Provisional recognition to private schools
2917 Shri Narain Dass Gupta:
Will the Minister of Education be pleased to state:
(a) the details of private schools given provisional recognition in the last three years, State-
wise;
(b) the details of private schools failed on legal, security, infrastructure and academic
parameters and what action has been taken against them, details thereof; and
(c) how many private schools have failed in conforming to the guidelines relating to EWS/
DG/CWSN categories and what action has been taken against them in the last three years,
details thereof?

(a) to (c): Education is a subject in the Concurrent List of the Constitution. Schools, other than those
owned/funded by the Central Government, are under the jurisdiction of the respective State
Governments. Therefore, matters related to the management of schools that are not owned/funded by
the Central Government are regulated in accordance with the Rules and Instructions of the respective
State Government concerned. As such, regularising/taking action against and management of
provisionally recognised or unrecognised schools is a subject matter of the concerned State/UT
Government.
Section 19 of the RTE Act stipulates that those schools established before the commencement
of the Act and not fulfilling the norms shall take steps to fulfil the norms within three years from the
date of commencement of the Act. The Act also mandates that, if such schools fail to fulfil the norms,
the recognition shall be withdrawn and the school shall cease to function. The Ministry of Education,
Government of India, has identified 19518 unrecognised schools functioning with UDISE code and
has shared the details of the unrecognised schools, with the concerned States/UTs to take necessary
action at their end. The details of the number of unrecognised schools, State/UT-wise, is placed at
‘Annexure’.ANNEXURE
