SCHEMES FOR ROAD ACCIDENT VICTIMS

be pleased to state:
(a) the details of the Central schemes for road accident victims in the
country;
(b) the details of the compensation and medical assistance provided
under these schemes;
(c) the number of road accident victims benefited under these
schemes in the Shahjahanpur Parliamentary Constituency;
(d) the details of the issues being faced in the disbursement of
compensation to such victims in the country; and
(e) the impact of these schemes on providing assistance to road
accident victims?

(a) and (b) The Central Government has put in place the following
schemes for providing emergency medical care through cashlesstreatment of road accident victims and compensation to victims of hit
& run motor accidents:
(i) Prime Minister Road Accident Victims’ Hospitalisation and Assured
Treatment (PM-RAHAT) Scheme: Introduced in accordance with the
legal mandate under Section 162 of the Motor Vehicles Act, 1988, the
Cashless Treatment of Road Acccident Victims scheme provides
treatment cover upto ₹1.5 lakh per victim, subject to a maximum cap
of 7 days from the date of accident on any category of road. Further,
the treatment cover will be available to all those victims who are
involved in road accidents caused by use of motor vehicles.
(ii) Compensation to Victims of Hit and Run Motor Accidents Scheme,
2022: As per Section 161 of the Motor Vehicles Act, 1988, the Central
Government is required to provide compensation in respect of death or
grievous hurt resulting from hit-and-run motor accidents. Accordingly,
the Compensation to Victims of Hit and Run Motor Accidents Scheme,
2022 was notified vide G.S.R. 163(E) and is being implemented with
effect from 01.04.2022. Under the Scheme, a fixed compensation of
Rs. 2 lakh is provided in case of death and Rs. 50,000 in case of
grievous hurt.
(c) As on 31.07.2026, the following is the status of beneficiaries in the
Shahjahanpur Parliamentary Constituency:
Under the PM-RAHAT Scheme, 1 road accident victim has been
registered for treatment. The corresponding eDAR request was
approved by the police, making the victim eligible for full treatment
coverage in accordance with the Scheme provisions.
Under the Compensation to Victims of Hit and Run Motor Accidents
Scheme, 2022, 2 claims have been received and settled.
(d) Time-bound procedures and clearly defined responsibilities have
been prescribed under the respective Schemes to minimise delays in
the provision of treatment, processing of claims and disbursement of
compensation:
Under the PM-RAHAT Scheme, treatment is initiated upon admission
and police authentication is undertaken in parallel through theintegrated Transaction Management System (TMS) portal of National
Health Authority (NHA) and Electronic Detailed Accident Report
(eDAR) portal. After discharge, the hospital submits its claim to the
State Health Agency for verification and approval. To ensure timely
payments to the hospitals, a period of 10 days has been defined from
the claim being approved by SHA for District Collectors or GI council
to make the payments, as the case maybe. Beyond the prescribed
time, the claim shall be deemed approved. The end-to-end digital
workflow provides a complete trail from accident reporting and
treatment to claim approval and final payment.
Similarly, the Compensation to Victims of Hit and Run Motor Accidents
Scheme, 2022 provides a time-bound process for settlement of claims.
The Claims Enquiry Officer is required to submit the enquiry report
within one month of receipt of the application, the Claims Settlement
Commissioner is required to sanction the claim within 15 days of
receiving the report, and the General Insurance Council (GIC) is
required to transfer the compensation to the claimant within a further
period of 15 days.
(e) The PM-RAHAT Scheme is formulated to achieve the objective of
reducing fatalities and provide financial certainty to the hospitals
ensuring non-denial of treatment to road accident victims. Integration
of Emergency Response Support System (ERSS - 112), accident
reporting mechanism for police (eDAR) and the designated hospital
network (TMS 2.0) facilitates ambulance support, identification of the
nearest designated hospital, prompt initiation of treatment, parallel
police authentication and direct reimbursement to hospitals.
The Compensation to Victims of Hit and Run Motor Accidents Scheme,
2022 provides fixed financial assistance of Rs. 2 lakh in case of death
and Rs. 50,000 in case of grievous hurt, where the offending vehicle
cannot be identified. The prescribed time-bound claims process, along
with digital processing, eDAR linkage and monitoring through the
District Road Safety Committees and State Road Safety Councils,
supports transparent and timely disbursement to eligible claimants.The Government has instituted the Rah-Veer Scheme to encourage
citizens to assist victims of serious road accidents during the Golden
Hour. The Scheme operates along with the protections provided to
Good Samaritans under Section 134A of the Motor Vehicles Act, 1988
and the Good Samaritan Rules notified vide G.S.R. 594(E) dated
29.09.2020. Any individual who has assisted a victim of a serious
accident involving a motor vehicle by administering immediate
assistance and rushing the victim to a Hospital/Trauma Care Centre
within the Golden Hour of the accident for medical treatment is
eligible for a cash reward of Rs. 25,000 per incident, along with a
Certificate of Appreciation, subject to the provisions of the Scheme.
