NOTIFICATION Sachivalaya, Gandhinagar, 26th December, 2025.
GUJARAT POLICE ACT, 1951.
No. GHG/2025/170/NPC/102007/1141-II-2/D:- In exercise of the powers conferred by sub-section (2) of section 32F of the Gujarat Police Act, 1951 (Bom. XXII of 1951), the Government of Gujarat hereby makes following rules to decide the terms and conditions of the service of the Chairperson and the Member, in the office of the State Police Complaints Authority, namely: -
1. Short title and commencement. -
(1) These rules may be called the Gujarat State Police Complaints Authority (Terms and Conditions of the Service of Chairperson and Member) Rules, 2025.
(2) They shall come into force on the date of their publication in Official Gazette.
2. Definitions. -
(1) In these rules, unless the context otherwise requires, -
(a) "Act" means the Gujarat Police Act, 1951;
(b) "Authority" means the State Police Complaints Authority constituted under section 32 F (1);
(c) "Chairperson” means a chairperson of the Authority as defined in section 32 F (1) (a) of the Act;
(d) "Member” means a member of the Authority as appointed under section 32 F (1) of the Act.
(2) The words and expressions used in these rules but not defined and defined in the Act shall have the same meaning respectively assigned to them in the Act.
3. Tenure, Remuneration, Allowances and other facilities of the Chairperson of the Authority. -
(1) The Chairperson shall hold office initially for a term of three years or for such period not exceeding three years as specified in the order of his appointment. However, he shall be eligible for reappointment.
(2) The Chairperson, if a retired Judge of the High Court, the terms and conditions of service shall be applicable as per the Government Resolution, Finance Department No.PGR/1009/66/pay cell (ch), dated 03.12.2011, as amended from time to time.
(3) The Chairperson, if a retired IAS officer, shall receive remuneration based on the last pay drawn, minus pension, in accordance with the Government Resolution, General Administration Department No.AIS-
10.2020-183855-G, dated 22.12.2020, as amended from time to time.
(4) The Chairperson, if a retired IAS officer, shall receive the Dearness Allowance based on the last pay drawn immediately before retirement. By virtue of this, he shall not be entitled to receive any Temporary Increase (T.I.) on the monthly pension.
(5) The Chairperson shall be entitled to the facility of Government accommodation on the same scale as was allowed to him while in service prior to his retirement on superannuation.
(6) The Chairperson shall be entitled to fifteen days of paid leave on non-cumulative and non-cashable basis for every completed year of his tenure. However, he shall not be allowed to encash the accumulated Earned Leave upon completion of the tenure.
(7) The Chairperson shall be entitled to the facility of a vehicle on the same scale as that provided to the Additional Chief Secretary of All India Services, including TA/DA, while travelling on official duty. He shall not be entitled to any other conveyance allowance.
(8) The Chairperson shall be entitled to the facility of a driver through outsourcing or, alternatively, be given the option to arrange a driver at his own, for which he shall be paid lump sum of Rs. 4,500/- per month.PART IV-B] GUJARAT GOVERNMENT GAZETTE, 08-01-2026 4
(9) The Chairperson shall also be entitled to the facility of a residential telephone, mobile phone, and laptop on the same scale as he was availing prior to retirement. Additionally, He will be provided with the facility of four newspapers and two magazines.
(10) The Chairperson, if a retired IAS officer, shall be entitled to medical facilities/ medical reimbursement as available to an IAS pensioner under the Standing Orders of the Health and Family Welfare Department, Government of Gujarat, as amended from time to time.
(11) The Chairperson shall be entitled to the facility of residential peon or residential attendant in accordance with the Government Resolution, General Administration Department No.AIS-2283-1294-G, dated
28.08.2023.
(12) The Chairperson shall be allowed to use office car for the private purpose in accordance with the Government Resolution, General Administration Department No. AIS/3185/1468/G, dated 25.7.2005.
4. Tenure, Remuneration, and Allowances of the Member of the Authority. -
(1) The Member shall hold office initially for a term of three years. However, he shall be eligible for reappointment.
(2) The Member appointed to fill a casual vacancy shall hold office for the remaining period of the term of the Member in whose place he is appointed.
(3) The Member shall not be paid any monthly remuneration. However, an honorarium to the tune of Rs. 7,500/- shall be paid for each seating of the Authority’s meetings.
(4) The Member shall be entitled to T.A., D.A., and conveyance allowances as per the State Government rules and Government Resolution, Finance Department No. MSB/102014/1125/CH, dated 16.10.2014, mutatis mutandis.
5. Other terms and conditions of service. –
(a) The Chairperson may accept any employment before the expiry of the period of his appointment with approval of the Government.
(b) The terms and conditions of service of the Chairperson and the Members, in respect of which no express provision has been made in these rules, shall be those admissible to the equivalent class of the State Government.
