Executive Summary & Key Takeaways

## Report on Amendment to National Highways Act, 1956 **1. Executive Summary:** This report analyzes a notification issued by the Ministry of Road Transport and Highways on January 28, 2022. This notification constitutes an amendment to a prior notification S.O. 1096E, dated August 4, 2005, concerning the execution of works pertaining to National Highways. The key change is the delegation of authority to the State Government of Karnataka for specific sections of various National Highways, replacing the previous arrangement. This amendment aims to streamline highway maintenance and development by assigning responsibility to the state government for designated stretches. **2. Introduction:** This report provides a detailed overview of an amendment to the National Highways Act, 1956, specifically focusing on the notification issued on January 28, 2022. The analysis is based solely on the information presented within the provided policy text. **3. Policy Overview:** * **Original Policy Being Amended:** The amendment modifies notification S.O. 1096E, dated August 4, 2005, issued by the erstwhile Ministry of Shipping, Road Transport and Highways Department of Road Transport and Highways. * **Core Objective(s):** The original policy's objective, as inferred from the amendment text, is to define and assign responsibility for the execution of works related to National Highways. This amendment's objective is to modify this assignment by delegating specific responsibilities to the State Government of Karnataka. **4. Background and Rationale:** This amendment appears to be driven by a need to refine the allocation of responsibilities for highway management. The previous notification likely assigned these functions differently, and this amendment indicates a shift in strategy, potentially to improve efficiency, responsiveness, or to align with jurisdictional boundaries. The specific nature of the problem the amendment addresses is not stated within the provided text. **5. Key Provisions / Changes:** This notification substitutes serial number 11 and its entries in the schedule of the S.O. 1096E notification. The key change is the delegation of powers to the State Government of Karnataka for the execution of works related to specific sections of multiple National Highways. These Highways include: * National Highway No. 4 * National Highway No. 4A * National Highway No. 9 * National Highway No. 13 * National Highway No. 17 * National Highway No. 42 * National Highway No. 48 * National Highway No. 63 * National Highway No. 67 * National Highway No. 206 * National Highway No. 207 * National Highway No. 209 * National Highway No. 212 * National Highway No. 218 * National Highway No. 234 * New National Highway No. 50 * New National Highway No. 67 * New National Highway No. 150 * New National Highway No. 150 Extn * New National Highway No. 150A * New National Highway No. 150C * New National Highway No. 160 * New National Highway No. 166E * New National Highway No. 167N * New National Highway No. 167 * New National Highway No. 169A * New National Highway No. 173 * New National Highway No. 275 * New National Highway No. 275K * New National Highway No. 367 * New National Highway No. 369E * New National Highway No. 373 * New National Highway No. 544DD * New National Highway No. 544E * New National Highway No. 548B * New National Highway No. 548H * New National Highway No. 561A * New National Highway No. 748AA * New National Highway No. 752K * New National Highway No. 766C * New National Highway No. 766E * New National Highway No. 766EE The specific sections of these highways delegated to the State Government are explicitly defined by kilometer markers within the notification. The effect of this change is to transfer responsibility for the execution of works on these designated highway sections from the Central Government (or a previous delegate) to the State Government of Karnataka. **6. Target Audience and Stakeholders:** The primary target audience and stakeholders directly affected by this amendment include: * The State Government of Karnataka, which now holds responsibility for the execution of works on the specified National Highway sections. * Contractors and construction companies involved in highway development and maintenance within Karnataka. * Commuters and businesses that rely on these National Highways within the State of Karnataka. **7. Implementation Aspects (Inferred):** * **Responsible Agency:** The State Government of Karnataka is the primary responsible agency. * **Procedures:** The State Government is bound to comply with the rules currently in force under the National Highways Act, 1956, when exercising these delegated functions. * **Timelines:** No specific timelines for implementation are provided in the text. **8. Expected Outcomes / Impact of Changes:** The intended outcome of this amendment is likely to improve the efficiency and effectiveness of highway development and maintenance within Karnataka. By delegating authority to the State Government, the amendment aims to facilitate better coordination, faster decision-making, and a more localized approach to addressing highway-related issues. This could lead to improved road conditions, reduced travel times, and enhanced safety for commuters. **9. Conclusion:** The amendment to the National Highways Act, 1956, through the notification issued on January 28, 2022, represents a significant shift in the delegation of authority for National Highway works within the State of Karnataka. By assigning responsibility to the State Government for specific highway sections, the amendment aims to improve efficiency, responsiveness, and overall management of the national highway network. This change has direct implications for the State Government, contractors, and the public who rely on these highways for transportation.
