**Report on Amendment to National Highways Act, 1956**
**1. Executive Summary:**
This report analyzes an amendment to the National Highways Act, 1956, specifically regarding the execution of works pertaining to National Highways within Andhra Pradesh. The amendment, enacted via notification S.O. 4882(E) on November 26, 2021, transfers the responsibility for executing works on specified National Highways to the State Government of Andhra Pradesh, subject to compliance with existing rules under the Act. This amendment seeks to streamline highway development and maintenance by delegating authority to the state level. The key finding is that this amendment modifies a previous notification (S.O 1096E, dated the 4th August, 2005) by substituting entry number 1 in the schedule, effectively transferring control over execution of works pertaining to a range of national highways within Andhra Pradesh to the Andhra Pradesh State Government.
**2. Introduction:**
This report provides an informative overview of an amendment to the National Highways Act, 1956. The analysis is based solely on the provided government policy text, specifically notification S.O. 4882(E) dated November 26, 2021, and aims to inform affected industries and stakeholders about the changes introduced.
**3. Policy Overview:**
* **Original Policy:** This amendment modifies the notification of the Government of India in the erstwhile Ministry of Shipping, Road Transport and Highways number S.O 1096E, dated the 4th August, 2005.
* **Core Objective(s):** The primary objective, as inferred from the text, is to delegate the execution of works pertaining to certain National Highways to the State Government of Andhra Pradesh. This aims to improve the efficiency of highway development and maintenance.
**4. Background and Rationale:**
The amendment likely arises from a need for more localized control and responsiveness in managing National Highways within Andhra Pradesh. Transferring authority to the State Government potentially allows for better coordination with local needs, faster decision-making, and improved monitoring of projects. The specific reason for amending S.O. 1096E, is to update which entities have power over the sections of highway.
**5. Key Provisions / Changes:**
This amendment focuses specifically on amending Schedule entry 1 of notification S.O. 1096(E).
* **Specific Part Changed:** The amendment substitutes the entirety of serial number 1 and its related entries in the Schedule of the original notification.
* **New Rule/Provision:** The new provision designates the State Government of Andhra Pradesh as the responsible authority for the execution of works on a comprehensive list of National Highways and sections thereof *within Andhra Pradesh*. The affected highways, specified by their old and new National Highway numbers, include: No.4 New NH No. 69 from Chittoor to Karnataka Border and State New NH No. 40 from Chittoor to Tamil Nadu Border, No. 5new NH No. 16 from Km. * **Difference/Effect:** This change effectively shifts the direct responsibility for the execution of highway works on the specified routes from the Central Government (or its previously designated agency) to the State Government of Andhra Pradesh.
**6. Target Audience and Stakeholders:**
The primary target audience and stakeholders affected by this amendment include:
* The State Government of Andhra Pradesh and its relevant departments (e.g., Department of Roads & Buildings).
* Construction companies and contractors involved in highway development and maintenance projects within Andhra Pradesh.
* Local communities and businesses along the specified National Highways in Andhra Pradesh.
* Transportation and logistics companies operating on these routes.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The State Government of Andhra Pradesh, particularly its relevant departments responsible for infrastructure development and road maintenance, is now the primary responsible body.
* **Timelines/Procedures:** The text does not specify any timelines or procedures, beyond requiring the State Government to comply with the existing rules under the National Highways Act, 1956. The amendment takes effect immediately upon publication.
* Since this is an amendment, implementation relies on changes to the existing process. The primary change is who to contact for projects.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of this amendment are:
* **Increased Efficiency:** Streamlined decision-making and project implementation due to localized control.
* **Improved Coordination:** Better alignment of highway development with local needs and priorities.
* **Enhanced Monitoring:** More effective oversight of projects by the State Government.
* **Economic growth:** Better maintained highways lead to economic growth.
**9. Conclusion:**
The amendment to the National Highways Act, 1956, detailed in notification S.O. 4882(E), signifies a shift in the management of National Highways within Andhra Pradesh. By delegating authority to the State Government, the amendment aims to improve the efficiency and responsiveness of highway development and maintenance, ultimately benefiting the region's economy and transportation infrastructure. This change is significant, as it alters the execution of works process for many kilometers of highways.
