## Policy Analysis Report: Amendment to National Highways Act, 1956
**1. Executive Summary:**
This report analyzes an amendment to the National Highways Act, 1956, specifically focusing on a notification published on June 21, 2022. The amendment, through notification S.O. 2818(E), concerns the delegation of authority to State Governments for the execution of works pertaining to specific National Highways within their jurisdictions. The key finding is that the amendment substitutes the entry for serial number 4 of the Schedule in the original notification S.O. 1096(E) of 2005. This change assigns the responsibility for executing works on a significant list of National Highways and new National Highway numbers (or parts thereof) situated within the State of Bihar to the State Government of Bihar.
**2. Introduction:**
The purpose of this report is to provide an informative analysis of the amendment to the National Highways Act, 1956, as outlined in the notification S.O. 2818(E) dated June 21, 2022. This analysis is based solely on the provided text and aims to elucidate the amendment's core objectives, key changes, and potential implications.
**3. Policy Overview:**
* This report analyzes an *amendment* to the National Highways Act, 1956.
* The original policy being amended is the Government of India notification S.O. 1096(E), dated August 4, 2005. It has been amended previously, vide number S.O. 2408(E), dated the 27th May, 2022.
* **Core Objective (inferred):** The amendment aims to decentralize the execution of works related to specific National Highways by delegating authority to the respective State Governments. This potentially streamlines project implementation and leverages local expertise.
**4. Background and Rationale:**
* This is an amendment, so the focus is on the *reason for the change*. The amendment appears to be designed to clarify and assign responsibilities for highway construction and maintenance to the Bihar State Government for specific stretches of National Highways located within its boundaries. It modifies the existing delegation framework established by the 2005 notification. The likely reason is to improve efficiency and accountability by aligning responsibility with the geographic location of the highway projects.
**5. Key Provisions / Changes:**
* **Specific Part of Original Policy Changed:** The amendment substitutes the entire entry for serial number 4 in the Schedule of the original notification S.O. 1096(E) of 2005.
* **New Rule/Provision:** The State Government of Bihar is now responsible for the execution of works pertaining to the National Highways specified in column 2 of the Table, which includes:
* Sections of National Highways No. 2C, 19, 28B, 30A, 80, 81, 82, 98, 99, 101, 103, 104, 105, 106, 110.
* New National Highway numbers 227J, 227L, 333, 327 Extension, 131A, 120, 122A, 122B, 131B, 133, 133E, 219, 227A, 227F, 319A, 322, 327A, 327AD, 333A, 333C, 527A, 527E, 727A, 727AA, and 727B, as they are situated within the State of Bihar.
* **Difference/Effect of Change:** The previous assignment of responsibilities for these specific highways (under the original serial number 4) is now superseded. The State Government of Bihar is now explicitly granted the authority and responsibility for executing works on these highways. The condition is that the State Government must comply with the rules in force under the National Highways Act, 1956.
**6. Target Audience and Stakeholders:**
The primary target audience and stakeholders directly affected by this amendment are:
* The State Government of Bihar (specifically its relevant departments involved in road construction and maintenance).
* Contractors and construction companies operating or planning to operate on the specified National Highways within Bihar.
* Communities and businesses located along these National Highways in Bihar, who will be impacted by any construction or maintenance activities.
* The Ministry of Road Transport and Highways, which oversees the implementation of the National Highways Act.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The State Government of Bihar is the primary responsible agency. The Central Government (Ministry of Road Transport and Highways) retains oversight to ensure compliance with the National Highways Act and its rules.
* **Timelines/Procedures:** The amendment is effective from the date of notification (June 21, 2022). The State Government of Bihar is expected to follow the established rules and procedures under the National Highways Act, 1956, for executing the works. No specific timelines are mentioned in the provided text.
* The text indicates that the State Government concerned is bound to comply with the rules for the time being in force under the National Highways Act and for that purpose makes the following further amendments.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of this amendment is:
* Increased efficiency in the execution of works on the specified National Highways within Bihar, due to localized management and decision-making.
* Improved coordination between the Central Government and the State Government of Bihar regarding highway development.
* Potentially faster project completion times and better maintenance of these critical transportation arteries.
* The burden of monitoring and carrying out these functions will be the responsibility of the State Government of Bihar.
**9. Conclusion:**
The amendment to the National Highways Act, 1956, through notification S.O. 2818(E), represents a significant step in decentralizing highway development and maintenance. By delegating authority to the State Government of Bihar for specific National Highways within its jurisdiction, the amendment aims to improve efficiency and accountability. This change is significant because it alters the established framework for highway project execution and has the potential to positively impact infrastructure development within the State of Bihar.
