Parliament Question: Compliance of Waste Management Rules by Industries

SHRI PATEL UMESHBHAI BABUBHAI: Will the Minister of ENVIRONMENT, FOREST AND CLIMATE CHANGE be pleased to state: (a) the details of chemical plants, pharmaceutical industries and furniture units located in Dadra and Nagar Haveli and Daman and Diu and Valsad district of Gujarat; (b) the number of industries in each of the said districts that have obtained consent and authorization under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981; (c) the details of industries registered/authorized under e-commerce in each of the said districts; (d) the status of implementation of the Waste Management Rules, 2016, Bio-Medical Waste Management Rules, 2016, Solid Waste Management Rules, 2016 and the Construction and Demolition Waste Management Rules, 2016 in the said districts; and (e) the details of industries that have not renewed their registration/authorization under the above said waste management rules? ANSWER MINISTER OF STATE IN THE MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE (SHRI KIRTI VARDHAN SINGH) (a) to (e): The Consent to Establish/Consent to Operate (CTE/CTO) is granted by respective State Pollution Control Boards/Pollution Control Committee (SPCBs/PCCs) as per the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. As per the report submitted by the Dadra & Nagar Haveli and Daman & Diu Pollution Control Committee (DNH&DD PCC) based on Online Consent Management & Monitoring System (OCMMS) Data, there are 23 Chemical Industries, 64 Pharmaceutical Industries which are only formulation units and 07 Furniture Units located in Dadra & Nagar Haveli and Daman & Diu (DNH&DD) and all the industries mentioned above have obtained valid Consent under the Water (Prevention and Control of Pollution) Act, 1974, and the Air (Prevention and Control of Pollution) Act, 1981, along with applicable authorizations under the relevant Waste Management Rules.As informed by DNH&DD PCC, there are no industries mentioned above in the Union Territory with pending renewal of registration and there are no Health Care Facilities with pending renewal of Bio- Medical Waste Authorization as on date. Further, as per report submitted by Gujarat Pollution Control Board (GPCB) there are 675 chemical plants, 81 pharmaceutical industries and 18 furniture units located in Valsad district of Gujarat and total 2277 industries have obtained consent and authorization under The Water Act, 1974 and The Air Act, 1981. As informed by GPCB, industries under the Red, Orange and Green categories in Valsad district, have obtained valid Consent and Authorization from GPCB. E-commerce platforms and the registration of industries/businesses on them are primarily governed by the Department for Promotion of Industry and Internal Trade (DPIIT), which operates under the Ministry of Commerce and Industry. As per the report submitted by the DNH&DD PCC, implementation Status of the provisions of Waste Management Rules, 2016, Bio-Medical Waste Management Rules, 2016, Solid Waste Management Rules, 2016, and Construction and Demolition Waste Management Rules, 2016 in Union Territory of DNH&DD is as follows: (i) The provisions of Waste Management Rules, 2016, Bio-Medical Waste Management Rules, 2016, Solid Waste Management Rules, 2016, and Construction and Demolition Waste Management Rules, 2016 have been implemented in the Union Territory of DNH&DD. Further, All Health Care Facilities (HCFs) generating bio-medical waste have obtained authorization from the Pollution Control Committee, DNH &DD and are required to comply with provisions of the Bio-Medical Waste Management Rules, 2016. (ii) There is no Common Bio-Medical Waste Treatment Facility (CBWTF) established within the Union Territory of DNH &DD. Accordingly, the bio-medical waste generated by the authorized Health Care Facilities is collected, transported and scientifically treated and disposed of through the authorized Common Bio-Medical Waste Treatment Facility (CBWTF) located at Vapi, Gujarat, in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016. (iii) Solid Waste Management Rules, 2016 have been superseded by Solid Waste Management Rules, 2026 vide notification no. S.O. 388(E) dated 27.01.2026. The Union Territory of DNH&DD has adopted the Solid Waste Management Rules, 2026 that is effective from 01.04.2026. The Solid Waste Management Rules, 2026 provides for environmentally sound management of solid waste such as dry waste, wet waste, special care waste, sanitary waste, horticultural waste as well as of sanitary landfill management and existing or legacy waste dumpsite remediation and also provides for duties of waste generators, Bulk Waste Generators, operators of solid waste processing facilities and local bodies. More than 200 Bulk Waste Generators have been identified and registered on the centralized portal. (iv) The State Level Implementation Committee has been constituted to conduct periodic review meetings, while Special Cells have been established in all three districts to facilitate effective implementation. 100% door-to-door collection of municipal solid waste has been achieved across the Union Territory.(v) The UT has adopted the Environment (Construction and Demolition) Waste Management Rules, 2025, which came into effect on 01.04.2026, superseding the Construction and Demolition Waste Management Rules, 2016. The Extended Producer Responsibility (EPR) Portal for Construction and Demolition Waste was launched by Central Pollution Control Board (CPCB) in April 2026. All ULBs in the UT have been successfully on boarded onto the EPR Portal. As per the report submitted by the GPCB, implementation Status of the provisions of Waste Management Rules, 2016, Bio-Medical Waste Management Rules, 2016, Solid Waste Management Rules, 2016, and Construction and Demolition Waste Management Rules, 2016 in Valsad district of Gujarat is as follows: (i) The bio-medical waste generated in Valsad district is managed through the operational Common Bio-Medical Waste Treatment Facility (CBWTF). Total of 1,440 Health Care Facilities/industries are registered and have obtained authorization under the Bio-Medical Waste Management Rules, 2016. A CBWTF is operational with an Incineration capacity of 3,000 kg/day and having valid consent cum authorization up to 05.03.2029. All CBWTF under the jurisdiction of Valsad district are having valid authorization under the Bio-Medical Waste Management Rules, 2016. (ii) The Urban Local Bodies (ULBs) carry out door-to-door collection, transportation, and processing of wet waste through Waste-to-Compost/Windrow Composting plants. Material Recovery Facilities (MRFs) have been established for dry waste processing, and recyclable materials are channelized to authorized recyclers through appropriate forward linkages. A Special Cell for effective monitoring and implementation of waste management activities under Solid Waste Management Rules has been constituted under the chairmanship of District Collector at the district level. (iii) Construction & Demolition (C&D) waste collection centers have been established at Valsad district, and dedicated helpline numbers have been published for facilitating collection and proper management of C&D waste. *****
