Notifying of QCO for Air Conditioner and its related parts, Hermetic Compressors and Temperature Sensing Controls (Quality Control) Amendment Order 2022
## Report on the Air Conditioner and its related Parts, Hermetic Compressors and Temperature Sensing Controls Quality Control Amendment Order, 2022
**1. Executive Summary:**
This report analyzes the Air Conditioner and its related Parts, Hermetic Compressors and Temperature Sensing Controls Quality Control Amendment Order, 2022, as published in the Gazette of India on December 21, 2022. This amendment modifies the Air Conditioner and its related Parts, Hermetic Compressors and Temperature Sensing Controls Quality Control Order, 2019. The key change is an extension of the implementation deadline for certain provisions of the 2019 order, pushing it from January 1, 2023, to October 1, 2023. This report details the specific change, its likely rationale, and the potential impact on stakeholders.
**2. Introduction:**
The purpose of this report is to provide information and analysis regarding the Air Conditioner and its related Parts, Hermetic Compressors and Temperature Sensing Controls Quality Control Amendment Order, 2022, based solely on the text of the official notification. It aims to inform affected industries about the specific change introduced and its implications.
**3. Policy Overview:**
This document is an amendment to the Air Conditioner and its related Parts, Hermetic Compressors and Temperature Sensing Controls Quality Control Order, 2019. The core objective of the original 2019 order, as inferred from the amendment, is to establish quality control measures for air conditioners, their related parts, hermetic compressors, and temperature sensing controls.
**4. Background and Rationale:**
This amendment likely addresses concerns related to the readiness of manufacturers and other stakeholders to comply with the quality control standards mandated by the original 2019 order by the initial deadline of January 1, 2023. The extension suggests that industries may have required additional time to adjust their processes, obtain certifications, or address other logistical challenges to meet the stipulated quality control requirements. This extension is being done in the public interest, as determined by the Central Government after consulting the Bureau of Indian Standards
**5. Key Provisions / Changes:**
This amendment *specifically* modifies paragraph 1, subparagraph 2, of the Air Conditioner and its related Parts, Hermetic Compressors and Temperature Sensing Controls Quality Control Order, 2019. The original text specified an implementation date of “the 1st January, 2023”. The amendment *changes* this date to “1st October, 2023”.
The *effect* of this change is a nine-month delay in the enforcement of the provisions originally scheduled to take effect on January 1, 2023. This provides manufacturers and other relevant entities with additional time to comply with the quality control standards.
**6. Target Audience and Stakeholders:**
Based on the text and the nature of the Order, the directly affected audience and stakeholders include:
* Manufacturers of air conditioners and related parts.
* Manufacturers of hermetic compressors.
* Manufacturers of temperature sensing controls.
* Importers and distributors of these products.
* The Bureau of Indian Standards (BIS).
* Consumers who purchase these products.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency:** The Department for Promotion of Industry and Internal Trade (Ministry of Commerce and Industry) is the responsible agency. The Bureau of Indian Standards (BIS) plays a consultative role.
* **Timeline:** The key timeline change is the extension of the implementation date to October 1, 2023. No specific procedures related to the extension are detailed in the provided text, but it can be inferred that companies should use this time to ensure they are compliant by the new deadline.
**8. Expected Outcomes / Impact of Changes:**
The primary intended outcome of this amendment is to facilitate a smoother transition to the mandatory quality control standards for the air conditioning industry. By extending the deadline, the government likely aims to minimize disruptions to the supply chain and allow manufacturers sufficient time to achieve compliance. This could result in:
* Reduced risk of non-compliance and associated penalties.
* More orderly adoption of quality control measures by manufacturers.
* Potentially a more robust and sustainable implementation of the quality control order in the long term.
**9. Conclusion:**
The Air Conditioner and its related Parts, Hermetic Compressors and Temperature Sensing Controls Quality Control Amendment Order, 2022, represents a significant adjustment to the implementation timeline of the 2019 Quality Control Order. The extension to October 1, 2023, provides affected industries with additional time to prepare for and meet the required quality standards. Understanding this amendment is crucial for all stakeholders to ensure compliance and avoid potential disruptions to their operations. This adjustment highlights the government's intent to promote quality control while also considering the practical challenges faced by industry stakeholders.
