सा.का.जन. 724(अ).— माननीर् राष्टर ीर् ररत अजधकरण ीएनिीनी ने ‘’म ासजचव के माध् र्म से जमत्र बनाम
िल संसाधन मंत्रालर्’’ िीर्ाक वाले ओ.ए.सं. 134/2015 मामल े म ें तारीख 20 मई, 2019 के आिेि द्वारा पर्ाावरण, वन
और िलवार्ु पररवतना मंत्रालर् ीएमओईएफ एंड सीसी को जनिेि दिर्ा था दक व ररवसा ऑस्ट् मोजसस आधाररत िल
िुजिकरण प्रणाली के समुजचत उपर्ोग के संबंध में जवजनर्म बनाए;
और, भारत के माननीर् उच् चतम ् र्ार्ालर् ने ‘’िल गणु वत् ता भारत संब बनाम जमत्र एवं अ्र् ’’ िीर्ाक वाले वर् ा
2019 के जसजवल अपील डार्री सं. 37657 के मामल े म ें तारीख 22 नवम् बर, 2019 के आिेि द्वारा पर्ाावरण, वन और
िलवार्ु पररवतान मंत्रालर् को जनम्न वत जनिेि दिर्ा था -
‘‘दकसी जनष्टक र्ा पर पुंचं ने से प ले, जिसे अंततोगत् वा उस अजधसूचना के प प में लाना जजिसे िारी दकए िाने का
आिेि दिर्ा गर्ा ,ज मंत्रालर् इस तथ् र् पर अ् र् सभी तथ्र् ों के साथ जनजत तत तपर पर जवचार करना चाज ए’’;

और, पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् न े भारत के माननीर् उच् चतम ् र्ार्ालर् के जनिेिों के
अनुपालन में िल गुणवत् ता भारत संब द्वारा उपलध कराए गए तथ्र् ों/औजचत् र् पर जवचार दकर्ा और तारीख 18 नवम् बर,
2019 के कार्ाालर् ज्ञापन द्वारा ररवसा ऑस्ट् मोजसस आधाररत िल िुजिकरण प्रणाली के समुजचत उपर्ोग से संबंजधत
जवजनर्म के संबंध में प्राप प अजधसूचना की समीक्षा करन े के जलए तकनीकी सजमजत का गठन दकर्ा;
और, ररवसा ऑस्ट् मोजसस आधाररत िल िुजिकरण प्रणाली के समुजचत उपर्ोग के संबंध में तकनीकी सजमजत के
साथ परामिा करके तजर्ार दकए गए जवजनर्म से संबंजधत प्राप प अजधसूचना को व् र्ापक पररचालन के जलए तथा रन पजणर्ा ं
आमंजत्रत करन े के जलए पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् की वेबसाइन पर अपलोड दकर्ा गर्ा, और प्राप प
अजधसूचना के संबंध म ें अनेक रन पजणर्ां प्रा त ुंईं और र् िखे ा गर्ा दक भपगोजलक और स्रोत उपल धता, उपभोक्त ा की
गुणवत् ता अपेक्षां, तकनीकी एवं आर्थाक व् र्व ार्ाता संबंधी सीमा, जवजनर्ामक अनुपालन और स्ट् वास्ट् थ् र् संबंधी मु्ों की
िजृ ि से िल की गणु वत् ता में पररवतान ोता ;ज
और, भारतीर् मानक र्रू ो ीबीआईएस द्वारा ररवसा ऑस्ट् मोजसस ीआरओ आधाररत वाइंन ऑफ र्ूि ीपीओर्ू
िल िोधन प्रणाली के जलए आईएस मानक ीआईएस 16240 2015 तजर्ार दकर्ा गर्ा जऔर आरओ आधाररत िल िोधन
मिीन के जलए उसके प्रकार के अनुमोिन का उपाबंध दकर्ा गर्ा ।ज
अत अब के् रीर् सरकार पर्ाावरण ीसंरक्षण अजधजनर्म, 1986 (1986 का 29 की धारा 6 और धारा 25 द्वारा
प्रित् त िजतियर्ों का प्रर्ोग करते ुंए, एतद्द्वारा पर्ाावरण ीसरं क्षण अजधजनर्म, 1986 में और संिोधन करन े के जलए
जनम्न जलजखत जनर्म बनाती ,ज अथाात -
1. ी1 इन जनर्मों का संजक्ष त नाम पर्ाावरण ीसरं क्षण 115 संिोधन जनर्म, 2021 ।ज
ी2 इन जनर्मों म ें अ् र्था उपबंजधत के जसवाए, वे रािपत्र म ें प्रकािन की तारीख से अठार मा ों की अवजध
के समा त ोने पर प्रवृत् त ोंगे।
2. पर्ाावरण ीसंरक्षण जनर्म, 1986 में, अनुसूची-I म,ें क्रम संख्र् ा 114 और उससे संबंजधत प्रजवजिर्ों के प चात
जनम्न जलजखत को अंत स्ट् थाजपत दकर्ा िाएगा, अथाात -
‘’115 िल िजु िकरण प्रणाली ीडल् र् ूपीएस के उपर्ोग के सबं धं म ेंजवजनर्म
1. पररभार्ा.-
(i) ‘’भारतीर् मानक र् रू ो ीबीआईएस ’’ का भारतीर् मानक र्ूरो से अजभप्रेत ,ज िो उपभोक्त ा मामल,े खाद्य
और िन-जवतरण मंत्रालर्, भारत सरकार का राष्टर ीर् मानक जनकार् ;ज
(ii) ‘’केंरीर् प्रिर्ू ण जनर्त्रं ण बोडा ीसीपीसीबी ’’ का के् रीर् प्रिर्ू ण जनर्ंत्रण बोडा से अजभप्रेत ,ज जिसे िल ीप्रिर्ू ण
जनवारण और जनर्ंत्रण अजधजनर्म, 1974 (1974 का 6 के उपाबंध के त त गरठत दकर्ा गर्ा ;ज
(iii) ‘’पररत्र् क्त तत्व ’’ स े अजभप्रेत ज व तत्व ज जिसे र्ा तो जवजनमााण की त्रुरनर्ों, नून-फून, उपािेर्ता संबंधी
जविेर्तां की कमी के कारण त् र्ाग कर दिर्ा गर्ा जर्ा बरेलू िल िुजिकरण प्रणाली से ना दिर्ा गर्ा जर्ा[भाग II—खण् ड 3(i)] भारत का रािपत्र असाधारण 3
जिसके उपर्ोग की अवजध समा त ो गई ,ज र्ा जिसे अजभ कजल्पत मापिडं पर कार्ािील न ोने के कारण
प्रजतस्ट् थाजपत दकर्ा गर्ा ;ज
(iv) “जवजनमाताा” से अजभप्रेत ज जिसमें, कंपनी अजधजनर्म, 2013 (2013 का 18 म ें र्था-पररभाजर्त कोई व् र्जतिय,
र्ा कोई इकाई र्ा कोई कंपनी अथवा कारखाना अजधजनर्म, 1948 (1948 का 63 म ें र्था पररभाजर्त कोई
कारखाना अथवा सूक्ष्म , लब ु और मध् र्म आकार के उद्यम जवकास अजधजनर्म, 2006 (2006 का 27 म ें र्था
पाररभाजर्त लबु और मध् र्म आकार के उद्यम ,ं जिनमें दफल्न रों के जनमााण और संर्ोिना की सुजवधाएं ;ं
(v) “उपर्ोग का स्ट्थ ान ीपीओर् ू” से अजभप्रेत ज िो उपर्ोग के स्ट्थ ान के नदीिीक िल िुजिकरण प्रणाली का स्ट् थान
और दकसी एक नल र्ा कई नलों, िजसे रसोई के ससंक के नल अथवा दकसी अजतररक्त नल म ें सीधे पानी भेिना
;ज
(vi) “खराब िल” से अजभप्रेत ज िो डल् र्पू ीएस से जनकलने वाला पानी ज और जिसे तंत्र द्वारा िोजधत दकर्ा गर्ा
न ीं माना िाता ;ज
(vii) “राज्र् प्रिर्ूण जनर्त्रंण बोडा अथवा प्रिर्ूण जनर्त्रंण सजमजतर्ां” से िल ीप्रिर्ू ण जनवारण और जनर्ंत्रण
अजधजनर्म, 1974 (1974 का 6 के प्रावधान के अतं गता गरठत राज्र् के जलए र्थाजस्ट्थजत राज्र् प्रिर्ू ण
जनर्ंत्रण बोडा अथवा सबं राज्र् क्षेत्र के मामल े में प्रिर्ू ण जनर्ंत्रण सजमजत, ो, से अजभप्रेत ;ज
(viii) “प्रकार अनमु ोिन” से अजभप्रेत ज ऐसा कोई उत् पाि िो जवजनर्ामक, तकनीकी और सुरक्षात् मक आव र्कतां
की ् र्नू तम रेणणे ी को परू ा करता ,ज के जलए अनप ु पता प्रमाणपत्र और िो उत् पाि को जबक्री की अनज्ञु ा दिए
िाने से प ले अपेजक्षत ;ज
(ix) “िेिी िल िजुिकरण तत्रं ीडीडल् र् ूपीएस ” से अजभप्रेत ज ऐसा उपस्ट् कर र्ा र्ुजतियर्ा ं जिसमें 25 लीनर प्रजत बंन े
की क्षमता वाले ररवसा ऑसमोजसस पर आधाररत उपर्ोग के स्ट् थान ीपीओर् ू पर उपल ध िल िोधन तंत्र
िाजमल ,ज िो पानी के कुल बलु निील ठोस ीनीडीएस को कम करता ज, रासार्जनक संिर्ू ण को सुरजक्षत स्ट् तर
तक कम करता जऔर उपर्ोग के स्ट् थान पर सूक्ष्म िजजवक अिुजिर्ों सज त भपजतक कणों को नाता ज;
(x) “िेिी िल िजुिकरण तत्रं के अलावा अ्र् कोई ीओडीपीडल् र् एू स ” स े अजभप्रेत अथा ज ऐसा उपस्ट् कर र्ा
र्ुजतियर्ां जिसमें ररवसा ऑसमोजसस पर आधाररत िल िोधन तंत्र िाजमल ज, िो िल के कुल बलु निील ठोस
ीनीडीएस को कम करता ,ज रासार्जनक संिर्ू ण को सुरजक्षत स्ट् तर तक कम करता ज तथा पीओर् ू पर सूक्ष्म
िजजवक अिुजिर्ों सज त भपजतक कणों को नाता ;ज
(xi) “िल आपर्ूत ाअजभकरण” स े अजभप्रेत – िो लागू कानून के कानूनी उपबंध के कारण उत् प्न , व् र्ावसाजर्क र्ा
अजनवार्ा जिम् मिे ारी के आधार पर दकसी दिए गए भपगोजलक क्षेत्र में िल के िोधन, जवतरण और/अथवा
आपूर्ता में लगी ुंई कोई इकाई, संगठन, राज्र् सरकार का जवभाग, स्ट् थानीर् ि री जनकार्, सावािजनक र्ा

2. उपर्ोग सबं धं ी जवजनर्मन - (1) डीड ल् र्ूपीएस और ओडीड ल् र्ूपीएस के सभी उपर्ोगकताा, केंरीर् प्रिर्ू ण
जनर्ंत्रण बोडा द्वारा िारी दििा-जनिेिों का अनुपालन करेंगे।
ी2 केंरीर् प्रिर्ू ण जनर्ंत्रण बोडा द्वारा पर्ाावरण ीसंरक्षण 115 संिोधन जनर्म, 2021 के प्रकािन की तारीख स े
छ म ीनों की अवजध के भीतर डीडल् र्ूपीएस और ओडीडल् र्ूपीएस स े उत् प् न पररत् र्क्त की डं सलगं , भंडारण, प्रबंधन
और उपर्ोग के जलए दििा-जनििे प्रकाजित दकए िाएंगे।
(क) डीडल् र् पू ीएस -
(i) सभी जवजनर्मात, आर्ाजतत, उत् पादित र्ा संर्ोजित दकए गए डीडल् र्ूपीएस पर भारतीर् मानक
र्रू ो ीअनप ु पता आकलन जवजनर्मन, 2018 की स्ट् कीम-I, अनुसूची-II के अंतगात समर्-समर् पर
र्था-संिोजधत भारतीर् मानक आईएस-16240 के अनुसार, भारतीर् मानक र्ूरो के अनुज्ञज त के
त त मानक जच् िर्िता करना ोगा।
(ii) डीडल् र्ूपीएस से पररत् र्क्त तत्व ों का प्रबंधन, समर्-समर् पर र्था-संिोजधत लाजस्ट्नक अपजिष्टन
प्रबंधन जनर्म, 2016; ई-अपजिष्टन ीप्रबंधन जनर्म, 2016; खतरनाक अपजिष्टन प्रबंधन जनर्म,
2016 के उपाबंध के अनुसार दकेर्ा िाएगा और पररत् र्क्त तत्व ों के प प में उत् प् न लाजस्ट्नक,
इलजक्र ॉजनक और इलजजक्रकल अपजिष्टन को जवस्ट् ताररत उत् पािक उत् तरिाजर्त् व ीईपीआर के अतं गात
लार्ा िाएगा।
(ख) ओडीडल् र् पू ीएस –
(i) िल ीप्रिर्ू ण जनवारण और जनर्ंत्रण अजधजनर्म, 1974 (1974 का 6 और पर्ाावरण ीसंरक्षण
अजधजनर्म, 1986 के त त बन े जवजभ् न जनर्मों के उपाबंधों के अंतगात जवजनर्जमत ोगा।
(ii) कार्ाा् वर्न के जलए नोडल अजभकरण मामले के अनुसार, र्थाजस्ट्थजत राज्र् प्रिर्ू ण जनर्ंत्रण बोड ा
र्ा प्रिर्ू ण जनर्ंत्रण सजमजत ोगा।
3. उत्त रिाजर्त्व
(क) डीडल् र् पू ीएस
(क) जवजनमाता ा
(i) जवजनमााता पर्ाावरण ीसरं क्षण 115 संिोधन जनर्म, 2021 के प्रकािन की तारीख स े अठार म ीनों
की अवजध के भीतर भारतीर् मानक र्ूरो ीअनुप पता आकलन जवजनर्मन, 2018 की स्ट् कीम-I,
अनुसूची-II के त त भारतीर् मानक आईएस 16240 ीसमर्-समर् पर र्थासंिोजधत के अनुसार
भारतीर् मानक र्रू ों से अनुज्ञज त के त त मानक जचह्न अजभप्रा त करेगा।
(ii) डीडल् र्ूपीएस से पररत् र्क्त दकए गए तत्व ों को जवजनमााता द्वारा समर्-समर् पर संिोजधत दकए गए
लाजस्ट्नक अपजिष्टन प्रबंधन जनर्म, 2016; ई-अपजिष्टन ीप्रबधं न जनर्म, 2016; खतरनाक अपजिष्टन
प्रबंधन जनर्म, 2016 के उपाबंध के अनुसार प्रबंजधत दकर्ा िाएगा और जनष्टक ाजसत दकए गए तत्व ों के
प प में उत् सर्िात लाजस्ट्नक, इलेक्र ोजनक और इलेजक्रकल अपजिष्टन को उत् पािक के जवस्ट् ताररत
उत् तरिाजर्त् व ीईपीआर के त त िाजमल दकर्ा िाएगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र असाधारण 5
(iii) पजरा 2. के खंड ीक के उप-खंड ीi के अनुसार जवजनमााता द्वारा डीड ल् र्ूपीएस को बीआईएस प्रमाणन के
जबना न ीं बेचा िाएगा।
(iv) जवजनमााता के् रीर् प्रिर्ू ण जनर्त्रं ण बोड ा को र्थाजस्ट्थजत आग े प्रस्ट् तुत करने के जलए अगल े जवत् तीर् वर् ा के
अजधकतम 30 नवम् बर तक मामले के अनुसार एसपीसीबी र्ा पीसीसी को अनुपालन ररपोना प्रस्ट् तुत
करेगा।
(ख) के्र ीर् प्रिर्ू ण जनर्त्रं ण बोड ा
(i) इस पजरा के उपाबंधों के कार्ाा् वर्न के के्र ीर् प्रिर्ू ण जनर्ंत्रण बोडा नोडल अजभकरण ोगा।
(ii) के् रीर् प्रिर्ू ण जनर्ंत्रण बोड,ा पर्ाावरण ीसंरक्षण 115 संिोधन जनर्म, 2021 के प्रकािन भी तारीख स े
छ म ीनों की अवजध के भीतर डीडल् र्ूपीएस से उत् सर्िात अस्ट् वीकृत िल के प्रबंधन, भंडारण, उपर्ोग
और जनपनान के जलए दििाजनििे ों को तजर्ार और उ् ेंप्रकाजित करेगा।
(iii) के् रीर् प्रिर्ू ण जनर्ंत्रण बोडा जवज्ञापन, प्रकािनों, पोस्ट् नरों र्ा संचार के अ् र् माध् र्मों के द्वारा िन
िागप कता सृजित करेगा।
(iv) के् रीर् प्रिर्ू ण जनर्ंत्रण बोडा इन उपाबंधों के कार्ाा् वर्न की जनगरानी करेगा।
(ग) उपर्ोगकता ा उपर्ोगकताा र्था लाग,ू डीडल् र्ूपीएस र्ा ओडीड ल् र्पू ीएस, से उत् प् न पररत् र्क्त िल के प्रबधं न,
भंडारण, उपर्ोग और जनपनान के जलए के् रीर् प्रिर्ू ण जनर्ंत्रण बोडा द्वारा िारी दकए गए दििाजनिेिों का
अनुपालन करेगा।
(ब) बीआईएस भारतीर् मानक र् ूरो उपल ध प्रपद्योजगकी, तिनुप पी पुनाप्राजि की सक्षमता और आउनपुन िल की
गुणवत त ा की जव वसनीर्ता को ध् र्ान म ें रखत े ुंए डीडल् र्ूपीएस के जलए लाग ू मानक कोड ीआईएस 16240
को तजर्ार र्ा संिोजधत करेगा।
4. ओडीडल् र् पू ीएस
(क) उपर्ोगकत्त ा ा
(i) उपर्ोगकताा रािपत्र म ें पर्ाावरण ीसरं क्षण 115 संिोधन जनर्म, 2021 के प्रकािन की तारीख स े छ
म ीनों की अवजध के भीतर, पर्ाावरण ीसंरक्षण अजधजनर्म, 1986 के त त बनाए गए उपाबंधों र्ा
जनर्मों के अनुसार रिस्ट् रीकरण प्रिान करन े के जलए, राज्र् प्रिर्ू ण जनर्ंत्रण बोड ा र्ा प्रिर्ू ण जनर्ंत्रण
सजमजतर्ों, मामले के अनुसार को प्राजधकार के जलए आवेिन करेगा और उनमें जनधााररत की गई ितों का
अनुपालन करेगा।
(ii) उपर्ोगकता,ा िल ीप्रिर्ू ण जनवारण और जनर्ंत्रण अजधजनर्म, 1974 और पर्ाावरण ीसंरक्षण
अजधजनर्म, 1986 के त त बनाए गए जनर्मों के उपबंधों के अधीन प्रचालन करेगा। बिते दक इस
पर्ाावरण ीसंरक्षण 115वां सिं ोधन जनर्म, 2021 के प्रकािन की तारीख को र्ा उसस े प ल े से प्रचालन
कर र ी संस्ट्थ ापनाए,ं इस पर्ावा रण ीसंरक्षण 115वा ं संिोधन जनर्म, 2021 के तारीख स े छ मा की6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
अवजध के भीतर संबंजधत राज्र् प्रिर्ू ण जनर्ंत्रण बोडा/प्रिर्ू ण जनर्ंत्रण सजमजत को प्रचालन के जलए,
अनुज्ञा ि ां भी लागू ो, के जलए आवेिन करेंगे।
ीख राज्र् प्रिर्ू ण जनर्त्रं ण बोड/ाप्रिर्ू ण जनर्त्रं ण सजमजत
(i) राज्र् प्रिर्ू ण जनर्ंत्रण बोडा/प्रिर्ू ण जनर्ंत्रण सजमजत, र्थाजस्ट्थजत, सुजनजत तत करेगा/करेगी दक सभी
ओडीड ल् र्ूपीएस को िल ीप्रिर्ू ण जनवारण और जनर्ंत्रण अजधजनर्म, 1974 ी1974 का 6 और
पर्ाावरण ीसरं क्षण अजधजनर्म, 1986 के अंतगात बनाए गए जनर्मों के उपबंधों के अधीन जवजनर्जमत
दकर्ा िाए।
(ii) राज्र् प्रिर्ू ण जनर्ंत्रण बोडा/प्रिर्ू ण जनर्ंत्रण सजमजत, र्थाजस्ट्थजत लाजस्ट्नक अपजिष्टन प्रबधं न जनर्म,
2016 और ई-अपजिष्टन ीप्रबंधन जनर्म, 2016 के उपबंधों के अनुसार, ओडीडल् र् ूपीएस के
जवजनमाातां और आर्ातकों को रिस्ट् रीकृत करेगा/करेगी।
(iii) राज्र् प्रिर्ू ण जनर्ंत्रण बोड/ाप्रिर्ू ण जनर्ंत्रण सजमजत, र्थाजस्ट्थजत जवज्ञापन, प्रकािन, पोस्ट् नर र्ा संचार के
अ् र् माध् र्मों से िन िागप कता उत् प् न करेगा/करेगी।
(iv) राज्र् प्रिर्ू ण जनर्ंत्रण बोड/ाप्रिर्ू ण जनर्ंत्रण सजमजत, र्थाजस्ट्थजत ो, इन उपबंधों के कार्ाा् वर्न की
जनगरानी करेगा/करेगी।
(v) राज्र् प्रिर्ू ण जनर्ंत्रण बोड/ाप्रिर्ू ण जनर्ंत्रण सजमजत, र्थाजस्ट्थजत सीपीसीबी को आगामी जवत् तीर् वर्ा के
15 दिसम् बर से प ल-े प ल े अनपु ालन ररपोना प्रस्ट् तुत करेगा/करेगी।
ीग केंरीर् प्रिर्ू ण जनर्त्रं ण बोड ा
i. केंरीर् प्रिर्ू ण जनर्ंत्रण बोड,ा एसपीसीबी र्ा पीसीसी से प्रा त वार्र्ाक ररपोनों को आगामी जवत् तीर् वर्ा के 30
दिसम् बर से प ल-े प ले पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को प्रस्ट्त ुत करन े ते ु समेदकत करेगा।
4. सामा्र् ित त – ी1 पीने र्ोग् र् पानी की आपूर्त ा के कार्ा म ें लग े िल आपूर्ता अजभकरण ीड ल् र्ूएसए , संबंजधत
स्ट् थानीर् जनकार् िजसे दक िन स्ट्व ास्ट् थ् र् इंिीजनर्री जवभाग ीपीएचईडी , िल जनगम, नगर जनगम, िल बोड,ा नगर
पाजलका, प्राइवेन और पजलक सेक्न र के अजभकरण, जबल प्राजि उपकरणों के माध् र्म से और समाचार पत्रों म ें
सावािजनक जवज्ञापन और िन संपका के अ् र् साधनों के माध् र्म से भी आपूर्त ा दकए िा र े िल के कुल बुलनिील

NOTIFICATION
New Delhi, the 4th October, 2021
G.S.R. 724(E).—WHEREAS, Hon’ble National Green Tribunal in the matter of O.A. no.134/ 2015 titled
“Friends through its General Secretary vs Ministry of Water Resources” vide order dated the 20th May, 2019 directed
the Ministry of Environment, Forest and Climate Change (MoEF&CC) to come out with Regulation on Appropriate
Use of Reverse Osmosis Based Water Purification System;
AND WHEREAS, Hon’ble Supreme Court of India in the matter of Civil Appeal Diary No. 37657 of 2019
titled “Water Quality India Association vs Friends & Ors” vide order dated the 22nd November, 2019 directed
MoEF&CC as follows: −
“The Ministry must consider this material together with all other material, before it arrives at any conclusion,
which then ultimately is put in the form of the notification that has been ordered to be issued” ;
AND WHEREAS, MoEF&CC in compliance to the directions of Hon’ble Supreme Court of India
considered the material / justification provided by the Water Quality India Association and vide Office Memorandum8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
dated the 18th November, 2019 constituted Technical Committee to review the draft notification on Regulation on
Appropriate Use of Reverse Osmosis Based Water Purification System;
AND WHEREAS, draft notification on Regulation on Appropriate Use of Reverse Osmosis Based Water
Purification System prepared in consultation with Technical Committee was uploaded on MoEF&CC’s website for
wider circulation and inviting comments, and numerous comments were received on the draft notification and it was
observed that there is variation in water quality with respect to geographical and source availability, consumer quality
requirements, limitation on techno-economic feasibility, regulatory compliances and health issues;
AND WHEREAS, Bureau of Indian Standards (BIS) has developed IS standard (IS 16240: 2015) for
Reverse Osmosis (RO) based Point of Use (PoU) Water Treatment System and providing Type approval for RO based
Water Purifier.
Now, therefore, in exercise of the powers conferred by sections 6 and 25 of the Environment (Protection)
Act, 1986 (29 of 1986), the Central Government hereby makes the following rules further to amend the Environment
(Protection) Act, 1986, namely:−
1. (1) These rules may be called the Environment (Protection) 115 Amendment Rules, 2021.
(2) Same as otherwise provided in these rules, they shall come into force on expiry of period of eighteen
months from the date of their publication in the Official Gazette.
2. In the Environment (Protection) Rules, 1986, in Schedule – I, after serial number 114 and the entries relating
thereto, the following shall be inserted, namely: −
“115 Regulation on Use of Water Purification System (WPS)
1. Definition. –
(i) “BIS” means the Bureau of Indian Standard which is the national Standards Body of India working under
the aegis of the Ministry of Consumer Affairs, Food and Public Distribution, Government of India;
(ii) “CPCB” means the Central Pollution Control Board constituted under the provision of the Water
(Prevention and Control of Pollution) Act, 1974 (6 of 1974);
(iii) “Discarded element” means element which is discarded or removed from the Domestic Water
Purification System due to either manufacturing defects, wear, tear, loss of its utility attributes or
achieved its end of life usability, or is replaced due to non-functioning at designed parameter;
(iv) “Manufacturer” means a person or an entity or a company as defined in the Companies Act, 2013 (18 of
2013) or a factory as defined in the Factories Act, 1948 (63 of 1948) or Small and Medium Enterprises as
defined in Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), which has
facilities for manufacturing or assembling of filters;
(v) “Point of use (PoU)” means location of water purification system close to the use point and deliver
directly to a single tap or multiple tap such as a kitchen sink faucet or an auxiliary faucet;
(vi) “Reject water” means water coming out of WPS and not considered as treated by the system;
(vii) “SPCB or PCC” means State Pollution Control Board for State or Pollution Control Committee in case of
Union territory, as the case may be, constituted under the provision of the Water (Prevention and Control
of Pollution) Act, 1974 (6 of 1974);
(viii) “Type approval” means certificate of conformity to a product that meets a minimum set of regulatory,
technical and safety requirements, and is required before the product is allowed to be sold;
(ix) “Domestic Water Purification System (DWPS)” means equipment or devices, which involves Reverse
Osmosis based Point of Use (PoU) water treatment system with a capacity of up to 25 litres per hour that
reduces Total Dissolved Solids (TDS) of water, reduces chemical contamination to safe level and removes
physical particles including microbiological impurities at PoU;
(x) “Other than Domestic Water Purification System”(ODPWS) means equipment or devices, which
involves Reverse Osmosis based water treatment system that reduces Total Dissolved Solids (TDS)
water, reduces chemical contamination to safe level and removes physical particles including

(xi) “Water Supply Agency” means any entity, organisation, Department of State Government, local urban
bodies, public or private sector entities engaged in treatment, distribution or supply or both of water in a
given geographical area on commercial or obligatory responsibility basis arising due to statutory provision
of applicable law.
2. Regulation on use.− (1) All users of DWPS and ODWPS shall comply with the guidelines issued by CPCB.
(2) A guideline shall be published by the Central Pollution Control Board for handling, storage, management
and utilisation of reject generated from DWPS and ODWPS within a period of six months from the date of publication
of the Environment (Protection) 115 Amendment Rules, 2021.
(A) DWPS. −
(i) All manufactured, imported, produced or assembled DWPS shall bear the Standard Mark under a license from
the Bureau of Indian Standards as per the Indian Standard IS 16240, as amended from time to time, under
Scheme –I , Schedule - II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.
(ii) Discarded elements from DWPS shall be managed as per the provisions of the Plastic Waste Management
Rules, 2016; E-Waste (Management) Rules, 2016; Hazardous Waste Management Rules, 2016, as amended
from time to time and plastic, electronic and electrical waste generated as discarded elements shall be brought
under Extended Producer Responsibility (EPR).
(B) ODWPS. −
(i) Shall be regulated under the provisions of the Water (Prevention and Control of Pollution), Act, 1974 (6 of
1974) and various rules under the Environment (Protection) Act, 1986.
(ii) The nodal agency for implementation shall be the State Pollution Control Board or the Pollution Control
Committee, as the case may be.
3. Responsibilities. −
(A) DWPS
(a) Manufacturer
(i) The manufacturer shall obtain Standard Mark under a license from the Bureau of Indian
Standards as per the Indian Standard IS 16240 ( as amended from time to time) under Scheme –I
, Schedule- II of Bureau of Indian Standards (Conformity Assessment) Regulations, 2018 within
period of eighteen months from the date of publication of the Environment (Protection) 115
Amendment Rules, 2021.
(ii) Discarded elements from DWPS shall be managed by the manufacturer as per the provisions of
the Plastic Waste Management Rules, 2016; E-Waste (Management) Rules, 2016; Hazardous
Waste Management Rules, 2016 and as amended from time to time, and plastic, electronic and
electrical waste generated as discarded elements shall be brought under Extended Producer
Responsibility (EPR).
(iii) No DWPS shall be sold by the manufacturer without BIS certification as per sub-clause (i) of
the clause (A) of paragraph 2.
(iv) The manufacturer shall submit compliance report to SPCB or PCC, as the case may be, for
further submission to CPCB latest by the 30th November of following financial year.
(b) CPCB
(i) The CPCB shall be the nodal agency for implementation of the provisions of this paragraph.
(ii) The CPCB shall prepare and publish guidelines for management, storage, utilisation and disposal of
reject water generated from DWPS within a period of six months from the date of publication of the
Environment (Protection) 115 Amendment Rules, 2021.
(iii) The CPCB shall create public awareness through advertisement, publication, posters or by other
means of communication.
(iv) The CPCB shall monitor the implementation these provisions. .10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(c) User: The user shall comply with the guidelines issued by CPCB for management, storage, utilisation and
disposal of reject water generated from DWPS or ODWPS, as applicable .
(d) BIS : The BIS shall prepare or modify the applicable standard code (IS 16240) for DWPS having regard to
the available technology, corresponding recovery efficiency and output water quality reliability.
4. ODWPS
(a) User :
(i) The user shall apply for authorisation within a period of six months from the date of publication of the
Environment (Protection) 115 Amendment Rules, 2021 to the State Pollution Control Board or the Pollution
Control Committee, as the case may be, for grant of registration as per the provisions of rules made under
the Environment (Protection) Act, 1986 and shall comply with the conditions stipulated therein.
(ii) The user shall operate within the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (
6 of 1974) and the rules made under the Environment (Protection) Act 1986: provided that the installations
operating on or before the date of publication of the Environment (Protection) 115 Amendment, Rules, 2021
shall apply for Consent to Operate, wherever applicable, to the concerned State Pollution Control Board or
Pollution Control Committee, as the case may be, within a period of six months from the date of publication
of the said rules. .
(b) State Pollution Control Board or Pollution Control Committee
(i) The State Pollution Control Board or Pollution Control Committee, as the case may be, shall ensure that
all ODWPS are regulated within the provisions of the Water (Prevention and Control of Pollution), Act,
1974 ( 6 of 1974) and rules made under the Environment (Protection) Act 1986.
(ii) The State Pollution Control Board or Pollution Control Committee, as the case may be, shall register
manufacturers and importers of ODWPS, as per the provisions of the Plastic Waste Management
Rules, 2016, E-Waste (Management) Rules, 2016.
(iii) The State Pollution Control Board or Pollution Control Committee, as the case may be, shall create
public awareness through advertisement, publication, posters or by other means of communication.
(iv) The State Pollution Control Board or Pollution Control Committee, as the case may be, shall monitor
the implementation of these provisions.
(v) The State Pollution Control Board or Pollution Control Committee, as the case may be, shall submit
compliance report to CPCB latest by the 15th December of following financial year.
(c ) Central Pollution Control Board
i. The Central Pollution Control Board shall compile annual reports received from SPCBs or PCCs for
submission to the Ministry of Environment, Forest and Climate Change latest by the 30th December of
following financial year.
4. General conditions. – (1) Water Supply Agency (WSA), concerned Local Bodies like Public Health
Engineering Department (PHED), Jal Nigam, Municipal Corporation, Jal Board, Municipalities, Private and
Public Sector Agencies engaged in potable water supply, shall inform the consumers about the water sources
and quality including Total Dissolved Solids (TDS) concentration of water being supplied through billing
instruments and also through public advertisement in newspaper and other mass media means on regular
basis.
(2) Every DWPS product shall be affixed with a conformance label meeting the following requirements,
namely:−
(a) The label shall be durable and legible.
(b) The label shall be affixed on a part necessary for normal operation of the product and not normally

(3) The conformance label shall contain the following information, namely:−
(a) Name and address of the manufacturer or assembler of product, as the case may be.
(b) Statement that the product conforms to the Environment (Protection) Rules, 1986.
(c) Type Approval certificate number.
(d) Date of manufacture of product or in case of import, the date of import of the product ; and
(e) Rated recovery efficiency and corresponding water reject generation.
(4) In case of any dispute or difficulty in implementation of these provisions, the matter shall be referred to the
nodal agency.
(5) The nodal agency shall constitute a Standing Committee for process integrity and recovery efficiency
assessment related issues and to advise on all matters related to implementation of these provisions
including disposal of disputes, if any”.
