L.-33004/99 सी.जी.-डी.एल.-अ.-23012025-260384 CG-DxLx-xEG-I2D3H0x1x2x0 25-260384 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 352] नई ददल्ली, मगं लवार, िनवरी 21, 2025/माघ 1, 1946 No. 352] NEW DELHI, TUESDAY, JANUARY 21, 2025/MAGHA 1, 1946 वाजणज्य और उद्योग मत्रं ालय (उद्योग सवं धनध और आतं ररक व्यापार जवभाग) आदेि अजधसचू ना नई ददल् ली, 16 िनवरी, 2025 का.आ. 355(अ).—भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) की धारा 16 द्वारा प्रदत् त िजियों का प्रयोग करते हुए और डोमेजस्ट्िक वॉिर हीटिंग के जलए जवदयतु उपकरण (गणु वत्ता जनयंत्रण) आदेि, 2023 के अजधक्रमण म,ें जसवाय ऐसे कायों के िो इस अजधक्रमण से पहल े दकए गए हों अथवा दकए िान े से छूि गए हों, केंद्र सरकार का भारतीय मानक ब्यूरो स े परामि ध करने के बाद यह मत ह ै दक यह िनजहत म ें आवश्यक अथवा जहतकर है, अत: एतद्वारा जनम्नजलजखत आदेि करती ह,ै नामत: - 1. सजं िप्त िीर्कध और प्रारंभ – (1) इस आदिे को डोमेजस्ट्िक वॉिर हीटिंग के जलए जवदयतु उपकरण (गणु वत्ता जनयंत्रण) आदेि, 2025 कहा िाएगा। (2) यह आदिे रािपत्र में इसके प्रकािन की तारीख से प्रभावी होगा। 2. मानक जचह्न का अजनवाय ध प्रयोग – ताजलका के कॉलम (1) में जवजनर्दधष्ट वस्ट्तुए ं या सामान ताजलका के कॉलम (2) में जवजनर्दधष्ट तदनरूु पी भारतीय मानक के अनरूु प होंगे तथा उन पर भारतीय मानक ब्यरू ो (अनुपालन मूल्यांकन) जवजनयम, 2018 की अनुसूची-II की -I के अनुसार ब्यूरो के लाइसेंस के तहत मानक जचह्न लगा होगा। 512 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] बिते दक इस आदेि का कोई भी प्रावधान जनयाधत के जलए घरेलू स्ट्तर पर जवजनर्मधत वस्ट्तुओं या सामानों पर लाग ू नहीं होगा: बिते यह दक सूक्ष्म, लघु और मध्यम उद्यम जवकास अजधजनयम, 2006 (2006 का 27) के तहत पररभाजर्त लघ ु उद्यम और सूक्ष्म उद्यम, ताजलका के क्रमिः कॉलम (5) और (6) के तहत संबंजधत प्रजवजष्ट म ें जनर्दधष्ट जतजथ से ऐस े भारतीय मानकों का अनुपालन करेंगे: बिते दक इस आदेि का कोई भी प्रावधान डोमेजस्ट्िक वॉिर हीटिंग के जलए जवद्युत उपकरण के जवजनमाधताओं द्वारा अनुसंधान और जवकास के प्रयोिन के जलए प्रजत वर् ध आयाजतत दो सौ वस्ट्तओंु या सामानों तक आयाजतत वस्ट्तओंु या सामानों पर लागू नहीं होगा एवं ऐसी आयाजतत वस्ट्तओंु या सामानों को वाजणजज्यक रूप से बेचा नहीं िाएगा और उनका स्ट्क्रैप के रूप म ें जनपिान दकया िाएगा तथा जवजनमाधता ऐसे माल या वस्ट्तओंु का वर्धवार ररकाडध रखगें े और इसका जववरण केन्द्द्र सरकार को प्रस्ट्तुत करेंगे। 3. प्रमाणन और प्रवतनध प्राजधकरण – ब्यूरो ताजलका में जवजनर्दधष्ट वस्ट्तओंु या सामान के जलए प्रमाणन और प्रवतधन प्राजधकरण होगा। 4. उल्लघं न के जलए पने ल्िी- इस आदिे के प्रावधानों का उल्लघं न करन े वाल े व्यजि को भारतीय मानक ब्यूरो अजधजनयम, 2016 के प्रावधानों के तहत दंजडत दकया िाएगा। ताजलका वस्ट् तु तथा भारतीय मानक भारतीय मानक का सामान्द्य रूप से सूक्ष्म उद्यमों के लघ ु उद्यमों के सामान िीर्धक कायाधन्द्वयन की जलए जलए जतजथ (सूक्ष्म और कायाधन्द्वयन की कायाधन्द्वयन की लघु उद्यमों को जतजथ जतजथ छोड़कर) डोमेजस्ट्िक 302 (भाग 2/ स्ट्िेिनरी स्ट्िोरेि 01 माच,ध 2025 01 जसतंबर, 01 िून, 2025 वॉिर हीटिंग के खंड 21): 2018 िाइप इलेजररक 2025 जलए जवदयुत वॉिर हीिर के जलए उपकरण उपकरण 302 (भाग 2/ इलेजररक खंड 35): 2017 इंस्ट्िेंिेजनयस वॉिर हीिर के जलए उपकरण 368:2014 इलेजररक इमसधन वॉिर हीिर 2082:2018 स्ट्िेिनरी स्ट्िोरेि िाइप इलेजररक वॉिर हीिर 17150:2019 पाइप्ड नैचरु ल गैस (पीएनिी) से चलन े वाला जमनी डोमेजस्ट्िक वॉिर हीिर नोि – इस ताजलका के प्रयोिन के जलए, भारतीय मानकों के सबं ंध में िारी संिोधनों सजहत उनके नवीनतम संस्ट् करण, िैसा दक ब् यरू ो द्वारा समय-समय पर अजधसूजचत दकए गए ह,ैं लाग ूहोंगे। [फा.सं. पी - 29026/8/2024– एलईआई] संिीव, संयुि सजचव[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 MINISTRY OF COMMERCE AND INDUSTRY (DEPARTMENT FOR PROMOTION OF INDUSTRY AND INTERNAL TRADE) ORDER NOTIFICATION New Delhi, 16th January, 2025 S.O. 355(E).—In exercise of the powers conferred by section 16 of the Bureau of Indian Standards Act, 2016 (11 of 2016) and in supersession of the Electrical Appliance for domestic water heating (Quality Control) Order, 2023, except as respects things done or omitted to be done before such supersession, the Central Government, after consulting the Bureau of Indian Standards, is of the opinion that it is necessary or expedient so to do in the public interest, hereby makes the following order, namely:- 1. Short title and commencement. – (1) This order may be called the Electrical Appliances for domestic water heating (Quality Control) Order, 2025. (2) It shall come into force on the date of its publication in the official Gazette. 2. Compulsory use of Standard Mark.- Goods or articles specified in column (1) of the Table shall conform to the corresponding Indian Standard specified in column (2) of the Table and shall bear the Standard Mark under a license from the Bureau as per Scheme-1 of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018: Provided that nothing in this order shall apply to goods or articles manufactured domestically for export: Provided further that the micro enterprises and small enterprises, as defined under the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006) shall conform to such Indian Standards from the date specified in the corresponding entry under columns (5) and (6) of the Table respectively: Provided also that nothing in this order shall apply for two hundred numbers of goods or articles imported for the purpose of research and development by manufacturers of electric appliances for domestic water heating per year and such imported goods and articles shall not be sold commercially and can be disposed of as a scrap and the manufacturers shall maintain a year-wise record of such goods or articles and furnish to the Central Government. 3. Certification and enforcement authority.- The Bureau shall be the certifying and enforcing authority for the goods or articles specified in the Table. 4. Penalty for contravention.- Any person who contravenes the provisions of this order shall be punishable under the provisions of the Bureau of Indian Standards Act, 2016.
