PART I CENTRAL SECTION Miscellaneous Notifications, Appointments, etc. FOOD & DRUGS CONTROL ADMINISTRATION NOTIFICATION Gujarat State, Gandhinagar, 24th August, 2026 UNDER SECTION 30(2)(A) OF THE FOOD SAFETY AND STANDARDS ACT, 2006. NO. CFDC/02/2026/CIR/E-FILE/141/2024/1755/I-FOOD:- WHEREAS, in the research done at Tata Memorial Hospital, it is observed that the consumption of Gutka and Pan Masala cause carcinogenic and co-carcinogenic effects; AND WHEREAS, the joint studies conducted by Hammer and the Tata Institute of Fundamental Research reveal that the consumption of Gutka leads to a very high increased risk of oral Cancer; AND WHEREAS, surveys conducted by the Global Adult Tobacco Survey of India (GATS) in the year 2009-10 and 2016-17 revealed that 35% adults use tobacco in some form, out of which 21% were found to be consuming smokeless tobacco; AND WHEREAS, several Non-Government Organizations have also reported to the State Government requesting a complete ban on the sale of Gutka and Pan Masala in the State of Gujarat; I-Misc. Ex-33 33-133-2 GUJARAT GOVERNMENT GAZETTE EX., 24-08-2026 [ PART- I AND WHEREAS, Gutka and Pan Masala known by any name are articles of food that contain tobacco and nicotine as ingredients and consumption of such products is injurious to health, thus contravening the provisions of regulation 2.3.4 of the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011; AND WHEREAS, it is expedient to prohibit in the interest of public health, the manufacture, storage, distribution and sale of Gutka and Pan Masala in which tobacco or nicotine is widely used as an ingredient and which are sold in the State of Gujarat. AND WHEREAS, the Commissioner of Food Safety is empowered under section 30 of the Food Safety and Standards Act, 2006 to prohibit, in the interest of public health, the manufacture, storage, distribution or sale of any article of food either in the whole of the State or in any area or part thereof; and accordingly the Commissioner of Food Safety, Gujarat State, prohibited the manufacture, storage, distribution and sale of Gutka and Pan Masala containing tobacco or nicotine in the State of Gujarat for a period of one year from 11th September 2012 vide notification No. FSSA/Notification/ 266/A, dated 28th August, 2012. SUBSEQUENTLY, the Commissioner of Food Safety, Gujarat State prohibited the manufacture, storage, distribution and sale of Gutka and Pan Masala containing tobacco or nicotine in the State of Gujarat for the following periods of one year. (1) From 12th September, 2013 to 11th September, 2014 (Vide Notification No. FSSA/Notification/161/A, dated: 6th September 2013) (2) From 12th September, 2014 to 11th September, 2015 (Vide Notification No. FSSA/Notification/1960/A, dated: 9th September 2014,) (3) From 12th September 2015 to 11th September, 2016 (Vide Notification No. FSSA/Notification/93419/A, dated: 10th September 2015) (4) From 12th September 2016 to 11th September 2017 (Vide Notification No.FSSA/Notification/106821/A, dated: 9th September 2016.) (5) From 12th September 2017 to 11th September 2018 (Vide Notification No.FSSA/Notification/100669769/A/2017, dated: 11th September 2017) (6) From 12th September 2018 to 11th September 2019 (Vide Notification No.FSSA/Notification/274-474/A/2018, dated: 10th September 2018) (7) From 12th September 2019 to 11th September, 2020 (Vide Notification No.FSSA/Notification/91094-294/A/2020, dated: 11th September 2019) (8) From 12th September 2020 to 11th September, 2021 (Vide Notification No.FSSA/Notification/89328-528/A/2021, dated: 11th September 2019) (9) From 12th September 2021 to 11th September, 2022 (Vide Notification No.FSSA/Notification/33470-670/A/2020, dated: 9th September 2021) (10) From 12th September 2022 to 11th September, 2023 (Vide Notification No.FSSA/Notification/55386-587/A/2022, dated: 6th September 2022) (11) From 13th September 2023 to 12th September, 2024 (Vide Notification No.FSSA/Notification/50398/A/2023, dated: 13th September 2023) (12) From 13th September 2024 to 12th September, 2025 (Vide Notification No.FSSA/Notification/44945/I/2024, dated: 04th September 2024) (13) From 13th September 2025 to 12th September, 2026 (Vide Notification No. FSSAI Notification/38110/I/2025, dated: 6th September, 2025)CENTRAL SECTION ] GUJARAT GOVERNMENT GAZETTE EX., 24-08-2026 33-3 Since Gutka and Pan Masala containing tobacco or nicotine, if consumed, will endanger human health; and therefore, I, the Commissioner of Food Safety, Gujarat State, in exercise of the powers conferred by clause (a) of sub section (2) of Section 30 of the Food Safety and Standards Act, 2006 (Act No. 34 of 2006), in the interest of public health, hereby prohibit the manufacture, storage, distribution or sale of Gutka and Pan Masala, known by any name containing tobacco or nicotine as ingredients and any other products marketed separately to constitute as Gutka and Pan Masala as a final product in the whole of the State of Gujarat, for a period of one year from 13th September, 2026. However, the said prohibition shall not be applicable with respect to 100 % export-oriented units. DR. RATANKANVAR H.
