## Report on Amendments to National Highways Act, 1956
**1. Executive Summary:**
This report analyzes two notifications, S.O. 1886(E) and S.O. 1887(E), both dated April 25, 2025, which amend previous notifications under Section 5 of the National Highways Act, 1956. Notification S.O. 1886(E) delegates authority for execution of works pertaining to specified National Highways within West Bengal to the State Government of West Bengal. Notification S.O. 1887(E) assigns the function of development and maintenance of a specific stretch of National Highway 110 in West Bengal to the National Highways Infrastructure Development Corporation Limited. This report details the specific changes introduced by these amendments, their likely rationale, affected stakeholders, and expected outcomes.
**2. Introduction:**
The purpose of this report is to provide an informative analysis of two recent amendments to notifications issued under the National Highways Act, 1956, based solely on the provided government policy text. The report focuses on understanding the changes introduced by these amendments, their objectives, and their potential impact.
**3. Policy Overview:**
These are amendments to existing policies under the National Highways Act, 1956. Specifically, S.O. 1886(E) amends notification S.O 1096(E), dated August 4th, 2005, and last amended by S.O. 1564(E) dated March 27th, 2025. The core objective of the overall framework (as inferred from the text) is to facilitate the development, maintenance, and management of National Highways in India.
**4. Background and Rationale:**
These amendments likely reflect a need to streamline the execution of highway works and maintenance by delegating responsibilities to appropriate bodies. The amendment S.O. 1886(E) suggests a move towards increased state government involvement in managing national highways within their jurisdiction. The specific allocation to the State Government of West Bengal suggests the Central Government has assessed that the State Government is best placed to execute works on the listed highways. The amendment S.O. 1887(E) suggests a need for specialized development and maintenance of a particularly important route by assigning that specific duty to the National Highways Infrastructure Development Corporation Limited.
**5. Key Provisions / Changes:**
* **S.O. 1886(E): Delegation of Authority to the State Government of West Bengal**
* **Specific Change:** The amendment substitutes the previous entry for serial number 25 in the Schedule of notification S.O. 1096(E).
* **New Rule/Provision:** It directs that the functions related to the execution of works on specific sections of National Highways, including NH 2B, NH 31, NH 31C, NH 34, NH 60, NH 35, NH 60A, NH 117, NH 80, NH 81, new National Highway Nos. 114 A, 116B, 218, 131A, 133A, 10, 317A, 327B, 419, 512 and 717, as are situated within the State of West Bengal, shall be exercisable by the State Government of West Bengal.
* **Effect of Change:** This effectively grants the State Government of West Bengal the authority to execute works (e.g., construction, repairs, upgrades) on these specified sections of National Highways. This includes certain exclusions within some sections that remain under the control of the Central Government.
* **S.O. 1887(E): Assignment to National Highways Infrastructure Development Corporation Limited**
* **Specific Change:** Assigns responsibility for development and maintenance.
* **New Rule/Provision:** The National Highways Infrastructure Development Corporation Limited will now exercise the function relating to the development and maintenance of National Highway 110 in the State of West Bengal. This is the entire highway from its junction with NH10 near Siliguri connecting Karsiyang and terminating at Darjeeling in the State of West Bengal.
* **Effect of Change:** This directs the National Highways Infrastructure Development Corporation Limited to handle the responsibilities of development and maintenance of this section of road.
**6. Target Audience and Stakeholders:**
* **S.O. 1886(E):** The primary target audience is the State Government of West Bengal, particularly its Public Works Department or equivalent agency responsible for road infrastructure. Other stakeholders include contractors involved in highway construction and maintenance in West Bengal, commuters using the specified National Highways, and local businesses along these routes.
* **S.O. 1887(E):** The National Highways Infrastructure Development Corporation Limited is the primary target. Other stakeholders include commuters using NH 110, local businesses along this route, and contractors specializing in development and maintenance.
**7. Implementation Aspects (Inferred):**
* **Responsible Agencies/Bodies:**
* **S.O. 1886(E):** The State Government of West Bengal is the primary responsible body.
* **S.O. 1887(E):** The National Highways Infrastructure Development Corporation Limited is the primary responsible body.
* **Timelines/Procedures:** The text doesn't specify explicit timelines or detailed procedures. However, the State Government of West Bengal and the National Highways Infrastructure Development Corporation Limited are bound to comply with the rules for the time being in force under the National Highways Act, 1956.
**8. Expected Outcomes / Impact of Changes:**
* **S.O. 1886(E):**
* **Likely Intended Outcome:** Enhanced efficiency and responsiveness in executing highway works within West Bengal due to increased state government control and local knowledge. This may lead to faster project completion and improved road conditions.
* **Potential Impact:** Streamlined coordination between the central and state governments, potentially fostering better infrastructure development in the region.
* **S.O. 1887(E):**
* **Likely Intended Outcome:** Improved road conditions and infrastructure development along the route of NH 110 due to specialized maintenance.
* **Potential Impact:** Increased economic activity and improved accessibility to previously difficult to reach regions.
**9. Conclusion:**
The amendments S.O. 1886(E) and S.O. 1887(E) reflect a strategic adjustment in the management of National Highways. By delegating authority to the State Government of West Bengal for specific highways and assigning development and maintenance to the National Highways Infrastructure Development Corporation Limited, the Central Government likely aims to improve efficiency, responsiveness, and overall infrastructure development. These changes are significant for the concerned stakeholders, particularly the State Government of West Bengal, the National Highways Infrastructure Development Corporation Limited and the commuters and businesses along the specified National Highways.
