## Policy Analysis Report: National Highways Authority of India - Notifications dated January 18, 2022
**1. Executive Summary:**
This report analyzes two notifications issued by the Ministry of Road Transport and Highways, Government of India, both dated January 18, 2022, concerning National Highways. The first notification (S.O. 263E) entrusts a specific stretch of National Highway 334B to the National Highways Authority of India (NHAI). The second notification (S.O. 264E) pertains to an amendment to a previous notification (S.O 1096E dated August 4, 2005) concerning the execution of works related to several National Highways within the State of Uttar Pradesh by the State Government. The key finding is a clarification of responsibility of the State Government for particular sections of highways and an entrustment to NHAI.
**2. Introduction:**
The purpose of this report is to provide an informative analysis of two notifications related to National Highways in India, based solely on the text provided. This analysis aims to clarify the scope, impact, and potential implications of these notifications.
**3. Policy Overview:**
* **Notification S.O. 263E:** This is a new policy for the specific road outlined.
* **Core Objective:** To entrust the management and development of a specific segment of National Highway to the National Highways Authority of India (NHAI).
* **Notification S.O. 264E:** This is an amendment to the notification S.O 1096E, dated the 4th August, 2005 and last amended vide number S.O. 5441 E, dated the 28th December, 2021.
* **Core Objective:** To modify the areas for which the State Government is responsible regarding the execution of works on specified National Highways within the State of Uttar Pradesh.
**4. Background and Rationale:**
* **Notification S.O. 263E (New Policy):** The entrustment of a National Highway stretch to NHAI suggests a potential need for centralized management, improved infrastructure development, and efficient maintenance of that particular section of the highway. The text itself does not specify this but implies it.
* **Notification S.O. 264E (Amendment):** The amendment seems to be enacted to delineate or clarify the specific sections of National Highways for which the Uttar Pradesh State Government is responsible for executing works. The previous notification appears to have required some modification regarding the scope of highways under its responsibility. It seems that a re-evaluation and adjustment of responsibilities were needed, potentially due to inconsistencies or ambiguities in the original notification or due to changes in route designations or highway construction projects.
**5. Key Provisions / Changes:**
* **Notification S.O. 263E (New Policy):**
* The notification states that the Central Government, exercising powers under Section 11 of the National Highways Authority of India Act, 1988, entrusts the "Meerut-Haryana Border section" of National Highway 334B, spanning from Km 0000 to Km 48260 (Design Chainage) in the State of Uttar Pradesh, to the National Highways Authority of India (NHAI).
* This essentially transfers responsibility for the management, development, and maintenance of this specific highway segment to the NHAI.
* **Notification S.O. 264E (Amendment):**
* **Specific Part Changed:** Serial number 24 in the Schedule of the original notification S.O. 1096E, dated August 4, 2005, is being replaced.
* **New Rule/Provision:** The amendment details a list of National Highways (or sections thereof) within Uttar Pradesh, for which the State Government will be responsible for the execution of works. This list includes several National Highways and specifies chainage exclusions. The provided extract explicitly outlines the sections falling under the State Government's jurisdiction, including (but not limited to): NH2A, NH11, NH24A, NH27, NH28B, NH28C, NH29, NH56, NH58, NH307, NH72A, NH74, NH75, NH76, NH86, NH91, NH91A, NH92, NH93, NH96, NH233, NH235, NH124D, NH321, NH321G, NH727A, NH727AA, NH730, NH730A, NH730H, NH731AG, NH931, NH931A, NH330B, NH334A, NH334B, NH334DD, NH219, NH227A, NH731A, NH124C, NH727B, NH727H, NH727G, NH328, NH328A, NH330D, NH730B, NH731B, NH731K, NH727BB, NH730S, NH730C, NH135C, and NH227B.
* **Difference/Effect of Change:** The amendment alters the original scope of responsibility, likely by clarifying which specific sections of the highways fall under the State Government's control for the execution of works. This ensures better clarity and potentially avoids overlapping responsibilities or jurisdictional disputes. It appears that the State Government maintains responsibility over long stretches of the described highways with some key sections removed from that responsibility as described in the text.
**6. Target Audience and Stakeholders:**
* **Notification S.O. 263E:** The primary stakeholders are the National Highways Authority of India (NHAI), the Uttar Pradesh State Government, and potentially any contractors or developers involved in projects along the specified section of NH-334B. Highway users and businesses relying on that route are also affected.
* **Notification S.O. 264E:** The primary stakeholders are the Uttar Pradesh State Government, particularly its Public Works Department or relevant agencies responsible for highway construction and maintenance, and the Ministry of Road Transport and Highways. Also affected are construction companies working on these specified stretches, and businesses that operate along those highways.
**7. Implementation Aspects (Inferred):**
* **Notification S.O. 263E:**
* **Responsible Agency:** The National Highways Authority of India (NHAI) is the primary responsible agency.
* **Timelines/Procedures:** No timelines or specific procedures are detailed in the text. However, it can be inferred that NHAI will initiate processes for planning, development, and maintenance of the entrusted highway section.
* **Notification S.O. 264E:**
* **Responsible Agency:** The Uttar Pradesh State Government is the responsible agency for the sections of highways listed in the amendment.
* **Timelines/Procedures:** No timelines or specific procedures are outlined in the amendment text. However, the State Government is bound to comply with the existing rules and regulations under the National Highways Act, 1956 while executing works on the specified highways. The key point is the *change* in the list of applicable highways.
**8. Expected Outcomes / Impact of Changes:**
* **Notification S.O. 263E:** Entrusting NH-334B to NHAI likely aims to achieve better highway management, potentially leading to improved road conditions, reduced travel times, and enhanced safety for commuters on that route.
* **Notification S.O. 264E:** This amendment aims to clarify the responsibilities of the Uttar Pradesh State Government regarding the execution of works on specific sections of National Highways. This clarification should lead to improved efficiency in project implementation, reduced ambiguity in jurisdictional matters, and potentially better allocation of resources for highway development and maintenance within the state.
**9. Conclusion:**
The two notifications dated January 18, 2022, represent important steps in managing and developing National Highways in India. The first notification, S.O. 263E, entrusts a specific stretch of highway to NHAI. The second notification, S.O. 264E, clarifies the responsibilities of the Uttar Pradesh State Government, ensuring better coordination and efficient execution of highway-related projects within the state. These actions contribute to improved infrastructure, enhanced connectivity, and economic growth.
