TAMIL NADU MEDIcAL cOUNcIL, chENNAI. Tamil Nadu Medical council at its Special Business Meeting held on 11th April, 2018. (Ref. No. TNMC/G 502/2018) No.VI(1)/371/2018. The Tamil Nadu Medical council at its Special Business Meeting held on 11th April,2018 has passed the following Resolutions. 3) “THE cME cREDIT REGISTRATION”: 3.1Brief: As per the code of Medical Ethics Regulations 2002 (amended upto 8th October 2016) and published in Part Ill, section 4 of the Gazette of India dated 6th April 2002. section 1 and clause 1.2.3 and vide the directions of the Medical council of India in their letter No. McI-7(9) /2011 Med./58885 dt 24.01.2012 to do crediting of the hours of participation in the cME programmes once in 5 years. The cME crediting process was announced by Medical council of India (McI) by incorporating the mandatory 30 hours of cME every 5 years in the code of Medical Ethics Regulations in 2012. subsequently the Tamil Nadu Medical council in its resolution dated 21.03.2012 have started the process. 3.2The TNMC has been carrying out the certification of CMEs held by various organizations in the state complying with the directions of the Medical council of India. 3.3 The council discussed the same elaborately and resolved to start the “cME credit Registration” for the period 2012-2017 as per the following guidelines. 3.3.1. The “cME credit Registration” should be done by all Medical graduates who have registered before 2013. (once in 5 years from the date of their M.b.b.s. individual registration.) 3.3.2. The “cME credit Registration” will be done for all Registered Medical Practitioners. 3.3.3. The fees for “CME Credit Registration” will be fixed and collected by TNMC 3.3.4. The process will be started shortly after completing the preparatory work, tentatively in November-December,2018. DTP—VI-1 (41)—1aOct. 10, 2018] TAMIL NADU GOVERNMENT GAZETTE 337 3.3.5. Registration / accreditation of reputed professional academic bodies and organizations for holding TNMc approved CME will be updated first. 3.3.6. subsequently, these organizations / institutions will be allowed to get a one-time retrospective approval for crediting of CME held by these organizations during the period 2012-2017. (after verification of the records produced) 3.3.7. For those who have not acquired 30 credit hours since 2012, s/he will have to pay a Fees based on the shortage of credit hours. The practitioners will be permitted to carry-over the credit hours short this term to the next block-5 years. 3.3.8. The “carry-Over Fees” will be Rs.50/- for carrying over the shortage of one credit hour. The fees has been fixed leniently as the “CME Crediting Process” is being done for the first time. 3.3.9. For defaulters, not doing the ‘cME credit Registration” before the stipulated time the late fee will be 5 fold and further they shall be considered to have violated the code of Medical Ethics Regulations section / clause 1.2.3. 3.3.10. The “cME credit Registration” will be intimated to all practitioners through a paper advertisement and communication letter to heads of Directorates and all Medical colleges, I.M.A, all specialty Associations, TNGDA. 3.3.11. A letter will written to MCI seeking clarifications on CME hours for crediting on the discrepancy in their letter with that of the code para 1.2.3 on the calculation of cME hours. The further decision will be taken based on the reply from McI and legal opinions on the calculation of cME hours and after publishing the same in Tamil Nadu Government Gazette. 3.3.12. A committee comprising Dr.R.V.s.surendran, Dr.T.sadagopan, Dr.R.Thiagarajan and Dr.P.Ramakrishnan have formulated the following Procedures for cME Accreditation. PROcEDURES fOR cME AccREDITATION:- 1. Medical councils shall consider the applications for accreditation of following organization for holding cME Programmes and convey their approval if the organization fulfills all requirements. (a) All recognised Medical colleges. (b) Indian Medical Association or the state/District/Tehsil/city chapters of the Indian Medical Association. (c) National Academy of Medical sciences. (d) specialists Associations (only National level Associations or their state chapters) (e) All Recognised Postgraduate Medical Institutions. (f) Central Govt. and State Govt. Hospitals(including Districts Hospitals) and training centers in health field including Ministry of health and family welfare, Defence, Railways. (g) International conference of Professional bodies (h) National conference of Professional bodies (i) state level conference of National Organizations. (j) Professional bodies of repute functional at District, city, state level ego Physician Forum / surgeons forum / Doctors Forum etc. in their areas I specialities and super specialties. (k) Educational Foundations setup for specific super speciality subjects (l) Private Medical Institutions with multi specialty Departments. (m) Private Medical Institutions registered with the state authorities as trusts. (2) Any professional organization or body or institution which wants to hold cME should apply for accreditation to the state Medical Council. The Council on verifying the credentials of the organization will give certificate of accreditations to those bodies to hold cMEs. (3) Accreditation will be for the period of 5 years subject to renewal on review. (4) (A) In case of accredited institutions/associations / bodies, every cME will not require separate permission. however state Medical council should reserve the right of periodic surprise checks / inspection to assess the functioning of cME system. The state Medical council will have right to revoke accreditation of any institution/association/body if it finds that CME is not held as per the guidelines.338 tamil nadu government gazette [Part VI—sec.1 (b) Those Institutions/associations / bodies which are not accredited must apply for cME with names of the speakers, program, duration etc. for permission to state Medical councils. (c) If foreign /NRI faculty members are involved in any teaching activity then accredited as well as non accredited organizations will need to take separate advance permission from Medical council of India after applying in the prescribed format. (5) Accreditation/credit hours to be awarded will be based on type of cME (i.e. for Family Physicians, for specialty Practitioners / national conference etc.) Duration (whether ½ day, 1day / 2days / 3days etc) and subject. (6) Association / Organization should strictly issue the Attendance certificate to the delegate who has attended the CME.No Certificate should be distributed on the first day at the time of Registration of the C.M.E./Conference. This Practice should be taken care of. The Certificates be distributed /awarded only on the last day. (7) Association /Organization will be duty bound to send the feedback of the delegates and the list of the delegates who have attended the cME conference. The details should include registration number, name of the state council and degree/qualification. (8) In case it is found that the certificate is false the issuing Association/Organization will be debarred for future accreditation. (9) state Medical council should maintain database of all cMEs and individual doctors credit hours either in computerized format or as paper records. (10) All accredited organizations must have at least two cMEs in a year on subject of Medical Ethics and National health Policy. credit Hours to the cME/ State/ District / Tehsil / National / International conference/ Workshop Organized may be follows; 1. Each cME/state /District/Tehsil/National/International conference/ workshop of two days(5-6 hours daily) shall be eligible for following credits. super speciality-8. for speciality-6, for Graduates doctors-4 2. The doctors may attend the International cMEs/ conferences held overseas as delegates. On the production of the certificates of attendance. CME Credit hours will be given. 3. Doctors doing Post graduate courses e.g. Diploma, M.D., M.s., D.N.b., M.ch., D.M.(Abroad) etc., from recognised /reputed Institutions in India will get 6 credit hours per year for the duration of the courses. eg. First year 6 credit hours, second year 6 credit hours, Third year 6 credit hours. 4. speakers at any conference /cME/workshop /Training Programme will be given one credit hour per talk in addition to the credit hours allotted for that particular academic activity. 5. Doctors working as Medical teachers can claim 6 Credit hours per year after producing certificate from their head of Institution that, they are taking undergraduate / postgraduate classes are engaged in postgraduate, research work. Exemption A) Medical Practitioners above the age of 65 years may complete only 15 credit hours in 5 years. b) Medical Practitioners above the age of 70 should be exempted from the preview of sec 1.2.3. c) Any Medical Practitioner who is unable to attend due reasons of ill health should submit adequate documentation to avail of exemption. State Medical Council’s decision will be final. 22. PENALTY fOR USING UN-REcOGNISED DEGREES, TITLES BY REGISTERED MEDIcAL PRAcTITIONERS. According to Regulation 1.4.2 of the Tamil Nadu Medical Council Code of Ethics Regulations 2002, “Physician shall display as suffix to their names only recognized medical degrees or such certificates/diplomas and memberships/honours which confer professional knowledge or recognizes any exemplary qualification / achievements” After discussion, the council opined that there are many violations in the display of unrecognized degrees, false issuing and using medical titles by Registered Medical Practitioners, and we have to levy the penalty to them.
