be pleased to state:
(a) the number of pending disputed cases related to compensation for development of National Highways across the country, State- wise and particularly for Uttar Pradesh;
(b) the number of farmers in Uttar Pradesh whose land was acquired for National Highway projects during the last five years and are still awaiting compensation classified by project particularly in Saharanpur Commissionerate;
(c) the total value of compensation payments pending classified by project, State-wise and particularly for Uttar Pradesh;
(d) whether any reviews have identified the key reasons for pendency such as administrative delays, land record disputes or valuation-related issues, if so, the details thereof; and
(e) the steps being taken by the Government to expedite compensation disbursement, strengthen mechanisms for dispute resolution and prevent hardship to affected farmers and delays in project execution?ANSWER THE MINISTER OF ROAD TRANSPORT AND HIGHWAYS (SHRI NITIN JAIRAM GADKARI)
(a) A total of approx. 1.7 lakh cases pertaining to the disputes in land acquisition are pending at various levels of arbitration, district court, High Court and Supreme Court. Details in respect of cases are annexed at Annexure-I.
(b) and (c) The land acquisition for National Highway projects is a continuous process and the Competent Authority for Land Acquisition (CALA) is responsible for the preparation of the awards.
However, there remains a time lag between award and disbursement which may be delayed if the award is challenged under law. The number of landowners in the State of Uttar Pradesh awaiting compensation for NHAI projects, during the last 5 years, including the current financial year is approximately 37,247, against whom approximately ₹2,780 crore is being disbursed including compensation by the competent authority and expected to be disbursed on completion of required procedures. The details of land owners awaiting compensation in Saharanpur Commissionerate are annexed at Annexure- II.
(d) The progress of NH projects, including land acquisition, is regularly monitored by the Government at various levels. The key land acquisition challenges are outdated land records, disputed ownership, and delays in the revision of circle rates.
(e) The Government has shifted to the BhoomiRashi Portal integrated with Public Finance Management System (PFMS) for online direct payment of compensation to the land-owners. To expedite the dispute resolution mechanism, the notification for the appointment of the Arbitrators (on recommendation of the State Government) is done through BhoomiRashi Portal.
