(अ).—भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) की धारा 17 और धारा 25 की उप-धारा (3) के साथ परित धारा 16 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, और खाद्य और पेय पदाथों के जलए कुकवेयर, बतनध और जडब्ब े (गणु वत्ता जनयंत्रण) आदेि 2025 के अजधक्रमण म,ें िहां तक यह पेय पदाथों के जलए गढ े एल्यूमीजनयम के बतनध और एल्यूमीजनयम के जडब्बों से संबंजधत है, जसवाय ऐसे कायों के, िो अजधक्रमण से पहले दकए गए अथवा जिन् ह ें दकए िाने से छोड़ ददया गया, केंद्र सरकार का, भारतीय मानक ब् यूरो से परामिध करने के बाद यह मत ह ै दक यह िनजहत म ेंआवश् यक अथवा जहतकर ह,ै अत: एतद्द्वारा जनम्न जलजखत आदेि करती ह,ै नामत:- 1. सजं िप्त िीर्कध और प्रारंभ - (1) इस आदेि को खाद्य और पेय पदाथों के जलए कुकवेयर, बतधन और जडब्बे (गुणवत्ता जनयंत्रण) आदेि, 2026 कहा िाएगा। (2) यह रािपत्र में इसके प्रकािन की तारीख से लागू होगा। 2. मानक जिह्न का अजनवाय ध प्रयोग – ताजलका के कॉलम (2) म ें जवजनर्दधष् ट वस्ट् तुएं या सामान ताजलका के कॉलम (3) म ें जवजनर्दधष्ट संबंजधत भारतीय मानक के अनरूु प होंगी तथा उन पर भारतीय मानक ब् यूरो (अनुपालन मल्ू यांकन) जवजनयम, 2018 की अनुसूिी-II की स्ट् कीम-I के अनुसार ब् यरू ो के लाइससें के तहत मानक जिह्न लगा होगा: बिते दक इस आदेि म ें से कुछ भी जनयाधत की िान े वाली स्ट् वदेि म ें जवजनर्मधत वस्ट् तओंु या सामान पर लाग ू नहीं होगा: 316 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] बिते यह भी दक सूक्ष्म, लघु और मध्यम उद्यम जवकास अजधजनयम, 2006 (2006 का 27) के तहत पररभाजर्त सूक्ष्म उद्यम और लघ ु उद्यम क्रमिः ताजलका के कॉलम (6) और (7) के अंतगधत संगत प्रजवजष्ट म ें जनर्दधष्ट जतजथ स े ऐसे भारतीय मानकों का अनुपालन करेंग:े बिते यह भी दक इस आदेि म ें कुछ भी ब्यरू ो द्वारा प्रमाजणत जवजनमाधता या ऐस े जवजनमाधता द्वारा, जिसन े प्रमाणन के जलए ब्यरू ो या आयातक द्वारा संबंजधत वस्ट्तओंु और सामानों के जलए आवेदन दकया ह,ै इस आदेि की ताजलका म ें जवजनर्दधष्ट कायाधन्वयन की तारीख स े पहल े घरेल ू रूप से जवजनर्मधत या आयाजतत वस्ट् तुओं या सामान पर लाग ू नहीं होगा, और ऐसे जनमाधता या आयातक को ताजलका के कॉलम (5), (6) और (7) में जवजनर्दधष्ट कायाधन्वयन की तारीख से छह महीन े तक ऐसे घोजर्त स्ट्टॉक की जबक्री करने या प्रदर्िधत करने या जबक्री का प्रस्ट्ताव करने की अनुमजत दी िाएगी, इस ितध के अध्यधीन दक ऐसे जवजनमाधता या आयातक, ब्यूरो के समि िाटधडध अकाउटेंट द्वारा प्रमाजणत इस आिय की घोर्णा करेंग:े बिते यह भी दक इस आदेि म ेंकुछ भी भारत म ेंआयात दकए िाने पर दकसी भी रूप में िोस, तरल या गैस के रूप में सामग्री से भरी वस्ट् तओंु या सामान पर लागू नहीं होगा: बिते यह भी दक इस आदेि म ें कुछ भी इस ितध के साथ प्रजत वर्ध खाद्य और पेय पदाथों के जलए कुकवेयर, बतनध और जडब्बों के जवजनमाधताओं द्वारा अनुसंधान और जवकास के प्रयोिनाथध आयाजतत दो सौ वस्ट् तुओं या सामानों पर लागू नहीं होगा, और ऐसी आयाजतत वस्ट्त ुओं या सामानों की वाजणजज्यक जबक्री नहीं की िाएगी तथा उन्ह ें स्ट् क्रैप के रूप में जनपटाया िा सकता ह,ै और जवजनमाधता ऐसी वस्ट् तुओं या सामानों का वर्धवार ररकाडध रखेंग े और यदद उसे केन्द्र सरकार को प्रस्ट्ततु करेंगे। ताजलका वस्ट् तु या भारतीय भारतीय सामान्यतः लघ ु उद्यमों के सूक्ष्म उद्यमों के सामान मानक मानक का कायाधन्वयन की जलए जलए िीर्धक तारीख कायाधन्वयन की कायाधन्वयन क्रम सं. (सूक्ष्म एवं लघ ु तारीख की तारीख उद्यमों को छोड़कर) (1) (2) (3) (4) (5) (6) (7) 1. 1660:2024 गढे एल्यूमीजनयम के बतधन खाद्य और पेय पदाथों के जलए 1 अिूबर, 1 िनवरी, 1 अप्रलै , 2027 2. 14407:2023 पेय पदाथों के कुकवेयर, बतधन और जडब्ब े जलए 2026 2027 एल्यूमीजनयम के जडब्ब े # नोट- इस ताजलका के प्रयोिन के जलए, भारतीय मानकों के संबंध म ें िारी संिोधनों सजहत उनके नवीनतम संस्ट् करण, िैसा दक ब् यरू ो द्वारा समय-समय पर अजधसूजित दकए गए ह,ैं लाग ू होंगे। 3. प्रमाणन और प्रवतधन प्राजधकरण – उि ब्यरू ो, ताजलका के कॉलम (2) म ेंजवजनर्दधष्ट वस्ट्तओंु या सामान के जलए प्रमाणन एव ंप्रवतधन प्राजधकरण होगा। [फा-पी .स ं.29026/14/2023-एलईआई] संिीव, संयुि सजिव[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 MINISTRY OF COMMERCE AND INDUSTRY (Department of Promotion of Indistry and Internal Trade) ORDER New Delhi, the 15th January, 2026 S.O. 219 (E).—In exercise of the powers conferred by section 16 read with section 17 and sub-section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016) and in supersession of the Cookware, Utensils and Cans for Foods and Beverages (Quality Control) Order 2025, in so far as it relates to Wrought Aluminium Utensils and Aluminium Cans for Beverages, except as respects things done or omitted to be done before such supersession, the Central Government, is of the opinion that it is necessary or expedient so to do in the public interest, after consulting the Bureau hereby makes the following order, namely:- 1. Short title and commencement. – (1) This Order may be called the Cookware, Utensils and Cans for Foods and Beverages (Quality Control) Order, 2026. (2) It shall come into force on the date of its publication in the Official Gazette. 2. Compulsory use of Standard Mark. - Goods or articles specified in column (2) shall conform to the corresponding Indian Standard specified in column (3), of the Table and shall bear the Standard Mark under a licence from the Bureau as per Scheme-1 of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018: Provided that nothing in this order shall apply to goods or articles manufactured domestically for export: Provided further that the micro enterprise and small enterprise, as defined under the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006) shall conform to such Indian Standards from the date specified in the corresponding entry under columns (6) and (7) of the Table respectively: Provided also that nothing in this order shall apply to goods or articles domestically manufactured or imported before the date of implementation specified in the Table of this order by the manufacturer certified by the Bureau or manufacturer who has applied to the Bureau for certification or by the importer for the relevant goods and articles and such manufacturer or importer shall be permitted to sell or display or offer to sell such declared stock up to six months from the date of implementation specified in columns (5), (6) and (7) of the Table, subject to the condition that such manufacturer or importer shall make a declaration to this effect certified by a Chartered Accountant to the Bureau: Provided also that nothing in this order shall apply to goods or articles filled with material in any form solid, liquid or gas, when imported into India: Provided also that nothing in this order shall apply for two hundred number of goods or articles imported for the purpose of research and development by manufacturers of cookware, utensils and cans for food and beverages per year with the condition that such imported goods and articles shall not be sold commercially and shall be disposed of as a scrap and the manufacturer shall maintain a year-wise record of such goods and articles and furnish to the Central Government.
