NO. GH/SH/29/2026/PVS/102020/285/S:- In exercise of the powers conferred by sub-section (1) of section 20 read with section 4 of the Gujarat Professional Technical Educational Colleges or Institutions (Regulation of Admission and Fixation of Fees) Act, 2007 (Guj. 2 of 2008), the Government of Gujarat hereby makes the following rules further to amend the Master of Business Administration Course (Regulation of Admission and Payment of Fees) Rules, 2020, namely: - 1. Short Title and Commencement.- (1) These rules may be called the Master of Business Administration Course (Regulation of Admission and Payment of Fees) (*Amendment) Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Master of Business Administration Course (Regulation of Admission and Payment of Fees) Rules, 2020(hereinafter referred to as “the said rules”), in rule 2, in sub-rule(1), for clause (b), the following clause shall be substituted, namely: - “(b)“Admission” means admission of students in the first year and/or second year (lateral entry) of the Master of Business Administration (MBA) Course;”. 3. In the said rules, existing rule 3 shall be renumbered as sub-rule (1) of that rule, and (i) in sub-rule(1) as so renumbered, clause (1) and clause (2) shall be renumbered as clause (i) and clause (ii), respectively;121 GUJARAT GOVERNMENT GAZETTE, 13-08-2026 [ PART IV-B (ii) after sub-rule (1) as so renumbered, the following sub-rule shall be added, namely:- “(2) Admissions to the Second Year (Lateral Entry) of the Master of Business Administration (MBA) course shall be given as under, namely: - (i) All the Seats of Government and Grant-in-aided institutes shall be filled on the basis of merit list prepared by the Admission Committee. (ii) All the Seats of the unaided institutes including CoE institutes shall be filled by the management of the respective Professional Educational College or Institution, on the basis of inter-se merit list of the candidates prepared by respective college or institute.”. 4. In the said rules, in rule 4, after Para C, the following Para D shall be added, namely: - “D. Admission to Second Year (Lateral Entry) MBA course: For the purpose of admission to the second year (lateral entry) of the Master of Business Administration (MBA) courses, available seats shall include, - (1) Lateral entry seats in Government institutes and Grant in Aided institutions: (i) These Seats shall be considered as Government Seats, (ii) The available seats shall be as per the prevailing guidelines of the AICTE, including seats remaining vacant of the immediate previous admission year (including biannual session if offered) of MBA first year course and the seats fallen vacant for any reason during immediate previous academic year of first year MBA course, within the previous year sanctioned intake in the Government Colleges or Institutions. (2) Lateral entry seats Unaided institutions including CoE institutions of the State: (i) These Seats shall be considered as Vacant Seats, (ii) The available seats shall be as per the prevailing guidelines of the AICTE, including seats remaining vacant during immediate previous admission year (including biannual session if offered) of the first year MBA course, and the seats fallen vacant for any reason during immediate previous academic year of first year MBA course, within the previous year sanctioned intake in the unaided Colleges or Institutions including Centre of Excellence institutions of the state, (iii) The intimation received, in respect of sanction of seats, by the Admission Committee prior to the counseling program, shall be considered as available seats: Provided that the Government Seats were offered in the immediate previous year for online admission for two rounds by the Admission Committee: 5. In the said rules, in rule 5, after Para B, the following Para C shall be added namely: - “C, Admission to Second Year (Lateral Entry) in the MBA course:- (1) Subject to the provisions of Para A and Para B, the candidate shall have eligibilitty criteria as per the prevailing guidelines of the AICTE. 6. In the said rules, in rule 13, after Para C, the following Para D shall be added namely: - “D. Admission to Second Year (Lateral Entry) in the MBA course:- The Admission committee shall notify the admission process through circulation on its official website and in leading newspapers, as per the prevailing guidelines of the AICTE. The Admission committee shall publish the available seats for admission into Government, Grant-in-Aid and Self-Financed institutes. (1) The admission process for Government and Grant-in-Aid institutes shall be carried out by the Admission Committee, through online/offline mode in the following manner, namely: - The Admission committee shall invite the application from eligible candidates as per these rules for lateral entry admission and prepares the merit list. The merit shall be published on the official website of the Admission Committee and/or by such other means, as it may consider convenient. The merit list shall be prepared in following order, namely:-PART IV-B ] GUJARAT GOVERNMENT GAZETTE, 13-08-2026 122 (i) The Candidates with the minimum eligibility criteria prescribed in Para C of rule 5 for the lateral entry and have appeared in the Common Management Aptitude Test (CMAT) of the corresponding academic year as per the prevailing guidelines of the AICTE and,- (a) have passed the qualifying examination from any Universities or institutes Situated in the State of Gujarat; or (b) have passed the Higher Secondary School Certificate Examination (Standard XII, 10+2 pattern) or its equivalent examination from any schools Situated in the state of Gujarat. The merit shall be prepared on the basis of the marks obtained in CMAT of the corresponding year; (ii) After allotting the seats to the candidate mentioned in clause (i) above, if seats remain vacant, the Admission Committee shall fill such seats by inviting the application from the candidates who; (a) have passed the qualifying examination from the Universities or institutes situated outside the state of Gujarat;and (b) have passed the Higher Secondary School Certificate Examination (Standard XII, 10+2 pattern) or its equivalent examination from any of the schools, situated outside the state of Gujarat with the minimum eligibility criteria prescribed in Para C of rule 5, and have appeared in the Common Management Aptitude Test(CMAT) of the corresponding academic year, The merit shall be prepared on the basis of the marks obtained in CMAT of the corresponding year; (iii) After allotting the seats to the candidate mentioned in clause (i) and (ii) above, if seats remains vacant, the Admission Committee shall fill such seats by inviting the application from the candidates, who have cleared qualifying examination with the minimum eligibility criteria prescribed in Para C of rule 5 for lateral entry, but not appeared in the Common Management Aptitude Test (CMAT) as per the prevailing guidelines of the AICTE for the corresponding academic year. The merit list for such candidates shall be prepared on the basis of percentage of marks obtained at qualifying examination. (2) The admission process for Unaided Institutes including CoE institutes shall be carried out at respective institute level through online/offline mode in the following manner, namely: - The respective institute shall invite applications from eligible candidates by publishing an advertisement in leading newspapers, on its official website, or through such others means as it may consider appropriate. The institute shall also display the details of vacant seats available for lateral entry and the Schedule for lateral entry admission to such vacant seats on the official website of the concerned University or institute. An acknowledgement shall be issued to every candidates by the concerned unaided college or instituion, including CoE institute, in the state, on receipt of the application. The concerned, unaided college or instituion, including a CoE institute, shall process the application for filling the vacant seats under the lateral entry admission process from amongst the eligible candidates who have applied for such vacant seats, by preparing a common intra-se merit list in accordance with these rules and the guidelines issued by the Admission Committee from time to time, namely- (i) The names of the candidates whose names appear in the merit list of the Admission Committee, who have cleared the qualifying examination with the minimum eligibility criteria prescribed in Para C of rule 5; (ii) After allotting the seats to candidates mentioned in clause (i) above, if seats remain vacant, the unaided college or institutions shall fill such seats by inviting the application from the candidates who have passed the qualifying examination with the minimum eligibility criteria prescribed in Para C of rule 5 for lateral entry from any Universities or institutes with the minimum eligibility criteria prescribed and have appeared in the Common Management Aptitude Test (CMAT) of the corresponding academic year, but have not appeared in the current year lateral entry admission process of the Admission committee. The merit list shall be prepared on the basis of the marks obtained in CMAT of the corresponding year; (iii) After allotting the seats to the candidates mentioned in clause (i) and (ii) above, if seats remain vacant, the institute shall fill such seats by inviting the application from the candidates who have cleared the qualifying examination with the minimum eligibility criteria prescribed in Para C of rule 5 and have123 GUJARAT GOVERNMENT GAZETTE, 13-08-2026 [ PART IV-B not appeared in the Common Management Aptitude Test (CMAT) as per the prevailing guidelines of the AICTE for the corresponding academic year. (2) They shall come into force on and from the date of publication in the Official Gazette. 2. In the Master of Computer Application (Regulation of Admission and Payment of Fees) Rules,2020, (hereinafter referred to as “the said rules”), in rule 2, in sub-rule(1), for clause (b) following clause shall be substituted, namely:- “(b)“Admission” means admission of students in the first year and/or second year (lateral entry) of the Master of Computer Application (MCA) Course;”. 3. In the said rules, existing rule 3 shall be renumberred as sub-rule(1)of that rule,and (i) in sub-rule(1) as so renumbered, clause (1) and clause (2) shall be renumberred as clause(i) and clause(ii), respectiveley; (ii) after sub-rule (1) as so renumbered, the following sub-rule shall be added, namely:- “(2) Admission to the Second Year (Lateral Entry) of the Master of Computer Application (MCA) course shall be given as under, namely: - (i) All the Seats of Government and Grant-in-aided institutes shall be filled on the basis of merit list prepared by the Admission Committee. (ii) All the Seats of the unaided institutes including CoE institutes shall be filled by the management of the respective Professional Educational College or Institution on the basis of inter-se merit list of the candidates prepared by respective college or institute. 4. In the said rules, in rule 4, after Para C, the following Para D shall be added, namely: - “D. Admission to Second Year (Lateral Entry) MCA course: For the purpose of admission to the second year (lateral entry) of the Master of Computer Application (MCA) courses, available seats shall include, - (1) Lateral entry seats in Government institutes and Grant in Aided institutions: (i) These Seats shall be considered as Government Seats,PART IV-B ] GUJARAT GOVERNMENT GAZETTE, 13-08-2026 124 (ii) The available seats shall be as per the prevailing guidelines of the AICTE, including seats remaining vacant of the immediate previous admission year (including biannual session if offered) of MCA first year course and the seats fallen vacant for any reason during immediate previous academic year of first year MCA course, within the previous year sanctioned intake in the Government Colleges or Institutions. (2) Lateral entry seats Unaided institutions including CoE institutions of the State: (i) These Seats shall be considered as Vacant Seats, (ii) The available seats will be as per the prevailing guidelines of the AICTE, including seats remaining vacant during immediate previous admission year (including biannual session if offered) of the first year MCA course, and the seats fallen vacant for any reason during immediate previous academic year of first year MCA course within the previous year sanctioned intake in the un aided Colleges or Institutions including Centre of Excellence institutions of the state. (iii) The intimation received, in respect of sanction of seats, by the Admission Committee prior to the counseling program, shall be considered as available seats: Provided that the Government Seats were offered in the immediate previous year for online admission for two rounds by the Admission Committee: Provided further that the registration and preparation of merit list of the Management Seats shall be managed, finalized and declared by the concerned college or institution.“ 5. In the said rules, in rule 5, after Para B, the following Para C shall be added namely: - “C, Admission to Second Year (Lateral Entry) in the MCA course:- Subject to the provisions of Para A and Para B, the candidate shall have eligibility criteria as per the prevailing guidelines of the AICTE. 6. In the said rules, in rule 13, after Para C, the following Para D shall be added namely: - “D. Admission to Second Year (Lateral Entry) in the MCA course:- The admission committee shall notify the admission process through circulation on its official website and in leading newspapers, as per the prevailing guidelines of the AICTE. The admission committee shall publish the available seats for admission into Government, Grant-in-Aid and Self-Financed institutes. (1) The admission process for Government and Grant-in-Aid institutes shall be carried out by the Admission Committee through online/offline mode in the following manner, namely: - The admission committee shall invite the application from eligible candidates as per these rules for lateral entry admission and prepares the merit list. The merit shall be published on the official website of the Admission Committee and/or by such other means, as it may consider convenient. The merit list shall be prepared in following order, namely- (i) the Candidates with the minimum eligibility criteria prescribed in Para C of rule 5 for the lateral entry and have appeared in the Common Management Aptitude Test (CMAT) of the corresponding academic year as per the prevailing guidelines of the AICTE and,- (a) have passed the qualifying examination from any Universities or institutes Situated in the State of Gujarat; or (b) have passed the Higher Secondary School Certificate Examination (Standard XII, 10+2 pattern) or its equivalent from any of the school Situated in the state of Gujarat. The merit shall be prepared on the basis of the marks obtained in CMAT of the corresponding year; (ii) After allotting the seats to the candidate mentioned in clause (i) above, if seats remain vacant, the Admission Committee shall fill such seats by inviting the application from the candidates who; (a) have passed the qualifying examination from the Universities or institutes situated outside the state of Gujarat; and125 GUJARAT GOVERNMENT GAZETTE, 13-08-2026 [ PART IV-B (b) have passed the Higher Secondary School Certificate Examination (Standard XII, 10+2 pattern) or its equivalent examination from any of the schools, Situated outside the state of Gujarat with the minimum eligibility criteria prescribed in Para C of rule 5, and have appeared in the Common Management Aptitude Test(CMAT) of the corresponding academic year.the merit shall be prepared on the basis of the marks obtained in CMAT of the corresponding year; (iii) After allotting the seats to the candidate mentioned in clause (iii) and (iv) above, if seat remains vacant, the admission committee shall fill such seats by inviting the application from the candidates who have passed qualifying examination with minimum eligibility criteria prescribed in rule 5 (C) for lateral entry but not appeared in the Common Management Aptitude Test (CMAT) as prescribed by AICTE for the corresponding academic year. The merit list of such candidates shall be prepared on the basis of percentage of marks obtained at qualifying examination. (2) The admission process for Un-Aided Institutes including CoE institutes shall be carried out at respective institute level through online/offline mode in following manner, namely: - The respective institute shall invite applications from eligible candidates by publishing an advertisement in leading newspapers, on its official website, or through such others means as it may consider appropriate.The institute shall also display the details of vacant seats available for lateral entry and the Schedule for lateral entry admission to such vacant seats on the official website of the concerned University or institute. The concerned unaided college or instituion, including a CoE institute, shall process the application for filling the vacant seats under the lateral entry admission process from amongst the eligible candidates who have applied for such vacant seats, by preparing a common intra-se merit list in accordance with these rules and the guidelines issued by the Admission Committee from time to time namely:- (i) The names of the candidates whose names appear in the merit list of the Admission Committee, who have cleared the qualifying examination with the minimum eligibility criteria prescribed in Para C of rule 5; (ii) After allotting the seats to candidates mentioned in clause (i) above, if seats remain vacant, the unaided college or institutions shall fill such seats by inviting the application from the candidates who have passed the qualifying examination with the minimum eligibility criteria prescribed in Para C of rule 5 for lateral entry from any Universities or institutes with the minimum eligibility criteria prescribed and have appeared in the Common Management Aptitude Test (CMAT) of the corresponding academic year, but have not appeared in current year lateral entry admission process of the admission committee. The merit list shall be prepared on the basis of the marks obtained in CMAT of the corresponding year. (iii) After allotting the seats to the candidates mentioned in clause (i) and (ii) above, if seats remains vacant, the institute shall fill such seats by inviting the application from the candidates who have cleared the qualifying examination with the minimum eligibility criteria prescribed in Para C of rule 5 and have not appeared in the Common Management Aptitude Test (CMAT) as per the prevailing guidelines of the AICTE for the corresponding academic year.
