का. आ. 2215(अ).—भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना को भारत के
रािपत्र, असाधारण, भाग II, खंड 3, उप-खंड (ii) में क्रमांक का.आ. 1533 (अ), तारीख 14 जसतंबर, 2006 द्वारा
प्रकाजित दकर्ा गर्ा था जिसमें (जिसे इसमें इसके पश्चात उक्त अजधसूचना कहा गार्ा ह)ै की अनुसूची के अधीन जवजनर्िाष्ट
पररर्ोिनाओं र्ा दक्रर्ाकलापों के जलए पूवा पर्ाावरणीर् मंिूरी अपेजित ह;ै
और, राष्ट्रीर् हररत अजधकरण, तारीख 12 फरवरी, 2020 के अपन े आिेि के द्वारा, मलू आवेिन संख्र्ा 55/2019
(डब्लल्र्ूिेड), (गिुभा िेसर िाडेिा बनाम भारत संघ और अन्र्) में अन्र् बातों के साथ-साथ र्ह अवलोकन दकर्ा ह ै दक
कोल्ड रोल्ड स्ट्टेनलेस स्ट्टील जवजनमााण उद्योगों को पूवा पर्ाावरण मंिूरी की अपिे ा होती ह;ै
और, केंद्रीर् सरकार न े उक्त अजधसूचना के अधीन पूवा पर्ावा रणीर् मंिूरी प्राप्त करन े के जलए ऐसे कोल्ड रोल्ड स्ट्टेनलेस
स्ट्टील जवजनमााण उद्योगों हते ु एक जनजश्चत अवजध प्रिान करने के जलए राष्ट्रीर् हररत अजधकरण के उपर्ुाक्त उक्त आिेि के
अनुरूप एक सुजवचाररत जवजनश्चर् जलर्ा था;
और, उक्त अजधसूचना म ें संिोधन करन े के जलए प्रारुप अजधसूचना भारत के रािपत्र, असाधारण, भाग II, खंड 3,
उप-खंड (ii) क्रम संख्र्ांक का.आ. 5020 (अ) तारीख 22 नवंबर, 2023 द्वारा प्रकाजित दकर्ा गर्ा था जिसमें उन सभी

व्यजक्तर्ों से जिनकी उनसे प्रभाजवत होने की संभावना थी उस तारीख से साठ दिन की अवजध के भीतर जिसको उक्त् प्रारुप
अजधसूचना में अंतर्वाष्ट रािपत्र की प्रजतर्ां िनता को उपलब्लध कराई गई थी,आिेप और सुझाव आमंजत्रत दकए गए थ;े
और उक्त प्रारुप अजधसूचना के प्रजतउत्तर में प्राप्त आिपे और सझु ाव पर केंद्रीर् सरकार द्वारा सम्र्क रुप से जवचार
दकर्ा गर्ा;
अत: अब, केंद्रीर् सरकार, पर्ाावरण (संरिण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के खडं (घ) के साथ परठत
पर्ाावरण (संरिण) अजधजनर्म, 1986 की धारा 3 की उप-धारा (1) और उप-धारा (2) के खंड (v) द्वारा प्रित्त िजक्तर्ों
का प्रर्ोग करते हुए, तत्कालीन पर्ाावरण और वन मंत्रालर्, भारत सरकार का.आ. 1533 (अ) तारीख 14 जसतंबर, 2006
की अजधसूचना में जनम्नजलजखत और संिोधन करती ह ैअथाात:् -
उक्त अजधसूचना म,ें अनुसूची म,ें -
(क) मि 2 (ख) और उससे संबंजधत प्रजवजष्टर्ों के पश्चात् जनम्नजलजखत मि और प्रजवजष्टर्ां अंत:स्ट्थाजपत की िाएंगी,
अथाात ् :-

NOTIFICATION
New Delhi, the 7th June, 2024
S.O. 2215(E).— Whereas the notification of the Government of India in the erstwhile Ministry of
Environment and Forest was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) vide
number S.O. 1533 (E), dated the 14th September, 2006, requires prior environmental clearance for the projects or
activities specified under Schedule there of (hereinafter referred to as the said notification);
And whereas the National Green Tribunal vide its order, dated the 12th February, 2020, in Original
Application No. 55/2019 (WZ), (Gajubha Jesar Jadeja vs Union of India & Ors.), has, inter alia, observed that cold
rolled stainless steel manufacturing industries require prior environment clearance;
And whereas the Central Government, had taken a considered decision in line with the above said order of
the National Green Tribunal to provide a window period for such cold rolled stainless manufacturing industries to
obtain prior environmental clearance under the said notification;
And whereas a draft notification for making amendments in the said notification was published in the Gazette
of India, Extraordinary, Part-II, Section 3, Sub-section(ii), vide number S.O. 5020(E), dated the 22nd November,
2023, inviting objections and suggestions from all the persons likely to be affected thereby, within a period of sixty
days from the date on which copies of the Gazette containing the said draft notification were made available to the
Public;
And whereas the objections and suggestions received in response to the said draft notification have been duly
considered by the Central Government;
Now, therefore, in exercise of powers conferred by sub-section (1) and clause (v) of sub-section (2) of
section 3 of the Environment (Protection) Act, 1986 (29 of 1986), read with clause (d) of sub-rule (3) of rule 5 of the
Environment (Protection) Rules, 1986, the Central Government hereby makes the following further amendments in[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5
