**Report: Analysis of Amendment to International Financial Services Centres Authority Act, 2019 Notification**
**1. Executive Summary:**
This report analyzes an amendment to a notification related to the International Financial Services Centres Authority (IFSCA) Act, 2019. The amendment, issued on June 27, 2022, modifies the composition of a committee or body established under the original notification of July 30, 2020, by replacing a member. Specifically, it replaces the existing entry for a member with "Ms. Mamta Suri, Executive Director, Insurance Regulatory and Development Authority of India." This suggests a change in the representation or expertise required for the committee/body. The key finding is a shift in personnel within the IFSCA framework, potentially indicating a renewed focus or adjustment in regulatory oversight.
**2. Introduction:**
This report aims to provide a clear and concise analysis of the amendment to the Government of India, Ministry of Finance, Department of Economic Affairs notification S.O. 2527(E) dated 30th July, 2020, pertaining to the International Financial Services Centres Authority (IFSCA) Act, 2019, as evidenced in the notification S.O. 2912(E) dated June 27, 2022. This analysis is based solely on the provided text.
**3. Policy Overview:**
* **Original Policy:** The amendment modifies the notification S.O. 2527(E) dated 30th July, 2020, concerning the IFSCA Act, 2019.
* **Core Objective(s):** Based on the provided text, the core objective of the *original* notification (S.O. 2527(E)) appears to be the establishment of a committee or body with specific membership under the IFSCA Act. The *amendment* focuses on modifying this membership. The IFSCA Act itself aims to develop and regulate financial services in International Financial Services Centres in India.
**4. Background and Rationale:**
The provided text offers limited insight into the specific reasons for this amendment. However, the change in membership (specifically replacing an existing member with the Executive Director of the Insurance Regulatory and Development Authority of India) suggests a possible strategic shift. The amendment could be motivated by a need for specific expertise from the insurance sector, a desire to enhance coordination between IFSCA and IRDAI, or a re-evaluation of the committee/body's composition.
**5. Key Provisions / Changes:**
This is an *Amendment*, so the focus is on the changes:
* **Specific Part Changed:** The amendment modifies the entry for serial number 3 in the original notification S.O. 2527(E).
* **New Rule/Provision:** The existing member entry at serial number 3 is replaced with "Ms. Mamta Suri, Executive Director, Insurance Regulatory and Development Authority of India ....... Member".
* **Difference/Effect:** The change replaces an existing member with Ms. Mamta Suri, who holds the position of Executive Director at IRDAI. This brings in expertise from the insurance regulatory body, suggesting increased involvement of the insurance sector within the IFSCA framework related to the committee/body in question.
**6. Target Audience and Stakeholders:**
The immediate target audience and stakeholders are the members of the committee/body established under the original notification. More broadly, the change impacts the Insurance Regulatory and Development Authority of India (IRDAI) and any entities or individuals interacting with the committee/body whose composition has been changed. This may include financial institutions operating within the International Financial Services Centres (IFSCs).
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Department of Economic Affairs, Ministry of Finance, is responsible for issuing the amendment. The International Financial Services Centres Authority (IFSCA) is the governing body under whose act the notification is issued. The Insurance Regulatory and Development Authority of India (IRDAI) is affected as the Executive Director will now be a member.
* **Timelines/Procedures:** No specific timelines or procedures are outlined in the amendment text. The change is effective from the date of the notification (June 27, 2022).
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of this amendment is to enhance the committee/body's capabilities through the inclusion of expertise related to insurance regulation and development. This may lead to more informed decision-making, improved coordination between the IFSCA and IRDAI, and a potentially greater focus on insurance-related activities within the IFSCs. The impact of this amendment is increased collaboration between financial sector and insurance sector regulation, resulting in better synergy.
**9. Conclusion:**
The amendment to the IFSCA Act, 2019 notification, specifically the replacement of a member on a committee/body with the Executive Director of IRDAI, signals a potential shift in focus within the IFSCA framework. This change likely aims to integrate insurance sector expertise more effectively into the regulatory process, potentially leading to better-informed decisions and enhanced development of financial services within the IFSCs. The industry should expect more collaboration between the IFSCA and IRDAI and a greater focus on insurance-related activities.
