Black marketing of fertilizers in Odisha
3558 Shri Manas Ranjan Mangaraj:
Will the Minister of Chemicals and Fertilizers be pleased to state:
(a) the number of cases registered in Odisha relating to black marketing/illegal sale of
fertilizers during the last three years;
(b) the action taken against dealers and the penalties imposed, district-wise; and
(c) the steps being taken to strengthen monitoring and ensure fair distribution of fertilizers
in Odisha?

(a) to (c) Fertilizers have been declared as an essential commodity under the
Essential Commodities Act, 1955 and are regulated under the Fertilizer (Control) Order,
1985 to address issues such as black-marketing and illegal sale. State Governments are
empowered to take action against persons involved in such malpractices in accordance
with the provisions of the said Act and Order. Further, any complaints received at the level
of the Department of Fertilizers regarding such malpractices are forwarded to the
concerned State Governments for appropriate action under the relevant provisions.
Accordingly, as per the information received from the Government of Odisha, no cases
relating to black-marketing or illegal sale of fertilizers were reported during the years
2023–24 and 2024–25. However, during 2025–26, three cases of black-marketing have
been reported, one each in the districts of Dhenkanal, Jharsuguda, and Sambalpur.
Further, six cases relating to unauthorized sale have been reported during 2025–26 in the
districts of Angul (2 cases), Ganjam (1 case), Nabarangpur (1 case), Nayagarh (1 case),
and Nuapada (1 case). In all the above cases, appropriate action, including cancellation
of Letter of Authorization (LoA), seizure of materials and lodging of FIRs, has been taken
against the offenders in accordance with the provisions of the Fertilizer (Control) Order,
1985 and the Essential Commodities Act, 1955.District-wise details of action taken against dealers for contravention of various provisions
of the Fertilizer (Control) Order, 1985 during 2023–24 to 2025–26 are provided in
Annexure-I. Similarly, district-wise details of enforcement activities carried out by block
and district-level enforcement teams during 2025–26 are provided in Annexure-II.
However, the State Government of Odisha has taken following steps to strengthen
monitoring and ensures fair distribution of fertilizers to the farmers in the right quantity &
at right prices:
i. State level committee under joint chairmanship of Secretary Agriculture and
Farmers Empowerment, Cooperation has been formed to monitor availability of
fertilizers in different parts of the State.
ii. District level committee has been formed under the chairmanship of Collector and
District Magistrate for micro planning to make fertilizer available in different parts
of the district.
iii. District wise requirement is placed before GOI in Zonal Conference held before
commencement of each cropping season. Accordingly, supply is being made as
per GOI allocation.
iv. Prepositioning of fertilizers especially Urea in PACs/LAMPCs is being made much
ahead of cropping season.
v. The Department of Agriculture and Farmers Empowerment (DA&FE) provides
financial assistance to MARKFED towards transportation and handling cost of
Urea through scheme “Grant to State Fertiliser Procurement Agencies”
vi. In addition to this, an amount of Rs 150 Crores has been given to MARKFED as
corpus fund for prepositioning and distribution of different fertilizers to
PACS/LAMPCS/dealer network in the State.
vii. 60% of fertilizers required in the season to be supplied to PACs/LAMPCs
channelized through MARKFED.
viii. District level/block level Enforcement Team comprising of officials from
Agriculture, Revenue Dept. & Police Personnel have been formed for regular
enforcement activities throughout the State.
