L.-33004/99 सी.जी.-डी.एल.-अ.-30012025-260636 CG-DxLx-xEG-I3D0H0x1x2x0 25-260636 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 525] नई ददल्ली, बृहस्ट्प जतवार, िनवरी 30, 2025/माघ 10, 1946 No. 525] NEW DELHI, THURSDAY, JANUARY 30, 2025/MAGHA 10, 1946 वाजणज्य और उद्योग मत्रं ालय (उद्योग सवं धनध और आतं ररक व्यापार जवभाग) आदेि नई ददल्ली, 30 िनवरी, 2025 का.आ. 529(अ).—भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) की धारा 16 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, तथा एयर कूलर और एयर दिल्टर (गणु वत्ता जनयंत्रण) आदेि, 2023 के अजधक्रमण म,ें ऐस ेअजधक्रमण से पहल े दकए गए या दकए िान े के जलए छोडे गए कायों के जसवाय, केंद्र सरकार का, भारतीय मानक ब्यरू ो स ेपरामि ध करने के बाद यह मत ह ैदक यह िनजहत में आवश्यक अथवा जहतकर ह,ै अत: एतद्वारा जनम्नजलजखत आदिे करती ह,ै नामत:- 1. सजं िप्त िीर्कध और प्रारंभ - (1) इस आदेि को एयर कूलर और एयर दिल्टर (गुणवत्ता जनयंत्रण) आदेि, 2025 कहा िाएगा। (2) यह आजधकाररक रािपत्र म ेंइसके प्रकािन की तारीख स ेलागू होगा। 2. मानक जिह्न का अजनवाय ध प्रयोग – ताजलका के कॉलम (2) म ें जवजनर्दधष्ट वस्ट्तुएं या सामान ताजलका के कॉलम (3) में उजल्लजखत तदनुरूपी भारतीय मानक के अनरूु प होंग े तथा उन पर भारतीय मानक ब् यूरो (अनुपालन मूल्यांकन) जवजनयम, 2018 की अनुसूिी-II के स्ट् कीम-I के अनुसार ब्यरू ो के लाइसेंस के तहत मानक जिह्न लगा होगा। 764 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] बिते दक सूक्ष्म, लघ ु और मध्यम उद्यम जवकास अजधजनयम, 2006 (2006 का 27) के तहत पररभाजर्त लघ ु उद्यम और सूक्ष्म उद्यम, ताजलका के क्रमिः कॉलम (6) और (7) के तहत संबंजधत प्रजवजष्ट में जनर्दधष्ट जतजथ से ऐसे भारतीय मानकों का अनुपालन करेंग:े बिते दक इस आदेि में स े कुछ भी जनयाधत की िाने वाली स्ट्वदिे म ें जवजनर्मधत वस्ट्तओंु या सामान पर लागू नहीं होगा। बिते यह भी दक इस आदेि की कोई भी बात, केंद्र सरकार के सूक्ष्म, लघु और मध्यम उद्यम मंत्रालय के "उद्यम पोटधल" पर पंिीकृत दकसी उद्यम द्वारा घरेल ू स्ट्तर पर जवजनर्मधत उन वस्ट्तओंु या सामानों पर लाग ू नहीं होगी, जिनमें मलू लागत पर संयंत्र और मिीनरी या उपकरण म ेंजनवेि पच्चीस लाख रुपए से अजधक नहीं ह ैऔर जपछल ेजवत्त वर्ध का टनओध वर दो करोड रुपए से अजधक नहीं ह ैऔर जिसे िाटधड धअकाउंटेंट द्वारा प्रमाजणत दकया गया हो। बिते यह भी दक इस आदेि की कोई भी बात एयर कूलर और एयर दिल् टर के जवजनमाधताओं द्वारा अनुसंधान और जवकास के प्रयोिन के जलए प्रजतवर्ध आयाजतत दो सौ वस्ट्तओंु या सामानों पर लागू नहीं होगी, तथा साथ ही यह ितध होगी दक ऐसी आयाजतत वस्ट्तओंु और सामानों को वाजणजज्यक रूप से बेिा नहीं िाएगा और उन्ह ेंस्ट्क्रैप के रूप म ेंजनपटाया िाएगा तथा जवजनमाधता ऐसे माल या वस्ट्तुओं का वर्धवार ररकॉडध रखेंग ेऔर केंद्र सरकार को प्रस्ट्तुत करेंगे। बिते यह भी दक इस आदेि म ें से कुछ भी, संगत सामानों या वस्ट्तुओं के जलए ब्यूरो द्वारा प्रमाजणत जवजनमाधता या जवजनमाधता जिसने प्रमाणन के जलए ब्यरू ो को आवेदन दकया है, द्वारा इस आदेि के प्रारंभ की तारीख से पहल े घरेल ू रूप स े जवजनर्मधत या आयाजतत सामानों या वस्ट्तओंु पर लाग ूनहीं होगा तथा ऐसे जवजनमाधता को ऐसे घोजर्त स्ट्टॉक को 31 अक्टूबर, 2025 तक बेिन े या प्रदर्िधत करने या बेिन े का प्रस्ट्त ाव करने की अनुमजत होगी, िो इस ितध के अध्यधीन ह ै दक ऐस े जवजनमाधता ने ब्यूरो को इस आिय की घोर्णा की हो। 3. प्रमाणन और प्रवतनध प्राजधकरण – ब् यरू ो ताजलका के कॉलम (2) म ें जवजनर्दधष्ट वस्ट्तुओं या सामानों के जलए प्रमाणन और प्रवतधन प्राजधकरण होगा। 4. उल्लघं न के जलए पने ल्टी – इस आदेि के प्रावधानों का उल्लघं न करने वाल े व्यजि को भारतीय मानक ब्यरू ो अजधजनयम, 2016 के प्रावधानों के तहत दंजडत दकया िाएगा। ताजलका क्रम स.ं वस्ट्त ुअथवा भारतीय मानक भारतीय मानक का िीर्कध सामान्य रूप स े लघ ुउद्यमों के सक्ष्ू म उद्यमों के सामान कायान्ध वयन की जलए कायान्ध वयन जलए कायान्ध वयन जतजथ (सक्ष्ू म की जतजथ की जतजथ और लघ ु उद्यमों को छोडकर) (1) (2) (3) (4) (5) (6) (7) 1 एयर कूलर 3315:2019 इवैपोरेरटव एयर कूलर(डेिटध कूलर) 1 अप्रैल, 2025 1 िुलाई, 2025 1 अक् तूबर, 2025 और एयर 2 17570 सामान्य वेंरटलेिन के जलए एयर दिल्टर दिल्टर – पार्टधकुलेट मैटर (भाग 1): 2021 दिता(ईपीएम) के आधार पर आईएसओ तकनीकी जवजनदेि आवश्यकताएं और 16890-2: 2016 वगीकरण[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 नोट – इस ताजलका के प्रयोिन के जलए, भारतीय मानकों के सबं ंध में िारी संिोधनों सजहत उनके नवीनतम संस्ट्करण, िैसा दक भारतीय मानक ब्यरू ो द्वारा समय-समय पर अजधसूजित दकए गए ह,ैं लागू होंगे। [िा. सं. पी- 29026/25/2023– एलईआई] संिीव, संयक्ु त सजिव MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal Trade) ORDER New Delhi, the 30th January, 2025 S.O. 529(E).— In exercise of the powers conferred by section 16 of the Bureau of Indian Standards Act, 2016 (11 of 2016) and in supersession of the Air Cooler and Air Filters (Quality Control) Order, 2023, except as respects things done or omitted to be done before such supersession, the Central Government, after consulting the Bureau of Indian Standards, is of the opinion that it is necessary or expedient so to do in the public interest, hereby makes the following Order, namely:- 1. Short title and commencement.- (1) This Order may be called the Air Cooler and Air Filters (Quality Control) Order, 2025. (2) It shall come into force on the date of its publication in the Official Gazette. 2. Conformity to Standard and Compulsory use of Standard Mark.- Goods or articles specified in column (2) of the Table shall conform to the corresponding Indian Standard mentioned in column (3) of the Table and shall bear the Standard Mark under a license from the Bureau as per Scheme-1 of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018: Provided that the small enterprise and micro enterprise, as defined under the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006) shall conform to such Indian Standards from the date specified in the corresponding entry under columns (6) and (7) of the Table respectively: Provided further that nothing in this Order shall apply to goods or articles manufactured domestically for export: Provided also that nothing in this Order shall apply to goods or articles manufactured domestically by an enterprise, registered under “Udyam Portal” of the Central Government in the Ministry of Micro, Small and Medium Enterprises, wherein the investment in plant and machinery or equipment at original cost does not exceed twenty-five lakh rupees and the turnover does not exceed two crore rupees for the previous financial year as certified by a Chartered Accountant: Provided also that nothing in this Order shall apply for two hundred numbers of goods or articles imported for the purpose of research and development by manufacturers of Air Cooler and Air Filters per year with the condition that such imported goods and articles shall not be sold commercially and shall be disposed of as a scrap and the manufacturer shall maintain a year-wise record of such goods or articles and furnish to the Central Government: Provided also that nothing in this Order shall apply to goods or articles domestically manufactured or imported before the date of commencement of this Order by the manufacturer certified by the Bureau or manufacturer who has applied to the Bureau for certification for the relevant goods and articles and such manufacturer shall be permitted to sell or display or offer to sell such declared stock up to the 31st October, 2025 subject to the condition that such manufacturer shall made a declaration to this effect to the Bureau. 3. Certification and enforcement authority.- The Bureau shall be the certifying and enforcing authority for the goods or articles specified in column (2) of the Table. 4.
