(1) इन जनर्मों का संजक्षप् त नाम प्ल ाजस्ट्िक अपजिष्ि प्रबंधन (िसू रा संिोधन) जनर्म, 2021 ह।ै (2) वे रािपत्र म ें उनके प्रकािन क तारीख को प्रवृत् त होंग े। 2. प् लाजस्ट्िक अपजिष्ि प्रबंधन जनर्म, 2016 म,ें जनर्म 4 म,ें उप-जनर्म (1) म,ें खंड (ख) के स्ट्थ ान पर जनम्न जलजखत खंड रखा िाएगा, अथाात् :- ‘‘(ख) पनु चादित प्ल ाजस्ट्िक स े जनर्मात कैरी बगै ों र्ा पनु ्चदित प्ल ाजस्ट्िक स े जनर्मात उत् पािों का उपर्ोग तत्क ाल खाने र्ा पीने र्ोग् र् खाद्य पिाथों के भंडारण, वहन, प्रबंधन र्ा पैककंग के जलए भारतीर् खाद्य सुरक्षा और मानक प्राजधकरण द्वारा खाद्य सुरक्षा और मानक अजधजनर्म, 2006 (2006 का 34) के तहत उपर्ुक् त मानकों और समुजचत जवजनर्मन के संबंध म ेंिारी अजधसूचना के अधीन दकर्ा िा सकता ह;ै’’। रिप्प ण: मूल जनर्मों को अजधसूचना संख् र्ा सा.का.जन. 320 (अ), तारीख 18 माच,ा 2016 द्वारा भारत के रािपत्र म ें प्रकाजित दकर्ा गर्ा था और तत्प श् चात् अजधसूचना संख् र्ा सा.का.जन. 285 (अ), तारीख 27 माच,ा 2018 द्वारा संिोजधत दकर्ा गर्ा था और उसम ें अंजतम सिं ोधन अजधसूचना संख् र्ा सा.का.जन. 571 (अ), तारीख 12 अगस्ट् त, 2021 द्वारा दकर्ा गर्ा। [फा.स.ं 17/17/2021-एचएसएमडी] नरेि पाल गगं वार, संर्ुक् त सजचव MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 17th September, 2021 G.S.R. 647(E).—Whereas, the Plastic Waste Management Rules, 2016 were notified by the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 320 (E), dated the 18th March, 2016; Whereas clause (b) of sub-rule (1) of rule 4 of the said rules provides that carry bags made of recycled plastic or products made of recycled plastic shall not be used for storing, carrying, dispensing or packaging ready to eat or drink food stuff; Whereas, Food Safety and Standards Act, 2006 (34 of 2006) is an Act to consolidate the laws relating to food and to establish the Food Safety and Standards Authority of India for laying down science based standards for articles of food and to regulate their manufacture, storage, distribution, sale and import, to ensure availability of safe and wholesome food for human consumption and for matters connected therewith or incidental thereto; Now therefore, in exercise of powers conferred by sections 6, 8 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government after having dispensed with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the said rule in public interest, hereby makes the following rules to further amend the Plastic Waste Management Rules, 2016, namely:- 1. (1) These rules may be called the Plastic Waste Management (Second Amendment) Rules, 2021. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Plastic Waste Management Rules, 2016, in rule 4, in sub-rule (1), for clause (b), the following clause shall be substituted, namely: -[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 “(b) carry bags made of recycled plastic or products made of recycled plastic can be used for storing, carrying, dispensing, or packaging ready to eat or drink food stuff subject to the notification of appropriate standards and regulation under the Food Safety and Standards Act, 2006 (34 of 2006) by the Food Safety and Standards Authority of India;”.
