(1) इस आदिे को एयर कंडीिनर तथा इसके संबद्ध पुजे, हमेरिक कम् प्रेसर और िेंपरेचर सेंससग कंरोल (गुणवत् ता जनयंत्रण) संिोधन आदिे , 2023 कहा जाएगा। (2) यह आजधकाररक राजपत्र में इसके प्रकािन की तारीख से प्रभावी होगा। 2. एयर कंडीिनर तथा इसके संबद्ध पुजे, हमेरिक कम् प्रेसर और िेंपरेचर सेंससग कंरोल (गुणवत् ता जनयत्रं ण) आदिे , 2019 म ें पैराग्राफ 2 में परंतुक के बाद जनम् नजलजखत परंतुक जोडा जाएगा, नामत: “बिते यह भी दक इस आदिे में से कुछ भी एयर कंडीिनर तथा इसके संबद्ध पुजे, हमेरिक कम् प्रेसर और िेंपरेचर सेंससग कंरोल (गुणवत् ता जनयंत्रण)संिोधन आदिे , 2023 के लाग ू दकए जाने की तारीख से एक वर्ध के जलए एयर कंडीिसनग और रेदिजरेिन उपकरण और इससे संबंजधत पुजों के जवजनमाधताओं पर 7000 वॉि (2 िीआर) से अजधक क्षमता के हमेरिक कम् प्रेससध पर लाग ूनहीं होगा। बिते यह भी दक इस आदिे में से कुछ भी एयर कंडीिसनग और रेदिजरेिन उपकरण और इसके संबंध पुजों के जवजनमाधताओं द्वारा अनुसंधान और जवकास प्रयोजन के जलए प्रजतवर्ध आयाजतत 200 वस्ट्त ुओं अथवा सामानों पर लाग ू नहीं होगा तथा इस ितध के 42 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अध्यधीन होगा दक ऐसी आयाजतत वस्ट्त ुओं और सामान को वाजणजज्यक रूप से बेचा नहीं जाएगा एव ं इसका स्ट् रैप के रूप में जनपिान दकया जा सकता ह ै तथा ओईएम ऐसी वस्ट्त ुओं और सामान का वर्ध-वार ररकॉडध रखेंगे और यदद सरकार द्वारा मांग े जाएं तो, इस े उपलब् ध कराएंगे। बिते यह भी दक एयर कंडीिनर तथा इसके संबद्ध पुजे, हमेरिक कम् प्रेसर और िेंपरेचर सेंससग कंरोल (गुणवत् ता जनयंत्रण) संिोधन आदिे , 2023 में से कुछ भी इस आदिे की अजधसूचना की तारीख से पहले ब्यूरो से प्रमाजणत जवजनमातध ा अथवा संगत वस्ट्त ओंु अथवा सामानों के जलए ब्यूरो से प्रमाणन हते ु आवेदन करने वाले जवजनमाधता द्वारा जवजनर्ममत अथवा आयाजतत वस्ट्त ुओं अथवा सामान पर लागू नहीं होगा तथा ऐसे जवजनमाधताओं को 31 माचध, 2024 से पहले ऐसे घोजर्त स्ट् िॉक बेचने अथवा प्रदर्मित करने अथवा बेचने का प्रस्ट्ताव करने की अनुमजत होगी जो दक इस ितध के अध्यधीन होगी दक ऐसे जवजनमाधता को ब्यूरो के समक्ष इस संबंध में एक घोर्णा पत्र प्रस्ट्तुत करना होगा। बिते यह भी दक इस आदिे में से कुछ भी एयर कंडीिसनग और रे दिजरेिन उपकरण और संबद्ध पुजों के प्रत् येक जवजनमाधता, जो ब्यूरो स े प्रमाजणत जवजनमाधता ह ैं अथवा जजन्होंने एयर कंडीिनर तथा इसके संबद्ध पुजे, हमेरिक कम् प्रेसर और िेंपरेचर सेंससग कंरोल (गुणवत् ता जनयंत्रण) संिोधन आदिे , 2023 के कायाधन्वयन की तारीख से तीन साल तक संगत वस्ट्तुओं अथवा सामानों के जलए ब्यूरो स े प्रमाणन हते ु आवेदन दकया है, द्वारा प्रजतवर्ध रखरखाव और जबरी के जलए स्ट् वदिे ी रूप से जवजनर्ममत या आयाजतत 6000 तक हमेरिक कम् प्रेसर और हीि एक् सचेंजसध पर लागू नहीं होगा तथा यह इस ितध के अध्यधीन होगा दक ऐसे जवजनमातध ाओं को स्ट् वदे िी रूप से जनर्ममत या आयाजतत हमेरिक कम् प्रेसर और हीि एक्सचेंजसध के अपने पुराने स्ट्िॉक की घोर्णा एयर कंडीिनर तथा इसके संबद्ध पुजे, हमेरिक कम् प्रेसर और िेंपरेचर सेंससग कंरोल (गुणवत् ता जनयंत्रण) संिोधन आदिे , 2023 के कायाधन्वयन की तारीख से पहले करनी होगी और ऐसी वस्ट्तुएं या सामान का वर्धवार ररकॉडध रखना होगा तथा इसे ब्यूरो के समक्ष इस संबंध में एक घोर्णा पत्र के साथ केंद्र सरकार को प्रदान करना होगा। बिते यह भी दक इस आदिे में से कुछ भी ऐसे स्ट् वदिे ी जवजनमाधता द्वारा हमेरिक कम् प्रेसर और हीि एक् सचेंजर के आयात पर लागू नहीं होगा, जो ब्यूरो द्वारा प्रमाजणत जवजनमाधता ह ैं अथवा जजन् होंने जनयाधत के जलए जवजनर्ममत उत्प ादों के जलए संगत उत् पादों हते ु ब्यूरो प्रमाणन हते ु आवेदन दकया है, यदद जनयाधत आदिे में उनका जविेर् रूप से उल् लेख दकया गया है।” [फा. सं. पी-29014/63/2017-एलईआई] संजीव, संयुक्त सजचव नोि:- मुख्य आदिे सां.आ. 4354 (अ), ददनांक 5 ददसंबर, 2019 के जररए भारत के राजपत्र, असाधारण, भाग II, धारा 3, उप-धारा (ii) में प्रकाजित दकया गया था तथा बाद में सां.आ. 1518 (अ) ददनांक 18 मई, 2020, सां.आ. 4671 (अ) ददनांक 22 ददसंबर, 2020, सां.आ. 5095 (अ) ददनांक 8 ददसंबर, 2021 और सां.आ. 5972 (अ) ददनांक 21 ददसंबर, 2022 के जररए इसमें संिोधन दकया गया था। MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal Trade) ORDER New Delhi, the 29th December, 2023 S.O. 32(E).—In exercise of the powers conferred by section 16 read with sub-section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Central Government, after consulting the Bureau, is of the opinion that it is necessary so to do in the public interest, hereby makes the following order further to amend the AirConditioner and its related Parts, Hermetic Compressor and Temperature Sensing Controls (Quality Control) Order, 2019, namely:— 1. (1) This order may be called the Air Conditioner and its related Parts, Hermetic Compressor and Temperature Sensing Controls (Quality Control) Amendment Order, 2023. (2) It shall come into force on the date of its publication in the Official Gazette. 2. In the Air Conditioner and its related Parts, Hermetic Compressor and Temperature Sensing Controls (Quality Control) order, 2019, in paragraph 2, after the proviso, the following proviso shall be inserted, namely: - “Provided further that nothing in this order shall apply to Hermetic Compressors of more than 7000 W (2 TR) capacity for one year from the date of commencement of the Air Conditioner and its related parts, Hermetic Compressor and Temperature Sensing Controls (Quality Control) Amendment Order, 2023 to the manufacturers of Air conditioning and Refrigeration equipment and related parts:[भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3 Provided also that nothing in this order shall apply for 200 numbers of goods or articles imported for the purpose of research and development by manufacturers of air conditioning and refrigeration equipment and related parts per year subject to the condition that such imported goods and articles will not be sold commercially and can be disposed of as a scrap and also the OEMs shall maintain a year-wise record of such goods or articles and furnish the same, if so desired by the Government: Provided also that nothing in this order shall apply to goods or articles domestically manufacturedor imported before the date of commencement of the Air Conditioner and its related Parts, Hermetic Compressor and Temperature Sensing Controls (Quality Control) Amendment Order, 2023 by the manufacturer certified by the Bureau or manufacturer who has applied to the Bureau for certification for the relevant goods and articles and such manufacturer shall be permitted to sell or display or offer to sell such declared stock up to the 31st March 2024 subject to the condition that such manufacturer shall made a declaration to this effect to the Bureau: Provided also that nothing in this order shall apply to up to 6,000 numbers of hermetic compressors and heat exchangers domestically manufacturedor imported for maintenance and sales per year by each of the manufacturers of air conditioning and refrigeration equipment and related parts who are certified by the Bureau or manufacturer who has applied to the Bureau for certification for the relevant goods and articles till three years from the date of commencement of the Air Conditioner and its related Parts, Hermetic Compressor and Temperature Sensing Controls (Quality Control) Amendment Order, 2023 subject to the condition that such manufacturers shall declare its old stock of hermetic compressors and heat exchangers domestically manufactured or imported before the date of commencement of the Air Conditioner and its related Parts, Hermetic Compressor and Temperature Sensing Controls (Quality Control) Amendment Order, 2023 and maintain a year-wise record of such goods or articles and furnish the same to the Central Government with a declaration made to this effect to the Bureau: Provided also that nothing in this order shall apply to hermetic compressor and heat exchanger imported by domestic manufacturer who are certified by the Bureau or manufacturer who has applied to the Bureau for certification for the relevant goods and articles for manufacturing products for export, if specifically mentioned in the export order".
