## Policy Analysis Report: Amendments to National Highways Authority of India Act & National Highways Act
**1. Executive Summary:**
This report analyzes two notifications issued by the Ministry of Road Transport and Highways on July 21, 2022. The first notification (S.O. 3274(E)) amends a prior notification regarding the National Highways Authority of India Act, removing a specific section of highway from its jurisdiction. The second notification (S.O. 3275(E)) amends a previous notification concerning the National Highways Act, delegating functions related to the execution of works on specific National Highway sections in Tamil Nadu to the State Government. The report details the specific changes introduced by these amendments and their likely impact on the relevant stakeholders.
**2. Introduction:**
This report aims to provide a clear and concise analysis of two notifications issued by the Ministry of Road Transport and Highways on July 21, 2022, concerning amendments to prior notifications related to the National Highways Authority of India Act, 1988 and the National Highways Act, 1956. This analysis is based solely on the provided text.
**3. Policy Overview:**
* **S.O. 3274(E) - Amendment:** This notification amends notification number S.O. 1018(E), dated March 28, 2017, which likely defined the scope of a project under the National Highways Authority of India Act. The core objective of the original notification, based on the amendment, appears to have involved defining the jurisdiction or scope of work of the National Highways Authority of India (NHAI) on specific highway sections.
* **S.O. 3275(E) - Amendment:** This notification amends notification number S.O 1096(E), dated August 4, 2005, further amended by S.O. 3163(E) dated July 11, 2022. The core objective of the original notification appears to have been delegating functions to specific state governments in relation to national highways.
**4. Background and Rationale:**
* **S.O. 3274(E) - Amendment:** The amendment removes a section of highway in Tamil Nadu from the NHAI's jurisdiction, suggesting a potential reassessment of project priorities, jurisdictional disputes, or a decision to transfer responsibility for this section (Kangayampalayam Mettupalayam Km 323.850 to Km 380.00) to another entity, potentially the state government.
* **S.O. 3275(E) - Amendment:** The amendment delegates functions related to the execution of works of specified highways to the State Government of Tamil Nadu. This suggests a strategic decision to empower state governments in managing national highway projects within their jurisdiction, potentially for increased efficiency or better alignment with local needs.
**5. Key Provisions / Changes:**
* **S.O. 3274(E) - Amendment:**
* **Specific Change:** The amendment omits entries under columns 1, 2, and 3 of the table in the original notification (S.O. 1018(E) dated March 28, 2017), pertaining to the Kangayampalayam Mettupalayam section of highway from Km 323.850 to Km 380.00 in Tamil Nadu.
* **New Rule/Provision:** The amendment essentially removes this specific section from the purview of the National Highways Authority of India's (NHAI's) earlier defined responsibility.
* **Effect of Change:** The NHAI is no longer directly responsible for the specified section of highway between Kangayampalayam and Mettupalayam.
* **S.O. 3275(E) - Amendment:**
* **Specific Change:** The amendment substitutes serial number 22 and its related entries in the Schedule of the original notification (S.O. 1096(E) dated August 4, 2005).
* **New Rule/Provision:** Functions related to the execution of works of specific national highways described in column 2 of the table shall be exercisable by the State Government specified in column 3 of the table against each highway subject to the condition that the State Government concerned shall in the exercise of such functions be bound to comply with the rules for the time being in force under the said Act.
* **Effect of Change:** The power to execute works on the specified sections of National Highways within Tamil Nadu is transferred to the Tamil Nadu State Government. This delegation is conditional upon the State Government adhering to the established rules under the National Highways Act, 1956.
**6. Target Audience and Stakeholders:**
* **S.O. 3274(E):**
* **Directly Affected:** The National Highways Authority of India (NHAI). Contractors and subcontractors previously involved in the Kangayampalayam-Mettupalayam section.
* **Indirectly Affected:** Commuters and businesses relying on the Kangayampalayam-Mettupalayam section of the highway, as the change may impact future development or maintenance activities.
* **S.O. 3275(E):**
* **Directly Affected:** The State Government of Tamil Nadu, who will now be responsible for executing works on specified sections of national highways. Contractors and subcontractors who will now likely be contracted by the Tamil Nadu State Government.
* **Indirectly Affected:** Commuters and businesses relying on the listed National Highways within Tamil Nadu, as the change may impact future development or maintenance activities.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:**
* S.O. 3274(E): Potentially the State Government of Tamil Nadu, or another entity to which responsibility is transferred.
* S.O. 3275(E): The State Government of Tamil Nadu is responsible for the execution of works related to the specified sections of National Highways.
* **Timelines/Procedures:** The text does not provide specific timelines or procedures for the implementation of these changes. The State Government is bound by the existing rules under the National Highways Act, 1956.
**8. Expected Outcomes / Impact of Changes:**
* **S.O. 3274(E) - Amendment:** The intended outcome of this amendment is unclear based solely on the provided text. However, it could lead to:
* Shifting of resources and focus of the NHAI.
* Potentially faster development or maintenance of the Kangayampalayam-Mettupalayam section if the new responsible entity can operate more efficiently or with greater local knowledge.
* **S.O. 3275(E) - Amendment:** The likely intended outcome of this delegation of power to the Tamil Nadu State Government is:
* More efficient execution of works on the specified sections of National Highways within Tamil Nadu, due to greater local knowledge and control.
* Better alignment of highway development with the state's specific needs and priorities.
**9. Conclusion:**
The two notifications represent key changes in the administration and management of national highways in Tamil Nadu. The first amendment (S.O. 3274(E)) removes a segment of highway from NHAI jurisdiction, while the second (S.O. 3275(E)) delegates the execution of works on several other national highway sections to the Tamil Nadu State Government. These changes likely aim to optimize efficiency and align projects with state-level priorities, although further information would be needed to fully understand the long-term implications and rationale behind S.O. 3274(E).
