दकर्ा गर्ा था, जिसमें सभी व् र्जक्त र्ों स,े जिनके उसके द्वारा प्रभाजवत होन े की संभावना थी, आक्षपे और सुझाव उस तारीख से, जिसको उक्त अजधसूचना को अन्तर्वाष्ट करने वाले रािपत्र की प्रजतर्ां िनसाधारण को उपलब्ध करा िी गई थी, साठ दिन की अवजध के समाप्त होन े से पूवा आमंजत्रत दकए गए थे; और उक्त रािपजत्रत अजधसूचना की प्रजत िनसाधारण को तारीख 18 अक्टूबर, 2023 को उपलब्ध करा िी गई थी; और, पूवोक्त अजधसूचना के [PART II—SEC. 3(i)] अतः, अब, केंद्रीर् सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 6 और धारा 25 द्वारा प्रित्त िजक्तर्ों का प्रर्ोग करते हुए, पर्ाावरण (सरं क्षण) जनर्म, 1986 का और सिं ोधन करने के जलए जनम्नजलजखत जनर्म बनाती ह,ै अथाात:् - 1. संजक्षप्त नाम और प्रारंभ.- (1) इन जनर्मों का संजक्षप्त नाम पर्ाावरण (सरं क्षण) छठा संिोधन जनर्म, 2025 ह।ै (2) र् ेरािपत्र में इनके प्रकािन की तारीख को प्रवृत्त होंगे। 2. पर्ाावरण (संरक्षण) जनर्म, 1986 की अनुसूची-I म ें क्रम संखर्ा 40 और उससे संबजं धत प्रजवजष्टर्ों के स्ट्थान पर जनम्नजलजखत क्रम संखर्ा और प्रजवजष्टर्ां रखी िाएंगी, अथाात:् - क्र.स.ं उद्योग मानिंड मानक “40 कीटनािक बजहस्राव मानक उद्योग पीएच और बार्ो एस्ट्से परीक्षण को छोड़कर, जम.ग्रा./ली. म ेंसान्द्रता को सीजमत करना क. अजनवार् ामानिंड सीओडी तकनीकी ग्रडे इकाइर्ों और उन इकाइर्ों के जलए िहां एक ही पररसर में प्रजतपािन कार्ाकलापों के साथ-साथ तकनीकी ग्रडे उत्पािन होता ह,ै के जलए 250 प्रजतपािन ग्रेड इकाइर्ों के जलए 150 बीओडी (3 दिन 27 °C) 30 (प्रजतपािन इकाइर्ों के साथ-साथ तकनीकी ग्रडे इकाइर्ों िोनों के जलए) पीएच (pH) 6.5-8.5 ऑइल और ग्रीस 10 प्लवमान ठोस पिाथ ा 100 *बार्ोएस्ट्से परीक्षण 100% बजहस्राब में 96 घंटों के बाि मछली की 90% उत्तरिीजवता ख. अजतररक्त मानिडं साइनाइड बजहःस्राव िोधन संर्ंत्र (सीईटीपी) में जवसर्िात करने वाल े उद्योग पर लागू नहीं ह,ै और बागबानी र्ा ससंचाई उिेश्र्ों के जलए िोजधत अपजिष्ट िल के उपर्ोग सजहत भूजम और सतही िल स्रोतों में दकए िाने वाले सभी जवसिानों पर लागू होगा। 2. संबंजधत राज्र् प्रिषू ण जनर्त्रं ण बोडा/ प्रिषू ण जनर्ंत्रण सजमजत अनुप्रवाह में प्रापक िल जनकार् के उपर्ोग के आधार पर कुल घलु निील ठोस कण (टीडीएस), सल्फेट्स और क्लोराइड की मान को िुष्क आधार पर 11% ऑक्सीिन तक सही दकर्ा िाएगा। (ii) टेल गैस में CO की सांद्रता 7% से कम नहीं होगी। 2 (iii) र्दि हलै ोिेनेटेड काबाजनक अपजिष्ट का विन इनपुट अपजिष्ट के जहसाब से 1% स े कम ह,ै तो एकल कक्ष भस्ट्मक म ें सभी सुजवधाएं इस प्रकार से बनाई िाएगं ी दक भस्ट्मक में न्र्नू तम तापमान 1100°C प्राप्त दकर्ा िा सके। द्रवीकृत बेड प्रौद्योजगकी आधाररत भस्ट्मक के जलए, तापमान 950°C पर बनाए रखा िाएगा। (iv) र्दि हलै ोिेनेटेड काबाजनक अपजिष्ट का विन इनपुट अपजिष्ट के जहसाब से 1% स े अजधक ह,ै तो अपजिष्ट को केवल रटवन चैम्बर भस्ट्मक म ें िलार्ा िाएगा और सभी सुजवधा संर्ंत्रों को प्राथजमक कक्ष म ें 850±25°C और जद्वतीर्क िहन कक्ष म ें 1100°C का न्र्ूनतम तापमान प्राप्त करने के जलए बनार्ा िाएगा और जद्वतीर्क िहन कक्ष में गसै मौिूिगी समर् िो सेकंड से कम नहीं होना चाजहए। (v) स्ट्क्रसबंग उत्सिान के जलए बने स्ट्क्रबर का उपर्ोग िमनकताा के रूप म ेंनहीं दकर्ा िाएगा। (vi) भस्ट्मीकरण संर्ंत्रों (िहन कक्षों) को ऐसे तापमान, अवधारण समर् और वार्ुमण्डलीर् जवक्षोप के साथ संचाजलत दकर्ा िाएगा, तादक भस्ट्मीकरण भस्ट्म और अवजिष्टों में कुल काबाजनक काबान (टीओसी) सामग्री 3% से कम हो और िहन करन े पर उनका नुकसान सूख े विन का 5% से कम हो। मानकों को पूरा न करने की जस्ट्थजत में, र्थाजस्ट्थजत, भस्ट्म और अवजिष्ट को पनु ः िला दिर्ा िाएगा। (vii) भस्ट्मक म ेंकम स ेकम तीस मीटर ऊंची जचमनी होनी चाजहए। ड. भस्ट्मक स ेउत्पन्न बजहःस्राव रटप्पणी : (i). स्ट्क्रबर और फिा की धलु ाई से उत्पन्न बजहःस्राव बंि नाली र्ा पाइपों के माध्र्म से प्रवाजहत दकर्ा िाएगा और पर्ाावरण (संरक्षण) जनर्म, 1986 के अधीन अजधसूजचत पर्ाावरण प्रिषू ण (भाग कः बजहःस्राव) के जवसिान के जलए सामान्र् मानकों की अनुसूची: VI के साथ परठत ऊपर 'ख' म ेंउजल्लजखत बजहःस्राव मानकों का अनपु ालन करन े के जलए उपचाररत दकर्ा िाएगा। (ii). अपजिष्ट िल र्ा फि ा धोन े स े बनन े वाला कुल घलु निील ठोस कण (टीडीएस) उपर्ोग दकए गए अिोजधत पानी के (टीडीएस) से 1000 जमलीग्राम/लीटर से अजधक नहीं होना चाजहए। च. तफू ान का पानी रटप्पणी : (i). तूफान के पानी को स्ट्क्रबर पानी और/र्ा फिा धोन े के पानी के साथ जमजित होने की अनमु जत िी िाएगी। (ii). तूफान के पानी को 10 जमनट (प्रजत घंटा औसत) वषाा िल धारण क्षमता की एचडीपीई लाइन गड्ढे से गुिरने वाली अलग-अलग नाजलर्ों के माध्र्म से प्रवाजहत दकर्ा िाएगा।”6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 487(E).—Whereas, the draft of certain rules further to amend the Environment (Protection) Rules, 1986 were published, vide notification of the Government of India in the Ministry of Environment, Forest and Climate Change, number, G.S.R. 753(E), dated 17th October, 2023, in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), dated the 18th October, 2023, inviting objections or suggestions from all persons likely to be affected thereby before the expiry of a period of sixty days from the date on which copies of the Gazette containing the said notifications were made available to the public; And whereas, the copy of the said Gazette notification was made available to the public on the 18th October, 2023; And Whereas, objections and suggestions received from all persons and stakeholders in response to the aforesaid notification have been duly considered by the Central Government; Now, therefore, in exercise of the powers conferred by sections 6 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following rules further to amend the Environment (Protection) Rules, 1986, namely: - 1. Short title and commencement.—(1) These rules may be called the Environment (Protection) Sixth Amendment Rules, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Environment (Protection) Rules, 1986, in Schedule-l, for serial number 40 and the entries relating thereto, the following serial number and entries shall be substituted, namely:- S. Note: 1. Not applicable to industry discharging to Common Effluent Treatment Plants, and shall be applicable to all discharge to land and surface water bodies including use of treated wastewater for horticulture or irrigation purpose. 2. The concerned State Pollution Control Board or Pollution Control Committee shall prescribe limits of Total Dissolved Solids, Sulphates and Chlorides depending on the usages of recipient water body in downstream, in which effluent shall be disposed off.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. Parameters listed as “Additional Parameters” shall be prescribed depending upon the process and product, on a case to case basis. C. (ii) The CO concentration in tail gas shall not be less than 7%. 2 (iii) In case, halogenated organic waste is less than 1% by weight input waste, all the facilities in single chamber incinerators shall be designed so as to achieve a minimum temperature of 1100oC in the incinerator. For fluidized bed technology based incinerator, temperature shall be maintained at 950oC.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 (iv) In case halogenated organic waste is more than 1% by weight in input waste, waste shall be incinerated only in twin chamber incinerators and all the facilities shall be designed to achieve a minimum temperature of 850±25oC in primary chamber and 1100oC in secondary combustion chamber with a gas residence time in secondary combustion chamber not less than two seconds. (v) Scrubber meant for scrubbing emissions shall not be used as quencher. (vi) Incineration plants shall be operated (combustion chambers) with such temperature, retention time and turbulence, as to achieve Total Organic Carbon (TOC) content in the incineration ash and residue less than 3% and their loss on ignition is less than 5% of the dry weight. In case of nonconformity, ash and residue as the case may be, shall be re-incinerated. (vii) The incinerator shall have a chimney of at least thirty meters height. E. Effluent from Incinerator Note: (i) Effluent from scrubber(s) and floor washings shall flow through closed conduit or pipe network and be treated to comply with the effluent standards mentioned at ‘B’ above read with Schedule VI: General Standards for Discharge of Environment Pollutions (Part A : Effluents) notified under the Environment (Protection) Rules, 1986. (ii) The build-up in Total Dissolved Solids in wastewater or floor washings shall not exceed 1000 mg/l over and above the Total Dissolved Solids of raw water used. F. Storm water Note: (i) Storm water shall be allowed to mix with scrubber water and/or floor washings. (ii) Storm water shall be channelized through separate drains passing through a High Density Polyethylene lined pit having holding capacity of 10 minutes (hourly average) of rainfall.” [F.
