आदेश सं. आईआरडीएआई/एफ&आई/ओआरडी/एमआईएससी/108/8/2026 Order No. IRDAI/F&I/ORD/MISC/108/8/2026 ददन ंक / Date: 17th August, 2026 आदेश / ORDER बीम अदिदनयम, 1938 की ि र 52डी के अिीन आदेश – सह र इंदडय ल इफ इंश्योरेंस कं पनी दलदमटेड के संबंि में प्रश सक की दनयुक्ति के आदेश क दनरसन Order under Section 52D of the Insurance Act, 1938-Cancellation of the order of Appointment of Administrator in respect of Sahara India Life Insurance Company Limited 1. सहारा इंशिया लाइफ इंश्योरेंस कं पनी शलशमटेि (“बीमाकर्ाा”) को बीमा अशिशनयम, 1938 (“अशिशनयम”) के अिीन जीर्वन बीमा व्यर्वसाय संचाशलर् करने के शलए प्राशिकरण द्वारा सं. 127 से युक्त पंजीकरण प्रमाणपत्र प्रदान शकया गया था। 2. प्राशिकरण ने बीमाकर्ाा के पाशलसीिारको ंके शहर्ो ंका संरक्षण करने के प्रयोजन के शलए, बीमा अशिशनयम, 1938 की िारा 52ए के अंर्गार् प्रदत्त िस्ट्क्तयो ं का प्रयोग करर्े हुए, आदेि सं. आईआरिीएआई/एफ&ए/ओआरिी/एफए/134/06/2017 शदनांक 12 जून 2017 (“उक्त आदेि”) के अनुसार बीमाकर्ाा के प्रिासक के रूप में श्री आर. के . िमाा को शनयुक्त शकया था। 3. उक्त प्रिासक को कायाकु िलर्ा के अनुरूप अशिकाशिक शमर्व्यशयर्ा के साथ बीमाकर्ाा के व्यर्वसाय के प्रबंि का संचालन करने के शलए बीमा अशिशनयम, 1938 के अंर्गार् लागू उपबंिो ं के अनुसार िस्ट्क्तयााँ और कर्ाव्य स पं े गये थे। 4. र्दुपरांर्, प्राशिकरण ने आदेि संदभाः आईआरिीएआई/एफ&आई/ओआरिी/शर्वशर्वि/ 119/6/2023 शदनांक 2 जून 2023 के अनुसार बीमाकर्ाा के जीर्वन बीमा व्यर्वसाय का अंर्रण एसबीआई लाइफ इंश्योरेंस कं पनी शलशमटेि (एसबीआई लाइफ) को करने के शलए आदेि जारी शकया है। 5. उपयुाक्त आदेि के अनुसरण में, बीमाकर्ाा के जीर्वन बीमा व्यर्वसाय का अंर्रण, उससे संबंशिर् आस्ट्ियो ं और देयर्ाओ ं सशहर्, शर्वशि के अनुसार एसबीआई लाइफ इंश्योरेंस कं पनी शलशमटेि को शकया गया है। पररणामस्वरूप, अंर्ररर् बीमा व्यर्वसाय के सभी पाशलसीिारको ं संबंिी सशर्वाशसंग और दाशयत्ो ंका शनर्वाहण एसबीआई लाइफ इंश्योरेंस कं पनी शलशमटेि द्वारा शकया जा रहा है। 6. प्राशिकरण ने बीमाकर्ाा के पास प्रिासक की शनयुस्ट्क्त की शनरर्ंरर्ा की समीक्षा की है र्था इस संबंि में शनम्नानुसार पाया हैः क) उक्त प्रिासक को शनयुक्त करने का प्राथशमक प्रयोजन पाशलसीिारको ं के संरक्षण के शलए उपयुक्त शर्वशनयामक कारार्वाई होने र्क बीमाकर्ाा के कायों का परररक्षण करना और प्रिासन को संभालना था; ख) बीमा व्यर्वसाय का अंर्रण पूरा शकया गया है; पष्ृ ठ / Page 1 का / of 3 सर्वे सं. 115/1, फाइनंशियल शिस्ट्रिक्ट, नानकरामगुिा, हैदराबाद - 500032 Survey No. 115/1, Financial District, Nanakramguda, Hyderabad 500 032 दूरभाष Phone: 040-20204000; www.irdai.gov.inग) उक्त प्रिासक द्वारा प्रबंिन या प्रिासन के शलए अपेशक्षर् कोई बीमा व्यर्वसाय नही ंबचा है; र्था घ) प्रिासक की शनयुस्ट्क्त का प्रयोजन पूरा हो गया है। 7. अर्ः प्राशिकरण इस बार् से संर्ुष्ट है शक पररस्ट्िशर्यो ं के शलए उक्त अशिशनयम की िारा 52िी के अिीन प्रिासक की शनयुस्ट्क्त के संबंि में जारी शकये गये आदेि को शनरि करने की आर्वश्यकर्ा है। 8. अर्ः अब प्राशिकरण बीमा अशिशनयम, 1938 की िारा 52िी के अंर्गार् प्रदत्त िस्ट्क्तयो ंका प्रयोग करर्े हुए इसके द्वारा शनम्नानुसार आदेि जारी करर्ा हैः क) आदेि सं. आईआरिीएआई/एफ&ए/ओआरिी/एफए/134/06/2017 शदनांक 12 जून 2017 के अनुसार सहारा इंशिया लाइफ इंश्योरेंस कं पनी शलशमटेि के प्रिासक के रूप में श्री आर. के . िमाा को शनयुक्त करनेर्वाला आदेि इस आदेि की र्ारीख से शनरि शकया जाएगा र्था श्री आर. के . िमाा उक्त बीमाकर्ाा के प्रिासक की िस्ट्क्तयो ं का प्रयोग करना और कायों का शनष्पादन करना समाप्त करेंगे। ख) िेयरिारको ं के शनर्वेिो ं के शनयंत्रण और पयार्वेक्षण सशहर्, बीमाकर्ाा का प्रबंिन और कायों का शनर्वाहण 17.8.2026 से प्रभार्वी रूप में उक्त बीमाकर्ाा में शनशहर् शकये जाएाँगे और उनका संचालन उक्त बीमाकर्ाा के द्वारा शकया जाएगा। 9. यह स्पष्ट शकया जार्ा है शक यह आदेि— क) उक्त प्रिासक द्वारा अपनी शनयुस्ट्क्त की अर्वशि के द रान शकये गये शकसी भी काया, शनणाय, शनदेि अथर्वा कारार्वाई की शर्वशिमान्यर्ा को प्रभाशर्वर् नही ंकरर्ा; ख) प्राशिकरण अथर्वा शकसी अन्य सक्षम प्राशिकारी के द्वारा प्रारंभ शकये गये अथर्वा प्रारंभ करने के शलए प्रिाशर्वर् शकसी भी अन्वेषण, शनरीक्षण, जााँच, न्यायशनणायन, अशभयोजन अथर्वा अन्य शर्वशिक या शर्वशनयामक कायार्वाही पर प्रशर्कू ल प्रभार्व नही ंिालेगा। 1. Sahara India Life Insurance Company Limited (“the insurer”) was granted a certificate of registration bearing no.127 by the Authority to carry on life insurance business under the Insurance Act, 1938 (“the Act”). 2. The Authority, for the purpose of protecting the interests of the policyholders of the insurer, in exercise of the powers conferred under Section 52A of the Insurance Act, 1938, vide Order No. IRDAI/F&A/ORD/FA/134/06/2017 dated 12th June, 2017 ("the said Order"), had appointed Shri R.K. Sharma as the Administrator of the insurer. 3. The Administrator was entrusted with powers and duties as per the applicable provisions under the Insurance Act, 1938 to conduct the management of the business of the insurer with the greatest economy compatible with efficiency. 4. Subsequently, the Authority, vide order ref: IRDAI/F&I/ORD/MISC/119/6/2023 dated 2nd June, 2023, has ordered for transfer of the life insurance business of the insurer to SBI Life Insurance Company Limited (SBI Life). पष्ृ ठ / Page 2 का / of 3 सर्वे सं. 115/1, फाइनंशियल शिस्ट्रिक्ट, नानकरामगुिा, हैदराबाद - 500032 Survey No. 115/1, Financial District, Nanakramguda, Hyderabad 500 032 दूरभाष Phone: 040-20204000; www.irdai.gov.in5. Pursuant to the aforesaid order, the insurance business of the insurer, together with the assets and liabilities pertaining thereto, stood transferred to SBI Life Insurance Company Limited in accordance with law. Consequently, all policyholder servicing and obligations under the transferred insurance business are being discharged by SBI Life Insurance Company Limited. 6. The Authority has reviewed the continuance of the appointment of the Administrator with the insurer and observes as under: a) the primary purpose of appointing the Administrator was to preserve and administer the affairs of the insurer pending appropriate regulatory action for protection of policyholders; b) the transfer of the insurance business has been completed; c) there remains no insurance business requiring management or administration by the Administrator; and d) the purpose of appointment of Administrator has been fulfilled. 7. The Authority is, therefore, satisfied that the circumstances warrant cancellation of the order regarding appointment of the Administrator under Section 52D of the Act. 8. Now, therefore, in exercise of the powers conferred under Section 52D of the Insurance Act, 1938 hereby orders as follows: a) The order appointing Shri R.K. Sharma as the Administrator of Sahara India Life Insurance Company Limited made vide Order No. IRDAI/F&A/ORD/FA/134/06/ 2017 dated 12th June, 2017, shall stand cancelled from the date of this order and Shri R.K. Sharma shall cease to exercise the powers and perform the functions of the Administrator of the insurer. b) The management and affairs of the insurer, including control and supervision of Shareholders’ investments, shall, with effect from 17.8.2026, stand vested in and be carried on by the insurer. 9.
