IMPLEMENTATION OF RIGHTS OF PERSONS WITH DISABILITIES ACT (RPWD)

Will the Minister of SOCIAL JUSTICE AND EMPOWERMENT be pleased to state:
(a) the list of States that have notified rules under the Rights of Persons with Disabilities (RPwD)
Act;
(b) the status of implementation of reservation in Government employment;
(c) whether accessibility audits of public buildings have been completed;
(d) if so, the details thereof;
(e) whether the Unique Disability ID (UDID) system is fully operational nationwide; and
(f) if so, the details of the operationalisation thereof?

(a): Under Section 101 of the RPwD Act, 2016, State Governments are empowered to notify
rules for implementing the provisions of the Act. As per available record in the Department, all
the States have notified the rules.
(b): Under Section 34 of the RPwD Act, 2016, every appropriate Government is required to
reserve not less than 4% of the total vacancies in each cadre strength, in each group of posts, for
persons with benchmark disabilities in Government employment. In r/o the central government
establishments, the 4% reservation is implemented in both direct recruitment and promotion. For
State Government establishments, the respective State Governments are the appropriate
authorities responsible for implementing the reservation provisions as mandated in the Act.(c) & (d): The Accessible India Campaign (Sugamya Bharat Abhiyan), launched on 3 December
2015, now subsumed under the “Scheme for Creation of Barrier Free Environment
(CBFE)", aimed to improve accessibility for persons with disabilities in the built environment,
transport, and information- communication sectors.
The Centre does not maintain district- wise accessibility data. To aid States and service
providers, the Department has empanelled 60 accessibility auditors for the built environment,
who can be engaged by authorities on mutually agreed terms to conduct audits of public and
private infrastructure as required.
(e) & (f): The Unique Disability ID (UDID) system is fully operational in all 36 States and
Union Territories (UTs) across country. So far, 1,35,91,096 UDID cards/certificates have been
generated across all States/UTs. The details of state wise operationalisation of UDID card is
attached at Annexure.
