SHRI PARIMAL NATHWANI: Will the Minister of ENVIRONMENT, FOREST AND CLIMATE CHANGE be pleased to state: (a) whether environmental clearances have been granted during the last five years for projects involving discharge of treated industrial effluents into the deep sea off the coasts of Gujarat and Andhra Pradesh; (b) the details of such projects, including location, industrial clusters involved, daily discharge quantity permitted and length/depth of marine outfall pipelines; (c) the monitoring mechanism presently in place to assess marine biodiversity impact and compliance with Coastal Regulation Zone (CRZ) norms; and (d) whether any violations, non-compliance notices or penalties have been recorded in respect of such projects? ANSWER MINISTER OF STATE IN THE MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE (SHRI KIRTI VARDHAN SINGH) (a) & (b) The details of clearances granted during the last five years for projects involving discharge of treated industrial effluents into the deep sea off the coasts of Gujarat and Andhra Pradesh are given in the Annexure-I. (c) In order to ensure monitoring of impacts on the marine environment and biodiversity, projects involving discharge of treated effluents into the sea are required to undertake a Marine Environmental Impact Assessment, including baseline environmental data and a marine environmental monitoring plan covering biodiversity aspects. Further, the EAC may also stipulate specific conditions, where required, for the regular monitoring of marine environment and biodiversity status on the basis of baseline data. In such cases, these aspects are reported in the six-monthly compliance report. As per the provisions of the CRZ Notification, the State Government/Union Territory Coastal Zone Management Authorities (CZMAs) are primarily responsible for enforcement and monitoring of the provisions of the Notification and for facilitating its effective implementation. Further, in accordance with the Ministry’s notification dated 30.09.2022, the State/UT CZMAs have been empowered under Sections 5, 10 and 19 of the Environment (Protection) Act, 1986 to take necessary action for ensuring compliance with the CRZ Notification. 1Moreover, the environmental non-compliance for combined EC and CRZ Clearances are addressed as per provisions under Section 5, 15 and 19 of Environment (Protection) Act, 1986 and Rule 4 of Environment (Protection) Rules, 1986. Further, as per para 10 of Environment Impact Assessment (EIA) Notification, 2006 on ‘Post Environmental Clearance Monitoring’, it is mandatory for the project management to submit half-yearly compliance reports in respect of the stipulated prior environmental clearance terms and conditions to the regulatory authority concerned. The implementation of these provisions are guided by Standard Operating Procedure (SoP) established vide Office Memorandum dated 25.11.2022 for post environmental clearance monitoring and Compliance of projects, which prescribes the mechanism for taking action with respect to the observed non-compliance, including procedure of seeking clarification, issuing Show Cause Notice and concluding action. Recently, the Ministry has also notified Environment Audit Rules, 2025 to strengthen the environmental compliance framework for projects operating under various environmental laws. Besides, the State Pollution Control Boards are also empowered to take remedial actions in cases of violation of Consent to Operate and Consent to Establish conditions in accordance with Section 31A. of Air (Prevention and Control of Pollution) Act, 1981 and Section 33A. of Water (Prevention and Control of Pollution) Act, 1974. (d) As informed by the State Coastal Zone Management Authorities (SCZMAs) of Gujarat and Andhra Pradesh, no such cases have been reported. ****** 2Annexure -I S.N.
