1. सजं िप्त िीर्कध और प्रारंभ – (1) इस आदिे को खाद्य और पेय पदाथों के जलए कुकवेयर, यूटेंजसल् स और कैन् स (गणु वत् ता जनयंत्रण) आदेि, 2024 कहा िाएगा। (2) इस आदिे में अन् यथा की गई व् यवस्ट् था को छोड़कर, यह आदेि रािपत्र म ेंइसके प्रकािन की तारीख से प्रभावी होगा। 2. मानक जिह्न का अजनवाय ध प्रयोग – ताजलका के कॉलम (2) म ें जवजनर्दधष् ट वस्ट्त ुए ं या सामान ताजलका के कॉलम (3) में जवजनर्दधष् ट तदनुरूपी भारतीय मानक के अनुरूप होंगे तथा उन पर भारतीय मानक ब् यूरो (अनुपालन मूल् यांकन) जवजनयम, 2018 की अनुसूिी-II की स्ट् कीम-I के अनसु ार भारतीय मानक ब् यरू ो के लाइसेंस के तहत मानक जिह्न लगा होगा। 6654 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] बिते दक इस आदेि का कोई भी प्रावधान जनयाधत के जलए घरेलू स्ट्तर पर जवजनर्मधत वस्ट्तुओं या सामानों पर लाग ू नहीं होगा: बिते यह दक सूक्ष्म, लघु और मध्यम उद्यम जवकास अजधजनयम, 2006 (2006 का 27) के तहत पररभाजर्त लघ ु उद्यम और सूक्ष्म उद्यम, ताजलका के क्रमिः कॉलम (6) और (7) के तहत संबंजधत प्रजवजि म ें जनर्दधि जतजथ से ऐस े भारतीय मानकों का अनुपालन करेंगे: बिते यह भी दक इस आदेि में कोई भी प्रावधान, ऐसे उद्यमों द्वारा घरेल ू रूप से जनर्मधत माल या वस्ट्तओंु पर लाग ू नहीं होगा, िो सूक्ष्म, लघ ु और मध्यम उद्यम मंत्रालय के "उद्यम पोटधल" पर पंिीकृत ह,ैं जिनमें संयंत्र और मिीनरी या उपकरण की मलू लागत पर पच्चीस लाख रुपए से अजधक जनवेि नहीं दकया गया हो और िाटधडध अकाउंटेंट द्वारा प्रमाजणत दकए गए अनुसार जपछले जवत्त वर्ध का टनधओवर दो करोड़ रुपए से अजधक ना हो। बिते यह भी दक इस आदिे का कोई भी प्रावधान उन माल या वस्ट्तुओं पर भी लाग ू नहीं होगा, िो इस आदेि की ताजलका में जनर्दधि कायाधन्वयन की तारीख से पहल,े ब्यरू ो द्वारा प्रमाजणत जवजनमाधता या प्रमाणन हते ु ब्यूरो के समि आवेदन करने वाले जवजनमाधता या संगत माल या वस्ट्तओंु के आयातक द्वारा घरेलु रूप से जवजनर्मधत या आयाजतत दकया गया हो, ऐस े जवजनमाधता या आयातक को इस आदेि की ताजलका में कायाधन्वयन जवजनदेि की तारीख से छह माह तक ऐसे घोजर्त स्ट्टॉक की जबक्री करने या प्रदर्िधत करने या जवक्रय करन े का प्रस्ट्ताव करन े की अनुमजत इस ित ध के अध्यधीन होगी दक ऐस े जवजनमाधता या आयातक द्वारा िाटधडध अकाउंटेंट द्वारा प्रमाजणत की गई इस आिय की घोर्णा ब्यूरो को दी िाएगी: बिते दक इस आदेि में कोई भी प्रावधान उन माल या वस्ट्तुओं पर भी लाग ू नहीं होगा, िो भारत म ें आयात दकए िाने पर िोस, तरल या गैस के दकसी भी रूप में सामग्री से भरे हुए ह:ैं बिते दक इस आदेि का कोई भी प्रावधान खाद्य और पये पदाथों के जलए कुकवेयर, यूटेंजसल् स और कैन् स जवजनमाधताओं द्वारा अनुसंधान और जवकास के प्रयोिन के जलए प्रजत वर् ध आयाजतत दो सौ वस्ट्तओंु या सामानों तक आयाजतत वस्ट्तुओं या सामानों पर, इस ितध के साथ लाग ू नहीं होगा दक ऐसी आयाजतत वस्ट्तओंु या सामानों को वाजणजज्यक रूप स े बेिा नहीं िाएगा और उन्ह ें स्ट्क्रैप के रूप म ें जनपटान दकया िाएगा तथा जवजनमाधता ऐसे माल या वस्ट्तओंु का वर्धवार अजभलेख रखेंग ेऔर इसका जववरण केन्द्र सरकार को प्रस्ट्तुत करेंगे। 3. प्रमाणन और प्रवतनध प्राजधकरण – भारतीय मानक ब् यरू ो ताजलका के कॉलम (2) में जवजनर्दधष् ट वस्ट् तुओं या सामान के जलए प्रमाणन और प्रवतनध प्राजधकरण होगा। 4. उल्ल घं न के जलए पने ल्ट ी– इस आदेि के प्रावधानों का उल्ल ंघन करन े वाल े दकसी व् यजि को भारतीय मानक ब् यरू ो अजधजनयम, 2016 के प्रावधानों के तहत दंजडत दकया िाएगा। ताजलका क्रम वस्ट् तु तथा भारतीय मानक भारतीय मानक सामान्य रूप स े सूक्ष्म उद्यमों के जलए लघ ु उद्यमों के जलए सं. सामान का िीर्धक कायाधन्वयन की कायाधन्वयन की कायाधन्वयन की जतजथ (सूक्ष्म और जतजथ जतजथ लघ ु उद्यमों को छोड़कर) (1) (2) (3) (4) (5) (6) (7) 1. खाद्य और पेय 14756:2022 स्ट्टेनलेस स्ट्टील 1 अप्रलै , 2025 1 अिूबर, 2025 1 िूलाई, 2025 पदाथों के यूटेंजसल्स जलए 2. 1660:2009 रॉट कुकवेयर, एल्यूमीजनयम यूटेंजसल् स और यूटेंजसल्स कैन् स 3. 13983:1994 घरेलू प्रयोिनों के जलए स्ट्टेनलेस स्ट्टील ससंक[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 4. 9396 (भाग 1): खाद्य और पेय 1987 पदाथों के जलए राउंड ओपन टोप सैजनटरी कैन्स - 29026/14/2023– एलईआई] संिीव, संयुक् त सजिव MINISTRY OF COMMERCE AND INDUSTRY (Department For Promotion Of Industry And Internal Trade) ORDER New Delhi, the 11th October, 2024 S.O. 4494(E).—In exercise of the powers conferred by section 16 read with section 17 and sub- section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016) and in supersession of the Cookware, Utensils and Cans for foods and beverages (Quality Control) Order 2024, except as respects things done or omitted to be done before such supersession, the Central Government, after consulting the Bureau of Indian Standards, is of the opinion that it is necessary or expedient so to do in the public interest, hereby makes the following order, namely:- 1. Short title and commencement. – (1) This Order may be called the Cookware, Utensils and Cans for Foods and Beverages (Quality Control) Order, 2024. (2) Save as otherwise provided in this order, it shall come into force on the date of its publication in the official Gazette. 2. Compulsory use of Standard Mark.- Goods or articles specified in Column (2) of the Table shall conform to the corresponding Indian Standard specified in Column (3) of the Table and shall bear the Standard Mark under a license from the Bureau as per Scheme-1 of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018: Provided that nothing in this order shall apply to goods or articles manufactured domestically for export: Provided further that the micro enterprise and small enterprise, as defined under the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006) shall conform to such Indian Standards from the date specified in the corresponding entry under columns (6) and (7) of the Table respectively: Provided also that nothing in this order shall apply to goods or articles manufactured domestically by an enterprise, registered under "Udyam portal" of the Ministry of Micro, Small and Medium Enterprises, wherein the investment in plant and machinery or equipment at original cost does not exceed twenty-five lakh rupees and the turnover does not exceed two crore rupees for the previous financial year as certified by a Chartered Accountant: Provided also that nothing in this order shall apply to goods or articles domestically manufactured or imported before the date of implementation specified in the Table of this order by the manufacturer certified by the Bureau or manufacturer who has applied to the Bureau for certification or by the importer for the relevant goods and articles and such manufacturer or importer shall be permitted to sell or4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] display or offer to sell such declared stock up to six months from the date of implementation specified in the Table of this Order, subject to the condition that such manufacturer or importer shall make a declaration to this effect certified by a Chartered account to the Bureau: Provided also that nothing in this order shall apply to goods or articles filled with material in any form solid, liquid or gas, when imported into India: Provided also that nothing in this order shall apply for two hundred numbers of goods or articles imported for the purpose of research and development by manufacturers of Cookware, Utensils and Cans for Food and Beverages per year with the condition that such imported goods and articles shall not be sold commercially and shall be disposed of as a scrap and the manufacturer shall maintain a year-wise record of such goods and articles and furnish to the Central Government. 3. Certification and enforcement authority.- The Bureau shall be the certifying and enforcing authority for the goods or articles specified in Column (2) of the Table. 4. Penalty for contravention.- Any person who contravenes the provisions of this Order shall be punishable under the provisions of the Bureau of Indian Standards Act, 2016.
