L.-33004/99 सी.जी.-डी.एल.-अ.-22062024-254870 CG-DxLx-xEG-I2D2H0x6x2x0 24-254870 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 2282] नई ददल्ली, िुक्रिार , िनू 21, 2024/ज्य ष्े ठ 31, 1946 No. 2282] NEW DELHI, FRIDAY, JUNE 21, 2024/JYAISHTHA 31, 1946 जिद्यतु मत्रं ालय आदेि नई ददल्ली, 20 िून, 2024 का.आ. 2402(अ).—िबदक मेससस िुजनपर ग्रीन स्ट्टेलर प्राइिटे जलजमटेड, जिसका पंिीकृत कायासलय F-9, पहली मंजिल, मनीष प्लािा 1 प्लॉट संख्या 7, MLU सेक्टर 10 द्वारका, नई ददल्ली, भारत में जस्ट्ित ह,ै न े “रािस्ट्िान के बाड़मरे जिले म ें िुजनपर ग्रीन स्ट्टेलर प्राइिेट जलजमटेड के प्रस्ट्ताजित 365MW सौर ऊिास पररयोिना स े फतेहगढ़ IV (आई एस टी एस) पूललगं स्ट्टेिन तक कनेजक्टजिटी प्रदान करने के जलए 220 केिी पारेषण प्रणाली। “ के तहत ओिरहडे रांसजमिन लाइन जबछाने के जलए जिद्युत अजधजनयम, 2003 की धारा 164 के अंतगतस प्राजधकृत करने हते ुआिेदन दकया ह।ै और िबदक, केंद्रीय जिद्युत प्राजधकरण (के.जि.प्रा.), जिद्युत मंत्रालय, भारत सरकार ने अपन े पत्र सं. 25-17/21/2023-PG ददनांदकत 27.09.2023 के द्वारा “रािस्ट्िान के बाड़मेर जिल े म ें िुजनपर ग्रीन स्ट्टेलर प्राइिेट जलजमटेड के प्रस्ट्ताजित 365MW सौर ऊिास पररयोिना से फतेहगढ़ IV (आई एस टी एस) पूललंग स्ट्टेिन तक कनेजक्टजिटी प्रदान करन े के जलए 220kV पारेषण प्रणाली। “के अतं गतस आने िाली ओिरहडे रांसजमिन लाइनों के जलए जिद्युत अजधजनयम की धारा 68(1) के अंतगतस पूिस अनुमोदन प्रदान दकया िा। मेससस िुजनपर ग्रीन स्ट्टेलर प्राइिेट जलजमटेड न े स्ट्िानीय समाचार पत्रों इंजडयन एक्सप्रेस (अग्रं ेिी म)ें ददनांक 31.01.2024, दैजनक भास्ट्कर (लहदं ी म)ें ददनांक 31.01.2024 और भारत के साप्ताजहक रािपत्र ददनांक 10.02.2024 म ें रांसजमिन योिना के जलए प्रस्ट्ताजित रांसजमिन माग स पर प्रकािन की तारीख से 2 महीन े के भीतर आम िनता की रटप्पजणयों / अभ्यािेदन की मांग करते हुए नोरटस प्रकाजित दकया िा । इसके पश्चात, मेससस िुजनपर ग्रीन स्ट्टेलर प्राइिेट जलजमटेड न े 15.04.2024 ददनांदकत एक हलफनामा प्रस्ट्तुत दकया, जिसमें घोषणा की गई ह ै दक भारत सरकार के आजधकाररक रािपत्र एिं स्ट्िानीय समाचार पत्रों में प्रकािन की तारीख से 2 महीने के भीतर िनता से 4 3688 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] रटप्पजण/अभ्यािेदन प्राप्त हुआ ह ैं और मेससस िुजनपर ग्रीन स्ट्टेलर प्राइिेट जलजमटेड द्वारा उसका स्ट्पष्टीकरण/उत्तर ददया गया ह।ै तत्पश्चात समाचार पत्रों / भारत का रािपत्र म ें उपरोक्त पारेषण योिना के जलए सािसिजनक सूचना के प्रकािन के 60 ददनों के भीतर िनता से कोई आपजत्त प्राप्त नही की गई ह।ै और अब आिेदक न े जिद्युत अजधजनयम, 2003 की धारा 164 के अंतगसत “रािस्ट्िान के बाड़मेर जिल े में िुजनपर ग्रीन स्ट्टेलर प्राइिेट जलजमटेड के प्रस्ट्ताजित 365MW सौर ऊिा स पररयोिना से फतेहगढ़ IV (आई एस टी एस) पूललगं स्ट्टेिन तक कनेजक्टजिटी प्रदान करने के जलए 220 केिी पारेषण प्रणाली।” के तहत रांसजमिन लाइन जबछाने के जलए उसे िे सभी िजक्तयां प्रदान करन े का अनरु ोध दकया है, िो भारतीय टेलीग्राफ अजधजनयम, 1885 के तहत टेलीग्राफ के प्रयोिन के जलए सरकार द्वारा स्ट्िाजपत अििा अनुरजित दकये गए टेलीग्राफ लाइन एि ं खम्भे या इस प्रकार की स्ट्िापना और अनरु िण दकये िाने के जलए, टेलीग्राफ प्राजधकरण को प्राप्त ह।ैं योिना के अतं गसत जनम्नजलजखत ओिरहडे रांसजमिन लाइन ह:ैं 1. िुजनपर ग्रीन स्ट्टेलर प्राइिटे जलजमटेड सौर ऊिास पररयोिना (जिि गांि, बाड़मरे जिला, रािस्ट्िान में िने रेिन जस्ट्िचयाडस) से फतेहगढ़ IV (आई एस टी एस) पी एस तक 220 केिी एस/सी लाइन डी/सी टािर पर पारेषण प्रणाली। उपरोक्त योिना के अतं गतस ओिरहडे रांसजमिन लाइन रािस्ट्िान के जनम्न ांदकत गााँिों,कस्ट्बों और िहरों से होकर, उन पर स,े उनके आसपास से और बीच से होकर गुज़रेगी। क्र. गािाँ के नाम तहसील जिला 1 गूंगा, अम्बािाङी, जिि, जनम्बासर , बनादकया धोरा, हङिेचा , हङिा , िोरानाडा, जिि बाड़मेर मुठिाजनयों की ढाणी, रत्ता कुम्हारों की ढाणी, भोिा भाकरी, हुकुमलसंह की ढाणी, कोटन्या की ढाणी, रातो भाखर, पुंिराि लसंह की ढाणी, गंगोल, बलाई, जबसु कलां, लालसो की ढाणी, चक भेंसका, हािी लसंह की ढाणी, डुकरी िाली, सफले का धोरा, िडेली का धोरा, मांडई अब, सािधानीपूिसक जिचार करने के पश्चात, जिद्युत मंत्रालय, भारत सरकार, मेससस िुजनपर ग्रीन स्ट्टेलर प्राइिेट जलजमटेड को उपरोक्त ओिरहडे रांसजमिन लाइन को लगान े के जलए िे सभी िजक्तया ं जनम्नजलजखत जनबंधनों एि ं ितों के साि प्रदान करता ह,ै िो भारतीय टेलीग्राफ अजधजनयम, 1885 के तहत टेलीग्राफ के प्रयोिन के जलए सरकार द्वारा स्ट्िाजपत अििा अनुरजित दकये गए टेलीग्राफ लाइन एिं खम्भे या इस प्रकार की स्ट्िापना और अनरु िण दकये िाने के जलए, टले ीग्राफ प्राजधकरण को प्राप्त ह।ैं - i. यह अनुमोदन 25 िषों के जलए प्रदान दकया िाता ह।ै ii. आिेदक को प्रस्ट्ताजित लाइन की स्ट्िापना स े पूि स संबंजधत प्राजधकरणों अिासत ् स्ट्िानीय जनकायों, रेलिे, राष्ट्रीय रािमागस, राज्य रािमागस आदद की सहमजत प्राप्त करनी होगी। iii. आिेदक को जिद्युत अजधजनयम, 2003 के तहत समुजचत आयोग के द्वारा तैयार दकए गए रांसजमिन, ओ एडं एम, ओपन एक्सेस आदद के जिजनयमों/संजहताओं का पालन करना होगा। iv. आिेदक केंद्र सरकार के जिद्युत जनरीिक/मख्ु य जिद्युत जनरीिक के अनुमोदन के पश्चात ही लाइन का प्रचालन करेगा। v. यह अनुमोदन आिेदक द्वारा जिद्युत अजधजनयम, 2003 के प्रािधानों और उसके तहत बनाए गए जनयमों की अपेिाओं का अनुपालन दकए िाने के अध्यधीन ह।ै vi. मेससस िुजनपर ग्रीन स्ट्टेलर प्राइिेट जलजमटेड को जिद्युत जनरीिण के समय जिमानन एिं रिा प्राजधकरणों इत्यादद, से अपेजित अनुमजत को प्राप्त करने के बाद, इस े केंद्रीय जिद्युत प्राजधकरण को जिद्युत जनरीिण के समय प्रस्ट्ततु करना होगा। vii. यदद उपरोक्त ओिरहडे लाइन का माग स (या उपरोक्त ओिरहडे लाइन के माग स का कुछ भाग) ग्रेट इंजडयन बस्ट्टड स (िीआईबी) संभाजित िेत्र (या प्रािजमकता िेत्र) म ें आता ह ै तो आिेदक को ग्रेट इंजडयन बस्ट्टड स (िीआईबी) मामल े के संबंध म ें 2019 की याजचका संख्या 838 पर माननीय उच्चतम न्यायालय के आदिे ों का और माननीय उच्चतम न्यायालय द्वारा गरठत तकनीकी/जििेषज्ञ सजमजत के जनदेिों का पालन करना होगा। फा. स.ं 25-16/19/2024-पीिी] एम.िी.एन. िरा प्रसाद, अिर सजचि (पीिी)[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 MINISTRY OF POWER ORDER New Delhi, the 20th June, 2024 S.O. 2402(E).—Whereas M/s Juniper Green Stellar Private Limited has its registered address at F-9, First Floor, Manish Plaza 1 Plot No 7, MLU Sector10, Dwarka, New Delhi, India has applied for authorization under Section 164 of the Electricity Act, 2003 for laying of overhead transmission line under “Transmission System for providing connectivity to Juniper Green Stellar Private Limited for its proposed 365MW Solar Power Project in Barmer District of Rajasthan to Fatehgarh IV ISTS PS 220kV”. And whereas, Ministry of Power, Government of India vide its letter 25-17/21/2023-PG dated 27.09.2023 had granted prior approval under section 68(1) of the Electricity Act, 2003 for the overhead line covered under “Transmission System for providing connectivity to Juniper Green Stellar Private Limited for its proposed 365MW Solar Power Project in Barmer District of Rajasthan to Fatehgarh IV ISTS PS 220kV”. M/s Juniper Green Stellar Private Limited has published notice for transmission scheme in local newspapers Indian Express (in English) dated 31.01.2024, Dainik Bhaskar (in Hindi) dated 31.01.2024 and in Weekly Gazette of India dated 10.02.2024 for the general public to make observations/representations on the proposed transmission route within 2 Months from the date of publication. Subsequently, M/s Juniper Green Stellar Private Limited has submitted an affidavit dated 15.04.2024 declaring that 4 observations/representations from public on the proposed route alignment has been received and clarification/reply has been given by M/s Juniper Green Stellar Private Limited, except this no further observation/representation was received within 2 Months from the date of Publication in the official gazette of Government of India. And now the applicant has requested to confer upon him, all the powers under section 164 of the Electricity Act, 2003, which the telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purpose of a telegraph established or maintained by Government or to be so established or maintained for laying of electric lines under “Transmission System for providing connectivity to Juniper Green Stellar Private Limited for its proposed 365MW Solar Power Project in Barmer District of Rajasthan to Fatehgarh IV ISTS PS 220kV: 1. Juniper Green Stellar Private Limited Solar Power Project - Fatehgarh-IV PS 220 kV S/C line on D/C tower (2-3 km line will be implemented as S/C line on M/C tower towards entry of Fatehgarh-IV PS.) The transmission line covered under the above scheme will pass through, over, around and between the following villages, towns and cities of Rajasthan: S. No. Name of Villages Tehsil District 1 Goonga/Gunga, Amba Bari, Sheo/Shiv, Nimbasar, Banakiya Dhora, Harwecha, Harua/Harwa, Jora Nada, Muthwaniyo ki Dhani, Ratta Kumharon ki Dhani, Bhoja Bhakari, Hukumsingh ki Dhani, Kotanya ki Sheo/ Shiv Barmer Dhani, Rato Bhakhar, Punjraj Singh ki Dhani, Gangol, Balai, Bisu/Bisoo Kalan, Lalso ki Dhani, Chak Bhanska, Hathi Singh ki Dhani, Dukri Thali, Saphle ka Dhora, Jadeli ka Dhora, Mandai Now, after careful consideration, Ministry of Power, Government of India, under section 164 of the Electricity Act, 2003, confers all the powers to M/s Juniper Green Stellar Private Limited for laying above overhead line, which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by Government or to be established or maintained subject to following terms and conditions for installing the above mentioned line, namely: i. The approval is granted for 25 years. ii. The Applicant shall have to seek the consent of the concerned authorities i.e., local bodies, Railways, National Highways, State Highways etc. before erection of proposed line. iii. The Applicant shall have to follow regulations/codes of the Appropriate Commission regarding transmission, O&M, open access, etc., framed under Electricity Act, 2003. iv. The Applicant shall operate the line after approval of Electrical Inspector / Chief Electrical Inspector of Central Government. v. The approval is subject to compliance of the requirement of the provisions of the Electricity Act, 2003 and the rules made there under by the applicant.4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] vi. M/s Juniper Green Stellar Private Limited shall have to submit the requisite clearances to Central Electricity Authority after obtaining the same from concerned authorities like Civil Aviation, Defense etc., at the time of Electrical Inspection. vii. In case, the route of above overhead lines (or some portion of the route of above overhead line) falls in the Great Indian Bustard (GIB) potential zone (or priority zone), the applicant has to comply with the orders of the Hon’ble Supreme Court in the petition No.838 of 2019 regarding Great Indian Bustard (GIB) case, and the directions of the technical/expert committee constituted by the Hon’ble Supreme Court in this regard.
