Executive Summary & Key Takeaways

**Executive Summary** This notification, issued by the Ministry of Ports, Shipping and Waterways on June 25, 2026, establishes the official form and procedure for compounding offences under Section 53A of the Indian Ports Act, 2025. It specifies the requirements for application submission, payment methods for compounding amounts, and the verification duties of the Conservator. These regulations are scheduled to come into force on July 1, 2026. **Key Points / Main Content** **Application Requirements and Submission** * **Form-A:** All applications for compounding offences must be submitted using the prescribed Form-A. * **Authorized Signatories:** Applications must be signed by the applicant or a duly authorized representative. * **Submission Channels:** Applications can be submitted physically at the office of the Conservator or electronically through a specified Central Government online portal. * **Documentation:** Physical submissions require self-attested copies of documents, while electronic submissions require scanned copies. * **Acknowledgment:** An application is only considered "duly made" once an official acknowledgment is issued; applicants must retain a copy of this for verification. **Processing and Verification** * **Conservator Duties:** The Conservator is responsible for verifying that the offence is compoundable, the application is complete, and proof of payment has been provided. * **Deficiency Corrections:** If an application is incomplete, the applicant has a 15-day window to provide the missing particulars. **Compounding Amount and Payment** * **Financial Terms:** The sum payable for compounding is equal to the fine specified for the offence in the First Schedule of the Act, subject to statutory ceilings. * **First Offence Limitation:** Compounding is generally applicable to first offences; it does not authorize the compounding of subsequent offences as per the Act’s provisos. * **Payment Methods:** Payments must be made to the Central Government via a treasury challan under a designated head or through an authorized online government payment portal. * **Proof of Payment:** Applicants must obtain a payment acknowledgment from the treasury or electronic system and submit it to the Conservator. **Impact Analysis** **Applicants (Offenders or Authorized Representatives)** **Impact** They are now required to follow a standardized, formal procedure to settle specific port-related offences through compounding. This provides a clear legal path to resolve violations without full prosecution, provided the offence is a first-time occurrence. **Action Required** Submit Form-A with the necessary self-attested documents, calculate and pay the compounding fee through authorized channels, and ensure all missing information is provided within 15 days if requested. **Conservators / Compounding Authorities** **Impact** Conservators are designated as the administrative authority responsible for the intake, verification, and approval of compounding requests. **Action Required** Set up systems to receive physical and electronic applications, issue dated acknowledgments, verify the "compoundable" status of offences, and manage the 15-day window for applicants to correct deficiencies. **Ministry of Ports, Shipping and Waterways / Central Government** **Impact** The Ministry is responsible for providing the legal and digital infrastructure to support the compounding process. **Action Required** Maintain the specified online portal for electronic submissions and ensure the authorized government payment portals and treasury heads are active and accessible by July 1, 2026.
