और प्रारूप जनयमों के संबंध म ें िनता स े प्राप्त आक्षेपों और सझु ािों पर केंद्रीय सरकार द्वारा सम्यक रूप स े जिचार दकया गया ह;ै अत: अब केंद्रीय सरकार, पेरोजलयम अजधजनयम, 1934 (1934 का 30) की धारा 4, धारा 5, धारा 14, धारा 21, धारा 22 और धारा 29 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, परे ोजलयम जनयम, 2002 म ें और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती ह,ै अथाचत्: - 1. संजक्षप् त नाम और प्रारंभ – (1) इन जनयमों का संजक्षप्त नाम पेरोजलयम (संिोधन) जनयम, 2024 ह।ै (2) य ेरािपत्र म ें उनके प्रकािन की तारीख स े प्रिृत् त होंगे। 2. पेरोजलयम जनयम, 2002 म,ें- 1470 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (i) जनयम 2 म,ें उप जनयम (1) म,ें- (क) खडं (xiv) के पश्चात ् जनम्नजलजखत खडं अंत:स्ट्थाजपत दकए िाएंग,े अथाचत ् :- “(xivक) “भारी मिीनरी” स े हिै ी ड्यूटी मिीनरी, जनमाणच काय च या कृजि काय च या जििुद्धत: रािमागच के अलािा जनमाचण काय च करने के जलए जििेि रूप स े जडिाइन दकए गए या सड़क नेटिकच स े जभन्न पररसर, कारखाना, पत्तन या खान के भीतर उपयोग हते ु जडिाइन और अपनाए गए ऐस े जलफ्टंग उपस्ट्कर यान अजभप्रेत ह ै िो अपनी ऊिा च स े सािचिजनक सड़कों पर यात्रा के जलए सजित नहीं हो। (xivख) "भारी यान" स े कृजि, खनन, औद्योजगक उपक्रम, फसंचाई और जनमाचण सजहत जिजभन्न क्षेत्रीय कायों के जलए उपयुक्त उपकरणों के साथ जडिाइन दकए गए यान "ऑन या ऑफ" के साथ उपांतररत और जिजनर्मचत या "ऑन और ऑफ" रािमाग च क्षमताओं के साथ और एक गैर-पररिहन, गरै -माल या गैर-यात्री यान अजभप्रेत ह;ैस्ट्पष्टीकरण: इस खण्ड के प्रयोिन के जलए, "भारी यान" म ेंमोटर यान अजधजनयम, 1988 म ें पररभाजित रैक्टर सजम्मजलत नहीं ह’ै; (ख) खडं (xxvi) के पश्चात ्जनम्नजलजखत खडं अंत:स्ट्थाजपत दकए िाएंग,े अथाचत ् :- "(xviक) "आईएसओ टैंक कंटेनर" स े पेरोजलयम फ्रेट कंटेनर अजभप्रेत ह,ै िो आईएसओ टैंक कंटेनर ढांच े पर लगाया गया हो, िो जविस्ट्टर लॉक द्वारा सुरजक्षत हो, िो तरल पेरोजलयम की ढुलाई के जलए उपयक्तु हो, जिसे सड़क माग,च रेल या समुद्र माग च पर चलाया िा सकता हो, जिसम ें पररिहन के इन रूपों के बीच एक माग च से िसू रे पर िाना सजम्मजलत हो, जिस े पररिहन के जलए गरुु त्िाकिचण या िबाि जनिचहन द्वारा लोड या अनलोड दकया िा सकता ह ै और िो मुखय जनयंत्रक या जनयंत्रक द्वारा स्ट्िीकार दकए गए राष्ट्रीय या अंतरराष्ट्रीय मानकों के अनुसार जडिाइन, जिजनिेिों और परीक्षण, अंकन के अनुरूप हो; "(xvi ख) "आईएसओ टैंक कंटेनर फ्रेमिकच" स े ऐसी टैंक माउंटटंग अजभप्रेत ह,ै िो अंजतम संरचना और सभी भार िहन करन े िाल े तत्ि िो कागो रखने के प्रयोिनों के जलए उपजस्ट्थत नहीं ह,ैं िो समग्र रूप स े टैंक कंटेनर को उठान,े संभालन,े सुरजक्षत करने और पररिहन स े उत्पन्न होने िाली स्ट्थैजतक और गजतिील िजक्तयों को संचाररत करते ह ैं और मुखय जनयंत्रक या जनयंत्रक द्वारा स्ट्िीकृत राष्ट्रीय या अंतरराष्ट्रीय मानकों के अनुसार जडिाइन, जिजनिेिों और परीक्षण के अनुरूप ह;ैं (ग) खंड(xxiv) म,ें िब्ि "प्रयोिनों" के बाि, "चौथी अनुसूची म ें यथा-पररभाजित सर्िचस स्ट्टेिन के खतरनाक क्षेत्रों की सीमा के बाहर स्ट्थाजपत गैर-ईंधन सुजिधाएं भी िाजमल ह"ैं िब्िों को अंत:स्ट्थाजपत दकया िाएगा; (घ) खंड(xxvi) म,ें "पेरोजलयम" िब्ि के पश्चात,् "आईएसओ टैंक कंटेनर सजहत" िब्ि अंत:स्ट्थाजपत दकए िाएंग;े (ड.) खंड(xxxiii) के पश्चात,् जनम्नजलजखत खडं अंत:स्ट्थाजपत दकए िाएंगे अथाचत:् - "(xxxiii) (क) "तृतीय पक्षकार जनरीक्षण अजभकरण (टीपीआईए)" स े खतरनाक रसायनों के जिजनमाचण, भडं ारण और आयात जनयम, 1989 के अधीन यथापररभाजित बड़ी िघु चटना के खतरों िाल े पररसर के सुरक्षा ऑजडट सजहत इन जनयमों के अधीन परीक्षण और प्रमाणन करने के जलए मुखय जनयंत्रक या जनयंत्रक द्वारा मान्यता प्राप्त व्यािसाजयक संगठन और सक्षम व्यजक्तयों के जलए यथा-लागू अहतच ा और अनुभि िाले व्यजक्त अजभप्रते ह।ै (ii) जनयम 4 म,ें उप जनयम (3) के पश्चात ् जनम्न जलजखत अंत:स्ट्थ ाजपत दकया िाएगा, अथाचत :- “(4) इन जनयमों म ें कुछ भी अनुसंधान और जिकास के जलए परे ोजलयम युक्त कंटेनरों के आयात के जलए लाग ू नहीं होगा परंत ु इनकी पैककंग समय-समय पर यथा-संिोजधत अंतरराष्ट्रीय िाय ु पररिहन सघं के खतरनाक माल संबंधी जिजनयमों के अनुरूप हो"; (iii) जनयम 8 म,ें -(क) उप जनयम (1) म ें िब् ि “इस प्रकार मरम् मत दकए िान े िाले” “अथिा टीपीआईए” स े प्रजतस्ट् थाजपत दकया िाएगा; (ख) उप जनयम (2) के पश्चात,् जनम्नजलजखत उप जनयम अतं :स्ट् थाजपत दकया िाएगा, अथाचत् :- "(3) परीक्षण और प्रमाणन के जलए फीस पहली अनुसूची के भाग ख म ें यथाजिजनर्िचष्ट होगी"; (iv) जनयम 13 म,ें - (क) उप जनयम (1) म,ें ‘’मखु य जिस्ट्फोटक जनयंत्रक, नागपरु के पक्ष म ें जलख े गए क्रास दकए गए बैंक ड्रा्ट द्वारा या ई-संिाय के माध्यम स’े’ िब्िों के स्ट्थान पर ‘’ई’संिाय के माध्यम स े या गैर-कर प्राजप्त पोटचल के माध्यम स’े’ िब्िों को रखा िाएगा ; (ख) उप जनयम (2) का लोप दकया िाएगा। (v) जनयम 14 के पश्चात् जनम्न जलजखत जनयम अतं :स्ट्थ ाजपत दकया िाएगा, अथाचत ् :-[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 “14(क) आईएसओ टैंक कंटेनरों के आयात और पररिहन पर जनबधं न- (1) कोई भी व्यजक्त मुखय जनयंत्रक या जनयंत्रक स े आयात की अनुज्ञा प्राप्त दकए जबना पेरोजलयम स े भरे हुए अथिा भरे िान े के जलए आिजयत दकसी भी आईएसओ टैंक कंटेनर का आयात नहीं करेगा। (2) उप जनयम (1) के अधीन आयात अनुज्ञा की िांछा करन े िाला कोई भी व्यजक्त जनम्नजलजखत िस्ट्तािेिों के साथ मुखय जनयंत्रक या जनयंत्रक को प्ररूप 8 (क) म ेंआिेिन प्रस्ट् तुत करेगा, अथाचत् - (क) आईएसओ टैंक कंटेनर की परू ी सामग्री को समायोजित करन े की पयाचप्त क्षमता सजहत प्ररूप 15 म ें िारी जिजधमान्य अनुज्ञजप्त की एक प्रजत; (ख) जनमाचता की जनरीक्षण, परीक्षण ररपोटच और जडिाइन जचत्र की िो प्रजतयां जिसम ें जडिाइन के ब् यौरे, टैंक की पानी की क्षमता, इसकी दफटटंग और आईएसओ टैंक कंटेनर के जनमाचण की सामग्री के जिजनिेिनों के जििरण दिखाए गए हों, िो मूल ििे की सक्षम अजभकरण द्वारा जिजधित समर्थचत हों; (ग) मलू ििे की सक्षम अजभकरण द्वारा िारी हाइड्रोटेस्ट्ट प्रमाण पत्र और कंटेनर सुरक्षा प्रमाण पत्र (सीएससी) सजहत आिजधक जनरीक्षण और िांच की एक प्रजत; (घ) मुखय जनयंत्रक या जनयंत्रक द्वारा सम्यकत: अनुमोदित सड़क मागच स े पररिहन के जलए माउंटटंग ड्राइंग की तीन प्रजतयां; (ङ) आयात के बंिरगाह स े अंजतम उपयोग स्ट्थान तक आईएसओ टैंक कंटेनर की हडैं फलगं और पररिहन के जलए सुरजक्षत प्रचालन प्रदक्रया; (च) अनलोफडगं के पश्चात ् आईएसओ टैंक कंटेनर की िापसी अथिा स्ट्थायी आधार पर भारत म ें उसके प्रजतधारण की अनुमाजनत तारीख के जलए स्ट्ि-घोिणा; (छ) पहली अनुसूची के भाग ग म ें यथा-जनर्िष्टच संिीक्षा िल्ु क। (3) उपयुचक् त ित ें पूरी होने के पश्चात,् मुखय जनयंत्रक अथिा जनयंत्रक मुखय जनयंत्रक द्वारा यथा उपबंजधत प्रारूप म ें अजधकतम तीन ििों के जलए िैध आयात अनुमजत प्रिान करेगा। (vi) जनयम 19 म,ें उप जनयम (1) म ें- (क) खण्ड(क) म ें"और" िब्ि का लोप दकया िाएगा; (ख) खण्ड(ख) म,ें "ऐसे पेरोजलयम का भंडारण" िब्ि के स्ट्थान पर जनम्नजलजखत खण्ड रखा िाएगा, अथाचत:् - “ऐसे पेरोजलयम का भडं ारण; और (ग) आईएसओ टैंक कंटेनर म ें पेरोजलयम के आयात और पररिहन की जस्ट् थजत म,ें मुखय जनयत्रं क अथिा जनयंत्रक द्वारा जनयम 14 (क) के अधीन िारी आईएसओ टैंक कंटेनर के जलए आयात अनुमजत"; (vii) जनयम 27 के अधीन जनम्नजलजखत भाग अंत:स्ट्थ ाजपत दकया िाएगा अथाचत् :- "भाग 4 िाय ु माग चद्वारा आयात 27(क) िाय ु माग च स े आयात पर प्रजतबधं : (1) केन्द्रीय सरकार द्वारा मुखय जनयंत्रक के साथ परामि च करके इस प्रयोिन के जलए पेरोजलयम का प्राजधकृत हिाई अड्डों को छोड़कर िाय ु माग च स े कोई आयात नहीं दकया िाएगा। (2) अतं रराष्ट्रीय हिाई पररिहन प्राजधकरण के जिजनयमों अथिा नागररक उड्डयन महाजनिेिक द्वारा जिसकी अनुमजत नहीं ह,ै ऐसे दकसी भी पेरोजलयम उत् पाि का आयात िाय ु मागच स ेनहीं दकया िाएगा। (3) पेरोजलयम के आयात और भंडारण के जलए अनुज्ञजप्त रखने िाला कोई भी व्यजक्त अथिा उसका प्राजधकृत अजभकता च पेरोजलयम को हिाई अड्ड े म ें लान े स े पूि च हिाई अड्ड े के प्रभारी अजधकारी और सीमा िल्ु क आयक्तु को यथा जनधाचररत आयात करने के जलए पेरोजलयम का परू ा जििरण िेत ेहुए घोिणा करेगा। (4) आयाजतत पेरोजलयम की सीधी सुपुिचगी लने े और उसे हिाई अड्डे स े हटाने के जलए आयातकताच द्वारा उजचत व्यिस्ट्थाए ं की िाएंगी। 27(ख) िाय ु माग च स े परे ोजलयम का आयात करन े स े पहल े घोिणा करनी होगी और प्रमाण पत्र और अनज्ञु जप्त प्रस्ट्ततु होगा- िाय ु मागच स े परे ोजलयम आयात करन े के इच्छुक प्रत्येक व्यजक्त को सीमा िुल्क आयक्तु को जनम्न जलजखत िस्ट् तािेि प्रस्ट्तुत करन े होंग,े अथाचत् :- (क) प्ररूप 1 म ें एक घोिणा िो उसके अथिा उसके अजभकता चद्वारा हस्ट्ताक्षररत हो; (ख) उसके अथिा उसके अजभकता च द्वारा हस्ट्ताक्षररत प्ररूप 2 म ेंभंडारण स्ट्थ ल का प्रमाण पत्र;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ग) ऐसे पेरोजलयम के आयात और भंडारण के जलए रखे गए अनुज्ञजप्त की एक अजध-प्रमाजणत प्रजत; (घ) नागररक उड्डयन महाजनििे क स े लैंफडंग परजमट और; (ड.) िाय ु मागच स ेपेरोजलयम के पररिहन के जलए संबंजधत ्लाइट ऑपरेटर स े एक अनुमजत पत्र; परंत ु इस जनयम म ें दकसी बात के होत े हुए अजधजनयम की धारा 7, 8 और 9 के अधीन छूट प्राप्त पेरोजलयम के आयात पर लाग ू नहीं होगा: परंत ु यह और दक अजधजनयम की धारा 7 के अधीन छूट प्राप्त मात्रा म ें थोक म ें पेरोजलयम “श्रेणी ग” के आयात के जलए खण्ड(ग) के अधीन अनुज्ञजप्त प्रस्ट्ततु करना आिश्यक नहीं होगा। 27(ग) पेरोजलयम की अनलोफडगं के जलए सीमा िल्ु क आयुक्त की अनुमजत - (1) सीमा िुल्क आयुक्त की अनुमजत के जबना कोई भी पेरोजलयम अनलोड नहीं दकया िाएगा। (2) सीमा िल्ु क आयक्तु , जनम्नजलजखत िस्ट् तािेि, अथाचत ्:- (क) पेरोजलयम संबंधी िांच अजधकारी की ररपोटच; (ख) प्ररूप 2 म ेंप्रमाण पत्र, यदि जनयम 27 (ख) द्वारा अपेजक्षत ह;ै (ग) नागररक उड्डयन महाजनिेिक स े लैंफडंग परजमट यदि जनयम 27 (ख) द्वारा अपेजक्षत हो; (घ) िाय ु माग च स े पेरोजलयम के पररिहन के जलए संबंजधत ्लाइट ऑपरेटर स ेअनुमजत पत्र; (ड.) अनुज्ञजप्त, यदि जनयम 27(ख) द्वारा आिश्यक हो; प्राप्त करने के पश्चात ् और ऐसी अजतररक्त पछू ताछ करन े के बाि िो िह आिश्यक समझे तथा संतुष्ट हो िाए दक पेरोजलयम को िैध रूप स े आयात दकया िा सकता ह ै और इसके जलए उपयुक्त स्ट्थान ह,ै तो िह इस े उतारने की अनुमजत िगे ा; (3) यदि सीमा िल्ु क आयक्तु इस बात स े सतं ुष्ट ह ै दक आयाजतत दकसी भी पेरोजलयम उत् पाि का भारत म ें भडं ारण नहीं दकया िाना ह,ै दकन्त ु अनलोफडंग के तुरंत पश्चात ् उस े भारत के बाहर दकसी भी स्ट्थान पर भेिा िाना ह,ै तो िह जनयम 27 (ख) की अपेक्षाओं को अजधत्यक्त कर सकता ह ै और ऐसी ितों के अधीन िो जिजनर्िचष्ट की िाए,ं उसके द्वारा जलजखत आिेि परजमट द्वारा ऐस े पेरोजलयम उत् पाि को उस स्ट्थान पर तत्काल भेिने के प्रयोिन स ेअनलोड दकया िाएगा। (4) इस जनयम म ें दकसी बात के होत े हुए अस्ट् थायी तौर पर लागू दकसी अन्य जिजध अथिा जनयम के अधीन पेरोजलयम को रोके रखन े की सीमा िुल्क आयुक्त की िजक्त को प्रभाजित नहीं करेगा; (viii) जनयम 32 म,ें - (क) उप-जनयम (1) म,ें "पोत" िब्ि के पश्चात,् "आईएसओ टैंक कंटेनर" िब्िों को अंत:स्ट् थाजपत दकया िाएगा; (ख) स्ट्पष्टीकरण म,ें "मुखय जनयत्रं क" िब्िों के पश्चात् "अथिा जनयंत्रक" िब्िों को अतं :स्ट् थाजपत दकया िाएगा। (ix) जनयम 70 म,ें उप-जनयम (1) म,ें खण्ड(iii) म ें परंतुक के पश्चात ् जनम्नजलजखत परंतुक अंत:स्ट्थ ाजपत दकया िाएगा, अथाचत ् :- "परंत ु इस जनयम के खण्ड(ii) और (iii) म ें दकसी बात के होत े हुए समय-समय पर सड़क पररिहन प्राजधकरण द्वारा जिजनर्िचष्ट बीएस-IV अथिा उन्नत इंिन िाल े िाहन पर लाग ू नहीं होगा;" (x) जनयम 75 म,ें- (क) उप-जनयम (1) म,ें "अनुज्ञजप्त" िब्ि के पश्चात,् "अथिा अनमु जत" िब्िों को अंत:स्ट् थाजपत दकया िाएगा; (ख) उप-जनयम (2) के पश्चात,् जनम्नजलजखत उप-जनयम अंत:स्ट्थ ाजपत दकया िाएगा, अथाचत ् - “(3) आईएसओ टैंक कंटेनर म ें सड़क माग च स े पेरोजलयम श्रणे ी क अथिा ख के पररिहन के जलए मुखय जनयंत्रक अथिा जनयंत्रक स े अनुमजत प्राप्त की िाएगी। ऐसी अनुमजत मखु य जनयंत्रक द्वारा जिजहत प्रारूप म ें िारी होन े की तारीख स े एक ििच की अिजध के जलए िैध रहगे ी; (4) (क) उप-जनयम (3) के अधीन अनुमजत चाहन े िाले व्यजक्त को मखु य जनयंत्रक अथिा जनयंत्रक को पहली अनुसूची के भाग ग म ेंजिजनर्िचष्ट संिीक्षा िुल्क के साथ प्ररूप 7 क म ेंआिेिन प्रस्ट्तुत करना होगा; (ख) मखु य जनयंत्रक अथिा जनयंत्रक उप-जनयम (क) के अधीन िस्ट्तािेिों की प्राजप्त के पश्चात ् तथा ऐसी और पूछताछ, जिस े िह आिश्यक समझता ह,ै करन े के पश्चात् इस बात स े संतुष्ट होन े पर दक िाहन इन जनयमों म ें अजधकजथत अपेक्षाओं को पूरा करता ह,ै आिेिक को जिजधित पृष्ांदकत ड्राइंग की एक प्रजत के साथ आईएसओ टैंक कंटेनर म ें पेरोजलयम श्रेणी क अथिा ख के पररिहन के जलए अनुमजत िारी करेगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (xi) जनयम 76 म,ें उप-जनयम (3) म,ें “(1934 का 22)” प्रतीकों और अंकों के पश्चात,् “और इन जनयमों के प्ररूप 19 के अधीन अनुज्ञजप्त प्राप्त िाहनों द्वारा भारी यानों/भारी मिीनरी/अचल उपकरणों में साइट पर ईंधन भरना” िब्िों और अंकों को अतं :स्ट्थाजपत दकया िाएगा; (xii) जनयम 77 म,ें “पनु : िाचं की गई” िब्िों के पश्चात,् “एक सक्षम व्यजक्त अथिा टीपीआईए द्वारा” िब्ि अंत:स्ट्थाजपत दकए िाएंग;े (xiii) जनयम 85 म,ें - (क) उप-जनयम (1) म,ें “सक्षम उत्तरिायी व्यजक्त” िब्िों के स्ट्थान पर, “सक्षम व्यजक्त अथिा टीपीआईए” िब्िों को रखा िाएगा; (ख) उप-जनयम (4) के पश्चात,् जनम्नजलजखत को अंत:स्ट्थ ाजपत दकया िाएगा, अथाचत ् :- “(5) आईएसओ टैंक कंटेनर फ्रेमिकच और/ अथिा आईएसओ टैंक कंटेनर की प्रत्येक मरम्मत के बाि फैजिकेिन कोड म ें अजधकजथत रीजत स े िांच की िाएगी। (xiv) जनयम 89 म,ें उप-जनयम (2) के पश्चात् जनम्नजलजखत उप-जनयम को अंतःस्ट्थाजपत दकया िाएगा, अथाचत ् :- “(3) उप-जनयम (2) के अधीन ड्राइंग और िल्ु क प्राप्त होन े पर और ऐसी यथा-अपेजक्षत अजतररक्त िानकारी प्राप्त करने के पश्चात ् मखु य जनयंत्रक, यदि िह संतुष्ट हो तो प्रस्ट्ताजित पाइपलाइन को उपयुक्त समझी िाने िाली ऐसी ितों के अधीन अनुमोदित करेगा” ; (xv) जनयम 90 म,ें उप-जनयम (1) म,ें “इस्ट्पात” िब्ि के पश्चात ् “अथिा मखु य जनयंत्रक द्वारा अनुमोदित कोई अन्य उपयुक्त सामग्री” िब्ि ों को अतं ःस्ट्थाजपत दकया िाएगा; (xvi) जनयम 93 म,ें उप-जनयम (2) के पश्चात,् जनम्नजलजखत उप-जनयमों को अतं ःस्ट्थाजपत दकया िाएगा, अथाचत्:- “(2क) सक्षम व्यजक्त अथिा टीपीआईए द्वारा पाइपलाइन की हाइड्रोस्ट्टेरटक िांच की िाएगी। (2ख) सक्षम व्यजक्त अथिा टीपीआईए उप-जनयम (1) के अधीन यथा-अपेजक्षत िांच करेगा और एक प्रमाण पत्र िारी करेगा; इस प्रकार िारी दकया गया प्रमाण पत्र मखु य जनयत्रं क को प्रस्ट्तुत दकया िाएगा” ; (xvii) जनयम 98 म,ें “काटन े अथिा पुन:िेजल्डत करन े िाल”े िब्िों के स्ट्थान पर, “अथिा तप्त िकच” िब्िों को रखा िाएगा; (xviii) जनयम 106 म,ें- (क) उप जनयम (1) म,ें “60079-II” अंकों के पश्चात् “आईएस/आईईसी 60079-26” जचन् हों, िब्िों और अंकों को अंत:स्ट् थाजपत दकया िाएगा; (ख) उप-जनयम (2) म,ें खण्ड(i) के स्ट्थान पर जनम्नजलजखत खण्ड रखा िाएगा, अथाचत ् :- “(i) आईएस/आईईसी 60079-1, आईएस/आईईसी 60079-2, आईएस/आईईसी 60079-5, आईएस/आईईसी 60079- 6, आईएस/आईईसी 60079-7, आईएस/आईईसी 60079-11, आईएस/आईईसी 60079-18 और मखु य जनयंत्रक द्वारा जलजखत रूप म ें अनुमोदित कोई अन्य समकक्ष मानक के अनुरूप ्लेमप्रूफ अथिा प्रेिराइज्ड टाइप अथिा पाउडर भरा अथिा तले म ेंडूबा हुआ अथिा बढी हुई सुरक्षा अथिा आंतररक रूप स े सुरजक्षत या एनकैप्सुलेटेड उपकरण, अथिा”; (ग) उप-जनयम (3) म ें खण्ड(i) के स्ट्थान पर जनम्नजलजखत खण्ड रखा िाएगा, अथाचत् :- “(i) आईएस/आईईसी 60079-15 और मखु य जनयंत्रक द्वारा जलजखत रूप म ें अनुमोदित एक टाइप के अनुरूप गरै - स्ट्पार्कंग उपकरण; अथिा”; (घ) उप-जनयम (3) के पश्चात,् जनम्नजलजखत उप-जनयम को अंत:स्ट् थाजपत दकया िाएगा, अथाचत ्:- “(3क) एक्स—इलैजक्र कल एपरेटसच का चयन आईएस 16724:2018/आईईसी60079-14 अथिा आईईसी 60079-14 अथिा मुखय जनयत्रं क द्वारा जलजखत रूप म ें स्ट्िीकृत दकसी अन्य समकक्ष मानक म ें यथा-पररभाजित उपकरण सुरक्षा स्ट्तर (ईपीएल) के अनुसार होगा।”; (xix) जनयम 114 म,ें "व्यजक्त" िब्ि के पश्चात ्"िो जिद्युत इंिीजनयर ह"ै िब्ि अंत:स्ट्थाजपत दकए िाएंग;े (xx) जनयम 117 म,ें उप-जनयम (4) म,ें खण्ड(ii) के स्ट्थान पर जनम्नजलजखत खण्ड रखा िाएगा, अथाचत:् - "(ii) नए/भािी प्रजतष्ठ ान के अन्य क्षेत्रों पर प्रिान की िान े िाली अजििमन सुजिधा का पैमाना ओआईएसडी मानक 244 म ें िी गई अपक्षे ा के अनुसार होना चाजहए। मुखय जनयंत्रक द्वारा पहल े से अनमु ोदित प्रजतष्ठ ान ओआईएसडी मानक 117 द्वारा अजभिाजसत होंगे।" (xxi) जनयम 120 म ेंउप-खण्ड(5) के पश्चात,् जनम्न जलजखत स्ट्प ष्ट ीकरण अतं स्ट्थ ाजपत दकया िाएगा; 2. प्ररूप 15 म ें िारी िधै अनुज्ञजप्त की एक प्रजत जिसम ें आईएसओ टैंक कंटेनर की पूरी अंतिचस्ट्त ु को समायोजित करन े की पयाचप्त क्षमता हो; 3. मूल ििे के सक्षम प्राजधकारी द्वारा सम् यक्त : पृष्ांदकत आईएसओ टैंक कंटेनर के जिजनमाचता की जनरीक्षण और परीक्षण ररपोटच; 4. मूल ििे के सक्षम प्राजधकारी द्वारा िारी हाइड्रोटेस्ट्ट प्रमाणपत्र और कंटेनर सुरक्षा प्रमाणपत्र (सीएससी) सजहत आिजधक जनरीक्षण और परीक्षण की एक प्रजत; 5. आईएसओ टैंक कंटेनर के जडिाइन जििरण ििाचन े िाली जडिाइन रेखाकंन, टैंक की िल क्षमता, इसकी दफटटंग और इसके जनमाणच म ें उपयोग की िाने िाली सामग्री के जिजनििे ों के जििरण, िो मूल ििे के सक्षम प्राजधकारी द्वारा सम् यकत: पष्ृ ांदकत हो; AND WHEREAS, copies of the Gazette containing the said notification was made available to the public on the 1st November, 2023; AND WHEREAS, objections and suggestions received from the public in respect of the draft rules have been duly considered by the Central Government; NOW, THEREFORE, in exercise of the powers conferred by sections 4, 5, 14, 21, 22 and sub-section (1) of section 29 of the Petroleum Act, 1934 (30 of 1934), the Central Government hereby makes the following rules further to amend the Petroleum Rules, 2002, namely: - 1. Short title and commencement. - (1) These rules may be called the Petroleum (Amendment) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Petroleum Rules, 2002, - (i) in rule 2, in sub-rule (1), - (a) after clause (xiv), the following clauses shall be inserted, namely: - ‘(xiva) “Heavy machinery” means heavy-duty machine, specially designed for executing construction or agricultural tasks or purely off-highway construction or lifting equipment vehicle designed and adopted for use within the premises, factory, port or mine other than road network, not equipped to travel on public roads on their power; (xivb) “Heavy vehicles” means vehicles designed with suitable implements for various field operations including agriculture, mining, industrial undertaking, irrigation and construction, modified and manufactured with "on or off" or "on and off" highway capabilities and is a non-transport, non- goods or non-passenger vehicle; Explanation. - For the purpose of this clause, “Heavy vehicles” does not include tractors as defined in the Motor Vehicle Act, 1988.’; (b) after clause (xvi), the following clauses shall be inserted, namely: - ‘(xvia) “ISO tank container” means a petroleum freight container, mounted with an ISO tank container framework, secured by twister locks, suitable for carriage of liquid petroleum which may be loaded or unloaded by16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] gravity or pressure discharge, for conveyance by road, rail or sea, including interchange between these forms of transport and conforms to design, specifications and testing, marking as per national or international standards accepted by the Chief Controller or Controller; (xvib) “ISO tank container framework” means tank mountings, end structure and all load bearing elements not present to contain cargo, which transmits static and dynamic forces arising out of lifting, handling, securement and transporting of the tank container as a whole and conforms to design, specifications and testing as per national or international standards accepted by the Chief Controller or Controller;’; (c) in clause (xxiv), after the word “purposes”, the words “including non-fuelling facilities installed outside the extent of hazardous areas of service station as defined in the FOURTH SCHEDULE” shall be inserted; (d) in clause (xxvi), after the word “petroleum”, the words “including ISO tank container” shall be inserted; (e) after clause (xxxiii), the following clause shall be inserted, namely: - ‘(xxxiiia) “Third Party Inspection Agency (TPIA)” means a professional organisation recognised by the Chief Controller or Controller to carry out testing and certification under these rules including safety audit of major accident hazards premises as defined under the Manufacture, Storage and Import of Hazardous Chemicals Rules, 1989 and having persons with qualifications and experience as applicable to the competent persons;’; (ii) in rule 4, after the sub-rule (3), the following shall be inserted, namely: - "(4) Nothing in these rules shall apply for import of containers containing petroleum for research and development purpose provided that the packing conforms to the International Air Transport Association Dangerous Goods Regulations as amended from time to time."; (iii) in rule 8, - (a) in sub-rule (1), for the words “to have been so repaired”, the words “or TPIA” shall be substituted; (b) after sub-rule (2), the following sub-rule shall be inserted, namely: - “(3) The fee for testing and certification shall be as specified in PART B of the FIRST SCHEDULE.”; (iv) in rule 13, - (a) in sub-rule (1), for the words “by a crossed bank draft of a nationalised or scheduled bank drawn in favour of the Chief Controller of Explosives, payable at Nagpur or through e-payment”, the words “through e-payment or through Non-Tax Receipt Portal” shall be substituted; (b) sub-rule (2) shall be omitted; (v) after rule 14, the following rule shall be inserted, namely: - “14A. Restriction on import and transport of ISO tank containers. - (1) No person shall import any ISO tank container filled or intended to be filled with petroleum without obtaining import permission from the Chief Controller or Controller. (2) Any person seeking import permission under sub-rule (1) shall submit an application in FORM VII (A) to the Chief Controller or Controller along with the following documents, namely: - (a) copy of valid licence issued in FORM XV having adequate capacity to accommodate the whole contents of the ISO tank container; (b) manufacturer’s inspection, test reports and two copies of design drawings showing design details, water capacity of the tank, its fittings and particulars of specifications of the materials of construction of the ISO tank container duly endorsed by the competent agency of the country of origin; (c) copy of periodic inspection and testing including Hydro Test Certificate and Container Safety Certificate issued by a competent agency of the country of origin; (d) three copies of mounting drawing for transportation by road duly approved by the Chief Controller or Controller; (e) safe operating procedure for handling and transportation of the ISO tank container from the port of import to the end-use location; (f) self-declaration for the approximate date of return of ISO tank container after unloading or its retention in India on a permanent basis;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 17 (g) scrutiny fees as provided in PART C of the FIRST SCHEDULE. (3) upon fulfilment of the above conditions, the Chief Controller or Controller shall grant import permission valid for a maximum period of three years in the format as provided by the Chief Controller.”; (vi) in rule 19, in sub-rule (1), - (a) in clause (a), the word “and” shall be omitted; (b) in clause (b), for the words “storage of such petroleum”, the following clause shall be substituted, namely:- “storage of such petroleum; and (c) import permission for ISO tank container granted by the Chief Controller or Controller issued under rule 14A, in case of import and transport of petroleum;”; (vii) after rule 27, the following Part shall be inserted, namely: - “PART IV IMPORTATION BY AIR 27A. Restriction on import by air. - (1) No petroleum shall be imported by air except at the airports authorised for this purpose by the Central Government in consultation with the Chief Controller. (2) Petroleum not permitted by the International Air Transport Authority regulations or Director General of Civil Aviation, shall not be imported by air. (3) Any person holding a license for the import and storage of petroleum or his authorised agent shall declare before bringing the petroleum into the airport to the officer in-charge of the airport and to the Commissioner of Customs, furnishing the complete particulars of the petroleum intended to be imported. (4) The proper arrangements shall be made by the importer to take direct delivery of the imported petroleum and remove the same from the airport. 27B. Declaration and certificate to be furnished and licence to be produced before importing petroleum by air. - Every person desiring to import petroleum by air shall furnish to the Commissioner of Customs the following documents, namely: - (a) a declaration in FORM I signed by him or his agent; (b) a certificate of storage accommodation in FORM II signed by him or his agent; (c) an authenticated copy of the licence held for the importation and storage of such petroleum; (d) a landing permit from the Director General of Civil Aviation; and (e) a consent letter from the respective flight operator for the transportation of petroleum by air; Provided that nothing in this rule shall apply to the importation of petroleum exempted under sections 7, 8 and 9 of the Act. Provided further that the furnishing of licence under clause (c) shall not be necessary for the importation of petroleum class C, in bulk, in quantity exempted under section 7 of the Act. 27C. Permission of Commissioner of Customs to unload petroleum. – (1) No petroleum shall be unloaded except with the permission of the Commissioner of Customs. (2) the Commissioner of Customs shall make such inquiries as he deems necessary and is satisfied that the petroleum can be lawfully imported and that there is suitable accommodation, he shall permit it to be unloaded after receiving the following documents, namely: - (a) testing report on the Petroleum; (b) certificate in FORM II, if required by rule 27B; (c) landing permit from the Director General of Civil Aviation, if required by rule 27B; (d) consent letter from the respective flight operators for transportation of petroleum by air; and (e) licence, required under rule 27B;18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) If the Commissioner of Customs is satisfied that any petroleum imported is not intended to be stored in India but is intended to be dispatched immediately after unloading to any place outside India, he may waive the requirements of rule 27B and by written order permit, subject to such conditions as may specify, such petroleum to be unloaded for the purpose of immediate dispatch to that place. (4) Nothing in this rule shall affect the power of the Commissioner of Customs to detain petroleum under any other law or rule for the time being in force.; (viii) in rule 32, - (a) in sub-rule (1), after the word “vessel”, the words “, ISO tank container” shall be inserted; (b) in the Explanation, after the words “Chief Controller”, the words “or Controller” shall be inserted; (ix) in rule 70, in sub-rule (1), in clause (iii), after proviso, the following proviso shall be inserted, namely: - “Provided further that nothing in clause (ii) and (iii) of this rule shall apply to the vehicle with engines of type BS-IV or upgraded version as specified by Road Transport Authority from time to time.”; (x) in rule 75, - (a) in sub-rule (1), after the word “licence”, the words “or permission” shall be inserted; (b) after sub-rule (2), the following sub-rules shall be inserted, namely: - “(3) Permission shall be obtained from the Chief Controller or Controller for transportation of petroleum Class A or B by road in the ISO tank container and such permission shall remain valid for a period of one year from the date of issue in the format as prescribed by the Chief Controller; (4) (a) A person desiring permission under sub-rule (3) shall submit an application in FORM VII A to the Chief Controller or Controller with a scrutiny fee as specified in PART C of the FIRST SCHEDULE; (b) the Chief Controller or Controller, after receipt of the application under sub-rule (a) and after making such further inquiries as deems necessary, is satisfied that the vehicle meets the requirements laid down in these rules, shall issue a permission for transportation of petroleum Class A or B in ISO Tank Container to the applicant with one copy of drawing duly endorsed.”; (xi) in rule 76, in sub-rule (3), in the proviso, after the symbols, figures and words “(22 of 1934)”, the words and figures “and on-site refuelling of heavy vehicle, heavy machinery or stationary equipment by vehicles licensed under FORM XIX of these rules” shall be inserted; (xii) in rule 77, in clause (i), after the words “re-tested”, the words “by a competent person or TPIA” shall be inserted; (xiii) in rule 85, – (a) in sub–rule (1), for the words “competent responsible person”, the words “competent person or TPIA” shall be substituted; (b) after sub-rule (4), the following shall be inserted, namely: - “(5) The ISO tank container framework or the ISO tank container shall be tested after each repair in the manner laid down in the code of fabrication”; (xiv) in rule 89, after sub-rule (2), the following sub-rule shall be inserted, namely: - “(3) On receipt of the drawings along with fee under sub-rule (2) and after eliciting such additional information as may be required, the Chief Controller may approve the proposed pipeline subject to such conditions as deemed fit.”; (xv) in rule 90, in sub-rule (1), after the word “steel”, the words “or any other suitable materials approved by the Chief Controller” shall be inserted; (xvi) in rule 93, after sub-rule (2), the following sub-rules shall be inserted, namely: - “(2A) The hydrostatic testing of the pipeline shall be carried out by a competent person or TPIA. (2B) The competent person or TPIA shall carry out the test as required under sub-rule (1) and issue a certificate; the certificate so issued shall be submitted to the Chief Controller.”; (xvii) in rule 98, for the words “involving cutting or re-welding”, the words “or hot work” shall be substituted; (xviii) in rule 106, -[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 19 (a) in sub rule (1), in the proviso, after the figure “60079-II”, the letters and figures, “, IS/IEC 60079-26” shall be inserted; (b) in sub-rule (2), for clause (i), the following clause shall be substituted, namely: - “(i) a flameproof or pressurised type or powder-filled or oil immersed or increased safety or intrinsically safe or encapsulated apparatus confirming to IS/IEC 60079-1, IS/IEC 60079-2, IS/IEC 60079-5, IS/IEC 60079- 6, IS/IEC 60079-7, IS/IEC 60079-11, IS/IEC 60079-18 and any other equivalent standard approved in writing by the Chief Controller; or”; (c) in sub-rule (3) for clause (i), the following clause shall be substituted, namely: - “(i) non-sparking apparatus conforming to IS/IEC 60079- 15 and of a type approved in writing by the Chief Controller; or”; (d) after sub-rule (3), the following sub-rule shall be inserted, namely: - “(3A) The selection of Ex-Electrical Apparatus shall be as per equipment protection level (EPL) as defined in IS 16724:2018/IEC60079-14 or IEC 60079-14 or any other equivalent standard accepted in writing by the Chief Controller.”; (xix) in rule 114, after the word “person”, the words “who is an electrical engineer” shall be inserted; (xx) in rule 117, in sub-rule (4), for clause (ii), the following clause shall be substituted, namely: - “(ii) Scale of firefighting provided on other areas of new or upcoming installation shall be as per the requirement given in OISD Standard 244. Installations already approved by the Chief Controller shall be governed by the OISD Standard 117.”; (xxi) in rule 120, after sub-rule (5), the following Explanation shall be inserted, namely: - “Explanation. - For the purposes of this rule, it is clarified that with regard to drainage, the Standards as applicable shall be followed.”; (xxii) in rule 122, the following Explanation shall be inserted, namely: - “Explanation. - The Chief Controller or Controller is authorised to permit use of service station for other purposes not directly connected with storage and distribution of petroleum.”; (xxiii) in rule 124, in sub-rule (1), after the letters and figures “API:650”, the words, letters and figures “or ASTM D3299-18, BS EN 13121-3, UL1316” shall be inserted; (xxiv) in rule 126, - (a) in sub-rule (1), after the words “competent person”, the word and letters “or TPIA” shall be inserted; (b) in sub-rule (3), after the words “competent person”, word and letters “or TPIA” shall be inserted; (c) in sub–rule (4), for the Proforma of Certificate of Tank Testing, the following Proforma shall be substituted, namely: - “Proforma of Certificate of Tank Testing [See rule 126] Sl. Tank vehicle for ISO tank containers. - (1) ISO Tank container, associated piping, fittings and the framework suitable for carriage of liquid petroleum shall conform to design, specifications, testing and marking as per national or international standards accepted by the Chief Controller. (2) ISO tank container framework including the ISO tank mountings, end structure and all load-bearing elements not present for the purposes of containing cargo, which transmits static and dynamic forces arising out of lifting, handling, securement and transporting of the ISO tank container as a whole and conforms to design, specifications and testing as per national or international standards accepted by the Chief Controller. (3) There shall be no requirement for a baffle inside the ISO tank container for transportation of petroleum if the capacity of ISO tank container is not exceeding 7.5 kiloliters. (4) The maximum capacity of ISO tank container shall not exceed 26 kiloliters. (5) The maximum capacity shall be restricted corresponding to gross vehicle weight certified by the Regional Transport Office.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (6) ISO tank container having capacity of more than 7.5 kiloliters but less than 15 kiloliters shall be provided with 1 baffle plate. ISO tank container having capacity of 15 kiloliters or more but less than 22.5 kiloliters shall be provided with 2 baffle plates. ISO tank container having capacity of 22.5 kiloliters or more shall be provided with 3 baffle plates. (7) The maximum payload of the petroleum product in such ISO container shall be restricted to 95% of the maximum capacity of ISO container. Explanation. - As approved by the Chief Controller or Controller, baffle plates are metal plates attached or suspended to the inside portion of an ISO tank either horizontally or vertically and at regular intervals not amounting to fixed partitions or compartments and capable of arresting the surge of petroleum product.”.
