसआरआईपीएल को कनेजक्िजििी प्रदान करन े के जलए रांसजमिन जसस्ट्िम” के तहत रांसजमिन लाइन जबछाने के जलए उसे िे सभी िजिया ंप्रदान करने का अनरु ोध दकया ह,ै िो भारतीय िेलीग्राफ अजधजनयम, 1885 के तहत िेलीग्राफ के प्रयोिन के जलए सरकार द्वारा स्ट्थाजपत अथिा अनुरजित दकये गए िेलीग्राफ लाइन एिं खम्भ े या इस प्रकार की स्ट्थापना और अनरु िण दकये िाने के जलए, िेलीग्राफ प्राजधकरण को प्राप्त ह।ैं योिना के अंतगसत जनम्नजलजखत जिरोपटर रांसजमिन लाइन ह:ैं 1. एसआरआईपीएल पूहलगं स्ट्िेिन (ियमलसर) - बीकानेर II पीएस (आईएसिीएस) 220 केिी लाइन उपरोि योिना के अतं गतस जिरोपटर रांसजमिन लाइन रािस्ट्थान के जनम्नांदकत गााँिों,कस्ट्बों और िहरों से होकर, उन पर स,े उनके आसपास से और बीच से होकर गुज़रेगी। क्रजमक सख्ं या गािं ों तहसील जज़ला 1. ियमलसर , किनी बीकानेर बीकानेर 2. नोखा दैया कोलायत बीकानेर 3. भानीपुरा पूगल बीकानेर अब, सािधानीपूिसक जिचार करने के पश्चात, जिद्युत मंत्रालय, भारत सरकार, सेरेंटिका टरन्यूएबल्स इंजडया प्राइिेि जलजमिेड (एसआरआईपीएल) को उपरोि जिरोपटर रांसजमिन लाइन को लगान े के जलए िे सभी िजियां जनम्नजलजखत जनबंधनों एि ं ितों के साथ प्रदान करता ह,ै िो भारतीय िेलीग्राफ अजधजनयम, 1885 के तहत िेलीग्राफ के प्रयोिन के जलए सरकार द्वारा स्ट्थाजपत अथिा अनुरजित दकये गए िेलीग्राफ लाइन एि ं खम्भे या इस प्रकार की स्ट्थापना और अनरु िण दकये िाने के जलए, िेलीग्राफ प्राजधकरण को प्राप्त ह:ैं i. यह अनुमोदन 25 िषों के जलए प्रदान दकया िाता ह।ै ii. आिेदक को प्रस्ट्ताजित लाइन की स्ट्थापना से पूिस संबंजधत प्राजधकरणों अथातस ् स्ट्थानीय जनकायों, रेलि,े राष्ट्रीय रािमाग,स राज्य रािमागस आदद की सहमजत प्राप्त करनी होगी। iii. आिेदक को जिद्युत अजधजनयम, 2003 के तहत समुजचत आयोग के द्वारा तैयार दकए गए रांसजमिन, ओ एडं एम, ओपन एक्सेस आदद के जिजनयमों/संजहताओं का पालन करना होगा। iv. आिेदक केंद्र सरकार के जिद्युत जनरीिक/मुख्य जिद्युत जनरीिक के अनुमोदन के पश्चात ही लाइन का प्रचालन करेगा। v. यह अनुमोदन आिेदक द्वारा जिद्युत अजधजनयम, 2003 के प्रािधानों और उसके तहत बनाए गए जनयमों की अपेिाओं का अनुपालन दकए िाने के अध्यधीन ह।ै vi. मेससस सेरेंटिका टरन्यूएबल्स इंजडया प्राइिेि जलजमिेड (एसआरआईपीएल) को जिद्युत जनरीिण के समय जिमानन एिं रिा प्राजधकरणों इत्यादद, से अपेजित अनुमजत को प्राप्त करने के बाद, इसे केंद्रीय जिद्युत प्राजधकरण को जिद्युत जनरीिण के समय प्रस्ट्तुत करना होगा। vii. यदद उपरोि जिरोपटर लाइनों का मागस (या उपरोि जिरोपटर लाइन के मागस का कुछ भाग) मानजचत्र म ें जचजननत िीआईबी संभाजित िेत्र (या प्राथजमकता िेत्र) म ें आता ह ै िो माननीय सुप्रीम कोिस के िीआईबी (ग्रेि[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 इंजडयन बस्ट्िड)स मामले के संबंध में 2019 की याजचका संख्या 838, आदेि ददनांक 19.04.2021 का जहस्ट्सा ह ै | आिेदक को उपरोि जिरोपटर रांसजमिन लाइन के भूजमगत होने के संबंध या बड स डायििसर लगान े के जलय,े िैसा भी मामला हो, माननीय उच्चतम न्यायालय के आदेि ददनांक 19.04.2021 के जनदेिों का और माननीय उच्चतम न्यायालय द्वारा गटित तकनीकी सजमजत के जनदेिों का पालन करना ह ै। [फा. स.ं 25-16/2/2024-पीिी] दीपक राि, जनदेिक (पीिी) MINISTRY OF POWER ORDER New Delhi, the 14th February, 2024 S.O. 768(E).— Whereas M/s Serentica Renewables India Private Limited, the applicant with its registered office at DLF Cyber Park Tower B, 9th Floor, Sector 20, Udyog Vihar Phase-III, Gurugram-122008, Haryana, has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line under “Transmission system for providing connectivity to SRIPL for its 400 MW Solar Power Project in Bikaner, Rajasthan”. And whereas, Ministry of Power, Government of India vide its letter No.25-17/2/2023-PG dated 26.06.2023 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead transmission line covered under “Transmission system for providing connectivity to SRIPL for its 400 MW Solar Power Project in Bikaner, Rajasthan”. M/s Serentica Renewables India Private Limited had published notice for transmission scheme in local newspapers The Times of India (in English) dated 02.09.2023, Dainik Navjyoti (in Hindi) dated 02.09.2023, Prabhat Abhinandan (in Hindi) dated 02.09.2023 and in Weekly Gazette of India dated 21.10.2023 for the general public to make observations/representations on the proposed transmission route within two months from the date of publication. Subsequently, M/s Serentica Renewables India Private Limited has submitted an affidavit dated 22.12.2023 declaring that no observation/representation was received within two months from the date of publication in the official Gazette of Government of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of transmission line under “Transmission system for providing connectivity to SRIPL for its 400 MW Solar Power Project in Bikaner, Rajasthan”. The following overhead transmission line is covered under this scheme: 1. 220 kV line from SRIPL Pooling Station (Jaimalsar) – Bikaner II PS (ISTS) The transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Rajasthan: Sl. No. Villages Tehsil District 1. Jaimalsar, Kawni Bikaner Bikaner 2. Nokha Daiya Kolayat Bikaner 3. Bhanipura Poogal Bikaner Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Serentica Renewables India Private Limited for laying above overhead transmission line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant. vi. M/s Serentica Renewables India Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line ) falls in the GIB potential zone (or priority zone) marked in the map which is part of the order of the Hon’ble Supreme Court order dated 19.04.2021, in the petition No.838 of 2019 regarding GIB (Great Indian Bustard) case, the applicant has to comply with the directions of the Hon’ble Supreme Court, with regard to undergrounding of the above overhead transmission line and / or fixing of bird diverters, as the case may be as per the Hon’ble Supreme Court Order dated 19.04.2021 and the directions of the technical committee constituted by the Hon’ble Supreme Court in this regard.
