L.-33004/99 सी.जी.-डी.एल.-अ.-16102024-257944 CG-DxLx-xEG-I1D6H1x0x2x0 24-257944 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 577] नई दिल्ली , सोमवार अक्त बू र 14, 2024/ आजिन 22, 1946 No. 577] NEW DELHI, MONDAY, OCTOBER 14, 2024/ ASHVINA 22, 1946 वाजणज्य और उद्योग मत्रं ालय, (उद्योग सवं धनध और आतं ररक व्य ापार जवभाग) अजधसूचना नई दिल्ली,11 अक् तूबर, 2024 सा. का. जन. 633 (अ).—–जवस्ट्फोटक अजधजनयम, 1884 (1884 का 4) की धारा 18 की उप-धारा (1) की अपेक्षा के अनुसार, जवस्ट्फोटक जनयम, 2008 में संिोधन करने हते ु प्रारूप जनयम, भारत सरकार के वाजणज्य और उद्योग मंत्रालय (उद्योग संवधधन और आंतररक व्यापार जवभाग) की अजधसूचना संख्या सा.का.जन. 570(अ), तारीख 18 िून 2018 द्वारा भारत के रािपत्र, भाग-II, खण्ड 3, उप-खण्ड (i) म ें प्रकाजित दकए गए थ े और उस रािपत्र की प्रजतयां जिनस े इन जनयमों के प्रभाजवत होने की संभावना ह,ै उस तारीख से जिसको उक्त अजधसूचना में अतं र्वधष्ट रािपत्र की प्रजतयां िनता को उपलब्ध करायी गईं थी 45 दिन की अवजध की समाजि के पूवध आपजियां और सुझाव आमंजत्रत दकए गए थे। और उक्त रािपत्र की प्रजतया ं 18 िून, 2018 को िनता को उपलब् ध करा िी गई थीं; और केन्‍द रीय सरकार द्वारा उक्त प्रारूप जनयमों के संबंध म ें िनता से प्राप् त आपजियों और सुझावों पर उजचत रूप स े जवचार दकया गया ह;ै 6649 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अत: अब, केन्‍द रीय सरकार, जवस्ट्फ ोटक अजधजनयम, 1884 की धारा 5 और धारा 7 द्वारा प्रिि िजक्तयों का प्रयोग करते हुए जवस्ट् फोटक जनयम, 2008 का और संिोधन करन े के जलए जनम्न जलजखत जनयम बनाती ह,ै अथाधत्:- 1. (1) इन जनयमों का संजक्षप् त नाम जवस्ट्फोटक (संिोधन) जनयम, 2024 ह।ै (2) ये रािपत्र में इनके प्रकािन की तारीख से प्रवृत् त होंगे। 2. जवस्ट्फोटक जनयम, 2008 म ेंजिसे इसमें (इसके पश् चात ् इसे उक्त जनयम कहा गया ह)ै जनयम 2, म-ें (क) खण्ड (11) म,ें "मख्ु य जनयत्रं क" िब्िों के पश् चात िब्ि "या जनयंत्रक” को अंतःस्ट् थाजपत दकया िाएगा। (ख) खण्ड (18) के पश् चात, जनम् नजलजखत खण्ड अंतःस्ट् थाजपत दकया िाएगा, अथाधत-् ’(18क) "जनवधहन स्ट्थल (जडस्ट् चािध साइट)" से वह क्षेत्र अजभप्रेत है, िो आजतिबािी के बाहरी प्रििधन के जलए प्रयुक्त आजतिबािी के जनकटतम आस-पास का क्षेत्र ह;ै'; (ग) खण् ड (19) के जलए, जनम्न जलजखत खण् ड रखा िाएगा, अथाधत्:- ’(19) "प्रििधन आजतिबािी" से ऐसी जवजनर्मधत आजतिबािी अजभप्रेत ह,ै िो िश्ृ य या श्रव्य प्रभाव उत्पन्न करने के जलए आजतिबािी के प्रििधन हते ु साइट पर एकत्र की िाती है’; (घ) खण् ड (24क) के स्ट्थ ान पर जनम्नजलजखत खण्ड रखा िाएगा, अथाधत:् - ’(24क) "हवाई आजतिबािी" से ऐसे कम िोजखम वाल े जवस्ट्फ ोटक अजभप्रेत ह,ै िो ध्वजन, कई ध्वजनयां, प्रकाि, रंग और पॉयरो टेक्नीक प्रभाव या एकसाथ जवजभन्न प्रभावों का संयोिन पैिा करन े के जलए साइट पर उपयोग के जलए तैयार रूप म ें है, जिसमें गोला और रॉकेट सजम्मजलत है, लेदकन इसमें ऐसी आजतिबािी सजम्मजलत नहीं ह ैजिसका व् यास 1 इंचसे कम या ऊंचाई 6 इंच से कम ह।ै (ङ) खण्ड (25क) के पश्चात, जनम्नजलजखत खण्ड अंतः स्ट्थाजपत दकया िाएगा, अथाधत्:- (25ख) "आजतिबािी प्रििनध सहायक" से ऐसे व्यजक्त अजभप्रेत ह,ै िो मुख्य जनयंत्रक या जनयंत्रक द्वारा मान्‍दयता प्राि ह ै और िो आजतिबािी के उपकरणों की स्ट्थापना, मोटाधर लोड करने, आजतिबािी सुलगान े और जडस्ट्चािध स्ट्थल की सफाई के जलए आजतिबािी प्रििधन ऑपरेटर की सहायता करता है; ’(25ग) "आजतिबािी प्रििधन ऑपरेटर" से ऐसे व् यजक्त अजभप्रेत ह,ै िो मुख्य जनयंत्रक या जनयंत्रक द्वारा मान्‍दयता प्राि ह ैऔर आजतिबािी प्रििधन के प्रचालन और सुरक्षा के जलए उिरिायी है;'; (च) खण्ड (30) के पश्चात, जनम्नजलजखत खण्ड अंतःस्ट्थाजपत दकया िाएगा, अथाधत:् - (30क) "लोडर" से ऐस े सहायक अजभप्रेत ह,ै िो हवाई गोले और अन्‍दय आजतिबािी प्रििनध वस्ट्तुओं को लोड करता ह;ै'; (छ) खण् ड (35) के पश्चात, जनम्नजलजखत खण्ड अंतःस्ट्थाजपत दकया िाएगा, अथाधत:् - (35क) "मॉनीटर" से ऐसे व्यजक्त अजभप्रते है, िो दकसी अनजधकृत व्यजक्त को आजतिबािी प्रििधन स्ट्थल म ें प्रवेि करन े से रोकता ह ैया उसे जनयंजत्रत करता है;। 3. उक्त जनयमों के जनयम 10 के उप-जनयम (6) म ें “प्रणाली या उपकरण” िब्िों के पश्चात् “केन्‍द रीय सरकार द्वारा जवकजसत जवस्ट्फोटक रैककंग और रेससंग सॉफ़्टवेयर के साथ लोड दकए गए बारकोड रीडसध को छोड़कर” िब्िोंको अतं ःस्ट् थाजपत दकया िाएगा। 4. उक्त जनयमों के जनयम 24 के जलए,[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (क) उप-जनयम (1) के स्ट् थान पर, जनम्न जलजखत उप-जनयम रखा िाएगा, अथाधत:् - "(1) इन जनयमों के अधीन जवस्ट्फोटकों के जवजनमाधण, कब्ि,े जवक्रय, प्रयोग या पररवहन के जलए अनुज्ञजि धारक कोई व्यजक्तया सगं ठन या कंपनी, अनुसूची 5 के भाग 5 म ें जवजनर्िधष्ट प्रारूप म ें अजभलेखों का अनुरक्षण करेगा और जनयम 128 के उप-जनयम (1) के अधीन सारणी म ें जवजनर्िधष्ट प्राजधकारी द्वारा मांग दकए िाने पर ऐस े अजभलेख प्रस्ट् तुत करेगा।” (ख) उप-जनयम (3) के स्ट् थान पर, जनम्नजलजखतउप-जनयम रखा िाएगा, अथाधत:् - "(3) अनुज्ञजिधारक जवजनर्मधत, प्राि, जवक्रय दकए गए या अन्‍दतररत या प्रयक्तु अथवा नष्ट दकए हुए या आयाजतत या जनयाधजतत जवस्ट्फोटकों (आजतिबािी सेजभन्न) की त्रैमाजसक जववरणी जनयंत्रक और जिला मजिस्ट्रेट को प्रत्येक आगामी जतमाही के िस दिनों के भीतर केन्‍द रीय सरकारद्वारा जवस्ट्फोट कों की रैककंग एव ं रेससंग के जलए जवकजसत ऑनलाइन प्रणाली में प्रस्ट् तुत करेगा।” 5. उक्त जनयमों के जनयम 51 के उप-जनयम (2) के परन्‍दतुक के स्ट्थान पर जनम्नजलजखत परन्‍दतुक रखा िाएगा, अथाधत्:- “परंत ु यदि पररवहन दकया िाने वाला जवस्ट् फोटक श्रणे ी 2 का हो, तो जवस्ट्फोटकों की मात्रा बीस टन या वैन की अजधकतम वहन क्षमता, इनम ें से िो भी कम हो, स े अजधक नहीं होगी और ऐसी वैन का जडिाइन मुख्य जनयंत्रक या जनयंत्रक द्वारा अनुमोदित दकया िाएगा और इस े मुख्य जनयंत्रक द्वारा मान्‍दयता प्राि फैजिकेटर द्वारा जवजनर्मधत दकया िाएगा।" 6. उक्त जनयमों के जनयम 66 के परंतुक में “दकलोग्राम आजतिबािी” िब् िों के पश् चात "या एक हिार दकलोग्राम सेफ्टी फ्यूि या उसका संयोिन”, िब्िों को अंतः स्ट्थाजपत दकया िाएगा। 7. उक्त जनयमों के जनयम 74 म,ें उप-जनयम (3) के पश्चात, जनम्नजलजखतउप-जनयम अंतः स्ट्थाजपत दकया िाएगा, अथाधत्:- "(4) जवजनमाधण इकाइयों से िुड़ी मैगिीन के मामल े म ें कुल भंडारण क्षमता जवजनमाधण के जलए अनुज्ञात जवस्ट्फोटकों की उस श्रेणी की प्रजतदिन जवजनमाणध क्षमता से कम नहीं होगी;"। 8. उक्त जनयमों के जनयम 102 म,ें उप-जनयम (2) म,ें खण्ड (ख) म,ें “समान” िब्िों के पश्चात "परंतु जवद्यमान सुरक्षा िरू ी को लांघा नहीं िाएगा" िब्िों को अंतःस्ट्थाजपतदकया िाएगा। 9. उक्त जनयमों के जनयम 103 म,ें उप-जनयम (7) म,ें “छह” िब्िके स्ट् थान पर "तीन"िब्िरखा िाएगा। 10.उक्त जनयमों के जनयम 107 म,ें उप-जनयम (6) केपश्चात, जनम्नजलजखत उप-जनयम अंतःस्ट्थाजपतदकया िाएगा, अथाधत्:- "(6क) आजतिबािी प्रििनध ऑपरेटर या आजतिबािी प्रििधन सहायक प्रमाण पत्र प्रिान करने के आवेिन के मामले में, मुख्य जनयंत्रक या जनयंत्रक, जनयम 113 की मि संख्या (26) म ें जवजनर्िधष्ट िस्ट्तावेिों और फोरमैन के प्रमाण पत्र के जलए यथा जवजनर्िधष्ट िुल्क की प्राजि पर प्रमाण पत्र प्रिान करने से पहले आवश्यक समझी िाने वाली परीक्षा ली िाएगी और पूछताछ की िाएगी। (6ख) इस बात स े संतुष्ट होने पर दक आवेिक को आजतिबािी प्रििधन से संबंजधत क्षेत्र म ें पयाधि ज्ञान और अनुभव है, अनुज्ञजि प्राजधकारी प्रपत्र एलई-11 (क) म ेंप्रमाण पत्र प्रिान करेंगे। (6ग) उप-जनयम (6ख) के अधीन प्रिान दकए गए प्रमाण पत्र िारी करने की तारीख से पांच वर्ध की अवजध के जलए वैध होगा। (6घ) प्रमाण-पत्र समाि होने पर उसे अगले पांच वर्ध की अवजध के जलए नवीनीकृत दकया िा सकता है, जिसके जलए आवेिन पत्र और आवेिन प्रपत्र एई-11 (क) म ें उजल्लजखत िस्ट्तावेिों की प्राजि और प्रमाण पत्र प्रिान करन े के मामल े म ें प्रदक्रयाओं को पूरा करना होगा।"4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 11. उक्त जनयमों के जनयम 113 म,ें सारणी म-ें (क) क्रम संख्या 1 के सामने ििाधई गई प्रजवजष्टयों में, स्ट्त ंभ2 में "आजतिबािी या गन पाउडर या िोनों" िब्ि के पश् चात, "हवाई और प्रििधनकारी आजतिबािी वस्ट्तुओंको छोड़कर" िब्ि को अतं ः स्ट्थाजपत दकया िाएगा; (ख) क्रम संख्या 20 के सामने ििाधयी गई प्रजवजष्टयों में- (i) स्ट् तम् भ 2 म,ें प्रजवजष्टयों केस्ट्थ ान परजनम्नजलजखत प्रजवजष्टयां रखी िाएंगी, अथाधत:- "सावधिजनक प्रििधन के जलए अजधकतम िो हिार दकलोग्राम आजतिबािी रखने और उपयोग करने के जलए अनुज्ञजि"। (ii) स्ट् तंभ6 की प्रजवजष्टयों के स्ट् थान पर जनम्नजलजखत प्रजवजष्टयों को रखा िाएगा, नामतः- 1. “(क)प्रपत्रएई -6; 2. जडस्ट्चािध साइट की लंबाई-चौड़ाई, ििधकक्षेत्र, पार्किंग क्षेत्र, सुरजक्षत क्षेत्र, जनकासी पथ, संबद्ध अलग-अलग िरू ी क्षेत्र और प्रििधन क्षेत्र के छोर स े 250 मीटरकेिायरे के भीतर की संरचनाओं को ििाधन े वाला साइट प्लान; 3. सावधिजनक प्रििधन आयोजित दकए िाने की तारीख और समय; 4. प्रििधन में उपयोग की िान े वाली आजतिबािी के प्रकार; 5. प्रििधन में उपयोग की िान े वाली आजतिबािी के आपूर्तधकताध का नाम, पता और अनज्ञु जि संख्या; 6. जनयम 2 के अनुसार अजधभोगी के रूप में नामांकन के िस्ट्तावेिी साक्ष्य के साथ अजधभोगी का पासपोटध साइि का फोटो; 7. जनयम 107 के उप-जनयम (6क) के अनुसार िल्ु क; 8. सावधिजनक िेयता बीमा; 9. िोजखम मूल्यांकन ररपोटध; 10. ऑनसाइट आपातकालीन योिना; 11. आजतिबािी प्रििनध ऑपरेटर और आजतिबािी प्रििधन सहायक के प्रमाण पत्रों की प्रजतयां; 12. आवेिक के पक्ष म ेंिारी साइट पर मगै िीन अनुज्ञजि की प्रजत।"; (ग) क्रम संख्या 25 और उसस े संबंजधत प्रजवजष्टयों के पश् चात, जनम्नजलजखत क्रम संख्या और प्रजवजष्टयां अंतःस्ट्थाजपत की िाएंगी, अथाधत:् - 1 2 3 4 5 6 “26 आजतिबािी प्रििनध 12 एलई-11(क) अपेजक्षत नहीं (i) प्रपत्र एई-11(क); ऑपरेटर या आजतिबािी (ii) पासपोटध साइि फोटोग्राफ की िो प्रििधन सहायक प्रमाण पत्र प्रजतयां; (iii) अनुभव प्रमाण पत्र; (iv) िन्‍दम जतजथ का प्रमाण;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (v) मेजडकल दफटनेस सर्टधदफकेट; (i) प्रििधन के जलए मुख्य जनयंत्रक द्वारा अनुमोदित आजतिबािी का ही प्रििधन के जलए उपयोग दकया िाएगा। (ii) ऐसी आजतिबािी के जवजनमाधण के जलए वैध अनुज्ञजि रखने वाल े व्यजक्तयों स े प्रििनध आजतिबािी खरीिी िाएगी। (iii) आजतिबािी को प्रििधन के जलए ले िाने से पहले दकसी भी िोर् के जलए िजृ ष्टगत रूप से िांच की िाएगी और ऐसी िोर्पूणध आजतिबािी का प्रििधन के जलए उपयोग नहीं दकया िाएगा। 6. प्रििधन उद्दश्े य के जलए आजतिबािी के संयोिन के जलए एक िेड आजतिबािी भंडारण मगै िीन स े न्‍दयूनतम 20 मीटर की िरू ी पर और प्रििनध स्ट्थल से न्‍दयूनतम 100 मीटर की िरू ी पर उपलब्ध कराया िाएगा। 7. आजतिबािी में क्लोरेट या प्रजतबंजधत जवस्ट्फोटक जमश्रण नहीं होना चाजहए। 8. दकसी भी आजतिबािी म ें जलजथयम, एंटीमनी, मकधरी, आसेजनक, लेड और स्ट्रोंजियम क्रोमेट या तत्समय प्रवृि दकसी जवजध के अधीन के तहत प्रजतबंजधत कोई अन्‍दय रसायन नहीं होना चाजहए।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 9. िब हवा की गजत 50 दकलोमीटर प्रजत घंटे से अजधक हो या ििधकों पर जनयंत्रण खो गया हो तो आजतिबािी का कोई प्रििधन नहीं दकया िाएगा। 10.आजतिबािी के संयोिन और प्रििधन के जलए कम से कम व्यजक्तयों को जनयोजित दकया िाएगा। 11.साइट की लगातार जनगरानी की िाएगी और वहां कायधरत व्यजक्तयों को सुरक्षात्मक कपड़े, कान के जलए सुरक्षा उपकरण, सुरक्षा चश्मा और अन्‍दय सुरक्षात्मक उपकरण पहनन ेहोंगे। 12.एक बार आजतिबािी को साइट पर ल ेिाने के बाि, साइट को जबना जनगरानी या असुरजक्षत नहीं छोड़ा िाएगा। 13. दकसी भी टेंट, रेलर, वाहन के कैनवस िल्े टर के 15 मीटर के अंिर या उसके करीब कोई आजतिबािी नहीं िलाई िाएगी। 14.दकसी भी आजतिबािी को दकसी अस्ट्पताल, नर्सिंग होम, जवद्यालय से 250 मीटर के अंिर तब तक नहीं छोड़ा िाएगा िब तक दक स्ट्थानीय प्राजधकाररयों से और उसके माजलक या अजभकताध से सहमजत प्राि न कर ली गई हो। 15.अजग्निमन सेवा अजधकाररयों के परामि ध स े पयाधि अजग्निमन उपकरण, सुजवधाएं और प्राथजमक जचदकत्सा प्रिान की िाएगी। 16.प्रििनध के पश्चात,् अपजिष्ट और अन्‍दय वस्ट्तुओं आदि को सावधानीपूवधक एकजत्रत दकया िाएगा, उन्‍दह ें स्ट्थल से हटा कर दकसी सक्षम प्राजधकारी के पयधवक्षे ण म ेंसम्यक् सावधानी बरतत ेहुए िला कर नष्ट कर दिया िाएगा । 17.अनज्ञु जिधारी, अजधजनयम और उसके अधीन बनाए गए जनयमों का या जिस रूप में वे अन्‍दयथा लाग ू हो, का अनुपालन करेगा। 18. िहां आजतिबािी रखी गई ह,ै उसके 15 मीटर के िायरे म ेंकोई भी जवद्युत तार नहीं लगाया िाएगा। 19.प्रििनध के जलए प्रयुक्त लोह े की माटधरों का आधा जहस्ट्सा भूजम में लगाया िाएगा। एक ही आकार के माटधरों को इस प्रकार समूहबद्ध दकया िाना चाजहए दक वे परस्ट्पर 50 सेंटीमीटर से कम की िरू ी पर न हो । जवजभन्न आकार के माटधरों के समूह परस्ट्पर कम स े कम 10 मीटर िरू ी पर रख े िाने चाजहए। मोटाधर या फ़्रेम को भूजम पर मजबूती स े रटकाया िाएगा। रटप्पण: मोटाधर लगाने स े पहल े उसका जनरीक्षण दकया िाएगा। िोर्पूणध मोटाधर का उपयोग नहीं दकया िाना चाजहए। मोटाधरों को इस तरह रखा िाएगा दक गोल े सुरजक्षत क्षेत्र म ें चलाए िा सकें और आजतिबािी प्रििधन ऑपरेटर/ आजतिबािी प्रििनध सहायक और लोडर को अजधकतम सुरक्षा प्रिान की िा सके। 20. प्रििधन प्रारंभ करने स े पवू ध यह सुजनजश्चत कर जलया िाएगा दक आजतिबािी सरु जक्षत क्षेत्र में िलायी िाए और उसका मलबा भी ऐसे ही क्षेत्र में जगरे । 21.केवल फायर करन े के प्रयोिन के जसवाय कोई भी दियासलाईयां, बजियां या कोई ज्वलनिील या पररसंकटमय प्रकृजत की वस्ट्तु जिससे आग लग सकती हो या जवस्ट्फोट हो सकता हो, अनुज्ञि पररसरों में न तो लाई िाएगी और न रखी िाएगी। 22. प्रििधन के प्रयक्तु माटधरों के जसवाय लोह े या इस्ट्पात के बने औिारों, उपकरणों आदि को दकसी भी समय पररसर म ें नहीं रखा िाएगा और अनज्ञु ि पररसर पर मौिूि दकसी भी व्यजक्त के कब्ि े में अथवा उसके बूटों या िूतों म ें कोई लोहा या इस्ट्पात लगा नहीं होगा। 23. अनुज्ञजिधारी को प्राि, प्रयक्तु तथा उपलब्ध सभी आजतिबािी का ररकाडध और लेखा-िोखा रखना होगा। 24. अनुज्ञजिधारी भडं ारण और प्रििधन के स्ट्थान पर स्ट्थानीय उप-जनयमों का पालन करेगा और िहा ं अपेजक्षत हो, आवश्यक अनुमजत प्राि करेगा।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 25.अनज्ञु जि की समाजि के पश्चात बच े जवस्ट्फोटकों के प्रकार और मात्रा की सूचना अनुज्ञजि प्राजधकारी को िी िाएगी और अनुज्ञजिधारी जवस्ट्फोटकों के जनपटान के संबंध म ेंऐसे प्राजधकारी के जनिेिों का अनपु ालन करेगा। 26.यदि अनुज्ञापन प्राजधकारी अनुज्ञजिधारी को जलजखत सूचना द्वारा ऐसा कोई पररवधनध या पररवतधन करने का जनिेि िेता ह ै िो ऐसे प्राजधकारी की राय में पररसरों या उसमें काम करने वाल े व्यजक्तयों या ििधकों की सुरक्षा के जलए आवश्यक समझे गए ह,ैं तो अनुज्ञजिधारी ऐसे पररवधधन या पररवतधन ऐसी अवजध के भीतर िो जवजहत की िाए, जनष्पादित करेगा। 27. अनुज्ञजिधारी और उसके कमधचारी आपातकाल के िौरान पररसर के भीतर की िान े वाली प्रदक्रया से अवगत होंगे। 28. अनुज्ञजि पररसरों पर जनरीक्षण या नमूना अजधकारी को सभी युजक्तयुक्त समयों पर अवजध पहुचं प्राि होगी और यह सुजनजश्चत करने के जलए ऐस े अजधकारी को प्रत्येक सुजवधा िी िाएगी दक अजधजनयम और जनयमों के उपबंधों का तथा इस अनज्ञु जि की ितों का सम्यक अनुपालन हो रहा ह।ै 29. यदि अनुज्ञापन प्राजधकारी अनुज्ञजिधारक को जलजखत म ें अनुज्ञि पररसर या मिीनरी या औिारों या उपकरण म ें कोई ऐसी मरम्मत पररवधधन या पररवतधन करन े या ऐसी जसफाररिों को पूरा करन े के जलए सूजचत करता ह ै जिसम ें ऐसे प्राजधकारी की राय में उससे अवांछनीय िोजखम पैिा हो सकता और इस प्रकार यह पररसर के बाहर या भीतर या व्यजक्तयों की सुरक्षा के जलए अजत आवश्यक ह ै तो अनुज्ञजिधारी उन जसफाररिों को जनष्पादित करेगा और ऐस े प्राजधकारी द्वारा जवजनर्िधष्ट अवजध के भीतर अनुपालन की ररपोटध िेगा । 30. आग या जवस्ट्फोट से होन े वाली िघु धटनाओं और जवस्ट्फोटकों के नुकसान, कमी या चोरी की सूचना तुरंत जनकटतम पुजलस स्ट्टेिन और अनुज्ञापन प्राजधकारी को िी िाएगी। 31. आजतिबाजी और पायरो टेदक्नक की सामग्री को प्रिर्िधत करन े से पहल े ही मोटाधर म ें लोड दकया िाएगा। आजतिबािी के प्रििनध के िौरान दकसी भी आजतिबािी और आजतिबाजी सामग्री को दफर से लोड नहीं दकया िाएगा। 32. फ़्यूज को इस तरह से दफट दकया िाएगा दक मोटाधर में डाले िान े के बाि फ़्यूज का कम स ेकम 15 सेंटीमीटर खोल स े बाहर जनकल आए। 33. आजतिबाजी के जवफल होने की जस्ट्थजत में, आजतिबाजी िलाने के 30 जमनट बाि तक दकसी भी व्यजक्त को प्रििधन स्ट्थल तक नहीं पहुचं ना चाजहए और न ही आने दिया िाना चाजहए। 34. अनुज्ञजि प्राजधकारी की िेखरेख म ें साइट पर आपातकालीन योिना की तैयारी का आकलन करन े के जलए आजतिबािी के वास्ट्तजवक प्रििधन से कम से कम िो दिन पहले मॉक जड्रल आयोजित की िाएगी। 35. अनुज्ञजिधारी द्वारा आजतिबाजी प्रििधन के संचालन के जलए जनयुक्त व्यजक्तयों की आसान पहचान के जलए फ्लोरेसेंट जस्ट्रप्स के साथ जवजिष्ट रंग की िैकेट पहननी होगी और उनके पास अनज्ञु जिधारी द्वारा िारी दकए गए पहचान पत्र होंगे। अनुज्ञापन प्राजधकारी के हस्ट्ताक्षर, अनुज्ञापन प्राजधकारी का पिनाम और सील (जिला मजिस्ट्रेट)"; (ii) प्रपत्र एलई-11 केपश्चात, जनम्नजलजखत प्रपत्र अंतः स्ट्थाजपत दकया िाएगा, अथाधत: - " प्रपत्र एलई-11(क) आजतिबािी प्रििनध ऑपरेटर / आजतिबािी प्रििनध सहायक प्रमाणपत्र[भाग II—खण् ड 3(i)] भारत का रािपत्र : (1) These rules may be called the Explosives (Amendment) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Explosives Rules, 2008 (hereinafter referred to as the said rules), in rule 2:- a. in clause (11) after the words “Chief Controller” the words "or Controller” shall be inserted; b. after clause (18), the following clause shall be inserted, namely:- '(18A) "discharge site" means the area immediately surrounding the fireworks used for an outdoor display of fireworks’; c. for clause (19), the following clause shall be substituted, namely:- '(19) "display fireworks" means a group of manufactured fireworks to be assembled at site for fireworks display to produce visible or audible effects or both’; d. for clause (24A) the following clause shall be substituted, namely:- '(24A) "aerial fireworks" means low hazard explosives, with a lifting charge and an aerial function charge to cause sound, multiple sounds, light, colour and any pyro technique effect or combination of various effects in an assembled form ready to use at site, including shells and rocket, but not including fireworks item whose contrivances is of diameter less than one inch or height less than six inch’; e. after clause (25A), the following clauses shall be inserted, namely:- '(25B) "fireworks display assistant" means a person recognised by the Chief Controller or Controller, to assist the fireworks display operator for the purpose of setting up of the equipments of fireworks, loading mortars, igniting the fireworks and cleaning the discharge site’; '(25C) " fireworks display operator" means a person recognised by the Chief Controller or Controller who is responsible for the operations and safety of fireworks display’; f. after clause (30), the following clause shall be inserted, namely:-14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ‘(30A) "loader" means an assistant who loads aerial shells and other fireworks display items’; g. after clause (35), the following clause shall be inserted, namely:- '(35A) "monitor" means a person who controls or prevents any unauthorised person from entering into the discharge site of display fireworks’; 3. In rule 10 of the said rules, in sub-rule (6), after the words “system or devices", the words “except barcode readers loaded with system for explosives tracking and tracing software developed by the Central Government” shall be inserted. 4. For rule 24 of the said rules, a. for sub-rule (1), the following sub-rule shall be substituted, namely:- "(1) Every person or organisation or company holding a licence under these rules for manufacture, possession, sale, use or transport of explosives shall maintain records in the forms specified in Part 5 of Schedule V and shall produce such records on demand to the authority specified in the Table under sub-rule (1) of rule 128.”; b. for sub-rule (3), the following sub-rule shall be substituted, namely:- "(3) The licensee shall submit quarterly returns of explosives (other than fireworks) manufactured, received, sold or transferred or used or destroyed or imported or exported to the Controller and District Magistrate in the online system for explosives tracking and tracing developed by the Central Government within ten days of every succeeding quarter.”; 5. In rule 51 ofthe said rules, in sub-rule (2), for the proviso, the following proviso shall be substituted, namely:- “Provided that if the explosive to be transported is of class 2, the quantity shall not exceed twenty tonnes or the maximum carrying capacity of the van, whichever is less and the design of such van shall be approved by the Chief Controller or Controller and be manufactured by the fabricator recognised by the Chief Controller.” 6. In rule 66 of the said rules, in the proviso after the words “kilograms of fireworks", the words “or one thousand kilograms of safety fuse or combination thereof shall be inserted. 7. In rule 74 of the said rules, after sub-rule (3), the following sub-rule shall be inserted, namely:- "(4) In case of magazines attached to manufacturing unit the total storage capacity shall not be less than the per day manufacturing capacity of that class of explosives licensed for manufacturing." 8. In rule 102 of the said rules, in sub-rule (2), in clause (b), after the words “the same", the words “provided that the existing safety distance shall not be encroached” shall be inserted. 9. In rule 103 of the said rules, in sub-rule (7), for the word “six", the words “three" shall be substituted. 10. In rule 107 of the said rules, after sub-rule (6), the following sub-rule shall be inserted, namely:- "(6A) In case of application for grant of fireworks display operator or fireworks display assistant certificate, the Chief Controller or Controller on receipt of documents specified in item number (26) of rule 113 and the fee as specified for Foreman’s certificate shall conduct such examination and enquiries as deemed necessary before granting the certificate. (6B) The licensing authority on being satisfied that the applicant has adequate knowledge and experience in related field of display fireworks, he shall grant the certificate in Form LE-11(A).[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15 (6C) The certificate granted under sub-rule (6B )shall be valid for a period of five years from the date of issue. (6D) The certificate on its expiry may be renewed for a period of five year on receipt of an application and documents in application form AE-11(A) and completion of procedures as in the case of grant of certificate". 11. in rule 113 of the said rules, in the Table, a. in the entries against serial number 1, in column 2, after the word "fireworks or gunpowder or both", the words "excluding aerial and display fireworks items" shall be inserted; b. in the entries against serial number 20- i. in column 2, for the entries, the following entries shall be substituted, namely:- "Licence to possess and use fireworks for public display not exceeding two thousand kilograms "; ii. in column 6, for the entries, the following entries shall be substituted, namely:— 1. "Form AE-6; 2. Site plan showing dimensions of the discharge site, spectator viewing area, parking area, the safe area, egress path, associated separation distances and structures within two hundred fifty meters radius from the edge of display facility; 3. Date and time at which the public display is to be held; 4. The types of fireworks to be used in display; 5. Name, address and licence number of the supplier of fireworks for use in display; 6. Passport size photograph of the occupier along with documentary evidence of nomination as occupier as per rule 2; 7. Fee as per sub-rule (6A) of rule 107; 8. Public liability insurance; 9. Risk assessment report; 10. Onsite emergency plan; 11. Copies of the certificate of Fireworks Display Operator and Fireworks Display Assistant; 12. CONDITIONS 1. The licensee shall intimate the licensing authority fifteen days before conducting fireworks display: a. Readiness of the site and his preparedness b. Names, addresses and contact number of fireworks display operators, fireworks display assistants, monitors and loaders. 2. The display fireworks shall be stored in a licensed magazine and displayed only at the places shown in the plan attached to the licence. The magazine shall be at least two hundred meters away from the display site. 3. (i) Display fireworks shall be brought and kept in magazine well in advance. (ii) Samples of display fireworks shall be drawn by the licensing authority and sent to Chemical Examiner’s Laboratory of the State Government for analysis to detect the use of prohibited chemicals in manufacture of display fireworks. 4. A minimum distance of one hundred meter shall be maintained between the spectators and the area where the display is carried out by effective barricading. 5. (i) Only fireworks approved by Chief Controller for display shall be used for display. (ii) Display fireworks shall be procured from person holding valid licence granted to manufacture such fireworks.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 19 (iii) Fireworks before being taken for display shall be examined and defective fireworks shall not be used for display. 6. A shed for assembling of the fireworks for display purpose shall be at a distance of min twenty meters from fireworks storage magazine and minimum onehundred meters from the display site. 7. No fireworks shall contain chlorate or prohibited explosives mixture. 8. No fireworks shall contain antimony, lithium, mercury, arsenic, lead and strontium chromate or any other chemicals prohibited under law for time being in force. 9. No display of fireworks shall be carried out when the wind velocity exceeds 50 kilometer per hour or the control over spectators has been lost. 10. Only minimum persons shall be employed for assembling and display of fireworks. 11. The site shall be constantly supervised and the persons employed shall wear protective clothes, ear defenders, safety glasses and other protective devices. 12. Once fireworks taken to the site, the site shall not be left unattended or unprotected. 13. No fireworks shall be ignited inside of or closer than 15 meters of any tent, trailer, canvas shelter of vehicle. 14. No fireworks shall be ignited within 250 meters of a hospital, nursing home, schools unless consent from local authorities and the owner or its agent is obtained. 15. Adequate firefighting equipments, facilities and first-aids shall be provided in consultation with the fire service authorities. 16. After the display, the wastes and remnants shall be carefully collected, removed from the site and destroyed by burning under supervision of a competent person, taking due precautions. 17. The licensee shall follow the provisions of the Act and these rules made there under as otherwise applicable. 18. No electrical wire shall be allowed within 15meter of the area where the fireworks are laid down. 19. Half the length of the iron mortars used for display shall be buried in the ground. The mortars of the same size shall be grouped and spaced not less than 50cm apart. Groups of different size mortars shall be placed at least 10 meter apart. The mortars or frames shall be securely anchored to the ground. Note: Mortars shall be inspected prior to placement. Defective mortars shall not be used. Mortars shall be positioned and spaced so that shells are propelled over the safe area and to afford maximum protection to the Fireworks Display Operator/ Fireworks Display Assistant and the loader. 20. Before starting the display it shall be ensured that the fireworks explode and the debris fall in the safe area. 21. No matches, lights or any article of flammable or hazardous nature liable to cause fire or explosion shall be brought or kept in the licensed premises except for firing purpose only. 22. No tools, implements etc. made of iron or steel except mortars used for display shall be kept at any time in the premises and not person on the licensed premises shall have any iron or steel in his possession or on his boots or shoes. 23. The licensee shall keep records and accounts of all fireworks received, used and stock on hand. 24. The licensee shall follow the local bye-laws at the place of storage and display and obtain necessary permission whenever required. 25. The kinds and quantities of explosives remaining after the expiry of licence shall be intimated to the licensing authority and the licensee shall abide by the instructions of such authority regarding disposal of explosives. 26. If the licensing authority directs the licensee by notice in writing to make any additions or alterations, which, in the opinion of such authority, is considered necessary for the safety, of the20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] premises or of the person working therein or the spectators the licensee shall execute such additions or alterations within such period as may be specified. 27. The licensee and the employee shall be conversant with procedure to be taken during the emergency within the premises. 28. Free access to the licensed premises shall be given at all reasonable times to any inspecting or sampling officer and every facility shall be provided to the officer for ascertaining that the provisions of the Act, these rules and the conditions are complied with. 29. If the licensing authority informs in writing, the holder of the licence to execute any repairs or to make any additions or alterations to the licensed premises or machinery, tools or apparatus or carry out recommendations, which are in the opinion of such authority may pose unacceptable risk and so necessary for the safety of either on-site or off-site of the premises or persons, the holder of the licence shall execute the recommendations and report compliance within the period specified by such authority. 30. Accidents by fire or explosion and losses, shortage or theft of explosives shall be immediately reported to the nearest police station and the licensing authority. 31. Fireworks and pyrotechnic materials shall be loaded into mortars only prior to display. There shall be no reloading of any fireworks and pyrotechnic materials during fireworks display. 32. The fuse shall be fitted in such a way that minimum 15 centimeter of the fuse protrudes out of the shell after it has been inserted into mortar. 33. In the event of misfire of fireworks, no person shall approach or be permitted to approach the display site until 30 minutes after igniting the fireworks. 34. Mock drill shall be conducted at least two days prior to the actual display of fireworks, to assess the preparedness of the onsite emergency plan under the supervision of the licensing authority. 35. The persons engaged by the licensee for conducting of fireworks display shall wear distinct colour jacket with fluorescent strips for easy identification and shall have identity cards issued by the licensee. Accidents by fire or explosion and losses, shortage or theft of explosives shall be immediately reported to licensee, the nearest police station and the licensing authority having jurisdiction over the area."; (c) in Part 4,- (i) in SET-I, after condition (25), the following condition shall be inserted, namely:- "(25A) No fireworks shall contain lithium, antimony, mercury, arsenic, leadand strontium chromate or any other prohibited chemicals"; (ii) in SET-II,- 1. in condition 24A for the word " Concrete ", the word “Wooden " shall be substituted; 2. after condition (31), the following condition shall be inserted, namely:- "(31A) No fireworks shall contain lithium, antimony, mercury, arsenic, lead and strontium chromate or any other prohibited chemicals;" 3. after condition (66), the followisng condition shall be inserted, namely:- "(66A) No fireworks shall contain lithium, antimony, mercury, arsenic, lead and strontium chromate or any other prohibited chemicals;” (iii) in SET-IX, after condition (3), the following condition shall be inserted, namely:- "(3A) No fireworks shall contain lithium, antimony, mercury, arsenic, lead and strontium chromate or any other prohibited chemicals;” (iv) in SET-XI, after condition (10), the following condition shall be inserted, namely:- "(10A) No fireworks shall contain lithium, antimony, mercury, arsenic, lead and strontium chromate or any other prohibited chemicals;". 14. In Schedule VII of the said rules, in specification 3 , in serial number (1), in the sub- heading ‘B. Manufacturing/Process Sheds’, for the item 'c', following shall be substituted, namely:-22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] "c. The roof shall be of cement sheets or 10 centimeters thick reinforced cement concrete;". 15. In Schedule VII of the said rules, in specification 3 , in serial number 1, in the sub- heading ‘F. Raw material Store, for the item 'c', following shall be substituted, namely:- "c. Dedicated charcoal room and oxidiser's rooms shall be provided 3 meters in between safety distance;". [F.
