(iv) जनयम 6 के स्ट्थान पर जनम्नजलजखत जनयम रखा िाएगा, अथाात :- “6. यात्रा भत्ता.-(1) अध्यक्ष और कोई पणू ाकाजलक सिस्ट्य जनयुजि पर, (क) प्राजधकरण म ें पिभार ग्रहण करन े के जलए जनिास स्ट्थान स े यात्रा करन े और प्राजधकरण के साथ अिजध की समाजप्त पर, पररिार के साथ गृह नगर की यात्रा करन े के हकिार होंग े (पररिार द्वारा की गई यात्रा के संबंध म ें सजहत); और (ख) भारत के भीतर और बाहर िौरे या प्रजिक्षण पर यात्रा भत्ता, िैजनक भत्ता और व्यजिगत प्रभािों के पररिहन पर खचा की प्रजतपूर्त ा के उसी िेतनमान और िरों पर हकिार होंग,े िो दक क्रमिः भारत सरकार के सजचि और अपर सजचि पर लाग ू होते ह।ैं ”; (v) जनयम 7 के स्ट्थान पर जनम्नजलजखत जनयम रखा िाएगा, अथाात :- "7. आिास.- अध्यक्ष और दकसी पूणाकाजलक सिस्ट्य को जनिास के जलए कोई घर आिंरित नहीं दकया िाएगा।”; (vi) जनयम 9 के स्ट्थान पर जनम्नजलजखत जनयम रखा िाएगा, अथाात :- 9. जचदकत्सा सहायता. - अध्यक्ष और कोई पणू ाकाजलक सिस्ट्य प्राजधकरण के साथ कायका ाल के िौरान ऐसी जचदकत्सा सहायता का हकिार होगा िो प्राजधकरण द्वारा तय दकया िाए: परंत ु यदि अध्यक्ष या पूणाकाजलक सिस्ट्य सरकारी सेिा स े या सािािजनक क्षत्रे की इकाई या दकसी केंद्रीय या राज्य अजधजनयम द्वारा स्ट्थाजपत जनगजमत जनकाय की सेिा स े सेिाजनिृत्त हो गया ह ै जिसम ें ऐसी सेिा के जलए जचदकत्सा सहायता के अनुिान के जलए जनयमों का एक अलग सेि ह,ै िह, ऐसे जनयमों द्वारा िाजसत होन े का जिकल्प चुन सकता ह।ै ”; (vii) जनयम 10 का लोप दकया िाएगा; (viii) जनयम 11 के स्ट्थ ान पर जनम्न जलजखत जनयम रखा िाएगा, अथाात्: 11. छुट्टी और छुट्टी नकिीकरण – (1) छुट्टी स्ट्िीकृत करने के जलए सक्षम प्राजधकारी अध्यक्ष के संबधं म ें केंद्रीय सरकार होगी और पूणाकाजलक सिस्ट्य के संबंध म ें अध्यक्ष होगा। (2) अध्यक्ष अथिा पणू ाकाजलक सिस्ट्य प्रत्येक सेिा िर्ा के जलए तीस दिनों की अर्िात छुट्टी प्राप्त करन े का हकिार होगा: परंतु छुट्टी खाते म ें प्रत्येक कैलेंडर िर्ा म ें प्रत् यके 1 िनिरी और 1 िुलाई को अजग्रम म ें पंद्रह दिनों की िो दकस्ट् तों म ें अर्िात छुट्टी डाली िाएगी: परंतु और यह दक जपछले छमाही िर्ा के अंत म ें िमा अर्िात छुट्टी को अगले छमाही िर्ा के जलए आगे बढाया िाएगा। (3) छुट्टी के िौरान छुट्टी िेतन का भगु तान केंद्रीय जसजिल सिे ा (छुट्टी) जनयम, 1972 के जनयम 40 के उपबंधों के द्वारा िाजसत होगा। (4) अध्यक्ष और पणू ाकाजलक सिस्ट्य दकसी भी समय अपन े खाते म ें अर्िात छुट्टी का पचास प्रजतित भाग का नकिीकरण करने हते ु हकिार होगा, इस िता के अध् यधीन दक नकिीकरण की अनुमजत दकसी कैलेंडर िर्ा के िौरान अजधकतम बारह दिनों के जलए केिल एक बार िी िाएगी।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (5) अध्यक्ष और पूणाकाजलक सिस्ट्य दकसी कैलडें र िर्ा म ेंआठ दिनों की आकजस्ट्मक छुट्टी के हकिार होंगे। (6) अध्यक्ष और पणू ाकाजलक सिस्ट्य सेिा के प्रत्येक पणू ा िर् ा के संबंध म ें बीस दिनों की िर स े जचदकत्सा प्रमाण पत्र या जनिी मामलों पर अधा िेतन छुट्टी के हकिार होंग,े प्रत्येक कैलेंडर िर्ा की 1 िनिरी और 1 िुलाई को िस दिनों की िो दकश्तों म ें अजग्रम म ेंिमा की िाएगी और अर्िात छुट्टी के िौरान अध ा िेतन के जलए छुट्टी का िेतन स्ट्िीकाय ा छुट्टी िेतन का आधा होगा। (7) आधे िेतन पर छुट्टी को अध्यक्ष या पूणाकाजलक सिस्ट्य के जििेक पर पूणा िेतन छुट्टी म ें पररिर्तात दकया िा सकता ह,ै यदि जचदकत्सा आधार पर जलया िाता ह ैऔर सक्षम जचदकत्सा प्राजधकारी द्वारा जचदकत्सा प्रमाण पत्र द्वारा समर्थात ह।ै (ix) जनयम 12 के स्ट्थ ान पर, जनम्नजलजखत जनयम रखा िाएगा, अथाात:् - “12. छुट्टी यात्रा ररयायत—छुट्टी यात्रा ररयायत भारत सरकार के सजचि और भारत सरकार के अपर सजचि पर लाग ू उपबंधों के अनुसार अध्यक्ष और पूणाकाजलक सिस्ट्य के जलए क्रमिः स्ट्िीकाय ा होगी.”; (x) जनयम 13 म,ें उप-जनयम (5) के स्ट् थान पर, जनम्नजलजखत उप-जनयम रखा िाएगा, अथाात:् — “(5) एक अंिकाजलक सिस्ट्य उसके द्वारा प्राजधकरण की बैठक म ें भाग लेन े के जलए प्रजत दिन छह हिार रुपय े के बैठक फीस के रूप म ेंभत्ता प्राप्त करन ेका अजधकार होगा: परंतु इस तरह के बैठक फीस की हकिारी प्राजधकरण की िस स े अजधक बैठकों तक सीजमत नहीं होगी, जिसम ें एक मास म ें अंिकाजलक सिस्ट्य द्वारा भाग जलया िाएगा। (xi) जनयम 14 के स्ट्थ ान पर, जनम्नजलजखत को रखा िाएगा, अथाात् :- “14. सेिा के अन्य जनबंधन एिं ितें. — (1) अध्यक्ष और एक पूणाकाजलक सिस्ट्य अपन े कायाालय के कायों के जनष्पािन म ें जहतों के िकराि की अनुपजस्ट्थजत सुजनजित करेगा और उसके पास ऐसा कोई जित्तीय या अन्य जहत नहीं होगा िो उसके कायाालय के कायों के जनष्पािन को पूिााग्रह स ेप्रभाजित करने की संभािना ह।ै (2) इन जनयमों, जसजिल सेिा (आचरण) जनयम, 1964 और केन्द्रीय जसजिल सेिा (िगीकरण, जनयंत्रण और अपील) जनयम, 1965 के अधीन अजभव् यक्त रूप स े उपबंजधत सेिाओं के अलािा अन्य सेिा ित ें ऐसी होंगी िैसी केंद्रीय सरकार के अजधकाररयों, अध्यक्ष के मामले म ें भारत सरकार के सजचि के स्ट्तर पर और पूणका ाजलक सिस्ट्य के मामल े म ें भारत सरकार के अपर सजचि पर लाग ू होती ह।ै (3) अध्यक्ष और पणू ाकाजलक सिस्ट्य प्राजधकरण की बैठकों म ें भाग लने े के जलए दकसी भी बैठक फीस के हकिार नहीं होंगे। [फा. स.ं आर-16012/02/2021-बीमा.I] सौरभ जमश्रा, संयुि सजचि रिप्पणी : मूल जनयम, भारत के रािपत्र, असाधारण, भाग-II, खंड 3, उपखंड (i) म ें अजधसूचना संखयांक सा.का.जन. स.ं 841(अ) तारीख 25 अिूबर, 2000 द्वारा प्रकाजित दकए गए थ े और तत्पिात ् अजधसूचना संख यांक सा.का.जन. स.ं 827(अ) तारीख 1 दिसंबर, 2008, सा.का.जन. स.ं 307(अ) तारीख 19 अप्रैल, 2012, सा.का.जन. स.ं 269(अ) तारीख 4 अप्रलै , 2014 और सा.का.जन. स.ं 580(अ) तारीख 24 िलु ाई, 2015 द्वारा िुजिपत्र द्वारा संिोजधत दकए गए थे। MINISTRY OF FINANCE (Department of Financial Services) NOTIFICATION New Delhi, the 21st June, 2022 G.S.R. 461(E). —In exercise of the powers conferred by sub-section (1) and clauses (a) and (b) of sub-section (2) of section 24 of the Insurance Regulatory and Development Authority of India Act, 1999 (41 of 1999), the Central Government hereby makes the following rules further to amend the Insurance Regulatory and Development Authority (Salary and Allowances payable to, and other terms and conditions of service of Chairperson and other members) Rules, 2000, namely: — 1. Short title and commencement. — (1) These rules may be called the Insurance Regulatory and Development Authority (Salary and Allowances payable to, and other terms and conditions of service of Chairperson and other members) Amendment Rules, 2022.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Insurance Regulatory and Development Authority (Salary and Allowances payable to, and other terms and conditions of service of Chairperson and other members) Rules, 2000, — (i) for rule 3, the following rule shall be substituted, namely: — “3. Pay. — (1) The Chairperson shall receive a consolidated salary of rupees four lakh fifty thousand per month, without the facility of house and car. (2) A whole-time member shall receive a consolidated salary of rupees four lakh per month, without the facility of house and car.”; (ii) for rule 4, the following rule shall be substituted, namely: — “4. Provident fund, gratuity and pension. — (1) The Chairperson and a whole-time member shall be eligible to contribute to provident fund of the Authority and the manner and terms and conditions applicable in this regard shall, mutatis mutandis, be the same as those applicable to other employees of the Authority under regulations made by the Authority for their provident fund. (2) The Chairperson and a whole-time member shall not be entitled to payment of pension or gratuity or any post-retirement allowance or benefit for service rendered in the Authority.”; (iii) rule 5 shall be omitted; (iv) for rule 6, the following rule shall be substituted, namely: — “6. Travelling Allowance.—(1) The Chairperson and a whole-time member at the time of appointment, shall, (a) be entitled to travel from place of residence to join the Authority and on the expiry of the term with the Authority, to travel to home town with family (including in respect of journey undertaken by family); and (b) on tour or training within and outside India, be entitled to journey allowance, daily allowance and reimbursement of expense on transportation of personal effects at the same scales and rates as are applicable to Secretary and Additional Secretary to the Government of India, respectively.”; (v) for rule 7, the following rule shall be substituted, namely: — “7. Accommodation. —The Chairperson and a whole-time member shall not be alloted any house for residence.”; (vi) for rule 9, the following rule shall be substituted, namely: — “9. Medical assistance. —The Chairperson and a whole-time member during tenure with the Authority shall be entitled to such medical assistance as may be decided by the Authority: Provided that if the Chairperson or a whole-time member has retired from Government service or from the service of a public sector entity or a body corporate established by a Central or State Act which has a separate set of rules for the grant of medical assistance for such service, he may, opt to be governed by such rules.”; (vii) rule 10 shall be omitted; (viii) for rule 11, the following rule shall be substituted, namely: — “11. Leave and leave encashment. — (1) The authority competent to sanction leave shall be the Central Government in respect of the Chairperson, and the Chairperson in respect of a whole-time member. (2) A Chairperson and a whole-time member shall be entitled to thirty days of earned leave for every year of service: Provided that the leave account shall be credited with earned leave in advance in two instalments of fifteen days each, on 1st January and 1st July of every calendar year: Provided further that the earned leave at the credit at the close of previous half year shall be carried forward to the next half year. (3) The payment of leave salary during the leave shall be governed by the provisions of rule 40 of the Central Civil Services (Leave) Rules, 1972.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (4) The Chairperson and a whole-time member shall be entitled to encashment of fifty percent of earned leave to his credit at any time, subject to the condition that encashment shall be permitted only once during any calendar year for a maximum of twelve days in a calendar year. (5) The Chairperson and a whole-time member shall be entitled to eight days casual leave in a calendar year. (6) The Chairperson and a whole-time member shall be entitled to half pay leave on medical certificate or on private affairs at the rate of twenty days in respect of each complete year of service, to be credited in advance in two instalments of ten days each, on 1st January and 1st July, of every calendar year and leave salary for half pay shall be equivalent to half of the leave salary admissible during the earned leave. (7) Leave on half pay may be commuted to full pay leave at the discretion of the Chairperson or a whole-time member, if is taken on medical grounds and is supported by a medical certificate by competent medical authority.”; (ix) for rule 12, the following rule shall be substituted, namely: - “12. Leave travel concession. —Leave travel concession shall be admissible to the Chairperson and a whole-time member in accordance with the provisions applicable to Secretary to Government of India, and Additional Secretary to Government of India, respectively.”; (x) in rule 13, for sub-rule (5), the following sub-rule shall be substituted, namely: — “(5) A part-time member shall be entitled to receive an allowance by way of sitting fee of rupees six thousand per day, for attending meeting of the Authority by him: Provided that the entitlement to such sitting fee shall be restricted to not more than ten meetings of the Authority attended by the part-time member in a month.”; (xi) for rule 14, the following shall be substituted, namely:- “14. Other terms and conditions of service. — (1) The Chairperson and a whole-time member shall ensure absence of conflict of interest in the performance of the functions of his office and shall not have any such financial or other interests as are likely to prejudicially affect the performance of the functions of his office. (2) Service conditions other than those expressly provided for under these rules, the Civil Service (Conduct) Rules, 1964 and the Central Civil Services (Classification, Control. and Appeal) Rules, 1965 shall be such as are applicable to officers of the Central Government, at the level of Secretary to Government of India, in the case of the Chairperson, and Additional Secretary to Government of India, in the case of a whole-time member.
