Compliance of NGT Orders
1268. SHRI SANJAY UTTAMRAO DESHMUKH:
Will the Minister of Environment, Forest and Climate Change be pleased to state:
(a) whether the Government has the details of the projects received during the last five years
for Environmental Clearance ;
(b) if so, the details thereof, region-wise along with their status;
(c) whether the Government has developed any mechanism to monitor the compliance of the
orders of the National Green Tribunal; and
(d) if so, the details thereof?

(a) to (b) The Government of India has issued Environment Impact Assessment (EIA)
Notification, 2006 under the powers conferred by sub-section (1) and clause (v) of sub-section
(2) of section 3 of the Environment (Protection) Act, 1986. As per the provisions laid down in
the EIA Notification, 2006, as amended from time to time, the proposals specified in its
Schedule are appraised by the Expert Appraisal Committee (EAC) at Central Level and State
Expert Appraisal Committee (SEAC) at the State/UT Level, considering all the environmental
implications associated with the project, including issues raised during the Public Consultation.
Based on the recommendation of the EAC/SEAC, projects are further considered by the
Ministry or State Environmental Impact Assessment Authority (SEIAA) at Central Level and
State/UT level respectively, for approval for grant of Environmental Clearance (EC) or
otherwise. As per the provisions stated above, ECs are granted after considering environmental
issues and incorporating appropriate environmental safeguards, including mitigation measures
prescribed in the Environmental Management Plan (EMP).
As per the extant provisions of the EIA Notification, 2006, as amended from time to time,
Environmental Clearance is required for project activities falling under the 38 categories
specified in its Schedule. The state-wise details of proposals granted EC by the Ministry during
the last five years are placed at Annexure I.
(c) to (d) All directions issued by the Hon'ble Tribunal to the Ministry are followed up for next
necessary action/compliance by the respective Divisions/Sectors and the Hon'ble Tribunal is
constantly informed from time to time, wherever required.Annexure-I
