2024 से आरंभ होने िाल े और 30 जसतम्ब र, 2025 को समाप् त होन े िाल े अफीम फसल िष थ के िौरान केन्‍दर सरकार की ओर से लांससंग के माध्यम से अफीम गोंि प्राप्त करने के जलए अफीम पोस्ट्त की खेती के जलए लाइसेंस प्रिान करने हते ु नीच ेजनर्िथष्ट सामान्‍दय ितों को अजधसूजचत करती ह:ै - 1. खते ी का स्ट्र्ान अफीम पोस्ट्त की खेती के जलए केंर सरकार द्वारा इस संबंध में अजधसूजचत दकसी भी क्षेत्र म ेंलाइसेंस दिया िा सकता ह।ै 2. खते ी के जलए पात्रता इस अजधसूचना के खंड 3 और 7 के अधीन, जनम्नजलजखत दकसान (जिजधक िाररसों सजहत) लांससंग के माध्यम स े अफीम गोंि प्राप्त करने के जलए अफीम पोस्ट्त की खेती करने के जलए लाइसेंस के जलए पात्र होंग:े 7093 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (i) ऐसे दकसान जिन्‍दहोंने फसल िषथ 2023-24 के िौरान अफीम पोस्ट्त की खेती की हो और प्रजत हक्े टेयर 4.2 दकलोग्राम से कम मॉर्फथन (एमक्यूिाई-एम) की औसत उपि पिे नहीं की हो। नोट- दकलोग्राम प्रजत हक्े टेयर में पेि की गई अफीम में मॉर्फथन की औसत अहकथ उपि को इसके बाि अजधसूचना में न्‍दयूनतम अहकथ उपि (एमक्यूिाई-एम) कहा िाएगा। (ii) ऐसे दकसान जिन्‍द होंने इसस ेसंबंजधत प्रािधानों के अनुसार केन्‍द रीय स्ट् िापक ब् यरू ो की िेखरेख म ेंफसल िष थ2021- 22, 2022-23 और 2023-24 के िौरान अपनी संपूणथ पोस्ट्त की फसल की िुताई की हो, परन्‍द तु जिन्‍द होंने इसी तरह फसल िष थ 2020-21 के िौरान अपनी सम् पूण थ पोस्ट् त फसल की ितु ाई नहीं की र्ी। (iii) िे दकसान जिनके लाइसेंस मंिरू न करन े के जखलाफ अपील को फसल िषथ 2023-24 में जनपटान की अंजतम तारीख के बाि अनुमजत िे िी गई हो। (iv) ऐसे दकसान िो फसल िषथ 2023-24 के जलए लाइसेंस के जलए पात्र र्े, लेदकन दकसी कारण से जिन्‍दह ें लाइससें प्राप्त नहीं हुआ/िारी नहीं हुआ, या जिन्‍दहोंने लाइसेंस प्राप्त करने के बाि िास्ट्ति में दकसी कारण से अफीम की खेती नहीं की। (v) दकसान जिसे फसल िषथ 2023-24 के जलए फामथ संख्या 1 (जनयम 7 िेखें) के कॉलम संख्या 11 में मृतक पात्र दकसान द्वारा नाजमत दकया गया हो। (vi) जिला अफीम अजधकारी द्वारा यर्ा-जनधाथररत प्रदिया का पालन करने के बाि मृतक पात्र कृषकों के कानूनी उत्तराजधकाररयों में स े एक, ऐस े मामलों म ें िहां दकसी कारण से फॉमथ संख्या 1 म ें नामांकन नहीं दकया गया ह ै या फॉमथ संख्या 1 में पररिार के सिस्ट्यों / रक्त संबंजधयों की पररभाषा के अतं गतथ नहीं आने िाल े व्यजक्त का नामांकन दकया गया ह।ै (vii) ऐसे दकसान जिन्‍दहोंने फसल िष थ 2023-24 के िौरान लांससंग के माध्यम से पोस्ट्त भूसा उत्पािन के जलए अफीम पोस्ट्त की खेती की र्ी, जिसमें से कोई रस नहीं जनकाला िाता ह ै और जिन्‍दहोंन े तौल केंर पर पोस्ट्त भूसा प्रस्ट्तुत दकया ह,ै जिसकी औसत उपि 900 दकलोग्राम प्रजत हक्े टेयर या उससे अजधक ह।ै 3. लाइससें की ित ें दकसी भी दकसान को तब तक लाइसेंस नहीं दिया िाएगा िब तक दक िह जनम्नजलजखत ितों को पूरा नहीं करता ह:ै (i) उसने िास्ट्तजिक खते ी के िौरान फसल िष थ 2023-24 के िौरान पोस्ट् त की खते ी के जलए लाइसेंसिुिा िास्ट् तजिक क्षेत्र से 5% ‘क्षम् य क्षेत्र’ से अजधक क्षेत्र में खते ी न की हो| (ii) उसने कभी भी अफीम पोस्ट् त की अिैध खते ी न की हो तर्ा स्ट् िापक औषजध तर्ा मन:प्रभािी पिार्थ अजधजनयम, 1985 और उसके अतं गतथ बनाये गए जनयमों के अंतगथत उस पर दकसी अपराध के जलए दकसी सक्षम न्‍द यायालय म ें आरोप नहीं लगा हो। (iii) उसने फसल िषथ 2023-24 के िौरान केन्‍दर ीय स्ट्िापक ब् यरू ो/स्ट्िापक आयुक् त द्वारा दकसानों को िारी दकन्‍द हीं जिभागीय अनुिेिों का उल्ल ंघन नहीं दकया हो| 4. अजधकतम क्षत्रे (i) उपयुथक्त खंड 2 के अंतगथत पात्र सभी दकसानों को केिल एक प्लॉट में 0.10 हक्े टेयर का लाइसेंस िारी दकया िाएगा। यह भूखंड एक से अजधक रािस्ट्ि खसरा नम्बरों म ेंफैला हुआ हो सकता ह।ै[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (ii) दकसानों को, यदि िे चाह ेंतो, लाइसेंस प्राप्त क्षेत्र को परू ा करन ेके जलए िसू रों की भूजम को पट्टे पर लेन ेकी अनुमजत होगी। 5. पिू थचते ािनी (i) आने िाले िष थअर्ाथत ् 2025-26 म ेंअफीम पोस्ट् त की खते ी के जलए लाइसेंस प्राप् त करन े की पात्रता हते ु फसल िष थ 2024-25 के िौरान 5.9 दकलोग्राम माफीन प्रजत हक्े ट ेयर की न्‍दय नू तम अहकथ उपि (एमक्युिाई-एम) िने ा िरूरी ह।ै (ii) िषथ 2024-25 के िौरान िी गई अफीम में माफीन की मात्रा को फसल िषथ 2024-25 के भुगतान का आधार माना िा सकता ह,ै यदि सरकार इस बारे में जनणथय ले। (iii) ऐसे दकसान जिन्‍द होंने फसल िष थ 2021-22, 2022-23 और 2023-24 के िौरान अपनी पूरी फसल की ितु ाई कर िी र्ी उनको फसल िष थ 2025-2026 के जलए लाइसेंस का पात्र नहीं माना िाएगा, यदि उन्‍दहोंने फसल िष थ 2024-25 म ेंभी पुन: अपन ेफसलों की पूरी तरह िुताई कर िी हो। 6. क्षम्य सीमा: यदि खेती दकया गया िास्ट् तजिक क्षेत्र लाइसेंसिुिा क्षेत्र स े5 प्रजतित तक अजधक ह ैतो ऐसा अजधक क्षत्रे क्षम् य हो सकता ह।ै 7. जिजिध i. फसल िष थ2024-25 के िौरान अफीम गोंि के उत्पािन के जलए अफीम पोस्ट्त की खेती के जलए लाइसेंस िारी करने के जलए पात्र दकसानों को आिेिन पत्र संख्या 1 में भूखंड के माजलक का जििरण, उस भखू ंड की सिेक्षण संख्या आदि िने ी होगी जिसमें िे अफीम पोस्ट्त की फसल उगाने का इरािा रखत ेह ैंऔर सार् ही नारकोरटक्स आयुक्त द्वारा जनिेजित कोई अन्‍दय जििरण भी िने ा होगा। ii. ये सामान्‍दय लाइसेंससंग ित ेंस्ट्िापक औषजध एि ंमन:प्रभािी पिार्थ अजधजनयम, 1985 और उसके अधीन बनाए गए जनयमों के प्रािधानों के अनुसार, िब भी उजचत समझा िाए, स्ट्िापक आयुक्त/ स्ट्िापक उप-आयक्तु के लाइसेंस िारी करने/रोकने के अजधकार पर प्रजतकूल प्रभाि डाले जबना ह।ैं iii. लाइसेंस इस ित थ पर दिया िाएगा दक दकसी भी खेत को सरकार द्वारा अर्िा सरकार द्वारा जिजिष्ट संस्ट् र्ा अर्िा एिेंसी के सार् सहयोग करके दकये िाने िाले अनुसंधान के प्रयोिनार्थ अजधग्रजहत दकया िा सकता ह।ै जिस दकसान के खते ों को अनुसंधान के जलए चनु ा िाएगा उसका अगल े िष थ लाइसेंस मंिरू करन े पर जिचार दकया िाएगा बिते उसने (जनधाथररत न्‍द यनू तम अहकथ ) उपि प्रस्ट् ततु की हो और िह अन्‍द यर्ा पात्र हो। अनुसंधान हते ु चुन े गए क्षेत्र को उपि की गणना करत े समय लेखे म ेंनहीं जलया िाएगा। iv. कृषक द्वारा प्रस्ट्तुत अफीम का भुगतान करने के प्रयोिनार्थ, रािकीय अफीम एिं अल्कलॉइड कारखाना, नीमच या गािीपुर द्वारा जिश्लषे ण के आधार पर, या तो कृषक द्वारा प्रस्ट्तुत अफीम की मात्रा के 70° सांरता के आधार पर या माफीन की मात्रा के आधार पर की िाएगी, यदि सरकार ऐसा करने का जनणयथ लते ी ह।ै v. ऐसे कृषकों के संबंध म ेंजिनके पास दकसी जििेष गांि म ेंअफीम की खेती का लाइसेंस ह,ै लेदकन ि ेजनकटिती गांि म ें जनिास करत े हैं, ऐस े कृषकों को अपन े जनिास में अफीम का भंडारण करन े की अनुमजत िी िा सकती ह,ै बित े दक ऐसे गांिों के बीच जनरंतर मानि बजस्ट्तया ंहों। vi. पात्र दकसानों के नाम सीबीएन िेबसाइट (cbn.nic.in) और/या सीबीएन ऑनलाइन पोटथल (cbnonline.nic.in) पर अपलोड दकए िाएंग े और दिए गए मोबाइल नंबर पर संिेि, मले आदि िैसे अन्‍दय माध्यमों से सूजचत दकया िा सकता ह।ै पात्रता सूची में सूचीबद्ध दकसान जनधाथररत समय सीमा के भीतर लाइसेंस प्राप्त करने के जलए सीबीएन ऑनलाइन पोटथल पर ऑनलाइन मोड के माध्यम से आििे न करेंगे।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] vii. मौिूिा लाइसेंसधाररयों को ऐस ेकागिात िमा करन े की आिश्यकता नहीं होगी जिसकी िानकारी सीबीएन के पास पहल े से ही ह।ै जपछले िषथ से दकसी भी पररितथन के मामले में िानकारी प्रिान की िाएगी। viii. अफीम नीजत 2024-25 के जहन्‍दिी संस्ट्करण के दकसी पैरा में यदि कोई अंतर हो तो उसका अंग्रिे ी संस्ट्करण ही अपनाया िाएगा। [फा. सं. एन-14011/1/2024-एनसी-1] राम लखन, अिर सजचि MINISTRY OF FINANCE (Department of Revenue) NOTIFICATION New Delhi, the 30th October, 2024 No. 02/2024-Narcotics Control-1 G.S.R. 676(E).— In pursuance of rule 8 of the Narcotic Drugs and Psychotropic Substances Rules, 1985, the Central Government hereby notifies the general conditions for grant of license specified below for cultivation of opium poppy for obtaining opium gum through lancing on account of the Central Government during the Opium Crop Year commencing on the 1st day of October, 2024 and ending with the 30th day of September, 2025. 1. Place of Cultivation Opium poppy cultivation may be licensed in any tract as may be notified in this behalf by the Central Government. 2. Eligibility for Cultivation Subject to clauses 3 and 7 of this notification, the following cultivators (including legal heirs) shall be eligible for a license to cultivate opium poppy for obtaining opium gum through lancing: (i) Cultivators who had cultivated opium poppy during the crop year 2023-24 and tendered an average yield of Morphine (MQY-M) not less than 4.2 kg per hectare. Note- Average qualifying yield of Morphine in opium tendered in kilograms per hectare will be termed as Minimum Qualifying Yield (MQY-M) in the notification hereinafter. (ii) Cultivators who ploughed back their entire poppy crop, cultivated during the crop year 2021-22, 2022-23 & 2023-24 under the supervision of the Central Bureau of Narcotics in accordance with the provisions in this regard, but had not similarly ploughed back their entire poppy crop during 2020-21. (iii) Cultivators whose appeal against refusal of License has been allowed after the last date of settlement in the crop year 2023-24. (iv) Cultivators who were eligible for a license for the crop year 2023-24, but did not obtain license for any reason, or who after having obtained a license, did not actually cultivate opium poppy due to any reason. (v) Cultivator who is nominated by deceased eligible cultivator in column No. 11 in Form No. 1 (see rule 7) for the crop year 2023-24. (vi) One of legal heirs of deceased eligible cultivators as determined by the District Opium Officer after following the due process, in the cases where nomination in Form No.1 is not made for any reason or nomination of person not falling under definition of family members/ blood relatives in Form No. 1 is made. (vii) Cultivators who had cultivated opium poppy for production of Poppy Straw from which no juice is extracted through lancing during the crop year 2023-24 and have tendered poppy straw at weighment center with an average yield of 900 kg per hectare or more. 3. Conditions of License No cultivator shall be granted license unless he/she satisfies that: (i) He/ She did not, in the course of actual cultivation, exceed the area licensed for poppy cultivation during the crop year 2023-24 beyond the 5% ‘Condonable Limit’ allowed in the licensing policy. (ii) He/she did not at any time resort to illicit cultivation of opium poppy and was not charged in any competent court for any offence under the Narcotic Drugs and Psychotropic Substances Act, 1985 and the Rules made there under. (iii) He/she did not, during the crop year 2023-24, violated any of the departmental instructions issued by the Central Bureau of Narcotics/ Narcotics Commissioner to the cultivators.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 4. Maximum Area (i) All the cultivators eligible under clause 2 above will be issued license of 0.10 Hectare in one plot only. This plot may be spread across more than one revenue khasra numbers. (ii) Cultivators will be permitted to take on lease, land belonging to others, to make up the licensed area, if they so desire. 5. Forewarning (i) A minimum qualifying yield (MQY–M) of 5.9 Kg Morphine/ Hectare of Morphine in opium tendered should be achieved during the crop year 2024-25 to become eligible for a license to cultivate opium poppy in the following year i.e. 2025-26. (ii) Morphine content of opium tendered during 2024-25 may become the basis for payment for the crop year 2024-25, if the Government decides to do so in this regard. (iii) Cultivators who had fully ploughed back their entire poppy during crop year 2021-22, 2022-23 and 2023- 24 would not be entitled for license in the crop year 2025-26, if they have also ploughed back their crop fully in the crop year 2024-25. 6. Condonable Limit: If the area actually cultivated is up to 5% in excess of the licensed area, such excess cultivation may be condoned. 7. Miscellaneous (i) The cultivators eligible for issue of license for opium poppy cultivation for production of Gum Opium during the Crop Year 2024-25 shall provide in the Application Form No. 1 the details of owner of the plot, survey number etc of the plot in which they are intending to cultivate opium poppy crop as well as any other details as may be suitably and reasonably notified by the Narcotics Commissioner. (ii) These General Licensing conditions are without prejudice to the right of the Narcotics Commissioner/ Deputy Narcotics Commissioner to issue/ withhold a license whenever it is deemed proper so to do in accordance with the provisions of the Narcotic Drugs & Psychotropic Substances Act, 1985 and the Rules made thereunder. (iii) The license shall be subject to the condition that any field may be taken over for any research that may be conducted by the Government directly or in collaboration with any specialized Institution or Agency for obtaining opium gum or poppy straw without extraction of opium. The cultivator whose field is selected for research shall be considered for license for the next year, if he/ she has tendered the stipulated MQY-M and is otherwise eligible. The area taken over for research will not be taken into account while calculating the Average yield. (iv) For the purpose of making payment of opium tendered by the cultivator, on the basis of analysis by the Government Opium and Alkaloid Works, Neemuch or Ghazipur, either on the quantity of opium tendered by a farmer calculated at 70° consistency or on the morphine content basis, if government decides to do so. (v) In respect of cultivators having opium cultivation license in a particular village but are having residence in the adjacent village, such cultivators may be allowed to store opium in their residence, provided that there is continuous human settlement between such villages. (vi) The name of eligible cultivators will be uploaded on CBN website(cbn.nic.in) and/or CBN online portal (cbnonline.nic.in) and may be communicated through other means like messages on given mobile number, mails etc. The cultivators listed in the eligibility list shall apply through online mode on CBN Online Portal for obtaining license within the stipulated timeline. (vii) Existing licensees shall not be required to submit paper for which information is already with CBN. Information will be provided in case of any change from previous year.
