GOVERNMENT OF INDIA MINISTRY OF ROAD TRANSPORT AND HIGHWAYS LOK SABHA UNSTARRED QUESTION NO. 1865 ANSWERED ON 30TH JULY 2026 CONSTRUCTION OF CONTROL LINE ALONG NATIONAL HIGHWAYS 1865. SHRI RAHUL KASWAN: Will the Minister of ROAD TRANSPORT AND HIGHWAYS सड़क परिवहन औि िाजमार्ग मंत्री be pleased to state: (a) whether the Government has assessed the number of families and establishments likely to be affected by the newly notified 40 mtrs/75 mtrs control line along National Highways, if so, the details thereof, State-wise; (b) whether affected persons would be given advance public notice and an opportunity to raise objections before implementation of the notification, if so, the details thereof; (c) whether the Government proposes to protect or regularise structures that existed prior to the notification, if so, the details thereof; and (d) whether compensation or any other relief would be provided to persons whose land or structures are affected by the notification and if so, the details thereof? ANSWER THE MINISTER OF ROAD TRANSPORT AND HIGHWAYS (SHRI NITIN JAIRAM GADKARI) (a) No such notification has been issued by the Government in Ministry of Road Transport and Highways, but arises from adirection dated 13.04.2026 by the Supreme Court of India in the case of Suo Moto Petition (Civil) No. 9 of 2025 in respect of Phalodi Accident versus National Highways Authority of India and Others, Regulation of building lines and control lines including issue of notifications thereunder and their enforcement falls within the domain of the respective State Governments and Union Territory Administrations. (b) to (d) Do not arise in view of the reply to part (a) above. *****
