## Policy Analysis Report: Notification Regarding Estate Officers under the Public Premises Eviction of Unauthorised Occupants Act, 1971
**1. Executive Summary:**
This report analyzes two notifications issued by the Ministry of Power on September 22, 2022, regarding the appointment of Estate Officers under the Public Premises Eviction of Unauthorised Occupants Act, 1971. These notifications designate specific officers within the Damodar Valley Corporation (DVC) as Estate Officers, granting them the authority to manage and ensure the eviction of unauthorized occupants from DVC-owned or leased properties within their respective jurisdictions. This report provides an overview of these appointments, their potential impact, and relevant implementation aspects derived from the text.
**2. Introduction:**
This report aims to provide an informative analysis of the notifications S.O. 4564(E) and S.O. 4565(E), both issued on September 22, 2022, by the Ministry of Power concerning the appointment of Estate Officers under the Public Premises Eviction of Unauthorised Occupants Act, 1971. The analysis is solely based on the information presented within the provided text.
**3. Policy Overview:**
* This analysis pertains to *new* appointments of Estate Officers rather than an amendment to an existing policy detailed in the provided text.
* **Core Objective(s):** The core objective is to delegate authority to specific officers within the Damodar Valley Corporation to enforce the Public Premises Eviction of Unauthorised Occupants Act, 1971, within their defined areas of jurisdiction. This ensures the proper management and protection of DVC properties by enabling the swift eviction of unauthorized occupants.
**4. Background and Rationale:**
As this is a *new* designation of authority for specific officers, the notifications likely address the need for efficient management and protection of Damodar Valley Corporation's (DVC) properties. The notifications suggest that there is a need for designated officers to handle issues related to unauthorized occupation of DVC lands and buildings. Appointing Estate Officers empowers DVC to take necessary legal actions to reclaim its properties and maintain their integrity.
**5. Key Provisions / Changes:**
The key provisions established by these notifications are:
* **Notification S.O. 4564(E):** Appoints the Resident Director, Damodar Valley Corporation, Ranchi, as the Estate Officer. This officer is granted authority over "All lands, buildings, quarters, outhouses and other accommodation including fitting and fixture owned or leased by Damodar Valley Corporation within the local limits of its jurisdiction at Ranchi."
* **Notification S.O. 4565(E):** Appoints the In-Charge Transmission System Construction TSCIII Division, Panchet, as the Estate Officer. This officer is granted authority over "All lands, buildings, quarters, outhouses and other accommodation including fitting and fixtures owned by Damodar Valley Corporation within the local limits of jurisdiction under Transmission System ConstructionIII Division, Panchet."
* Both officers are appointed under Section 3 of the Public Premises Eviction of Unauthorised Occupants Act, 1971, and are authorized to exercise the powers and perform the duties imposed on an Estate Officer under the Act.
**6. Target Audience and Stakeholders:**
The direct target audience and stakeholders are:
* The Resident Director, Damodar Valley Corporation, Ranchi.
* The In-Charge Transmission System Construction TSCIII Division, Panchet.
* Unauthorized occupants of DVC properties within the specified jurisdictions.
* Damodar Valley Corporation (DVC) itself.
**7. Implementation Aspects (Inferred):**
* **Responsible agency/bodies mentioned:**
* Ministry of Power (issuing authority)
* Damodar Valley Corporation (DVC)
* Resident Director, DVC, Ranchi
* In-Charge Transmission System Construction TSCIII Division, Panchet
* **Any timelines or procedures specified in the text:** The text does not specify any explicit timelines or procedures. However, the Estate Officers are expected to operate within the framework of the Public Premises Eviction of Unauthorised Occupants Act, 1971, which outlines the legal procedures for eviction.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of these appointments are:
* **More effective enforcement:** Streamlined and more effective enforcement of the Public Premises Eviction of Unauthorised Occupants Act, 1971, within the specified jurisdictions.
* **Protection of DVC Property:** Improved protection of DVC's assets from unauthorized occupation and potential damage.
* **Reduced unauthorized occupation:** Reduction in the number of unauthorized occupants on DVC properties.
* **Improved Asset Management:** Enhancement of overall asset management practices by DVC.
**9. Conclusion:**
The notifications S.O. 4564(E) and S.O. 4565(E) represent a significant step towards empowering the Damodar Valley Corporation to effectively manage and protect its properties. By designating specific officers as Estate Officers under the Public Premises Eviction of Unauthorised Occupants Act, 1971, the Ministry of Power aims to ensure that DVC can take swift and decisive action against unauthorized occupants, thereby safeguarding its assets and promoting efficient operations.
